PROPOSED

AN ORDINANCE ESTABLISHING THE BACOLOD TREE MUSEUM, PROVIDING


FUNDS THEREFOR AND FOR OTHER PURPOSES.

WHEREAS, Section 16, Article II of the Philippine Constitution states that, “the State
shall protect and advance the rights of every people to a balanced and healthful ecology in accord
with the rhythm and harmony of nature”;

WHEREAS, the Local Government Code of 1991 mandates Local Government Units
(LGUs) on the primary of conservation, development protection and preservation of the natural
resources falling within their jurisdiction;

WHEREAS, planting of the rare and endangered species of trees in the Bacolod City
Eco-park will not only preserve the said trees but will also boost the tourism industry in the City;

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the


Sangguniang Panlungsod in session assembled, that:

Section 1. TITLE. This Ordinance shall be known as “The Bacolod Tree Museum
Ordinance”.

Section 2. DEFINITION OF TERMS. For the purpose of this Ordinance, the following
terms are defined:

a. Endangered Species – are species which have been categorized as very likely to
become extinct.

b. Historic Tree – a specimen of tree to be of notable value and interest because of its
age, size or historic association.

c. Landscape Architecture - is the design of outdoor areas, landmarks, and structures to


achieve environmental, social-behavioural, or aesthetic outcomes and enrich or alleviate the
human experience.

d. Tree Nursery – is a place where seedlings of historic, endangered species, important


and related species of trees and significant other plants are propagated and grown into a usable
size.

Section 3. LOCATION OF THE TREE MUSEUM. The Bacolod Tree Museum will be
located in the Bacolod Eco-Park at Barangay Granada.

Section 4. CREATION OF THE TREE MUSEUM COUNCIL. The Tree Museum


Council (TMC) is hereby created for the implementation and monitoring of the said ordinance
and shall be composed of the following:

Vice-Chair - Chairman, SP Committee on Tourism
Chairman, SP Committee on Environment and Ecology
Members - City Tourism Officer
City Engineer
City Agriculturist
City Planning and Development Officer
City Budget Officer
City Environment and Natural Resources Officer
Environment and Natural Resources Officer
Two (2) Representatives, Non-Government Organization in
Architecture, Landscaping or Environment

Section 5. DUTIES AND FUNCTIONS. The following are the powers and functions of
the committee:

1. Design and make a blueprint of the landscape architecture of the Tree Museum.

2. Coordinate with other environment organizations or government units to gather rare


and endangered species of trees.

3. Make an inventory and develop a tree nursery for the seedlings of all available species
of trees planted in the Tree Museum.

4. Construct and maintain the Tree Museum.

5. Provide an area for historic trees that was proclaimed by the Department of
Environment and Natural Resources.

Section 6. TREE MUSEUM OFFICER. The City Mayor shall appoint a Tree Museum
Officer who shall have the following duties and responsibilities:

1. Monitor, maintain and manage the Tree Museum.

2. Maintain and manage the tree nursery in the Tree Museum.

3. Update, monitor and maintain the inventory of all available species of trees and
seedlings in the Tree Museum.

4. Prepare and submit a monthly report on visitor arrivals of the museum to the City
Mayor and to the Council.

5. Other duties or functions that may be assigned by the City Mayor.

Section 7. MEETINGS AND QUORUM. The Tree Museum Council shall meet once a
month. Special meetings may be called as deemed necessary upon the call of the Chairman.
Quorum shall be determined by the Tree Museum Council.

Section 8. COMPENSATION AND REMUNERATION. The Chairman, Vice


Chairman and Members of the Council shall perform their respective duties and responsibilities
as such without compensation or remuneration.

Section 9. BUDGET AND APPROPRIATION. The City shall appropriate an annual


budget of THREE HUNDRED THOUSAND PESOS (Php 300,000.00) as initial fund to be
taken from the General Fund and shall be augmented/supplemented as the need arises.

Section 10. SEPARABILITY CLAUSE. If any part of this ordinance is declared as


unconstitutional or unlawful, such declaration shall not affect the other parts or the section hereof
that are not declared unlawful or unconstitutional.
Section 11. REPEALING CLAUSE. All previous ordinances inconsistent with this
ordinance shall be deemed repealed or modified accordingly.

Section 12. EFFECTIVITY CLAUSE. This Ordinance shall take effect fifteen (15)
days after its publication in any newspaper of general circulation within the city.
