पिु िन्म जनयंत्रण जनयम, 2022
सा.का.जन. 656(अ).—पिु क्रूरता जनिारण अजधजनयम, 1960 (1960 का 59) की धारा 38 की उपधारा (2) के
खंड (i) द्वारा प्रित्सत िजतियय का प्रयगग करते ुए, सा.आ. 1256 (अ) 24 दिसम्बर 2001 कग प्रकाजित तथा सा.आ. 303
(अ) दिनांक 8 फरबरी, 2011 कग संिगजधत, इस तरह के अजधक्रमण से पहले दकए गए या छगडे गए कायों कग छगडकर, संघ
सरकार भारत के रािपत्र में मसौिा जनयम के प्रकािन के साठ दिन के भीतर सािविजनक टिप्पजणय के जलए मसौिा
जनयम कग प्रकाजित करने का प्रस्ट्ताि कर रही ह
उक्त प्राूपप जनयम के संबंध में कगई भी ्‍यजतिय संघ सरकार के जिचार हेतु िग कगई सुझाि या आपजि करना
चाहता ह, ऊपर जनर्िवष्ि अिजध के भीतर, संयुक्त आयुक्त (पिु कल्याण), के जबन नंबर 6, चंद्रलगक भिन, िनपत, नई
दिल्ली कग अरेषेज त कर सकता ह
1. संजिप्त नाम और प्रारं भ (1) इन जनयम कग पिु िन्म जनयंत्रण जनयम, 2022 कहा िायेगा
(2) ये रािपत्र में प्रकािन की तारीख कग प्रिृत्सत ह गे
2. पटरभा ाएं इन जनयम में, िब तक दक संिभव से अन्यथा अपेजित न हग,
(क) “अजधजनयम” से पिुओं के प्रजत क्रूरता का जनिारण अजधजनयम, 1960 अजभप्रेत ह;
(ख) “पिु िन्म जनयंत्रण कें द्र” का अजभप्राय सर्िवकल इं फ्रास्ट्रक्चर, पगस्ट्ि-ऑपरे टिि के यर के नेल, क्िारं िाइन
के नेल, आइसगलेिन के नेल, डॉग रांसपगिव ्‍हीकल्स के साथ आि्‍यक लॉजिजस्ट्िक्स और बगडव द्वारा जनधावटरत

ऐसी अन्य सुजिधाओं के साथ एक पिु जचदकत्ससा सुजिधा ह, िहां स्ट्रीि डॉ स कग पिु िन्म जनयंत्रण
कायवक्रम के जलए लाया िाता ह
(ग) “पिु आश्रय” का अजभप्राय ह िह स्ट्थान िहां आिारा या गली के या पटरत्सयक्त पिुओं कग गगि लेने या
पुनिावस, बीमार या घायल हगने पर सामान्य उपचार के जलए रखा िाता ह;
(घ) “पिु कल्याण सजमजत” का अजभप्राय इन जनयम के तहत सामुिाजयक ्‍िान कग खाना जखलाने के समाधान
हेतु गटठत सजमजत ह;
(ङ) “पिु कल्याण संगठन” का अजभप्राय ह पिुओं के कल्याण के जलए काम करने िाला कगई भी संगठन िग
1860 के सगसायिी पंिीकरण अजधजनयम (1860 का 21) या दकसी भी संबंजधत कानून के तहत पंिीकृ त ह
और बगडव की मौिूिा नीजत के अनुसार भारतीय िीि िन्तु कल्याण बगडव द्वारा मान्यता प्राप्त ह
(च) “बगडव” का अजभप्राय भारतीय िीि िन्तु कल्याण बगडव ह, जिसे अजधजनयम की धारा 4 के तहत स्ट्थाजपत
दकया गया ह और धारा 5ए के तहत पुनगवटठत दकया गया ह;
(छ) “प्रमाण-पत्र” का अजभप्राय ह इन जनयम के तहत पिु िन्म जनयंत्रण कायवक्रम के उद्दे्‍य से दकसी भी पिु
कल्याण संगठन या स्ट्थानीय प्राजधकरण कग बगडव द्वारा िारी पटरयगिना मान्यता का प्रमाण-पत्र
(ि) “सजमजत” का अजभप्राय ह इन जनयम के तहत स्ट्थाजपत एक जनगरानी सजमजत
(झ) “सामुिाजयक पिु” का अजभप्राय दकसी समुिाय में पिा ुआ कगई भी पिु ह जिसके जलए दकसी ्‍यजतिय या
संगठन द्वारा दकसी स्ट्िाजमत्सि का िािा नह दकया गया ह, िन्यिीि संरिण अजधजनयम, 1972 (1972 का
53) के तहत पटरभाज त िंगली िानिर कग छगडकर
(ञ) “जनटरिण िल” का अजभप्राय ह जनयम के तहत बगडव या राज्य बगडव द्वारा अजधकृ त िीम
(ि) “स्ट्थानीय प्राजधकरण” का अजभप्राय जनर्िवष्ि स्ट्थानीय िेत्र के अन्तगवत दकसी भी मामले के जनयंत्रण और
प्रिासन के साथ एक नगरपाजलका सजमजत, नगर पटर ि, जिला प्रिासन, जिला पंचायत/बगडव, छािनी
बगडव या कानून द्वारा जनिेजित अन्य प्राजधकरण ह;
(ठ) “स्ट्िामी” का अजभप्राय ह दकसी पिु का स्ट्िामी और इसमें कगई अन्य ्‍यजतिय िाजमल ह जिसके क्‍िे या
अजभरिा में ऐसा पिु ह चाहे िह स्ट्िामी की सहमजत से हग या उसके जबना;
(ड) “राज्य बगडव” का अजभप्राय राज्य सरकार द्वारा राज्य में गटठत राज्य पिु कल्याण बगडव ह
(ढ) “पिु क्रूरता जनिारण सजमजत (एस.पी.सी.ए.)” का अजभप्राय ह इस अजधजनयम के तहत बनाए गए जनयम
के तहत स्ट्थाजपत एक एसपीसीए;
(ण) “पिु जचदकत्ससक” का अजभप्राय ह भारतीय पिु जचदकत्ससा पटर ि अजधजनयम, 1984 (1984 का 52) के
प्रािधान के तहत पंिीकृ त एक पिु जचदकत्ससक
(त) “िेत्राजधकारी पिु जचदकत्ससा अजधकारी” का अजभप्राय ह िेत्र के पिुपालन जिभाग के सरकारी पिु
जचदकत्ससालय में तनात पिु जचदकत्ससा अजधकारी
(थ) “पटरयगिना प्रभारी” का अजभप्राय ह स्ट्थानीय प्राजधकरण द्वारा गली के ्‍िान के जलए पिु िन्म जनयंत्रण
कायवक्रम आयगजित करने हेतु तनात पिु जचदकत्ससा अजधकारी पटरयगिना प्रभारी स्ट्थानीय प्राजधकरण या
राज्य सरकार के जनयजमत पेरगल पर एक पिु जचदकत्ससा अजधकारी ह गे
(ि) “पटरयगिना मान्यता सजमजत” का अजभप्राय इन जनयम के तहत स्ट्थानीय प्राजधकरण या पिु कल्याण
संस्ट्थाओं द्वारा पिु िन्म जनयंत्रण कायवक्रम का संचालन ह
(ध) “पिु िन्म जनयंत्रण कायवक्रम” का अजभप्राय ह पिु िन्म जनयंत्रण कायवक्रम की पटरयगिना मान्यता के
आिेिन पर िांच और परीिा के जलए बगडव द्वारा गटठत सजमजत
(न) “मॉडयूल” का अजभप्राय ह ्‍िान िनसं‍या प्रबंधन और रे बीि उन्मूलन के जलए जलजखत िस्ट्तािेि िग बगडव
द्वारा समय-समस पर प्रकाजित और अद्यतन दकया िाता ह, िग गली के ्‍िान के जलए पिु िन्म जनयंत्रण
कायवक्रम के जलए मानक संचालन प्रदक्रया के ूपप में काम करे गा
3. पटरयगिना मान्यता
स्ट्थानीय प्राजधकरण अपने स्ट्ियं के पिु जचदकत्ससा अजधकाटरय के माध्यम से पिु िन्म जनयंत्रण कायवक्रम का
संचालन कर सकता ह, या यदि आि्‍यक हग, तग स्ट्थानीय प्राजधकरण एक पिु कल्याण संगठन की सेिाओं कग
संल न कर सकता ह जिसे बगडव द्वारा पिु िन्म जनयंत्रण हेतु जिजधित मान्यता प्रिान ह और जिसके पास पिु िन्म
[भाग II—खण्ड 3(i)] भारत का रािपत्र असाधारण 3
जनयंत्रण कायवक्रम के संचालन के जलए अपेजित प्रजििण, जििे ज्ञता और मानि संसाधन ह िगनग ितों के तहत,
बगडव से एक पटरयगिना मान्यता प्रमाण-पत्र प्राप्त करना अजनिायव हगगा
(1) कगई भी स्ट्थानीय प्राजधकरण या संगठन बगडव से पटरयगिना मान्यता प्रमाण-पत्र के जबना गली के ्‍िान के
जलए पिु िन्म जनयंत्रण कायवक्रम िुूप, संचाजलत या आयगजित नह करे गा
(2) कगई भी पिु कल्याण संगठन िग दकसी भी कानून के तहत अनुबंध करने के जलए अयग य नही ह, िह पहली
अनुसूची में संल न फॉमव –I में अपना आिेिन ूपपये 5,000 (पांच हिार ूपपये मात्र) की गर-िापसी िुल्क के
साथ बगडव कग प्रस्ट्तुत करके पटरयगिना मान्यता के जलए आिेिन कर सकता ह
(3) इन जनयम के तहत जपरयगिना मान्यता के जलए आिेिन करने िाले दकसी भी पिु कल्याण संगठन कग बगडव
द्वारा पहले से ही एक पिु कल्याण संगठन के ूपप में मान्यता प्राप्त हगनी चाजहए
(4) यदि कगई स्ट्थानीय प्राजधकरण अपने स्ट्ियं के पिु जचदकत्ससा अजधकाटरय के माध्यम से पिु िन्म जनयंत्रण
कायवक्रम का संचालन कर रहा ह, तग स्ट्थानीय प्राजधकरण का पटरयगिना प्रभारी बगडव से पटरयगिना मान्यता
प्राप्त करे गा यदि पिु िन्म जनयंत्रण कायवक्रम स्ट्थानीय प्राजधकरण के पिु जचदकत्ससा अजधकाटरय द्वारा
जनष्पादित दकया िाता ह तग आिेिन िुल्क में छू ि िी िाएगी अन्य सभी िततें और बगडव द्वारा प्रकाजित
मॉडयूल लागू ह गे
(5) पिु िन्म जनयंत्रण कायवक्रम के संचालन के जलए पटरयगिना मान्यता के जलए आिेिन करने िाले आिेिक कग
प्रत्सयेक अलग पिु िन्म जनयंत्रण कें द्र के जलए अलग-अलग आिेिन करने की आि्‍यकता हगगी
(6) पटरयगिना मान्यता की मांग करने िाले आिेिक कग प्रत्सयेक पिु जचदकत्ससक के जलए भारतीय पिु जचदकत्ससा
पटर ि / राज्य पिु जचदकत्ससा पटर ि द्वारा िारी पंिीकरण प्रमाण-पत्र की सत्सयाजपत प्रजत प्रस्ट्तुत करनी
हगगी, जिसे जििे पटरयगिना पर तनात दकया िाएगा आिेिक कग सरकारी प्राजधकरण द्वारा िारी अनुभि
प्रमाण-पत्र की एक प्रजत प्रस्ट्तुत करनी हगगी आिेिक द्वारा तनात दकए िाने के जलए प्रस्ट्ताजित पिु
जचदकत्ससक / पिु जचदकत्ससक कग नगर जनगम के िेत्र में तनाती के मामले में कम से कम 5,000 पिु िन्म
जनयंत्रण सिवरी आयगजित करने का कु ल संयुक्त अनुभि हगना चाजहए और नगर पाजलका, नगर पंचायत, रेषाम
पंचायत या अन्य रेषामीण स्ट्थानीय जनकाय के िेत्र में तनाती के मामले में कम से कम 2,000 पिु िन्म
जनयंत्रण आयगजित करने का कु ल संयुक्त अनुभि हगना चाजहए
(7) बगडव पटरयगिनाओं की मान्यता के जलए एक पटरयगिना मान्यता सजमजत का गठन करे गा;
(8) बगडव पटरयगिना मान्यता के जलए आिेिन प्राप्त हगने पर संबंजधत राज्य के पिुपालन जिभाग कग प्रस्ट्ताजित
पिु िन्म जनयंत्रण कें द्र का जनरीिण करने और बगडव द्वारा प्रकाजित मॉडयूल के अनुसार अपेजित सुजिधाओं
की उपल्‍धता की पुजटि करने का जनिदेशि िेगा जनरीिण एक िीम द्वारा दकया िाना चाजहए जिसमें जनम्न
िाजमल हैं;
i) जिले के मु‍य पिु जचदकत्ससा अजधकारी
ii) राज्य पिु िन्म जनयंत्रण जनगरानी सजमजत के नगडल अजधकारी
iii) बगडव या राज्य बगडव का प्रजतजनजध
(9) जनरीिण िल कग जनरीिण की तारीख से िस दिन की अिजध के अन्िर बगडव द्वारा जनधावटरत जनरीिण प्रपत्र
के अनुसार जनरीिण िल के सभी सिस्ट्य द्वारा हस्ट्तािटरत एक टरपगिव प्रस्ट्तुत करनी हगगी
(10) पटरयगिना मान्यता सजमजत, उप-जनयम (8) के तहत जनरीिण टरपगिव पर जिचार करने के बाि और संतुष्ि
हगने पर दक पिु िन्म जनयंत्रण कें द्र इन जनयम के तहत जनर्िवष्ि आि्‍यकताओं का अनुपालन कर रहा ह,
पटरयगिना पिु िन्म जनयंत्रण कायवक्रम की मान्यता का प्रमाण-पत्र िारी करने की जसफाटरि कर सकता ह
(11) पटरयगिना मान्यता सजमजत की जसफाटरि के आधार पर बगडव इन जनयम के तहत जिजिष्ि पटरयगिना के
जलए मान्यता प्रमाण-पत्र िारी कर सकता हि, िग अहस्ट्तांतरणीय हगगा
(12) स्ट्थानीय प्राजधकरण के जपरयगिना प्रभारी या संगठन के पिु जचदकत्ससक यह सुजनजित करें गे दक पटरयगिना
