फ़ा. सं. जेड-24/14/1/2020-डीपीसी (स्ट्था.I).—कममचारी राज्य बीमा ऄजधजनयम, 1948 (1948 का 34) की
धारा 97 की ईप धारा (1) के साथ पठठत ईप धारा (2) के खण्ड (xxi) और ईप-धारा (2क) तथा धारा 17 की ईप धारा
(2) द्वारा प्रदत्त िजतियय का प्रयगग करते ुए, कममचारी राज्य बीमा जनगम (कममचाठरृन्‍द और सेृा की ितें) जृजनयम,
1959 के ऄजधक्रमण में, ऐसे ऄजधक्रमण से पहले की गइ ऄथृा दकए जाने से छू ट गइ बात के ऄजतठरतिय, कममचारी राज्य
बीमा जनगम, एतदद्वारा जनम्नजलजखत जृजनयम बनाता ह, नामत:-
1. संजिप्त िीर्मक और प्रारं भ.― (1) ये जृजनयम कममचारी राज्य बीमा जनगम (कममचाठरृन्‍द और सेृा की ितें) जृजनयम,
2023 कहे जाएंगे।
(2) यह िासकीय राजपत्र में आनके प्रकािन की जतजथ से लागू ह गे।
2. पठरभार्ाएं.―(1)जब तक दक ऄ्‍यथा संदभम न हग, आन जृजनयम में––
(क) "ऄजधजनयम" का ऄथम कममचारी राज्य बीमा ऄजधजनयम, 1948 (1948 का 34) ह;
(ख) “ऄध्यि, जनगम” का ऄथम कममचारी राज्य बीमा (कें ्ीय) जनयम, 1950 के जनयम 2 के ईप-जनयम (2) के साथ पठठत
ऄजधजनयम की धारा 4 के खण्ड (क) के ऄंतगमत जनयक्‍त कममचारी राज्य बीमा जनगम का ऄध्यि ह;
(ग) “ऄध्यि, स्ट्थायी सजमजत” का ऄथम, कममचारी राज्य बीमा (कें ्ीय) जनयम, 1950 के जनयम 2 के ईप-जनयम (2) के साथ
पठठत ऄजधजनयम की धारा 8 के खण्ड (क) के ऄंतगमत जनयक्‍त ऄध्यि ह;

(घ) "जनगम" का ऄथम ऄजधजनयम के ऄधीन स्ट्थाजपत कममचारी राज्य बीमा जनगम ह;
(ङ) "महाजनदेिक" का ऄथम जनगम का महाजनदेिक ह;
(च) "कममचारी" का ऄथम जनगम के कममचाठरय के संृगम पर ृहन दकया गया ऄथृा ईसमें जनयकतिय व्यजतिय ह;
(छ) "माह" का ऄथम एक कलेंडर माह ह;
(ज) "पद" का ऄथम जनगम के ऄधीन एक पद ह, जग आन जृजनयम के साथ संलग्न प्रथम ऄनकसूची के कॉलम (2) में जृजनर्ददष्ट
ह, जजसमें सेृा की ितें, भती की पद्धजत कग छगड़कर, आन जृजनयम में यथा जृजनर्ददष्ट ह गी;
(झ) "ऄनकसूची" का ऄथम ह आन जृजनयम के साथ संलग्न ऄनकसूची;
(ञ) "सेृा" का ऄथम जनगम के ऄधीन सेृा ह;
(ट) "स्ट्थायी सजमजत" का ऄथम ऄजधजनयम की धारा 8 के ऄधीन जनगम की यथागठठत स्ट्थायी सजमजत ह।
(2) आसमें प्रयक्‍त ि्‍द और ऄजभ्‍यजतिययां, जग दक पठरभाजर्त नहीं की गईं हैं, ईनका संबंजधत ऄथम ृही हगगा जग
ऄजधजनयम, या जग समान ृेतनमान अहठरत करने ृाले, कें ्ीय सरकार के ऄजधकाठरय और कममचाठरय पर लागू
प्रासंजगक जनयम में ददया गया ह।
