MUNICIPAL ORDINANCE NO._____-2023

AN ORDINANCE DECLARING EVERY 2 ND DAY OF THE MONTH OF SEPTEMBER AS ARBOR DAY, ENJOINING ITS
CELEBRATION AS AN ANNUAL EVENT OF TREE PLANTING, APPROPRIATING FUNDS THEREFOR AND OTHER
PURPOSES.

WHEREAS, it is the policy of the State to protect and advance the right of the people to a balanced and
healthful ecology in accord with the rhythm and harmony of nature;

WHEREAS, Section 458 (a) (5) (1) of Republic Act 7160, otherwise known as the Local Government
Code of 1991, mandates the Sangguniang Bayan to enact ordinances that will provide for the establishment ,
maintenance, protection and conservation of communal forest and watersheds, tree parks, greenbelts,
mangroves and other similar forest development projects;

WHEREAS, Republic Act 10176, also known as the Arbor Day Act of 2012 authorizes all Local
Government Units to take on the responsibility of celebrating the day for tree planting as an annual event;

WHEREAS, Proclamation No. 396 declares the “Philippine Arbor Day” enjoining the active participation
of all government agencies including government-owned or controlled corporations, private sectors, schools,
civil societies, and citizenry in tree planting activity;

WHEREAS, there is a need for a collaborated effort between the State and its citizenry to combat the
loss of natural resources and rejuvenate the environment by undertaking nationwide tree planting activities
and providing effective measures for their maintenance and sustaintability;

NOW THEREFORE, be it ENACTED by the Sangguniang Bayan of Cavinti, Laguna in session assembled
that:

SECTION 1. This Ordinance shall be known as the ‘’ARBOR DAY ORDINANCE OF THE MUNICIPALITY OF
CAVINTI, LAGUNA.”

SECTION 2. Definition of Arbor Day - it refers to one-day activity of tree planting and other relevant
form of activity held annually at a date fixed in this Ordinance;

SECTION 3. Date of Arbor Day – Every Second Day of every month of September is hereby declared as
ARBOR DAY in the entire Municipality of Cavinti;

SECTION 4. Arbor Day Celebration Committee- there is hereby created an Arbor Day Celebration
Committee which shall be in charge of the activity composed of the ff.;

Members - One representative each of:
a) Municipal Environment and Natural Resource Officer
b) Municipal Agricultural Officer
c) District Supervisors, DepEd
d) School Principals (Public and Private)
e) Municipal Local Government Operation Office
f) Municipal Tourism Officer
g) Municipal Engineer
h) Municipal Police Officer
i) 202 Brigade
j) Liga ng mga Barangay
k) Transport Group
l) Civic Organization/Peoples Organizations
SECTION 5. Functions of the Arbor Day Committee- the following are the functions of the Committee:
a) Formulate plans and programs necessary to achieve the intent of this ordinance;
b) Specify the areas to be planted with trees and ornamental plants;
c) Monitor and record the activities and projects undertaken under this ordinance; and
d) Such other functions as the Local Chief Executive may deem necessary.

SECTION 6. Proclamation of Arbor Day. The Arbor Day celebration of the Municipality of Cavinti shall
be done every Second Day of September of every year.

SECTION 7. Planting of Trees – All able-bodied citizens of the Municipality of Cavinti, who are at least
twelve(12) years of age, shall be required to plant one(1) tree every year.

SECTION 8. Areas Covered by Tree Planting- The Arbor Day Celebration Committee shall specify the
area within the LGU to be planted or reforested. If the area to be planted or reforested is a protected
area or a protection forest, the Committee shall encourage the use of endemic or indigenous species
during the observance of the Arbor Day designated by the LGU.
The Tree Planting Activities shall be done in any of the following areas:
a) Public school grounds, gardens or other available areas within the school premises;
b) Idle or vacant public lands;
c) Public Parks in urban and rural areas; and
d) Private schools, parks and lands with the consent of the owner.

SECTION 9. Supply and Distribution of Seedlings. The Municipal Environment and Natural Resource
Officer and the Municipal Agricultural Officer shall be responsible in the supply and distribution of
seedlings for the tree planting program of the municipality.

SECTION 10. Maintenance of Trees . The Barangay Officials and deputized non-governmental
organizations shall be responsible for the maintenance of such trees every ATAG day of EveryMonth.

SECTION 11. Funding. For this year’s celebration of Arbor Day, the LGU shall appropriate by way of
supplemental budget the amount to be used for the celebration of this year’s Arbor Day, thereafter,
the appropriation shall be provided in the annual general budget;

SECTION 12. Implementing Rules and Regulations. To strictly implement the provisions under this
ordinance, the Local Chief Executive shall formulate and/or adopt Implementing Rules and Regulations
for this purpose upon the recommendation of the Arbor Day Celebration Committee.

SECTION 13. Separability Clause. If any provision of this ordinance or any part thereof be declared
invalid or unscontititutional, the remaining provisions not affected shall continue in full force and
effect.

SECTION 14. Reapealing Clause. All ordinances, resolutions. Executive orders or regulations and other
issuances inconsistent with the provisions and/or purposes of this ordinance are hereby repealed,
amended or modified accordingly.

SECTION 15. Effectivity Clause. This ordinance shall take effect immediately upon approval.