मान्यता का प्रमाण-पत्र पिु िन्म जनयंत्रण कें द्र पर प्रमुखता से प्रिर्िवत दकया गया ह और ऐसा प्रमाण-पत्र
जनरीिण प्राजधकारी के अनुरगध पर भी प्रस्ट्तुत दकया िाएगा
4. मान्यता से इं कार बगडव इन जनयम के तहत स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन द्वारा संचाजलत दकसी भी
पटरयगिना कग मान्यता नह िेगा, यदि –
(1) स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन द्वारा प्रस्ट्तुत की गई िानकारी यदि झूठी पाई िाती ह या
आिेिक ने आिेिन में िानबूझकर गलत जििरण दिया ह या बगडव कग जमथ्या या गढा ुआ टरकॉडव प्रिान दकया
ह;
(2) इन जनयम के तहत मान्यता के जलए आिेिन िमा करने से पहले दकसी भी स्ट्तर पर पिु कल्याण संगठन, इस
अजधजनयम या इसके तहत बनाए गए जनयम के तहत दकसी भी अपराध के जलए िग ी ठहराया गया ह, या
िानिर की सुरिा के जलए प्र‍याजपत दकसी अन्य राज्य या कें द्रीय अजधजनयम या दकसी अन्य लागू कानून के
तहत िानिर या िानिर से संबंजधत दकसी भी अपराध के जलए िग ी ठहराया गया ह;
(3) पिु कल्याण संगठन ने जनरीिण िल कग पूरे पटरसर या पटरसर के जहस्ट्से में जनरीिण करने की अनुमजत िेने से
इनकार कर दिया ह, या इन जनयम के तहत अजनिायव िस्ट्तािेि या दकसी भी टरकॉडव तक पुंचनें से इनकार
कर दिया ह
(4) यदि पटरयगिना मान्यता सजमजत यह मानती ह दक पिु िन्म जनयंत्रण कें द्र में बुजनयािी ढांचा और उपल्‍ध
िनिजतिय जनधावटरत आि्‍यकताओं के अनुूपप नह ह, तग बगडव उपरगक्त जनयम 3(7) के अनुसार जनरीिण िल
से टरपगिव प्राप्त हगने के 30 दिन की अिजध के भीतर जलजखत में कारण बताते ुए आिेिन कग अस्ट्िीकार कर
सकता ह
5. मान्यता के जबना जन ध
े गली के ्‍िान के जलए कगई भी पिु िन्म जनयंत्रण कायवक्रम तब तक आयगजित नह
दकया िाएगा िब तक दक स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन ने इन जनयम के तहत इस तरह के कायवक्रम
के संचालन के जलए पटरयगिना मान्यता का प्रमाण-पत्र प्राप्त नह दकया हग
बितदेश दक पहले परं तुक में जनर्िवष्ि कगई स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन छह महीने की अिजध के भीतर
पटरयगिना मान्यता के प्रमाण-पत्र के जलए आिेिन करने में जिफल रहता ह या इन जनयम के तहत जनर्िवष्ि दकसी
भी कारण से पटरयगिना मान्यता से इन्कार कर दिया गया ह, तग संबंजधत स्ट्थानीय प्राजधकरण ऐसे पिु िन्म
जनयंत्रण कायवक्रम कग बंि कर िेगा यदि कगई ्‍िान पकडे िा रहे हैं या सिवरी की िा रही ह तग उसे तत्सकाल रगक
दिया िाएगा और सभी ्‍िान का इलाि जपरयगिना प्रभारी या दकसी पिु कल्याण संगठन के द्वारा दकया
िाएगा, िब तक दक िे टरहा हगने के जलए दफि न ह
6. मान्यता का निीनीकरण
(1) बगडव द्वारा िारी पिु िन्म जनयंत्रण कें द्र के जलए पटरयगिना मान्यता का प्रमाण-पत्र मान्यता की तारीख से
तीन साल की अिजध के जलए िध हगगा और इन जनयम के तहत बगडव कग एक आिेिन प्राप्त हगने पर
निीनीकृ त दकया िा सकता ह
मान्यता के निीनीकरण के जलए एक आिेिन, पिु िन्म जनयंत्रण कायवक्रम के जलए पटरयगिना मान्यता की
समाजि से कम से कम साठ दिन पहले, बगडव कग पहली अनुसूची में संल न फॉमव – IV में पांच हिार ूपपये के
गर-िापसी यग य निीकरण िुल्क के साथ दकया िाएगा जनयम 3 के प्रािधान यथाि्‍यक पटरितवन सजहत
लागू ह गे
(2) बगडव, जनयम 3 के उप-जनयम (3) के तहत जनरीिण प्राजधकरण द्वारा प्रस्ट्तुत जनरीिण टरपगिव पर जिचार करने
के बाि और संतुष्ि हगने पर दक पिु िन्म जनयंत्रण कें द्र इन जनयम के तहत जनर्िवष्ि आि्‍यकताओं का
अनुपालन कर रहा ह, पहली अनुसूची के साथ संल न प्रपत्र – V में दिए गए प्राूपप में निीनीकरण िारी कर
पिु िन्म जनयंत्रण कें द्र की पटरयगिना मान्यता के प्रमाण-पत्र का निीनीकरण कर सकता ह
(3) बगडव द्वारा िारी पटरयगिना मान्यता प्रमाण-पत्र के जलए निीनीकरण तीन साल की अिजध के जलए िध हगगा,
यह इन जनयम के तहत बगडव द्वारा एक आिेिन और निीनीकरण िुल्क प्राप्त हगने पर निीकरणीय हगगा
7. िानिर का िगीकरण इन जनयम के उद्दे्‍य के जलए िगीकृ त िानिर इस प्रकार हैं
(क) पालतू िानिर – ्‍यजतियय के स्ट्िाजमत्सि में एिं घर के अंिर रखे िाने िाले ्‍िान
(ख) गली के ्‍िान या समुिाय के स्ट्िाजमत्सि िाले भारतीय ्‍िान या पटरत्सयक्त िंिािली िाले ्‍िान िग बेघर
हैं, गली या एक िरिाि िाले पटरसर में रहते हैं
8. िीकाकरण और बंध्याकरण का उत्सतरिाजयत्सि (1) पालतू पिुओं के मामले में पिु का स्ट्िामी कृ जममुजतियकरण,
प्रजतरिकण और नसबंिी के जलए जिम्मेिार हगगा
(2) गली में रहने िाले पिुओं के मामले में, स्ट्थानीय प्राजधकरण कृ जममुजतियकरण िीकाकरण और नसबंिी के जलए
जिम्मेिार हगगा और इन जनयम के अनुसार पिु िन्म जनयंत्रण कायवक्रम कग चलाने के जलए बगडव द्वारा
मान्यता प्राप्त एक पिु कल्याण संगठन कग जनयुक्त कर सकता ह
9. जनगरानी सजमजतय का गठन और उसके कायव रे बीि के उन्मूलन और मानि पिु संघ व कग कम करने के जलए इन
जनयम के अनुसार पिु िन्म जनयंत्रण कायवक्रम के प्रभािी कायावन्ियन के जलए जनगरानी सजमजतय का गठन दकया
िाएगा जनगरानी सजमजतय का गठन जनम्नानुसार दकया िाएगा
(1) कें द्र सरकार के जिजभन्न जहतधारकग के बीच और कें द्र सरकार और राज्य सरकार के बीच समन्िय सुजनजित
करने के जलए, ्‍िान िनसं‍या प्रबंधन और रे बीि उन्मूलन के जलए एक कें द्रीय पिु िन्म जनयंत्रण जनगरानी
और समन्िय सजमजत का गठन दकया िाएगा सजमजत का गठन और उसके कायव अनुसूची – II में जनधावटरत
दकए िाएंगे
(2) सभी राज्य और संघ िाजसत प्रिेि में राज्य/संघ िाजसत प्रिेि स्ट्तर पर एक राज्य पिु िन्म जनयंत्रण
कायावन्ियन और जनगरानी सजमजत का गठन दकया िाएगा यह सजमजत राज्य भर में िज्ञाजनक और चरणबद्ध
तरीके से पिु िन्म जनयंत्रण कायवक्रम के कायावन्ियन का समन्िय करे गी सजमजत का गठन और उसके कायव
अनुसूची – II में जनधावटरत दकए िाएंगे
(3) सभी राज्य और संघ िाजसत प्रिेि में स्ट्थानीय प्राजधकरण स्ट्तर पर एक स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी
सजमजत का गठन दकया िाएगा सजमजत का गठन और उसके कायव अनुसूची – II में जनधावटरत दकए िाएंगे
10. स्ट्थानीय प्राजधकरण के िाजयत्सि
(1) स्ट्थानीय प्राजधकरण यह सुजनजित करे गा दक उनके अजधकार िेत्र में प्रत्सयेक पिु िन्म जनयंत्रण कें द्र में
जनम्नजलजखत सुजिधाएं उपल्‍ध ह
(क) पयावप्त सं‍या में के नेल और पिु जचदकत्ससा अस्ट्पताल सुजिधाएं िग स्ट्थानीय प्राजधकरण या पिु कल्याण
संगठन द्वारा प्रबंजधत की िा सकती हैं;
(ख) ्‍िान के सुरजित संचालन और पटरिहन के जलए आि्‍यक ूपपान्तरण से युक्त अपेजित सं‍या में िन;
(ग) छगिे स्ट्थानीय जनकाय , िहां आि्‍यक समझा िाता ह और िहां पगस्ट्ि-ऑपरे टिि िेखभाल के जलए के नेल
उपल्‍ध हैं, के जलए नसबंिी और िीकाकरण के जलए मगबाइल सैंिर के ूपप में सर्िवकल इं फ्रास्ट्रक्चर से
लस एक मगबाइल ऑपरे िन जथएिर िन;
(घ) अंग और िि के जनपिान के जलए स्ट्थानीय प्राजधकरण द्वारा स्ट्थाजपत दकए िाने िाले भस्ट्मक िहां
भस्ट्मक संभि नह ह, िहां गहरी िफन जिजध अपनाई िा सकती ह
(ङ) पिु िन्म जनयंत्रण कें द्र की आिजधक मरम्मत और रख-रखाि
(च) पूरे पटरसर में क्लगि सर्कव ि िेलीजििन (सीसीिीिी), जििे ूपप से ऑपरे िन जथएिर में और िहां पिुओं
कग पिु िन्म जनयंत्रण कें द्र में रखा िाता ह तथा कम से कम तीन महीने के जलए इन िीडीयग जनगरानी के
टरकॉडव कग बनाए रखना हगगा या िसा दक जनर्िवष्ि ह बगडव या राज्य बगडव द्वारा समय-समय पर िीडीय
टरकॉर्डवग िांच या अनुरगध पर जनरीिण प्राजधकारी, जनगरानी सजमजत या बगडव के जलए उपल्‍ध कराई
िा सकती ह
(छ) पिु िन्म जनयंत्रण कें द्र में हर समय साफ-सफाई और स्ट्िच्छता बनाए रखी िानी चाजहए
(ि) पिु िन्म जनयंत्रण कें द्र में लाए गए सभी िानिर कग पकडने, छगडने, ििा, सिवरी, भगिन, िीकाकरण के
जलए टरकॉडव बनाए रखा िाना चाजहए
(2) यदि पिु कल्याण संगठन की सेिाएं ली गई हैं, तग स्ट्थानीय प्राजधकरण जनयजमत आधार पर नसबंिी /
िीकाकरण के खचों की प्रजतपूर्तव करे गा
(3) स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत का गठन स्ट्थानीय प्राजधकरण द्वारा दकया िाएगा और पिु
िन्म जनयंत्रण कायवक्रम के कायावन्ियन के संबंध में की गई प्रगजत का आकलन करने के जलए हर महीने कम
से कम एक बार बठक करे गा
(4) पिु िन्म जनयंत्रण कें द्र के जखलाफ जिकायत प्राप्त हगने पर स्ट्थानीय प्राजधकरण इन जनयम के उल्लंघन
के मामले की िांच करे गा और स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत या बगडव की जसफाटरि के
आधार पर ऐसे संगठन के साथ दकसी भी िुडाि कग समाप्त या जनलंजबत करे गा
11. पक्डना / नसबंिी / िीकाकरण / छौडना
(1) गली के ्‍िान कग पकडने का कायव के िल जनम्नजलजखत कारण से दकया िाएगा
(क) सामान्य उद्दे्‍य जिसके जलए स्ट्थानीय प्राजधकरण जनगरानी सजमजतय के परामिव से एक जिजिष्ि
िेत्र या िेत्र में पिु िन्म जनयंत्रण कायवक्रम के माध्यम से गली के ्‍िान की अजधक आबािी कग
जनयंजत्रत करने का जनणवय करे गा
(ख) जिजिष्ि जिकायतें जिसके जलए स्ट्थानीय प्राजधकरण जनगरानी सजमजत के परामिव से पिु िन्म
जनयंत्रण कें द्र में एक पिु जिकायत प्रकगष्ठ स्ट्थाजपत करे गा, िग रे बीि से पीजडत हगने िाले संदि ध
्‍िान के कािने के बारे में िानकारी या जिकायत प्राप्त करे गा
(2) ्‍िान कग पकडने िाली िीम में जनम्न िाजमल ह गे
(i) िन का चालक
(ii) स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन के िग या िग से अजधक प्रजिजित कमवचारी िग गली के