3. ऄनकप्रयगग.― (1) ये जृजनयम, प्रथम ऄनकसूची में जृजनर्ददष्ट पद के संबंध में जनगम के प्रत्येक जनयजमत कममचारी पर
लागू ह गे।
(2) प्रदाता प्राजधकरण नामत: कें ् सरकार या राज्य सरकार या संघ राज्य िेत्र प्रिासन या स्ट्थानीय जनकाय या
जृश्ृजृ्ालय सजहत स्ट्ृायत्त जनकाय से प्रजतजनयकजतिय अधार पर जनगम द्वारा जनयक्‍त ्‍यजतियय के मामले में, जनयकजतिय के
जनबंधन और ितें, जद्वतीय ऄनकसूची में यथाजृजनर्ददष्ट संबंजधत जनयकजतिय प्राजधकारी द्वारा प्रदाता प्राजधकरण के परामिम से
दकए व्यृस्ट्थापन ऄनकसार िाजसत ह गी।
(3) ये जृजनयम संजृदा ऄथृा ऄृजध के अधार पर जनयक्‍त ्‍यजतियय पर लागू नहीं ह गे।
4. जनयकजतिय प्राजधकारी.―प्रथम ऄनकसूची में जृजनर्ददष्ट पद के संबंध में जनयकजतिय प्राजधकारी जद्वतीय ऄनकसूची के कॉलम (4) में
यथा जृजनर्ददष्ट ह गे:
परं तक जनगम का ऄध्यि सामा्‍य या जृिेर् अदेि द्वारा, जनगम के दकसी ऄ्‍य प्राजधकारी या ऄजधकारी कग प्रथम
ऄनकसूची में जृजनर्ददष्ट दकसी पद या पद की श्रेणी में जनयकजतिय करने की िजतिययां प्रत्यायगजजत कर सकता ह।
5.पठरृीिा.― (1) सीधी भती ऄथृा पकनर्ननयगजन द्वारा ऄजधृर्नर्ता की अयक से पूृम दकसी पद पर जनयक्‍त प्रत्येक कममचारी
पठरृीिा पर रहेगा।
(2) आसके ऄजतठर्‍त सीधी भती या पदग्‍नजत या पकनर्ननयगजन के अधार पर ऄजधृर्नर्ता की अयक से पूृम जनयक्‍त
कममचाठरय के संबंध में पठरृीिा ऄृजध तथा संबंजधत ऄ्‍य सेृा-ितें तदनकसार ह गी जग कें ्ीय सरकार के समान
ृेतनमान अहठरत करने ृाले ऄजधकाठरय तथा कममचाठरय पर लागू हैं।
6.त्यागपत्र, सेृा-समाजि अदद.― (1) आन जृजनयम में जनजहत दकसी भी बात के हगते ुए, स्ट्थायी कममचारी जनयकजतिय
प्राजधकारी कग आस अिय का जलजखत रूप में तीन माह का नगठटस ददए जबना ऄपनी सेृा नहीं छगड़ेगा या समाि नहीं
करे गा और यह जनयकजतिय प्राजधकारी द्वारा ईसकी स्ट्ृीकन जत के ऄधीन हगगा।
(2) आन जृजनयम में जनजहत दकसी भी बात के हगते ुए, ऄस्ट्थायी कममचारी जनयकजतिय प्राजधकारी कग आस अिय का जलजखत
रूप में एक माह का नगठटस ददए जबना ऄपनी सेृा नहीं छगड़ेगा या समाि नहीं करे गा और यह जनयकजतिय प्राजधकारी
द्वारा ईसकी स्ट्ृीकन जत के ऄधीन हगगा।
(3) त्यागपत्र या सेृा-समाजि के संबंध में, तदनकरूपी ृेतनमान अहठरत करने ृाले कें ्ीय सरकार के ऄजधकाठरय और
कममचाठरय के जलए यथा लागू जनयम या ऄनकदेि ईप-जृजनयम (1) और (2) में संदर्नभत जनगम के कममचाठरय पर लागू
