CA G. R. SP No. 167055 DAVAO WESSCON TRADE CORPORATION and HEIRS OF
RAUL TAN CHIN (OR TAN CHIN) namely WEE SIOK DAN;
WILSON TAN, MICHAEL TAN, RICHARD TAN, JEFFERSON
TAN, WINSTON TAN and SUSAN TAN versus

MARCIANO BANUELOS

The Court RESOLVES to:

I. GRANT the twin Motions for Extension of Time (To File Opposition) for
a total period of twenty (20) days from February 01, 2022, or until
February 21, 2022 within which to file Comment on the Motion for
Execution Pending Appeal filed by petitioners' counsel via registered mail;

2. NOTE the following:

a) Opposition (To The Motion For Execution Pending Appeal) filed by

petitioners through counsel via registered mail on February 21,2022,
received by this Court on March 14,2022, and,

by Manifestation of Compliance filed by petitioners through counsel via

registered mail, received by this Court on April 19,2022, submitting a copy
of the Petition with the corrected Verification and Certification Against
Forum Shopping (Annex "A") together with the Spec al Power of Attorney
of Jefferson Tan (Annex "B") and, informing the Court of the death of
petitioner Wee SIok Dan on May 14,2014, hence she can no longer
provide her Special Power of Attorney (Annex "C" - her death certificate);
and, ADMIT the Annexes "A' to "C" of the Manifestation, in full compliance
with the Court's directive to rectify the defects of the petition per Minute
Resolution dated February 23,2022;

3. considering that petitioners have complied with Court's directive to

rectify the defects of the petition, the Court defers the resolution of the
motion for execution pending appeal until the respondent files a
Comment to the petition within ten (, 0) days from notice, and to which
petitioners may file their reply thereto within five (5) days from receipt of
the Comment. Parties are directed further to inform the Court of any
pending/subsequent filing of cases with same issues and parties, within
ten (10) days from notice thereof.