्‍िान कग मानिीय ूपप से पकडने में प्रजिजित हैं
(iii) दकसी भी पिु कल्याण संगठन का एक प्रजतजनजध िग इस उद्दे्‍य के जलए नामांदकत दकया गया ह
्‍िान पकडने िाली िीम के प्रत्सयेक सिस्ट्य के पास स्ट्थानीय प्राजधकारी द्वारा िारी िध पहचान पत्र हगना
चाजहए
(3) दकसी भी इलाके में गली के ्‍िान कग पकडने से पहले, स्ट्थानीय प्राजधकरण या पिु कलयाण संगठन के
प्रजतजनजध बनर/सािविजनक नगटिस द्वारा जनिाजसय कग सूजचत करते ुए घग णा करें गे दक िानिर कग
नसबंिी के उद्दे्‍य से उस िेत्र से पकडा िाएगा और िीकाकरण तथा नसबंिी के बाि उसी िेत्र में िाजपस
छगड दिया िाएगा घग णा िेत्र के जनिाजसय कग पिु िन्म जनयंत्रण कायवक्रम के बारे में भी संजिप्त में
जिजित कर सकती ह और सभी जनिाजसय के समथवन के जलए उन्हें आ्‍िस्ट्त कर सकती ह दक स्ट्थानीय
प्राजधकरण उनकी सुरिा और िानिर की सुरिा के जलए पयावप्त किम उठा रहा ह ऐसे प्रयास प्रत्सयेक पिु
िन्म जनयंत्रण कें द्र में भी स्ट्थाजपत दकए िाएंगे
(4) िानिर कग पकडने में मानिीय तरीक का उपयगग दकया िाएगा िसे दक िाल से पकडना या हाथ से
पकडना या दकसी उन्य तरीके से िग िानिर कग कम परे िान करता हग ्‍िान कग पकडने के जलए जचमिे
या तार का प्रयगग करना स‍त ूपप से िर्िवत हगगा
(5) पिु िन्म जनयंत्रण कें द्र की आिास िमता के अनुसार के िल जनधावटरत सं‍या में ही िानिर कग पकडा
िाएगा पिु िन्म जनयंत्रण कें द्र में एक जनजित समय पर के िल एक िेत्र के ्‍िान कग ही नसबंिी,
िीकाकरण के जलए लाया िाएगा जिजभन्न िेत्र के ्‍िान कग संपकव में लाने से बचने का प्रयास दकया िाना
चाजहए
(6) पकडे गए सभी ्‍िान की पहचान पिु िन्म जनयंत्रण कें द्र पर पुंचने के तुरंत बाि एक नंबर िाले कॉलर से
की िाएगी यह सं‍या पकडे गए ्‍िान के टरकॉडव के अनुूपप हगगी तादक यह सुजनजित दकया िा सके दक
प्रत्सयेक ्‍िान कग नसबंिी और िीकाकरण के बाि उसी िेत्र में छगडा िाए िहां से उसे पकडा गया था
(7) छह महीने से कम उम्र िाले गली के ्‍िान कग पकडा नह िाएगा और उनकी नसबंिी नही की िाएगी
जपल्ल के साथ मािा िानिर कग तब तक नसबंिी के जलए नह पकडा िाएगा िब तक दक उनके बच्चे 2
महीने का न हग िाए
(8) पकडे गए िानिर कग बगडव से पटरयगिना मान्यता प्रमाण-पत्र िाले और स्ट्थानीय प्राजधकरण या पिु
कल्याण संगठन द्वारा प्रबंजधत पिु िन्म जनयंत्रण कें द्र में लाया िाएगा िहां पिु जचदकत्ससक द्वारा उनकी
िांच की िाएगी स्ट्िस्ट्थ िानिर कग बीमार या घायल िानिर से अलग रखना चाजहए बीमार या घायल
िानिर कग पयावप्त उपचार दिया िाना चाजहये उपचाटरत िानिर के ठीक हगने के बाि ही उनकी
नसबंिी की िानी चाजहए
(9) के नेल िहां ्‍िान कग रखा िाता ह, प्रत्सयेक के नेल के िरिािे पर इलाके का नाम स्ट्पष्ि ूपप से जलखकर
जचजन्हत दकया िाना चाजहए अलग-अलग ्‍िान के जलए के नेल कम से कम 3 फीि चौडे, 4 फीि गहरे और
कम से कम 6 फीि ऊंचे हगने चाजहए 3 से 5 ्‍िान के जलए के नेल भी उपल्‍ध कराए िा सकते हैं, िहां
प्रत्सयेक ्‍िान कग कम से कम 3 फीि गुणा 4 फीि की िगह जमले के नेल में लगहे की खडी छड का िरिािा
या गेि हगना चाजहए सभी सलाख के बीच का अंतराल 2 इं च से अजधक नह हगना चाजहए खराब मौसम
से छाया और आश्रय प्रिान करने और ्‍िान कग भगने से रगकने के जलए पयावप्त छत आि्‍यक ह के नेल का
जडिाइन करते समय यह सुजनजित करने के जलए सािधानी बरतनी चाजहए दक के नेल के माध्यम से हिा का
पयावप्त क्रॉस िेंटिलेिन ह के नेल के पीछे का भाग उठा ुआ जडिाइन दकया िाना चाजहए िहां ्‍िान आराम
से सग सके सफाई की सुजिधा के जलए सभी के नेल में उजचत िल जनकासी ्‍यिस्ट्था हगनी चाजहए
(10) एक ही पटरिार / समाजिक समूह के ्‍िान कग एक ही के नेल में रखा िा सकता ह नर और मािा ्‍िान कग
अलग-अलग रखा िाना चाजहए ्‍िान कग सिवरी से पहले 12 घंिे तक क्िरं िाइन के नेल में जबना भगिन या
पानी के रखा िाना चाजहए
(11) एक अच्छी तरह से सुसज त ऑपरेिन जथयेिर में स्ट्थानीय प्राजधकरण के अजधकार िेत्र के पिु जचदकत्ससा
अजधकाटरय की जििे िेख-रे ख में एक पिु जचदकत्ससक द्वारा नसबंिी सिवरी और िीकाकरण दकया िाना
चाजहए अनुमगदित सर्िवकल प्रदक्रयाएं और न्यूनतम आि्‍यकताएं बगडव द्वारा मॉडयूल में जनधावटरत अुनसार
ह गी
(12) नसबंिी सिवरी के िौरान प्रत्सयेक ्‍िान के िाजहने कान पर एक ‘िी’ आकार का जनिान बनाया िाएगा कान
की इस तरह की कतरन से ्‍िान के गली में पर िापस आने के बाि उसे बंध्याकृ त और प्रजतरजित के ूपप में
पहचानने में मिि जमलती ह ्‍िान की रांांंडंग की अनुमजत नह हगगी
(13) सिवरी से ठीक हगने के बाि, ्‍िान की नसबंिी के बाि कम से कम चार दिन के जलए के नेल में रखा िाएगा
तादक पगस्ट्ि-ऑपरे टिि िेखभाल हग सके प्रत्सयेक ्‍िान कग दिन में िग बार पयावप्त और स्ट्िस्ट्थ भगिन और हर
समय पीने यग य पानी उपल्‍ध कराया िाना चाजहए
नर और मािा ्‍िान कग अलग-अलग रखा िाना चाजहए
(14) पिु िन्म जनयंत्रण कें द्र में ्‍िान की उजचत आिास और मुक्त आिािाही के जलए पयावप्त िगह हगगी िगह
में उजचत िेंटिलेिन और प्राकृ जतक प्रकाि ्‍यिस्ट्था हगनी चाजहए और इसे साफ रखना चाजहए
(15) ्‍िान कग उसी स्ट्थान या इलाके में िाजपस छगडा िाएगा िहां से उन्हें पकडा गया था और उनकी टरहाई की
तारीख, समय और स्ट्थान पूरी तरह से ठीक हगने के बाि ििव दकया िाएगा टरहाई के समय स्ट्थानीय
प्राजधकरण या पिु कल्याण संगठन का प्रजतजनजध िीम के साथ हगगा समय-समय पर, बगडव ्‍िान कग
पकडने और छगडने के िौरान उनके स्ट्थान की जियग-िंगंग के जलए उपयुक्त प्रदक्रया बता सकता ह
(16) पिु िन्म जनयंत्रण सिवरी कग सुरजित और मानिीय ूपप से करने के जलए, कायावन्ियन एिेंसी समय-समय
पर मॉडयूल में मानक संचालन प्रदक्रयाओं के संबंध में बगडव द्वारा दिए गए जनिदेशि का पालन करे गी
12. रखे िाने िाले टरकॉडव
स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन के पटरयगिना प्रभारी पिु िन्म जनयंत्रण कें द्र में जनम्नजलजखत टरकॉडव
बनाकर रखेंगे
(1) पकडे गए िानिर का टरकॉडव जनम्नजलजखत सजहत

(i) उस िेत्र / इलाके का नाम िहां से ्‍िान कग पकडा गया था,
(ii) पकडने की तारीख और समय,
(iii) पकडने के जलए जिम्मेिार कप्चरिरं ग िस्ट्ते के ्‍यजतियय के नाम,
(iv) पकडे गए ्‍िान के बारे में जििरण – ्‍िान की िग सं‍या, नर, मािाओं की सं‍या रं ग,
पहचान जचन्ह और अनुमाजनत आयु
(2) प्रत्सयेक के नेल के जलए फींडंग टरकॉडव और खाद्य सूची
(3) प्रत्सयेक ्‍िान के जलए उपचार टरकॉडव
(4) ििाईयां और िक्सीन इन्िेंिरी
(5) मृत्सयु िर टरकॉडव
(6) सर्िवकल उपकरण आदि सजहत उपकरण सूची
(7) ्‍िान िन लॉगबुक
(8) कमवचारी उपजस्ट्थजत टरकॉडव
(9) अंग जनरीिण टरकॉडव
(10) जपछले 30 (तीस दिन) दिन के सीसीिीिी फु िेि
13. टरपगिव स्ट्थानीय प्राजधकरण के पटरयगिना प्रभारी या पिु िन्म जनयंत्रण कायवक्रम का संचालन करने िाले पिु
कल्याण संगठन के पिु जचदकत्ससक प्रभारी, जिन्हगने इन जनयम के तहत पटरयगिना मान्यता प्राप्त
की ह
(क) अनुसूची - III और IV में जनधावटरत प्राूपप में जनम्नजलजखत जििरण के साथ बंध्याकृ त और िीकाकरण
दकए गए गली के ििान की सं‍या की माजसक प्रगजत टरपगिव स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत
कग प्रस्ट्तुत करें
i) पकडे गए गली के ्‍िान की कु ल सं‍या
ii) कु ल ्‍िान की नसबंिी की गई
iii) के िल अिलगकन के जलए रखे गए गली के ्‍िान की कु ल सं‍या
iv) सिवरी के पहले, िौरान या बाि में मरने िाले ्‍िान की कु ल सं‍या
v) पटरयगिना से िुडे प्रत्सयेक पिु जचदकत्ससक का नाम और यग यता तथा महीने के िौरान प्रत्सयेक
पिु जचदकत्ससक द्वारा बंध्याकृ त ्‍िान की सं‍या
vi) प्रत्सयेक पिु जचदकत्ससक का नाम और पंिीकरण सं‍या तथा उसके द्वारा जपछले प्रत्सयेक महीने में
आयगजित पिु िन्म जनयंत्रण सिवरी की सं‍या के साथ
vii) अनुसूची – III में जनधावटरत प्रपत्र में प्रत्सयेक पिु जचदकत्ससक द्वारा की गई सिवरी के जखलाफ
पगस्ट्ि-ऑपरे टिि िटिलताओं और मृत्सयु िर की सं‍या
(ख) राज्य पिु िन्म जनयंत्रण जनगरानी सजमजत के माध्यम से बगडव कग एक िार् वक टरपगिव प्रस्ट्तुत करें , िग
31 माचव कग समाप्त हगने िाले जपछले ि व के िौरान पकडे गए, बंध्याकृ त, प्रजतरजित िानिर की कु ल
सं‍या के बारे में हर साल 31 मई के बाि नह ;
(ग) समय-समय पर जनधावटरत प्राूपप में बगडव या राज्य बगडव द्वारा अपेजित ऐसी अन्य िानकारी िमा करें ;
14. जनरीिण करने की िजतिय

(1) बगडव कग एक जिकायत प्राप्त हगने पर या समय-समय पर जनरीिण के जलए दकसी भी पिु िन्म जनयंत्रण कें द्र
का जनरीिण करने के जलए जलजखत ूपप में एक जनरीिण िल कग अजधकृ त करने की िजतिय हगगी
(2) जनरीिण िल के पास िजतिय हगगी –
(क) पटरसर में प्रिेि कर पटरसर के भीतर सभी िेत्र और सभी िानिर और टरकॉडव तक पंुचे , यह
सुजनजित करने के जलए दक इन जनयम की आि्‍यकताओं का पालन दकया िा रहा ह
(ख) तस्ट्िीरे लेन,े िीजडय टरकॉडव करने, और टरकॉडव की प्रजतयां बनाने की
(3) इन जनयम के तहत मान्यता प्राप्त इकाई का एक साल में कम से कम एक बार जनरीिण दकया िाएगा
(4) जनरीिण िल अपनी टरपगिव बगडव और राज्य जनगरानी सजमजत कग प्रस्ट्तुत करे गा
(5) जनरीिण िल द्वारा ऐसा जनरीिण करने के जलए कगई पूिव सूचना नह िी िा सकती ह
15. गली के ्‍िान की सुखमयमृत्सयु
(1) स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत द्वारा जनयुक्त एक िीम द्वारा जनिान के ूपप में असाध्य ूपप से
बीमार और घातक ूपप से घायल ्‍िान कग एक यग य पिु जचदकत्ससक द्वारा सगजडयम पेंिगबार्बविल के अंत
