We the existing partners of “M/S. SARTHAK CONSTRUCTION”,

SOMENATH ROY (PAN: ACRPR2327N & AADHAAR No.7612 5077
4463), son of Late Rabindranath Roy, by nationality- Indian, by faith-
Hindu, by occupation- Business, residing at 93, Canal Street, Sree

Bhumi, Kolkata – 700 048, aged about 54 years and 2. MR. RABI GAYEN
(PAN : AJGPD5656D & AADHAAR No.7234 4069 0523), son of Late
Gopal Gayen, by nationality- Indian, by faith- Hindu, by occupation-
Business, residing at 25, S.K.Deb Road, 4th Bi-Lane, Kolkata- 700 048,
aged about 48 years and the legal heirs of the deceased partners Tarak
Chakraborty namely wife SMT. BOBY CHAKRABORTY (PAN:
ADWPC3493L & AADHAAR No. 4232 6878 8784), wife of Late Tarak
Chakraborty, by nationality- Indian, by faith- Hindu, by occupation-
Housewife, aged about 42 years, only on SRI AKASH CHAKRABORTY
(PAN: BWDPC1174M & AADHAAR No.9637 1847 0850), son of Late
Tarak Chakraborty, by nationality- Indian, by faith- Hindu, by
occupation- Student, aged about 21 years and only daughter MISS.
ANUSHKA CHAKRABORTY (AADHAAR No. 2031 9700 5682),
daughter of Late Tarak Chakraborty, by nationality- Indian, by faith-
Hindu, by occupation- Student, aged about 12 years, do hereby state
and affirm as follows :
i) THAT a partnership in the name of SARTHAK
CONSTRUCTION was incorporated with three partners
respectively Sri Somenath Roy, Sri Rabi Gayen, and Sri Tarak
Chakraborty with the registered office address at 53, S.K. Deb
Road Kolkata – 700 048 on and from 25th day of June,2009 to
deal in real estate development and to share future profit or loss
equally as 1/3rd share with the provision to contribute equal
capital to commence the business.

ii) THAT the first and second partner had introduced sufficient
capital for the business at the commencement and later on,
while the said Tarak Chakraborty could not introduce any
amount as his capital any time.

iii) THAT the said Tarak Chakraborty during his life time
withdrawn in different occasion various amounts for his
personal need which stands more than he deserved.

iv) THAT the said Tarak Chakraborty unfortunately died intestate

on 24.04.2021 leaving behind him (Declarant No.3 to 5 herein)
his wife Smt. Boby Chakraborty (PAN: ADWPC3493L &
AADHAAR No. 4232 6878 8784), one son Sri Akash

Chakraborty (PAN:BWDPC1174M & AADHAAR No.9637 1847

0850) and one daughter Miss. Anushka Chakraborty
(AADHAAR No. 2031 9700 5682) and none else as his legal heir.

v) THAT the legal heirs admitted all evidences of taking advances

by the said Tarak Chakraborty, since deceased, his
contribution towards the business and knowing all facts have
agreed to settle the dues at Rs.3,00,000 (Rupees Three Lakh)
only as full and final settlement on behalf of the said Tarak
Chakraborty, since deceased to be paid within 31st
March,2022, which the existing partners of M/s. Sarthak
Construction agreed to pay out of their humanity.

vi) THAT the legal heirs of the said Tarak Chakraborty, since
deceased, hereby without any coercion and without being
influenced from any end solemnly declare and assure that they
would never put any further claim more than Rs. 3,00,000
(Rupees Three Lakh) only as stated in clause (v) above any time
in future and never demand for participation in the partnership
upon the remaining partners namely Sri Somenath Roy and Sri
Rabi Gayen (Declarant No. 1 & 2 herein) and never be a cause
of disturbance to the business M/s. SARTHAK
CONSTRUCTION in any way and would be liable to put their
necessary signatures as and when required for necessary ‘No
Objection’ for Operation of Bank Accounts, towards Income
Tax & GST authorities, execution of Agreement for Sale,
registration of Deed of Conveyances in favour of Purchasers etc.
for smooth running of the business.
