Definitions (12 CFR 1024.

31)
12 CFR 1024.31 contains definitions that apply to Regulation X (12 CFR 1024.30-41, subpart C). Among other definitions,
amended Regulation X provides that “MORTGAGE LOAN” means “any federally related mortgage loan, as that term is
defined in section 1024.2 subject to the exemptions in section 1024.5(b), but does not include open-end lines of credit (home
equity plans).” Thus, the term “MORTGAGE LOAN” includes (but is not limited to) REFINANCING TRANSACTIONS,
whether secured by a senior or subordinate lien.

(iv) DEPOSIT.
(A) In a PURCHASE transaction as defined in paragraph (a)(9)(i) of this section, the AMOUNT that is paid to the seller OR
HELD IN TRUST OR escrow by an attorney OR other party under the terms of the agreement for the SALE of the property,
disclosed as a negative number, labeled “Deposit”; [“OR?” or WHAT?]
(B) IN ALL TRANSACTIONS other than purchase transactions as defined in paragraph (a)(9)(i) of this section, the
AMOUNT of $0, labeled “Deposit”;
(v) FUNDS FOR BORROWER. The AMOUNT of funds for the CONSUMER, labeled “FUNDS FOR BORROWER.”

The AMOUNT of the down payment AND OTHER FUNDS1 from the CONSUMER disclosed under paragraph (h)(1)(iii)
[“WHAT OTHER FUNDS?”]
(A)(2) or (h)(1)(iii)(B) of this section, as applicable, and OF FUNDS1 for the CONSUMER disclosed under this paragraph
(h)(1)(v), are determined by subtracting the sum of the loan AMOUNT disclosed under paragraph (b)(1) of this section
AND ANY AMOUNT OF EXISTING LOANS ASSUMED OR taken subject to that will be disclosed under §