जिरा प्रयगग से या दकसी अन्य अनुमगदित मानिीय तरीके द्वारा मानिीय तरीके से जनर्िवष्ि घंिग के िौरान
सुखमयमृत्सयु िी िाएगी
(2) िीम में िेत्राजधकारी पिु जचदकत्ससा अजधकारी, परजयगिना प्रभारी और बगडव / राज्य बगडव का एक प्रजतजनजध
िाजमल हगगा
(3) दकसी ्‍िान कग िूसरे ्‍िान की उपजस्ट्थजत में सुखमयमृत्सयु नह िी िाएगी सुखमयमृत्सयु के जलए जिम्मेिार
्‍यदकत कग जनपिाने से पहले यह सुजनजित करना हगगा दक िानिर मर चुका ह
(4) सुखमयमृत्सयु का टरकॉडव सुखमयमृत्सयु के कारण सजहत उपरगक्त जनयुक्त िीम के हस्ट्तािर सजहत रखा िाना
चाजहए
16. ्‍िान के कािने या पागल ्‍िान से संबजं धत जिकायत का समाधान
स्ट्थानीय प्राजधकरण एक पिु हेल्पलाइन स्ट्थाजपत कर सकता ह टरपगिव दकए िा सकने िाले संघ व के मामल कग
टरकॉडव करने और हल करने के जलए या तग पटरयगिना प्रभारी या पिु कल्याण संगठन जिम्मेिार हगगा
i) ऐसी जिकायत प्राप्त हगने पर, जिकायतकताव का नाम उसका पूरा पता, जिकायत की जतजथ और
समय, जिकायत की प्रकृ जत आदि िसे जििरण स्ट्थायी टरकॉडव के जलए रखे िाने िाले रजिस्ट्िर में
ििव दकए िाएंगे
ii) दकसी भी ्‍िान के कािने की सूचना तुरंत सरकारी जचदकत्ससा अस्ट्पताल के साथ साझा की
िाएगी तादक कािने के बाि उपचार की जसफाटरि की िा सकें
iii) ऐस िानिर कग मानिीय ूपप से पकडा िाएगा और पिु िन्म जनयंत्रण कें द्र में अिलगकन के
जलए रखा िाएगा पिु जचदकत्ससक की सलाह पर, दकसी भी संचारी रगग के लिण दिखाने िाले
्‍िान कग आइसगलेिन के नेल में रखा िाएगा िहां ्‍िान कग दिन में िग बार भगिन और पानी
उपल्‍ध कराया िाना चाजहए
iv) दकसी भी सदि ध पागल ्‍िान का िग ्‍यजतियय के पनल द्वारा जनरीिण दकया िाएगा जिसमें
स्ट्थानीय प्राजधकरण द्वारा जनयुक्त एक पिु जचदकत्ससा सिवन और एक पिु कल्याण संगठन का
एक प्रजतजनजध ह गे
v) यदि ्‍िान कग रे बीि हगने की उच्च संभािना पाई िाती ह, तग उसे तब तक अलग रखा िाएगा
िब तक दक उसकी प्राकृ जतक मृत्सयु न हग िाए मृत्सयु आमतौर पर रे बीि हगने के 10 दिन के
अन्िर हगती ह इसजलए, संदि ध पागल ्‍िान की समयपूिव हत्सया, रे बीि की िास्ट्तजिक
घिनाओं कग िानने से और उजचत कारव िाई दकये िाने से रगकती ह
vi) यदि ्‍िान कग रे बीि नही बजल्क कगई अन्य बीमारी या उरेष प्रकृ जत का पाया िाता ह तग उसे
पिु कल्याण संगठन कग सौप दिया िाएगा िग 10 दिन के अिलगकन के बाि ्‍िान कग ठीक
करने और छगडने के जलए आि्‍यक कायविाई करे गा
vii) जिन ्‍िान की रे बीि से मृत्सयु हगने का संिह
े ह, उनके िि कग जिले के मु‍य पिु जचदकत्ससा
अजधकारी द्वारा जनधावटरत दकसी भस्ट्मक में या दकसी अन्य जिजध कग अपनाते ुए जनपिाया
िाएगा
viii) यदि पिु िन्म जनयंत्रण कायवक्रम एक पिु कल्याण संगठन द्वारा चलाया िा रहा ह, तग स्ट्थानीय
पिु िन्म जनयंत्रण जनगरानी सजमजत द्वारा जनधावटरत िर पर ऐसे ्‍िान कग जनगरानी में रखने
और इलाि के जलए स्ट्थानीय प्राजधकरण द्वारा इसकी प्रजतपूर्तव की िाएगी
ix) गली के ्‍िान के बारे में लगगग कग िागूपक करने के जलए स्ट्थानीय प्राजधकरण बगडव द्वारा
उपल्‍ध कराई गई आउिरीच सामरेषी कग िहर के प्रमुख स्ट्थल पर प्रिर्िवत करे गा
17. अंग की जगनती और जनपिान
नर और मािा ्‍िान से जनकाले गए प्रिन अंग कग पिु िन्म जनयंत्रण कें द्र में 10% फॉमवलाडेहाइड में संरेषजहत
दकया िाएगा
i) अंग की गणना पाजिक या माजसक या जितनी बार स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत
द्वारा तय की गई हग, एक िीम द्वारा की िाएगी, जिसमें जनम्नजलजखत िाजमल ह गे
(क) मु‍य पिु जचदकत्ससा अजधकारी या उनके द्वारा अजधकृ त कगई पिु जचदकत्ससा अजधकारी
(ख) पटरयगिना प्रभारी पिु जचदकत्ससा अजधकारी
(ग) राज्य बगडव / एसपीसीए के प्रजतजनजध
बितदेश दक पिु कल्याण संगठन िग पिु िन्म जनयंत्रण कायवक्रम आयगजित कर रहा ह अंग जनरीिण
िीम का जहस्ट्सा नही हगगा
ii) नर और मािा िननांग अंग की सं‍या और सिवरी की तारीख के साथ जचजन्हत अलग-अलग
प्लाजस्ट्िक के बक्से में संरजित दकया िाएगा
iii) अंग जनरीिण िल सभी अंग की गणना करे गा और जिचाराधीन अिजध के जलए कायावन्ियन एिेंसी
की प्रगजत टरपगिव का सत्सयापन करे गा
iv) जगने ुए अंग कग अंग जनरीिण िल की उपजस्ट्थजत में ििू डाई के जछडकाि और गहरे में िफन या

v) राज्य एबीसी जनगरानी सजमजत जनयम का पालन सुजनजित करने और गर-अनुपालन के मामले में
आि्‍यक कारव िाई करने के जलए प्रत्सयेक एबीसी कें द्र में हर साल कम से कम एक बार औचक
जनरीिण करे गी
18. गर-अनुपालन का प्रभाि (1) जनयम 14 में संिर्भवत टरपगिव (टरपगिों) पर जिचार करने के बाि यदि बगडव की
राय ह दक इन जनयम के तहत दकसी भी प्रािधान का उल्लंघन दकया गया ह या पिु क्रूरता की रगकथाम
अजधजनयम, 1960 या उसके अधीन बनाए गए जनयम या क्रूरता की जस्ट्थजत में, बगडव पिु कल्याण संगठन या
पिु िन्म जनयंत्रण कें द्र चलाने िाले स्ट्थानीय प्राजधकरण कग 15 दिन के अन्िर ििाब के जलए कारण बता
नगटिस िारी करे गा
(2) पिु कल्याण संगठन या स्ट्थानीय प्राजधकरण से लंजबत उत्सतर की जस्ट्थजत में, बगडव जलजखत में कारण
बताकर इसकी मान्यता कग जनलंजबत कर सकता ह
(3) बगडव, जनरीिण टरपगिव और कारण बता नगटिस के ििाब के आधार पर, इस अजधजनयम के अनुसार
कारव िाई कर सकता ह या जिला मजिस्ट्रेि या जिला एसपीसीए कग कानून के अनुसार उल्लंघन करने िाल
के जखलाफ उजचत कारव िाई करने का जनिदेशि िे सकता ह
(4) यदि यह मानने का कारण ह दक इन जनयम का उल्लंघन हग रहा ह, बगडव के पास दकसी भी पिु कल्याण
संगठन के पंिीकरण कग रद्द करने की िजतिय हगगी तादक ऐसे संगठन कग दकसी भी िानिर के जलए पिु िन्म
जनयंत्रण कायवक्रम आयगजित करने से रगका िा सके
(5) बगडव ऐसे संगठन कग दकसी भी िानिर के जलए पिु िन्म जनयंत्रण कायवक्रम आयगजित करने से रगकने के
जलए दकसी भी पिु कल्याण संगठन कग ्‍लकजलस्ट्ि करे गा बितदेश दक ऐसी ्‍लकजलस्ट्ि के िल तभी की िाएगी
िब बगडव द्वारा अजधकृ त या संचाजलत जनरीिण पर यह स्ट्थाजपत हग िाए दक पिु कल्याण संगठन एक बार-
बार उपराधी ह या उल्लंघन की प्रकृ जत दकसी भी ूपप में िघन्य क्रूरता या ्रषष्िाचार से संबंजधत ह
(6) इन जनयम के तहत दकसी भी उल्लंघन कग अजधजनयम के तहत उपराध माना िाएगा और पिु कल्याण
संगठन या स्ट्थानीय प्राजधकरण के पटरयगिना प्रभारी के पिाजधकाटरय पर कानून के अनुसार आरगप लगाया
िा सकता ह
19. घरे लू / फारल जबजल्लय की नसबंिी और िीकाकरण – राज्य बगडव की सलाह पर, जबजल्लय की नसबंिी एक
मान्यता प्राप्त पिु कल्याण संगठन द्वारा प्रजििण और जििे ज्ञता के साथ बगडव द्वारा प्रकाजित कि
स्ट्िरलाइिेिन और िीकाकरण के जलए दििाजनिदेशि में जनधावटरत तरीके से जबजल्लय का स्ट्पे / न्यूिर
आयगजित की िा सकती ह
(1) जबल्ली के िन्म जनयंत्रण कायवक्रम के जलए बुजनयािी ढांचे और खचचो की प्रजतपूर्तव स्ट्थानीय प्राजधकरण
द्वारा प्रिान की िाएगी
(2) िबदक ्‍िान के जलए प्रिान दकए गए पिु िन्म जनयंत्रण कें द्र में जबल्ली नसबंिी कायवक्रम आयगजित
दकए िा सकते हैं, जबजल्लय कग ्‍िान के साथ नही रखा िाना चाजहए या दकसी भी तरह से संपकव में नह
आना चाजहए
(3) जबजल्लय की पगस्ट्ि–ऑपरे टिि िेखभाल ऐसी िगह की िानी चाजहए िहााँ िे ्‍िान की आिाि / गंध से
अनाि्‍यक तनाि से पीजडत न ह
20. सामुिाजयक पिुओं कग जखलाना – (1) यह रे जिडेंि िेलफे यर एसगजसएिन (आरड्‍ल्यूए) या अपािवमेंि नर
एसगजसएिन (ए ए) या उस िेत्र के स्ट्थानीय जनकाय के प्रजतजनजध की जिम्मेिारी हगगी दक पटरसर या उस
िेत्र में रहने िाले सामुिाजयक पिुओं कग जखलाने के जलए आि्‍यक ्‍यिस्ट्था करने के जलए उस िेत्र या
पटरसर में रहने िाले ्‍यजतिय, िसा भी मामला हग, िग उन पिुओं कग जखलाता ह या उन पिुओं कग जखलाने
का इरािा रखता ह और एक ियालु भाि के ूपप में सडक पर रहने िाले पिुओं की िेखभाल करता ह
आरड्‍ल्यूए या ए ए या स्ट्थानीय जनकाय के प्रजतजनजध यह सुजनजित करें गे
i) ्‍िान की आबािी और उनके संबंजधत िेत्र की सं‍या कग ध्यान में रखते ुए, पारस्ट्पटरक ूपप से
सहमत, फीड स्ट्पॉि नाजमत करना भगिन स्ट्थल बच्च के खेलने के िेत्र , प्रिेि और जनकास ंबंिओं
ु ,
सीदढय से िूर ह गे या ऐसे िेत्र में ह गे िहां बच्च और िटरष्ठ नागटरक द्वारा कम से कम बार-बार
आने की संभािना हग
ii) बच्च , िटरष्ठ नागटरक , खेल की आिािाही के आधार पर भगिन का समय जनधावटरत करना, जिसमें
बच्च और िटरष्ठ नागटरक द्वारा कम से कम बार-बार आने की संभािना हग
iii) नाजमत फीडर यह सुजनजित करे गा दक फीजडग स्ट्थान पर कगई बच्चे न हग या उस िेत्र आरड्‍ल्यूए या
ए ए द्वारा बनाए गए दििाजनिदेशि का उल्लंघन न हग
iv) नाजमत फीडर कग पिु िन्म जनयंत्रण कायवक्रम में सहायता के जलए िीकाकरण, ्‍िान कग पकडने और
छगडने के जलए स्ट्िेच्छा से अनुमजत िी िाती ह
(2) िहां आरड्‍ल्यूए या ए ए और पिु िेखभाल करने िाल या अन्य जनिाजसय के बीच कगई संघ व ह, एक
पिु कल्याण सजमजत का गठन दकया िाएगा जिसमें जनम्नजलजखत िाजमल ह गे
(क) मु‍य पिु जचदकत्ससा अजधकारी या उनके प्रजतजनजध
(ख) िेत्राजधकार पुजलस के प्रजतजतजध
(ग) जिला पिु क्रूरता जनिारण सजमजत के प्रजतजनजध पिु या राज्य बगडव
(घ) पिु िन्म जनयंत्रण का संचालन करने िाले दकसी भी मान्यता प्राप्त पिु कल्याण संगठन का प्रजतजनजध
(ङ) स्ट्थानीय प्राजधकारी द्वारा प्रजतजनयुक्त पिु जचदकत्ससा अजधकारी

(च) जिकायतकताव
(छ) उस िेत्र के आरड्‍ल्यूए या ए ए या स्ट्थानीय जनकाय के प्रजतजनजध
जनयम 20 के उपजनयम (2) के तहत गटठत सजमजत का जनणवय फींडंग प्िाइं ि के जनधावरण के संबंध में अंजतम जनणवय
