 ORDER (BELOW EXH.8) 

This regular Bail Application has been filed under Section
439   of   the   Code   of   Criminal   Procedure   in   Crime   No.I­108/2021
registered at Police Station Kasarwadavali for the offence punishable
under Section 302 of the Indian Penal Code.   

1] The Applicant/the Accused contended that he is innocent
and has been falsely implicated in the crime.   He was not present at
the spot at the time of the incident.  There was no marital relationship
between him and the deceased.  He did not demand mobile phone and
clothes  from  the   deceased.   There  is no direct  evidence  against  the
Applicant.     Dying   Declaration   of   the   deceased   was   recorded   on
08/04/2021 and she died on 12/04/2021.   There is manipulation in
the   date   and   signature   of   doctor   on   her   Dying   Declaration.     The
Applicant is the only earning member of his family.   His parents are
suffering from multiple diseases.  The investigation is completed.  The
Applicant is ready to abide by conditions, if released on bail.   This is
second   bail   application   and   has  not   filed   any  other   bail   application
before any other Court.  Hence, the present application.

2] The learned APP filed say and opposed the application.   It
is contended that the alleged offence under Section 302 of the Indian
Penal   Code   is   punishable   with  death  or   life  imprisonment.    It   is  of

serious nature.   The deceased has given detailed Dying Declaration.
The   Investigating   Officer   collected   ample   evidence   against   the
Applicant.     The  first   bail  application filed after filing of the  charge­
sheet was rejected by the Court on 21/12/2021.  There is no change in
circumstances to file the present application.   The Application is not
maintainable.     The   charge   is   framed   against   the   Applicant   on
02/01/2023.  If the Applicant is released on bail, he may abscond and
hamper the trial.  He may also tamper with the evidence.   Therefore,
it is prayed for rejection of the application.  

3] Heard, the learned  Adv. Arshad Shaikh  for the Applicant


and the learned APP Shri. Dixit.  On 08/04/2021, the informant Smt.
Farida   Nasir   Shaikh   lodged   the   Report.     She   contended   that   on
07/04/2021   at   about   10.20   p.m.,   her   husband   i.e.   the   Applicant
demanded her money for purchasing mobile phone and clothes.   The
informant told him that she was unable to pay money.   Thereupon,
quarrel started between them.  The Applicant closed door of the house
from inside.  He poured kerosene in can on the person of the informant
and set her on fire.  The informant ran outside the house.  The people
informed   the   Police   Station.     The   police   came   there   and   took   the
informant to Chhatrapati Shivaji Maharaj Hospital, Kalwa.   She was
further referred to Sion Hospital, Mumbai for treatment.  On the basis
of   this   information,   the   crime   was   registered   for   the   offences
punishable   under   Sections   307   and   326   of   the   Indian   Penal   Code.
Thereafter,   the   informant   died   on   12/04/2021   and   the   offence
punishable under Section 302 of the Indian Penal Code was added.  

4] On   perusal   of   the   charge­sheet,   it   is   revealed   that   the


deceased specifically mentioned the name of the Applicant in the FIR.

Her   Dying   Declaration  was  recorded  at  Chhatrapati  Shivaji   Maharaj


Hospital, Kalwa on the same day of the incident.  Later on, she died on
12/04/2021.  It is alleged that the Applicant demanded her money for
purchasing mobile phone and clothes.   On her refusal to pay money,
the   Applicant   set   her   on   fire.     She   came  out   of   the   house   and   the
people informed the Police Station.   Thereafter, she was admitted in
the hospital.  The postmortem Report of the deceased reveals probable
cause   of   death   as,   “shock   due   to   burn   injury   however,   necessary
samples   reserved   for   examination”.     Therefore,   there   is   prima   facie
strong   case   against   the   Applicant.     His   previous   bail   application
(Exh.3)   filed   after   submission   of   charge­sheet   was   rejected   on
21/12/2021 by my learned predecessor.  The learned Advocate for the
Applicant   contended that   the mother of the Applicant   is suffering
from   various  diseases  and  she   is serious.    According  to him,  this  is
change   in   the   circumstances.     However,   it   does   not   relate   to   the
present case.  There is no other considerable change in circumstance to
consider the application in favour of the Applicant.  Considering nature
of offence and accusations against him, the Applicant is not entitled to
bail.  Hence, I pass the following Order :   

ORDER
This Application at Exh.8 is hereby rejected.
