APPROVED ON THIRD AND FINAL READING. Introduced by: Councilor Armando S$. Tan ORDINANCE NO. 96-12 @N ORDINANCE IMPOSING THE STRICT COMPLIANCE ON THE INSTALLATION OF FIRE ESCAPES, EMERGENCY EXITS, AND OTHER FIRE FIGHTING DEVICES IN ALL BUILDINGS AND ESTABLISHMENTS WITHIN THE TERRITORIAL JURISDICTION OF SANTIAGO CITY. WHEREAS, under PD 1185, otherwise knows as the Fire Code of the Philippines, certain buildings, institutions, and establish- nents are required to install fire escapes and other fire fighting devices; WHEREAS, most buildings and establishments in the city do not have fire escapes and fire fighting devicess WHEREAS, these fire escapes and fire fighting devices are deemed necessary to prevent the loss of lives during emergencies particularly during fire incidents. NOW THEREFORE, on motion of Coun. Victorio V. Miranda, Jr., duly seconded by Couns. Virgilio P. Languban, Madeli R. Bautista, and Rolando L. Espiritu, be it ordained by the Sangguniang Pan- lungsod in its regular Session duly assembled, that: Section 1, The title of this Ordinance shall be AN ORDI- NANCE IMPOSING THE STRICT COMPLIANCE ON THE INSTALLATION OF FIRE ESCAPES, EMERGENCY EXITS, AND OTHER FIRE FIGHTING DEVICES IN ALL BUILDINGS AND ESTABLISHMENTS WITHIN THE TERRITORIAL JURISDICTION OF SANTIAGO CITY. Section 2, The purpose of this ordinance is to prevent the loss of lives in case of emergencies particularly during fire accidents where human lives and property are in danger- Section 3. Those des~ igned to accomodate and serve persons in the pursuit of educational, institutional, commercial, industrial, recrea~ tional, religious, political and social assemblage and other activities similar in nature as enuserated and provided herein (Section 106, PD 1185). b) Fire Escape ~ Refers to emergency passage ways or means of egress used during emergency situation or any mechanical or manually operated escape devices such as folded ladder, hanging ladder, escalator, elevator, escape Page Two of Ordinance No. 96-12 . « chute, descending lifeline (rope), or any device similar in nature (Section 7, PD 1185). ©) Fire Fighting Device - Refers to fire equipment, fire apparatus, fire accessories, fire nozzles, fire extin~ guishers, water hose, fire hydrants or standpipes, fire walls, fire alarm system, fire and smoke detection, and warning system or any other fire devices similar in nature. Section 4, All existing buildings or structure shall in~ stall fire escapes and other fire fighting devices. For every storey, there must be at least one (1) emergency exit and fire fighting device if the total floor area is fifty (50) square meters or less; two (2) emergency exits and fire fighting devices Af the total floor area is one hundred (100) square masters and one (1) additional fire exit and fire fighting device for every fifty (50) square meters added (Section 3, 401, PD 1185). Section 5. No building permit shall be issued or granted for the construction, repair, renovation, modification, lateration or extension of public or private buildings and related structures for public use whether owned or leased unless the owner thereot has provided in the submitted plans and specifications pravisions for fire escapes and emergency exits (Section 1, 202, PD 1185). Section 6. No building or structure shall be used for occupancy without a Fire Safety Inspection Clearance from the Bureau of Fire Protection of Santiago City in accordance with the provisions of the Fire Code of the Philippines (Section @, Para~ graph A, PD 1185). Section 7. The owner, administrator, occupant, or corpora~ tion who violates this ordinance shall be penalized based on the penalties imposed by the Fire Code of the Philippines (Section 12, PD 1185). Section 8. The owners of existing buildings and establish~ mants have up to December 31, 1996 to install or comply with the necessary fire escapes and fire fighting devices in treir build- ings and establishments.