हगगा सजमजत उस िेत्र में उन िानिर कग जखलाने के जलए बगडव द्वारा नाजमत कॉलगनी के यर िेकर में से ्‍यजतिय
(्‍यजतियय ) कग भी नाजमत कर सकती ह
(3) कगई भी स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन या कगई फीडर आरड्‍ल्यूए या ए ए या स्ट्थानीय
जनकाय जनयम 20 के उप-जनयम (2) के तहत बनाई गई सजमजत के जनणवय से ्‍यजथत हगने पर, अपील राज्य
बगडव कग िायर की िाएगी राज्य बगडव का जनणवय उस िेत्र में पिुओं कग जखलाने का अंजतम जनणवय हगगा
21. अपील – (1) पटरयगिना मान्यता सजमजत के जनणवय से ्‍यजथत पिु कल्याण संगठन, जनणवय प्राप्त हगने के तीस
दिन के भीतर, बगडव कग अपील कर सकता हैं;
(2) जिकायत प्राप्त हगने पर बगडव के अध्यि एक सजमजत का गठन करें गे िहां बगडव के सिस्ट्य और संबंजधत
अजधकारी जिकायत की िांच करें गे सजमजत नगटिस िेने के बाि और पार्िवय कग सुनिाई का अिसर िेने के
बाि या तग अपील कग खाटरि कर सकती ह या अनुमजत िे सकती ह जिसके कारण जलजखत में ििव दकये िायेंगे
(3) कगई भी स्ट्थानीय प्राजधकरण या पिु कल्याण संगठन या बगडव के जनणवय से ्‍यजथत ्‍यजतिय, िे बगडव से संचार
प्राप्त हगने के 30 दिन के भीतर पिुपालन जिभाग के सजचि कग िूसरी अपील िायर करें गे पिुपालन जिभाग
के सजचि के जनणवय कग जिकायत के संबंध में अंजतम जनणवय माना गया
22. िहां स्ट्थानीय उप-जनयम आदि मौिूि हैं, िहां जनयम का लागू हगना (1) यदि स्ट्थानीय जनयम, उप-कानून,
कगई अजधजनयम ह, तग राज्य या स्ट्थानीय प्राजधकरण द्वारा दकसी के संबंध में कु छ समय के जलए जिजनयम लागू
हैं जिन मामल के जलए इन जनयम में प्रािधान दकया गया ह, ऐसे जनयम, जिजनयम या उप-जनयम दकस सीमा
तक ह गे
(क) इसमें इन जनयम में जनजहत प्रािधान की तुलना में िानिर के जलए कम परे िान करने िाले प्रािधान हैं,

iv) पिु िन्म जनयंत्रण कायवक्रम के जलए आि्‍यक नीजगगत हस्ट्तिेप से संबंजधत मामले
v) पिु िन्म जनयंत्रण कायवक्रम से संबंजधत कगई अन्य मामले
vi) पिु कल्याण संगठन की मान्यता रद्द करने के संबंध में जिकायत की सुनिाई कर सकता ह और बगडव कग
आि्‍यक जनिदेशि या आिेि पाटरत कर सकता ह िसा भी मामला हग
vii) गली के ्‍िान के जनयंत्रण और प्रबंधन, िीक के जिकास और नसबंिी, िीकाकरण आदि की लागत
प्रभािी जिजधय से संबंजधत अनुसंधान के िेत्र में राष्रीय और अंतरावष्रीय जिकास पर निर रखना
सजमजत की बठक कें द्रीय जनगरानी और समन्िय सजमजत की छह महीने में एक बार या िब भी आि्‍यक हग बठक
हगगी
2. राज्य कायावन्ियन और जनगरानी सजमजत
पिु िन्म जनयंत्रण कायवक्रम कग अंिाम िेने के इरािे से प्रत्सयेक राज्य, राज्य कायावन्ियन और जनगरानी सजमजत का
गठन करे गा सजमजत का गठन इस प्रकार ह
क) िहरी जिकास जिभाग के प्रभारी सजचि या राज्य या संघ िाजसत प्रिेि में समकि राज्य जनगरानी और
कायावन्ियन सजमजत के अध्यि ह गे
ख) जनिेिक, स्ट्िास्ट्थ्य और पटरिार कल्याण जिभाग
ग) जनिेिक, पंचायती राि जिभाग
घ) जनेिेिक, िहरी जिकास जिभाग (या समकि)
ङ) भारतीय िीि िन्तु कल्याण बगडव के िग प्रजतजनजध
च) राज्य पिु कल्याण बगडव के िग प्रजतजनजध
छ) उस राज्य या संघ िाजसत प्रिेि में कम से कम 2 नगर जनगम के प्रिासजनक प्रमुख, और कम से कम 2
पंचायत और कम से कम 2 नगर पटर ि के प्रजतजनजध
ि) राज्य पिु कल्याण बगडव के प्रभारी अजधकारी सिस्ट्य सजचि के साथ-साथ प्रत्सयेक राज्य और संघ िाजसत
प्रिेि में कायवक्रम कग लागू करने के जलए नगडल अजधकारी ह गे
नगि बगडव या राज्य बगडव का कगई भी प्रजतजनजध सीधे उस अजधकार िेत्र में कायावन्ियन एिेंसी के ूपप में पिु
िन्म जनयंत्रण कायवक्रम में िाजमल नह हगना चाजहए
राज्य जनगरानी और कायावन्ियन सजमजत के कायव
राज्य जनगरानी और कायावन्ियन सजमजतयां जनम्नजलजखत कायों कग करने के जलए जिम्मेिार ह गी
i) पिु िन्म जनयंत्रण जनयम के अनुसार स्ट्थानीय प्राजधकरण स्ट्तर पर पिु िन्म जनयंत्रण जनगरानी
सजमजतय की स्ट्थापना
ii) राज्य भर में िहरी और रेषामीण िेत्र में ्‍िान की आबािी प्रबंधन के जलए एक ्‍यापक जिलािार
यगिना जिकजसत करना (जिसमें बुजनयािी ढांचे, बिि आदि िाजमल हैं, लेदकन इन्ह तक सीजमत नह ह)
iii) जिला और राज्य यगिना के अनुसार पिु िन्म जनयंत्रण कायवक्रम कग चलाने के जलए भारतीय िीि िन्तु
कल्याण बगडव द्वारा मान्यता प्राप्त अपेजित प्रजििण और अनुभि रखने िाली पिु िन्म जनयंत्रण
कायावन्ियन एिेंजसय कग सूचीबद्ध करना इसमें राज्य का पिुपालन जिभाग िाजमल हग सकता ह िग
भारतीय िीि िन्तु कल्याण बगडव के परामिव से और तकनीकी मागवििवन में काम कर रहा ह
iv) यह सुजनजित करना दक आि्‍यक बुजनयािी ढांचा स्ट्थाजपत दकया गया ह, और अन्य पूंिीगत लागत
(जिसमें पूरी तरह से सुसज त पिु िन्म जनयंत्रण सुजिधाएं / एम्बुलेंस और उपकरण के साथ पटरसर
िाजमल हैं, लेदकन इतनी ही सीजमत नह हैं), और िनिजतिय लागत सजहत पिु िन्म जनयंत्रण कायवक्रम कग
सफलतापूिवक चलाने के जलए अन्य सभी खचव पिु िन्म जनयंत्रण कायावन्ियन एिेंजसय कग स्ट्थानीय
अजधकाटरय से उपल्‍ध कराया िाता ह, और पिु िन्म जनयंत्रण जनयम के जनयम 6 के अनुसार समय
पर ढंग से प्रजतपूर्तव की िाती ह
v) स्ट्थानीय अजधकाटरय द्वारा राज्य में पिु िन्म जनयंत्रण कायवक्रम की समरेष जनगरानी के जलए जिम्मेिार
vi) राज्य जनगरानी सजमजत भी िन्म जनयंत्रण कायवक्रम के िौरान पिु िन्म जनयंत्रण और पिुओं के प्रजत
क्रूरता और पिु िन्म जनयंत्रण जनयम के उल्लंघन के संबंध में दकसी भी जिकायत की प्राजि / उल्लंघन के
संबंध में दकसी भी जिकायत की प्राजि पर जनटरिण करे गी और उजचत कारव िाई करे गी
सजमजत की बठक सजमजत की बठक प्रत्सयेक 3 माह में एक बार या िब भी आिियक हग बठक करे गी
3. स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत का गठन
स्ट्थानीय पिु िन्म जनयंत्रण जनगरानी सजमजत के गठन के जबना कगई भी पिु िन्म जनयंत्रण कायवक्रम नह चलाया
िाएगा पिु िन्म जनयंत्रण कायवक्रम की सफलता के जलए पिु िन्म जनयंत्रण जनयम के अनुसार स्ट्थानीय स्ट्तर पर
पिु िन्म जनयंत्रण जनगरानी सजमजत की स्ट्थापना अजनिायव ह सजमजत का गठन जनम्नजलजखत सिस्ट्य के साथ दका
िाएगा
क) नगर आयुक्त या स्ट्थानीय प्राजधकरण के कायवकारी अजधकारी, िग सजमजत के पिेन अध्यि ह गे
ख) जिले के िन स्ट्िास्ट्थ्य जिभाग का एक प्रजतजनजध
ग) पास के बलॉक या जिले के पिुपालन जिभाग का प्रजतजनजध
घ) एक िेत्राजधकार िाले पिु जचदकत्ससक
ङ) जिला पिु क्रूरता जनिारण सजमजत (एसपीसीए) का एक प्रजतजनजध
सजमजत के कायव
सजमजत इन जनयम के अनुसार ्‍िान जनयंत्रण कायवक्रम की यगिना और प्रबंधन के जलए जिम्मेिार हगगी सजमजत
जनम्न भी कर सकती ह
(क) बंध्यीकरण, िीकाकरण या इलाि दकए गए ्‍िान कग पकडने, पटरिहन, आश्रम, नसबंिी, िीकाकरण,
उपचार और छगडने के जलए जनिदेशि िारी करना
(ख) पिु जचदकत्ससक कग मामले के आधार पर जनणवय लेने के जलए अजधकृ त कर सकती ह दक सगजडयम पेिाथगल
का उपयगग करके गंभीर ूपप से बीमार या घातक ूपप से घायल या पागल ्‍िान कग ििव रजहत तरीके
से सुखमयमृत्सयु की आि्‍यकता ह कगई अन्य तरीका सखत ूपप से िर्िवत ह िग पिु जचदकत्ससा
अजधकाटरय और एक मान्यता प्राप्त पिु कल्याण संस्ट्था के एक प्रजतजनजध की एक उप-सजमजत के

माध्यम से जनणवय जलया िाना ह उप-सजमजत प्रत्सयेक िानिर की सुखमयमृत्सयु के जलए जलजखत में
कारण बताएगी
(ग) िन िागूपकता पिा करना और सहयगग और जित्सत पग ण मांगना
(घ) पालतू ्‍िान के माजलक और िाजणजज्यक प्रिनक कग समय-समय पर दििाजनिदेशि प्रिान करना
(ङ) ्‍िान के कािने के मामल की जनगरानी के उद्दे्‍य से और ्‍िान के कािने के कारण का पता लगाने के
जलए, इस तरह के किम उठाएं उस िेत्र में िहां यह ुआ था और क्या यह एक आिारा या पालतू
्‍िान से था इस प्रयगिन के जलए अपेजित प्राूपप में मानि अस्ट्पताल से जििरण एकत्र दकया िा
सकता ह
(च) भारतीय िीि िन्तु कल्याण बगडव द्वारा सुझाए गये तरीके से संगणना आयगजित करके अपनी िेत्रीय
सीमाओं के अन्िर ्‍िान की स‍या का अनुमान लगाएं
(छ) ्‍िान की अनुमाजनत सं‍या के जलए पिु िन्म जनयंत्रण कायवक्रम कग जनष्पादित करने के जलए आि्‍यक
बुजनयािी ढांच का जिकास सुजनजित करें ऐसा करने के जलए, जिस्ट्तृत पटरयगिना टरपगिव तयार कर
राज्य सरकार के समन्िय से राज्य जनगरानी और कायावन्ियन सजमजत कग प्रस्ट्तुत करना हगगा
(ि) एक नया िेत्र लेने से पहले लजित िेत्र में कम से कम 70% ििान के चरणबद्ध तरीके से िेत्रिार पिु
िन्म जनयंत्रण करने के जलए बुजनयािी ढांचे कग इस तरह से जडिाइन दकया िाएगा बुजनयािी ढांचे में
ऑपरे िन से पहले की तयारी के िेत्र, ऑपरे िन जथएिर, पगस्ट्ि-ऑप के यर, दकचन, रािन और ििाओं
के जलए स्ट्िगर ूपप, पार्कव ग िेत्र, पिु जचदकत्ससक और पटरचारक के जलए आिासीय कमरे , क्िारं िाइन
िाडव, एम्बुलेंस आदि िाजमल हैं यद्यजप यह इसी तक सीजमत नह ह

Animal Birth Control Rules, 2022
G.S.R. 656(E).— In exercise of the powers conferred by clause (i) of sub-sections (2) of section
38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), in supersession with the S.O. 1256 (E)
published on 24th December, 2001 and amended vide S.O. 303(E) dated 8th February, 2011,except
asrespect things done or omitted to be done before such supersession,the Central Government is
proposing to publish draft rules for public comments within sixty days of the publication of the draft rules
in the Gazette of India.
