permitted on stage during performance. Entertainers must represent PURCHASER in
a positive manner at all times during their contract.
b. Sound Checks: Sound checks must be performed regularly and not just when the
equipment is struck for maintenance, cleaning, etc. These checks will be completed at
least 1 hour prior to the beginning of the first set. The Band will also be in full compliance
with the Sound Engineer.
c. Dress: ENTERTAINER and musicians shall dress in a professional manner compatible
with PURCHASER standards.
d. Age Restrictions: No members of the ENTERTAINER group shall be under the age
of 21. No one associated with ENTERTAINER under the age of 21 will be allowed in
the Lounge area at any time before, during, or after the performance, regardless of
association with the ENTERTAINER.
e. Promotional Materials: ENTERTAINER agrees to submit all ENTERTAINER-
prepared promotional materials (e.g. posters, flyers, website listings, email,
advertisements) pertaining to this engagement for approval by PURCHASER prior to
general distribution of said materials.
11. It is understood that the ENTERTAINER executes this agreement as an independent contractor
and is not an employee of PURCHASER. It shall be the responsibility of the ENTERTAINER to
withhold and pay over to government authorities any and all income taxes and social security
contributions which may be required to be withheld from the musician’s fees.
12. In the event that ENTERTAINER, or any of the performers therein, commits a breach of this
contract, becomes intoxicated, or disobeys any of PURCHASER’S reasonable rules and
regulations, PURCHASER may, at its option, forthwith terminate this contract on written notice,
effective immediately.
13. If the ENTERTAINER is unable to execute the contract for any reason whatsoever, PURCHASER
may engage other entertainers to perform ENTERTAINER’S contract, and shall be entitled to
deduct the cost incurred by it in procuring substitute entertainment from the contract price. If
PURCHASER cannot provide the facility for ENTERTAINER to perform because of fire, accident,
act of God or public configuration, PURCHASER may terminate this contract without further
liability and the contract price shall be prorated for the services provided by ENTERTAINER
during the contract.
14. Exclusively The Point Casino management at any and all musical performances shall determine
all music volume levels.
15. It is understood and agreed that PURCHASER will not be liable for any loss or damage to
any equipment belonging to ENTERTAINER or performers, while such equipment is on the
premises of the PURCHASER.
16. Band will not perform at a similar Kitsap Peninsula venue as the PURCHASER’S for a
period of seven (7) days prior/following this contracted engagement.
17. We acknowledge and confirm that we have read and approve the terms and conditions set forth
in this contract.