Any person desiring to make any suggestion or objection in respect of the said draft rules may forward the
same for consideration of the Central Government, within the period specified above, to the Joint
Commissioner (Animal Welfare), Cabin No. 6, Chander Lok Building, Janpat, New Delhi -110001.
1. Short title and commencement :(1) These rules may be called the Animal Birth Control Rules,
2022.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. Definition: In these rules, unless the context otherwise requires, -
(a) "Act" means the Prevention of Cruelty to Animals Act, 1960.
(b) “Animal Birth Control Center” means a veterinary facility with surgical infrastructure, post-
operative care kennels, quarantine kennels, isolation kennels, dog transport vehicles with
necessary logistics and other such facilities as prescribed by the Board, built for the purpose of
carrying out the Animal Birth Control Program for street dogs.
(c) “Animal Shelter” means place where stray or street or abandoned animals are kept for
adoption or rehabilitation, general treatment while they are ill or injured.
(d) “Animal Welfare Committee” means committee constituted under these rules for resolution of
the community dog feeding;
(e) "Animal Welfare Organisation" means any organization working for welfare of animals which
is registered under the Societies Registration Act of 1860 (21 of 1860) or any corresponding law
for the time being in force and which is recognized by the Animal Welfare Board of India as per
the extant policy of the Board.
(f) "Board" means the Animal Welfare Board of India, established under section 4 and as
reconstituted under Section 5A of the Act;
(g) “Certificate” means the Certificate of Project Recognition issued by the Board to any
Animal Welfare Organization or Local Authority for the purpose of the Animal Birth Control
Programme under these Rules.
(h)“Committee" means a monitoring committee established under these rules
(i) “Community Animals” means any animal born in a community for which no ownership has
been claimed by any individual or an organization, excluding wild animals as defined under the
wildlife Protection Act, 1972 (53 of 1972)
(j) “Inspection Team” means team authorised by the Board or State Board under Rules.
(k) “Local Authority" means a Municipal Committee, Municipal Council, District
Administration, District Panchayats/Board, Cantonment Board or other authority for the time
being invested by the law with the control and administration of any matters within a specified
local area;
(l) "Owner" means the owner of an animal and includes any other person in possession or
custody of such animal whether with or without the consent of the owner;
(m) “State Board” means the State Animal Welfare Board constituted, in a State, by the State
Government.
(n) “Society for Prevention of Cruelty to Animals (SPCA)” means a SPCA established under
the Rules framed under this Act;
(o) “Veterinary practitioner” means a veterinary practitioner registered under the provisions of
the Indian Veterinary Council Act, 1984 (52 of 1984).
(p) "Jurisdictional Veterinary Officer" Veterinary Officer of the Animal Husbandry Department
deployed at the Government Veterinary Hospital of the Animal Husbandry Department of the
area.
(q) "Project In-charge" means Veterinary Officer deployed by the Local Authority for conducting
the Animal Birth Control program for street dogs. Project in-charge of the Local Authority shall
be a Veterinary Officer on the Regular Payroll of the Local Authority or State Government.
(r) “Project Recognition Committee” means committee constitute by the board for the scrunity and
examination on the applications of the Project Recognition of the Animal Birth Control
programme
(s) "Animal Birth Control program" means Birth Control program carried out for animal under
these Rules by a local authority or an animal welfare organisation.
(t) "Module" means document in writing for Dog Population Management and Rabies Eradication
published and updated by the Board from time to time, which shall serve as the Standard
Operating Procedure for Animal Birth Control program for street dogs.
3. Project Recognition:
The local authority may conduct the Animal Birth Control program through their own veterinary
officers, or if required, local authority may engage the services of an Animal Welfare Organisation
which is duly recognised by the Board for Animal Birth Control and which has the requisite training,
expertise and human resources, for conducting the Animal Birth Control program. Under both
conditions, obtaining a Certificate Project Recognition from the Board shall be mandatory.
(1) No local authority or organisation shall undertake, conduct or organise animal birth control
program for street dogs without a Certificate of Project Recognition from the Board.
(2) Any Animal Welfare Organization which is not disqualified from contracting under any law for the
time being in force, may apply for Project Recognition by submitting their application in the
Form-I appended to the First Schedule with a non-refundable fee of Rs 5,000/- (Five thousand
rupees only) to the Board.
(3) Any Animal Welfare Organisation applying for Project Recognition under these Rules must be
already recognised as an Animal Welfare Organisation by the Board.
(4) If a Local Authority is conducting the animal birth control program through its own veterinary
officers, the Project In-charge of the Local Authority shall obtain Project Recognition from the
Board. The application fee will be exempt if the Animal Birth Control program will be executed
by Veterinary Officers of the Local Authority. All other conditions and the Module published by
the Board will be applicable.
(5) An applicant applying for Project Recognition for conducting the Animal Birth Control Programme
shall be required to make separate applications for each separate Animal Birth Control Center.
(6) Applicant seeking aProject Recognition shall submit the attested copy of the Registration
Certificate issued by Veterinary Council of India/ State Veterinary Council, for each Veterinary
Doctor, who will be deployed on particular project. Applicant shall submit a copy of experience
certificate issued by Government Authority. The Vet/Vets proposed to be deployed by the
Applicant must have total combined experience of having conducted at least 5,000 Animal Birth
Control Surgeries in case of deployment in the area of a Municipal Corporation and total
combined experience of having conducted at least 2,000 Animal Birth Control Surgeries in case
of deployment in the area of a Nagar Palika, Nagar Panchayat, Village Panchayats or other Rural
Local Bodies.
(7) the Board shall constitute a Project Recognition committee for recognition of the projects;
(8) the Board shall upon receipt of the application for project recognition direct the Animal Husbandry
Department of the concerned State to inspect the proposed Animal Birth Control Center and
confirm the availability of requisite facilities in accordance with the Module published by the
Board. The inspection must be conducted by a team comprising of:
i) Chief Veterinary Officer of the District
ii) Nodal Officer of the State Animal Birth Control Monitoring Committee
iii) Representative of the Board or the State Board.
(9) The inspection team must submit a report signed by all the members of the inspection team as per
the inspection Performa prescribed by the Board within a period of ten days from date of inspection.
(10) The Project Recognition Committee, after consideration of the inspection report under sub-rule (8)
and on being satisfied that the Animal Birth Control Center is complying with the requirements as
specified under these Rules, may recommend issuing the Certificate of Project Recognition for Animal
Birth Control programme.
(11) Based on the recommendation of the Project Recognition Committee, the Board may issue
recognitioncertificate for the specific project under these rules which shall be non-transferable.
(12) Project In-charge of the Local Authority or Veterinarian of the Organisation shall ensure that the
Certificate of Project Recognition is prominently displayed at the Animal Birth Control Center and
such certificate shall also be produced on the request of the inspection authority.
4. Refusal of recognition: The Board shall not recognise any Project operated by the Local Authority
or Animal Welfare Organisation under these rules, if—
(1) The information submitted by the Local Authority or Animal Welfare Organisation is found to be
false or if the applicant has made deliberate misstatements in the application or provided falsified or
fabricated records to the Board;
(2) The Animal Welfare Organisation at any stage prior to submission of the application for
recognition under these rules, has been convicted of any offence under this Act and/or Rules made
thereunder, or any other State or Central Act promulgated for the protection of animals or for any
offence relating to animals under any other law for the time being in force;
(3) The Animal Welfare Organisation has refused to allow the inspection team to perform inspection in
the entire premises or part of the premises, or denied access to the documents or any records as
mandatory under these rules.
(4) If the Project Recognition committee considers that the infrastructure and available manpower at
the Animal Birth Control Center is not commensurate with the prescribed requirements, the Board may
reject the application giving reasons in writing within a period of 30 days from the receipt of the Report
from the Inspection team as in Rule 3(7) above.
5.Prohibition without recognition: No Animal Birth Control Program for street dogs shall be conducted
unless the Local Authority or the Animal Welfare Organisation has obtained a certificate of Project
Recognition for conducting such a program under these Rules.
Provided that any local authority or animal welfare organization referred to in the first proviso fails to
apply for the certificate of Project Recognition within a period of six months or has been refused the Project
Recognition for any reason specified under these rules, then the concerned local authority shall discontinue
such animal birth control programme. In case any dog catching or surgeries have been conducted then the
same shall be stopped immediately and all the dogs shall be treated by the Project In-charge or an animal
welfare organisation, until they are fit to be released.
6. Renewal of recognition:
(1) A certificate of Project Recognition for Animal Birth Control Center issued by the Board shall be valid
for a period of three years from the date of recognition and may be renewed upon receipt of an application
being made to the Board under these Rules.
An application for renewal of recognition shall be made, at least sixty days prior to the expiry of the Project
Recognition for Animal Birth Control program, to the Board in the Form-IV appended to the First Schedule
with a non-refundable Renewal Fee of five thousand rupees to the Board. The provisions of rule 3
shall mutatis mutandi apply.
(2) The Board, after consideration of the inspection report submitted by inspection authority under sub-rule
(3) of Rule 3 and on being satisfied that the Animal Birth Control Center is complying with the
requirements as specified under these rules, may renew the Certificate of Project Recognition of the Animal
Birth Control Center by issuing renewal in the format as given in Form-V appended to the First Schedule.
(3) A renewal for the Certificate of Project Recognition issued by the Board shall be valid for a period of
three years, renewable upon receipt of an application and Renewal Fee by the Board under these Rules.
7. Classification of animals: Animals classified for the purpose of these rules are as under
(a) Pet animals – dogs owned and kept indoor by individuals.
(b)Street dogs or community owned Indian dogs or abandoned pedigreed dogs which are homeless,
living on the street or within a gated campus.
8. Responsibility for Vaccination and Sterilization: (1) In case of pet animals the owner of the animal
shall be responsible for the deworming, immunization and sterilization.
(2) In case of street animals, the local authority shall be responsible for deworming, immunization and
sterilization and may engage an Animal Welfare Organisation duly recognised by the Board to carry out the
animal birth control program in accordance with these Rules.
9. Formation of Monitoring Committees and its Functions: The Monitoring Committees shall be
constituted for effective implementation of Animal Birth Control Programs in accordance with these Rules
to control the population of street animals, for eradication of rabies and for reducing man-animal conflict.
The Monitoring Committees shall be constituted as follows:
(1) A Central Animal Birth Control Monitoring &Coordination Committee for Dog Population
Management and Rabies Eradication shall be constituted to ensure coordination between
different stakeholders at the Central Government and between the Central Government and the
State Governments. The constitution of the Committee and its functions shall be prescribed in
Schedule-II.
(2) A State Animal Birth Control Implementation & Monitoring Committee shall be constituted at
the State /Union Territory level in all States and Union Territories. This Committee shall coordinate
the implementation of the Animal Birth Control Program across the State in a scientific and phase-
wise manner. The constitution of the Committee and its functions shall be prescribed in Schedule-II.
(3) A Local Animal Birth Control Monitoring Committee shall be constituted at the Local Authority
level in all States and Union Territories. The constitution of the Committee and its functions shall be
prescribed in Schedule-II.
10. Obligations of the Local Authority:
(1) The local authority shall ensure following facilities are available in each Animal Birth Control
Center within their jurisdiction:
(a) sufficient number of kennels and veterinary hospital facilities which may be managed by local
authority or animal welfare organization;
(b) requisite number of vans with necessary modifications for safe handling and transportation of
dogs;
(c) A mobile Operation Theatre Van equipped with surgical infrastructure to be provided as
mobile center for sterilisation and immunization for smaller local bodies, where considered
necessary and where kennels for post-operative care are available;
(d) incinerators to be installed by the local authority for disposal of organs and carcasses. Where
an incinerator is not feasible, deep burial method may be adopted.
(e) periodic repair and maintenance of Animal Birth Control Center.
(f) Close Circuit Television (CCTV) to be installed in the entire premises specifically in the
Operation theatre and where the animals are housed at Animal Birth ControlCentre, and shall
maintain the record of video surveillance for a minimum of three months or as specified from time
to time by the Board or State Board. The video recordings may be made available for the
inspecting authority, monitoring committee or the Board upon enquiry or request.
(g) cleanliness and hygiene to be maintained at all times at the Animal Birth Control Center.
(h) records for catching, release, medicine, surgery, feeding, vaccinations of all animalsbrought to
the Animal Birth Control Centerto be maintained.
(2) The local authority shall reimburse the expenses of sterilization/ immunization on a regular basis,
if the services of an animal welfare organisation have been engaged.
(3) The Local Animal Birth Control Monitoring Committee shall be constituted by the Local
Authority and it shall meet at least once every month to assess the progress made with regard to
implementation of the Animal Birth Control Program.
(4) The local authority shall inquire into the matter of violation of these rules on receipt of the
complaint against the Animal Birth Control Center and shall terminate or suspend any engagement
with such an organisation on the basis of the recommendation of the Local Animal Birth Control
Monitoring Committee or the Board.
11. Capturing/sterilization/immunization/release:
(1) Capturing of street dogs shall be conducted for the following reasons only:
(a) General purpose: for which the local authority in consultation with the Monitoring
Committees shall decide to control the excess population of street dogs through animal birth
control program in a specific area or region.
(b) Specific complaints: for which the local authority in consultation with the Monitoring
Committee shall set up an Animal Complaint Cell at the Animal Birth Control Centerto receive
information or complaints about dog bites from street dogs suspected to be suffering from Rabies.
(2) The dog capturing team shall consist of:
(i) The driver of the van
(ii) Two or more trained employees of the local authority or Animal Welfare Organisation who are
trained in humanely capturing street dogs.
(iii) One representative of any of the Animal Welfare Organization nominated for the purpose.
Each member of the capturing squad shall carry a valid identity card issued by the local authority.
(3) Before the street dogs are captured in any locality, the representative of the local authority or of the
Animal Welfare Organization shall put up banners/public notices making announcement informing
residents that animals will be captured from the area for the purpose of sterilization and immunization and
will be released in the same area after sterilization and immunization. The announcement may also briefly
educate the residents of the area about the animal birth control programme and solicit the support of all the
residents reassuring them that the local authority is taking adequate steps for their safety and the safety of
the animals. Such outreach efforts shall be instituted at each Animal Birth Control Center as well.
(4) The capturing of the animals shall be done by using humane methods such as net catching or hand
catching or any other manner that is less irksome to the animal. Use of tongs or wires for catching dogs
shall be strictly prohibited.
(5) Only a stipulated number of animals, according to the housing capacity of the Animal Birth Control
Center, shall be captured. Dogs from only one area shall be brought for sterilization, immunization at a
given time in Animal Birth ControlCenter. Effort must be made to avoid bringing into contact dogs from
different areas.
(6) All the dogs caught shall be identified with a numbered collar immediately upon arrival at the Animal
Birth ControlCenter. The number shall correspond to capture records to ensure that each dog is released, in
the same area from where it was captured, after sterilization and immunisation.
(7) Street dogsunder the age of six month shallnot be captured forand undergo sterilization.Female animals
with puppies shall not be captured for sterilization till their litter is 2 months of age.
(8) The captured animals shall be brought to the Animal Birth ControlCenter having Certificate of Project
Recognition from the Board and managed by the Local Authority or Animal Welfare Organisation where
they shall be examined by veterinary practitioners. Healthy animals should be separated from sick or
injured animals. The sick or injured animal shall be given adequate treatment. The treated animals should
be sterilized only after their recovery.
(9) The kennels where the dogs are kept should be marked by visibly writing the name of the locality on
each kennel door. The kennels for individual dogs should be at least 3 feet wide, 4 feet deep and at least 6
feet high. Kennels for 3 to 5 dogs can also be provided for, where each dogs gets at least 3 feet by 4 feet
floor space. The kennel should be provided with a door or gate of vertical iron bars. The gaps between
adjacent bars should be no more than 2 inches. Adequate roofing is necessary to provide shade and shelter
from inclement weather and also to prevent the dogs from escaping. Care should be taken while designing
the kennel to ensure that there is sufficient cross ventilation of air through the kennels. The kennels should
be designed to have a raised area at the rear of the kennel where the dog may lie down comfortably. There
must be proper drainage system in all kennels to facilitate cleaning.
(10) Dogs from the same family/social group may be kept one single kennel. Male and female dogs must be
housed separately. The dogs shall be kept in quarantine kennels for 12 hours before surgery, without food
or water.
(11) Sterilization surgery and vaccination must be performed by a Veterinarian under the close supervision
of the Jurisdictional Veterinary Officers of the Local authority in a well-equipped Operation Theatre. The
approved surgical procedures and the minimum requirements shall be as prescribed by the Board in the
Module.
(12) A 'V' shaped notch shall be made on the right ear of each dog during sterilization surgery. Such
clipping of the ear helps in identification of the dog as sterilized and immunized, once it is back on the
street. Branding of dogs shall not be permitted.
(13) After recovering from the surgery, the dogs shall be kept in kennels for at least four days after the
sterilization for post-operative care. Adequate and healthy food twice a day and potable drinking water at
all times must be provided to each dog.
Male and female dogs should be housed separately.
(14) The Animal Birth Control Center shall have sufficient space for proper housing and free movement of
dogs. The place should have proper ventilation and natural lighting and must be kept clean.
(15) The dogs shall be released at the same place or locality from where they were captured and the date,
time and place of their release shall be recorded after their complete recovery. The representative of the
local authority or of the animal welfare organization shall accompany the team at the time of release. From
time to time, the Board may prescribe a suitable application for geo-tagging the location of the dogs during
capture and release.
(16) In order to carry out the Animal Birth Control surgeries safely and humanely, the Implementing
Agency shall abide by the directions given by the Board regarding the Standard Operating Procedures in
the Module from time to time.
12. Records to be maintained:

The Project In-charge of the Local Authority or the Animal Welfare Organisation shall maintain the
following records at the Animal Birth Control Center:
(1) Record of animals captured including the following;
(i) the name of the area/locality from where the dog was captured,
(ii) date and time of capture,
(iii) names of persons in the capturing squad responsible for the capture,
(iv) details about dogs captured –tag number of the dog, number of males, females, colour,
identification marks and approximate age.
(2) Feeding Record for each kennel and Food Inventory
(3) Treatment Record for each dog
(4) Medicine and Vaccine Inventory
(5) Mortality Record
(6) Equipment Inventory including surgical equipment etc.
(7) Dog Van Logbooks
(8) Staff attendance Record
(9) Organ Inspection Record
(10) CCTV Footage for previous 30 days (Thirty days)
13. Reports: The Project In-charge of the Local Authority or the Veterinarian in-charge of the Animal
Welfare organisation conducting animal birth control program which has obtained Project Recognition
under these rules shall:-
(a) submit a monthly progress report to the Local Animal Birth Control Monitoring Committee, of
the number of street dogs sterilized and vaccinated with the following details in formats prescribed
in Schedule III and IV:
i) total number of street dogs caught
ii) total number of street dogs sterilized
iii) total number of street dogs housed for observation only
iv) total number of dogs that died before, during or after surgery
v) name and qualification of each veterinarian engaged with the project and the number of dogs
sterilized by each veterinarian during the month.
vi) name& registration number of each veterinarian with number of Animal Birth Controlsurgeries
conducted by him/her in each of the preceding month
vii) number of post-operative complications &mortality against the surgeries conducted by each
veterinarian, in a form prescribed in Schedule-III
(b) submit an annual report to the Board through the State Animal Birth Control Monitoring
Committee, not later than the 31st day of May every year regarding total number of animals
captured, sterilized, immunized during the previous year ending on 31st March;
(c) submit, such other information as may be required by the Board or State Board, from time to
time in prescribed format;
14. Power to Inspect:
(1) The Board shall have the power to authorise an inspection team in writing to inspect any Animal Birth
Control Centeron receipt of a complaint or for periodical inspection:
(2) The Inspection Team shall, have power to—
(a) enter into the premises and access to all areas within the premises and all animals, and records,
to ascertain whether the requirements of these rules are being complied with;
(b) take pictures, record videos, and make copies of the records.
(3) The recognised unit under these rules shall be inspected at least once in a year.
(4) The Inspection Team shall submit their report to the Board and to the State Monitoring Committee.
(5) No prior notice may be given by the Inspection team for conducting such inspection.
15. Euthanasia of Street Dogs:
(1) Incurably ill and mortally wounded dogs as diagnosed by a team appointed by the Local Animal Birth
Control Monitoring Committee shall be euthanized during specified hours in a humane manner by
intravenous administration of sodium pentobarbital or any other approved humane manner, by a qualified
veterinarian.
(2) The team shall consist of the Jurisdictional Veterinary Officer, the Project In-Charge and a
Representative of the Board/State Board.
(3) No dog shall be euthanized in the presence of another dog. The person responsible for euthanizing shall
make sure that the animal is dead, before disposal.
(4) Records for euthanasia shall be maintained with the reasons for euthanasia under the signature of the
team appointed as above.
16. Resolution of Complaints regarding dog bites or rabid dogs:
The Local Authority may establish an Animal Helpline. Either the Project In-Charge or the Animal Welfare
Organisation shall be responsible for recording and resolving conflict cases that may be reported.
i) On receipt of such a complaint, the details such as name of the complainant, his complete address, date
and time of complaint, nature of complaint etc. shall be recorded in a register to be maintained for
permanent record.
ii) The information of any dog bite shall be promptly shared with the Government Medical Hospital to
recommend post bite treatment.
iii) Such animals shall be humanely captured and kept for observation at the Animal Birth Control Center.
Upon the advice of the Veterinary Practitioner, a dog showing symptoms of any communicable disease
shall be housed in the Isolation Kennel where food and water must be provided to the dog twice every day.
iv) Any suspected rabid dog would then be subjected to inspection by a panel of two personsi.e a veterinary
surgeon appointed by the Local Authority and a representative from an Animal Welfare Organisation.
(v) If the dog is found to have a high probability of having rabies, it would be isolated till it dies a natural
death. Death normally occurs within 10 days of contracting rabies. Premature killings of suspected rabid
dogs, therefore, prevents the true incidence of rabies from being known and appropriate action being taken.
(vi) If the dog is found not to have rabies but some other disease or is furious in nature then it would be
handed over to the Animal Welfare Organisation who will take the necessary action to cure and release the
dog after 10 days of observation.
(vii) The carcasses of dogs that are suspected to have died of rabies shall be disposed of in an incinerator or
adopting any other method as prescribed by the Chief Veterinary Officer of the District.
(viii) If the Animal Birth Control program is being run by an animal welfare organisation, it shall be
reimbursed by the Local Authority for keeping and treating such dogs under observation at a rate
determined by the Local Animal Birth ControlMonitoring Committee.
(ix) The Local Authority shall display outreach material provided by the Board on prominent sites in the
city, to sensitize people about street dogs.
17. Counting and disposal of Organs:
The reproductive organs removed from male and female dogs shall be stored in 10% Formaldehyde at the
Animal Birth Control Center.
i) The organs shall be counted fortnightly or monthly or as often as decided by the Local Animal Birth
Control Monitoring Committee, by a team comprising of the following:
a) Chief Veterinary Officer or any Veterinary Officer authorised by him
b) Project In-Charge Veterinary Officer
c) Representative of the State Board/SPCA
c) Representative of any Animal Welfare Organisation
Provided that the Animal Welfare Organisation which is conducting the Animal Birth Control
program shall not be part of the Organ Inspection Team.
ii) The organs shall be preserved in separate plastic boxes marked with number of male & female genital
organs and date of Surgery.
iii) The Organ Inspection Team shall count all the organs and verify the Progress Report of the
Implementing Agency for the period in question.
iv) The counted organs shall be immediately destroyed in the presence of the Organ Inspection Team, by
spraying of tattoo dye and deep burial or incineration. The process of dying and burying the organs shall be
video recorded and photographed with the date and time stamp.
V) The State ABC Monitoring Committee shall conduct surprise inspection at least once every year in each
ABC Center to ensure adherence to the rules & take necessary action in case of non-compliance.
18. Effect of Non–Compliance: (1) After considering the report(s) referred to in rule 14 if the Board is of
the opinion that any provisions under these Rules are contravened or any violation of provision of the
Prevention of Cruelty to Animal Act, 1960 or Rules framed thereunder has occurred, or in the event of
cruelty, the Board shall issue show cause notice to the Animal Welfare Organisation or Local Authority
running the Animal Birth Control Center for reply within 15 days.
(2) Pending reply from the Animal Welfare Organisation or Local Authority, the Board may suspend its
recognition by communicating reason in writing.
(3) The Board, based on the inspection report and the reply to the Show Cause Notice, may take action in
accordance with this Act or direct the District Magistrate or District SPCA to take appropriate action
against the violators in accordance with law.
(4) The Board shall have the power to Cancel the registration of any Animal Welfare Organisation to
prevent such organisation from conducting animal birth control programs for any animals if there is reason
to believe that violation of these Rules is taking place.
(5) The Board shall Blacklist any Animal Welfare Organisation to prevent such organisation from
conducting animal birth control programs for any animals. Provided that such Blacklist shall only be done
if upon inspection authorised or conducted by the Board, it is established that the Animal Welfare
Organisation is a repeat offender or if the nature of the violation is concerning heinous cruelty or corruption
in any form.
(6) Any violation under these Rules shall be deemed to be an offence under the Act and the office bearers
of the Animal Welfare Organisation or the Project In-Charge of the Local Authority may be charged in
accordance with law.
19. Sterilization and Immunization of Domestic/Feral cats – Upon the advice of State Board, the
sterilization of cats may be conducted by a Recognized Animal Welfare Organisation with training and
expertise in spay/neuter of cats, in a manner prescribed in the Guidelines for Cat Sterilization and
Immunization, published by the Board.
(1) The infrastructure and reimbursement of expenses for a Cat Birth Control program shall be provided by
the Local Authority.
(2) While cat sterilization programs can be conducted in the Animal Birth Control Center provided for
dogs, the cats must not be housed with or come in contact in any way with dogs.
(3) The post-operative care of cats must be done in a place where they do not suffer from unnecessary
stress by the sounds/smells of dogs.
20. Feeding of Community Animals –(1) It shall be responsibility of the Resident Welfare Association
(RWA) or Apartment Owner Association(AoA) or Local Body’s representative of that area to make
necessary arrangement for feeding of community animals residing in the premises or that area involving the
person residing in that area or premises as the case may be, who feeds those animals or intends to feed
those animals and provide care to street animals as a compassionate gesture. The RWA or AoA or the
Local Body’s representative shall ensure:
(1) to designate feed spots which are mutually agreed upon, keeping in mind the number of dog
population and their respective territories. The feeding spots shall be far from children play areas,
entry and exit points, staircase or in an areas which is likely to be least frequented by children and
senior citizen.
(2) to designate feeding time depending on the movement of children, senior citizens, sports activities
which is likely to be least frequented by children and senior citizen.
(3) designated feeder shall ensure that there is no littering at the feeding location or violation of
guidelines framed by the RWA or AoA or that areas.
(4) designated feeders are allowed to volunteer for the vaccination, catching and release of dogs to
assist with the Animal Birth Control Program
(2) Where there is any conflict between the RWA or AOA and the animal caregivers or other residents, an
Animal Welfare committee comprising of the following shall be formed:
a) Chief Veterinary Officer or his representative
b) Representative of the Jurisdictional Police
c) Representative of the District Society for Prevention of Cruelty to Animal or State Board
d) Representative of any Recognized Animal Welfare Organisation conducting Animal Birth
Control
e) Veterinary Officer deputed by the local authority
f) Complainant
g) Representative of the RWA or AoA or Local Body of that area.
The decision of the Committee constituted under sub-rule (2) of Rule 20 shall be the final decision with
regard to the fixing of the feeding point. The Committee may also nominate person(s) from amongst the
designated Colony Care Taker by the Board to feed those animals in that area.
(3) Any local authority or animal welfare organisation or any feeder RWA or AoA or Local Body
aggrieved by the decision of the Committee framed under sub-rule (2) of Rule 20, the appeal shall be filed
to the State Board. The decision of State Board shall be the final decision for feeding of animals in that
area.
21. Appeal. — (1) The animal welfare organisation aggrieved by the decision of the project Recognition
Committee may, within thirty days of receipt of the decision, prefer an appeal to the Board;
(2) The Chairman of the Board on receipt of the grievance shall constitute a Committee where the
members from the Board and the relevant officials shall examine the grievance. The Committee shall after
giving notice and giving an opportunity of hearing to the parties, either may reject or allow the appeal, for
the reasons to be recorded in writing.
(3) Any local authority or animal welfare organisation or individual aggrieved by the decision of the Board,
they shall file second appeal to the Secretary Department of Animal Husbandry within 30 days of receiving
communication from the Board. The decision of the Secretary Department of Animal Husbandry treated as
final decision with regard to the grievance.
22. Application of rules where local bye-laws etc., exist: (1) If there is local rules, bye laws, any Act,
regulation for the time being is in force by the State or the Local Authority in respect of any of the matters
for which provision is made in these rules, such rule, regulation or bye-law shall to the extent to which:
(a) it contains provisions less irksome to the animal than those contained in these rules, shall prevail;
(b) it contains provisions more irksome to the animal than those contained in these rules, be of no effect.

Constitution of Monitoring Committees
1. Central Monitoring & coordinating Committee:
The Central Monitoring & Coordinating Committee shall be constituted with the following
members:
a) Secretary of the Administrative Ministry administering the Prevention of Cruelty to Animals Act, 1960,
shall be the Chairperson of the Central Coordination Committee.
b) Animal Husbandry Commissioner of Department of Animal Husbandry Dairying and Fisheries, Ministry
of Fisheries, Animal Husbandry and Dairying
c) Joint Secretary or Equivalent Officer from Urban Development Ministry, Government of India
d) Joint Secretary or Equivalent officer from Ministry of Panchayati Raj Department, Government of India
e) Chairperson, Animal Welfare Board of India
f) Chairperson, Veterinary Council of India
g) Joint Secretary, Ministry of Health and Family Welfare
h) Two Representatives of prominent State Animal Welfare Boards actively engaged in animal birth control
coordination in the State
i) An officer at the level of Joint Secretary of the Administrative Ministry administering the Prevention of
Cruelty to Animals Act, 1960, shall be the Member Secretary of the Central Monitoring &Coordination
Committee.
Functions of the Central Monitoring & coordinating Committee:
The Central Monitoring & Coordination Committee shall have the following functions:
i) To monitor proper implementation of the Animal Birth Control Rules.
ii) To promote the Animal Birth Control Programme and arrange budgetary provision for the animal birth
control in the states.
iii) To facilitate inter- ministerial coordination and also resolve the issues related to Animal Birth Control.
iv) Matter related to policy intervention required for Animal Birth Control Programme.
v) Any other matter related to Animal Birth Control programme.
(vi) may hear complaints in regard to the cancellation of recognition of Animal welfare organisation and
pass necessary direction or order to the Board as the case may be.
vii) Keep a watch on the national and international development in the field of research pertaining to street
dogs' control and management, development of vaccines and cost effective methods of sterilization,
vaccination, etc.
Meeting of the Committee: The Central Monitoring and Coordination Committee shall meet once in six
months or as and when necessary.
2. State Implementation & Monitoring Committee:
States intent to carry out the Animal Birth Control Programme shall constitute the State Implementation &
Monitoring Committee. The constitution of the Committee is as under:
a) Secretary in-charge of the Urban Development Department or equivalent in the State or Union Territory
shall be the Chairperson of the State Monitoring & Implementation Committee.
b) Director, Health and Family Welfare Department
c) Director, Department of Panchayeti Raj
d) Director, Urban Development Department (or equivalent)
e) Two Representative of the Animal Welfare Board of India
f) Two Representative of State Animal Welfare Board
g) Administrative heads of at least 2 municipal corporations, and representatives of at least 2 panchayats,
and at least 2 municipal councils in that state or union territory
h) Officer In-Charge of the State Animal Welfare Board shall be the Member Secretary as well as the
nodal officer for implementing the program in each state and union territory.
Note: No representative of the Board or State Board should be directly involved in the Animal Birth
Control Programme as Implementing Agency in that jurisdiction.
Functions of the State Monitoring and Implementation Committee:
The State Monitoring and Implementation Committees shall be responsible to carry out the following
functions:
(i). The setting up of Animal Birth Control Monitoring Committees at the local authority levels as required
by the Animal Birth Control Rules.
(ii). Developing a comprehensive district wise plan (including but not limited to infrastructure, budget, etc.
for dog population management in urban and rural areas throughout the state.)
(iii). Enlisting Animal Birth Control Implementing Agencies possessing of the requisite training and
experience, recognized by the Animal Welfare Board of India to carry out the Animal Birth Control
Programme as per the District and State Plan. This may include the animal husbandry department of the
State working in consultation with and the under the technical guidance of the AWBI.
(iv). Ensuring that the requisite infrastructure is set up, and other capital costs (including but not limited to
fully furnished Animal Birth Control facilities/campuses with ambulances and equipment), and all other
expenses for successfully running an animal birth control program, including manpower costs, are made
available to the Animal Birth Control Implementing Agencies from the local authorities, and reimbursed in
a timely manner as required by Rule 6 of the Animal Birth Control Rules.
(v). Responsible for overall monitoring of the Animal Birth Control Programme in the State by the Local
Authorities.
(vi). The State Monitoring Committee shall also carry out inspection on receipt of any complaints regarding
the Animal Birth Control and Cruelty to Animals during the Birth Control Program and violation of Animal
Birth Control Rules and take appropriate action.
Meeting of the Committee: The Committee shall meet once in every three months or as and when
necessary.
3. Constitution of Local Animal Birth Control Monitoring Committee
No Animal Birth Control Programme shall be carried without constitution of the Local Animal Birth
Control Monitoring Committee. The establishment of Animal Birth Control Monitoring Committee at the
local level in accordance with Animal Birth Control Rules is indispensable for the success of the Animal
Birth Control program. The Committee shall be constituted with the following members:
(a) Municipal Commissioner or Executive Officer of the local authority, who shall be the ex-officio
Chairman of the Committee.
(b) A representative of the Public Health Department of the District.
(c) A representative of the Animal Husbandry Department of the nearby Block or District.
(d) A jurisdictional veterinary doctor
(e) A representative of the district Society for Prevention of Cruelty to Animals (SPCA)
Functions of the Committee
The committee shall be responsible for planning and management of dog control programme in accordance
with these rules. The committee may:
(a) Issue instructions for catching, transportation, sheltering, sterilisation, vaccination, treatment and release
of sterilized vaccinated or treated dogs.
(b) authorize veterinary doctor to decide on case to case basis the need to put to sleep critically ill or fatally
injured or rabid dogs in a painless method by using sodium pentathol. Any other method is strictly
prohibited. To be decided through a sub-committee comprising of two veterinary officers and a
representative of a recognized animal welfare organization. The sub-committee shall specify reasons in
writing for euthanasia of each animal.
(c) creating public awareness and solicit co-operation and funding.
(d) providing guidelines to pet dog owners and commercial breeders from time to time.
(e) take such steps for the purpose of monitoring the dog bite cases and to ascertain the reasons of dog bite,
the area where it took place and whether it was from a stray or a pet dog. For the purpose details may be
collected from Human Hospital in a requisite format.
f) Arrive at an estimate of the number of dogs within its territorial limits by conducting a census in the
manner advised by the AWBI.
g) Ensure development of the infrastructure required to execute the Animal Birth Control program for the
estimated number of dogs. In order to do this, detailed project reports shall have to be prepared and
submitted to the State Monitoring and Implementation Committee in coordination with the state
government.
h) The infrastructure shall be designed in such a manner to carry out area-wise animal birth control in a
phased manner of at least 70% dogs in the targeted area before a new area is taken up. The infrastructure
shall include, but not be limited to pre-operation preparation areas, Operation Theatres, post-op care,
kennels, kitchen, store rooms for rations and medicines, parking area, residential rooms for veterinarians
and attendants, quarantine wards, ambulances, etc.