ह गे।
(4) जनयकजतिय प्राजधकारी द्वारा ऄस्ट्थायी कममचारी की सेृाएं, दकसी भी समय जबना कगइ कारण बताए एक माह का नगठटस
देकर समाि की जा सकती हैं:

बिते ऐसे दकसी भी कममचारी की सेृाएं तकरंत समाि की जा सकती हैं और आस तरह की सेृा-समाजि पर कममचारी
नगठटस की ऄृजध के जलए या ईस ऄृजध के जलए जजसके जलए नगठटस एक माह से कम पड़ता ह, ऄपने ृेतन और भत्त की
राजि के बराबर की राजि का दाृा ईस दर पर करने का हकदार हगगा, जजस दर पर ृह ई्‍हें सेृा-समाजि से तकरंत पूृम
प्राि कर रहा था।
7. ृेतन, छक ट्टी, भजृष्य जनजध, सेृाजनृनजत्त की अयक और भत्ते .― (1) जनगम के ऄधीन पद से जकड़े ृेतनमान प्रथम ऄनकसूची
में यथा जृजनर्ददष्ट ह गे।
2) कें ्ीय जसजृल सेृा (छक ट्टी) जनयम, 1972, जग कें ् सरकार के ऄजधकाठरय और कममचाठरय पर लागू हग, अृश्यक
पठरृतमन सजहत समान ृेतनमान पाने ृाले जनगम के कममचाठरय पर लागू हगगी।
(3) सामा्‍य भजृष्य जनजध (कें ्ीय सेृा) जनयम, 1960, जग कें ्ीय सरकार के ऄजधकाठरय और कममचाठरय पर लागू हग,
अृश्यक पठरृतमन सजहत समान ृेतनमान पाने ृाले जनगम के कममचाठरय पर लागू हगगी ।
(4) जनगम के कममचाठरय के जलए सेृाजनृनजत्त की अयक ृह हगगी, जग मूल जनयम के जनयम 56 के ऄनकसार समान ृेतनमान
अहठरत करने ृाले कें ्ीय सरकार के ऄजधकाठरय और कममचाठरय के संबंध में कें ्ीय सरकार द्वारा जनधामठरत की
जाए।
(5) जनगम के कममचारी यात्रा भत्ता और ठरयायत सजहत ऐसे भत्त के हकदार ह गे, जग तदनकरूपी ृेतनमान अहठरत करने
ृाले कें ् सरकार के ऄजधकाठरय और कममचाठरय के जलए समय-समय पर स्ट्ृीकायम ह गे।
8. पेंिन संबधं ी लाभ .― (1) ऄजधजनयम की धारा 16 के ऄधीन जनयकतिय प्रधान ऄजधकाठरय के ऄजतठरतिय जनगम के सभी
जनयजमत कममचारी, जग 31 ददसंबर, 2003 कग या ईस से पहले सेृा में अए, पेंिन, पेंिन के संरािीकरण, कक टक म्ब पेंिन,
मनत्यक-सह-सेृाजनृनजत्त ईपदान और सेृा ईपदान के लाभ के हकदार ह गे, जग कें ्ीय जसजृल सेृा (पेंिन) जनयम, 2021 के
ऄधीन कें ् सरकार के ऄजधकाठरय और कममचाठरय के जलए लागू ह:
बिते कममचारी राज्य बीमा जनगम के पेंिनभगजगय के मामले में, ऄंजतम अदेि पाठरत करने से पहले, कें ्ीय
जसजृल सेृा (पेंिन) जनयम, 2021 के जनयम 8 के परं तकक के ईपबंध के ऄनकसार, संघ लगक सेृा अयगग के साथ परामिम
लागू नहीं हगगा।
(2) 1 जनृरी, 2004 कग या ईसके बाद सेृा में प्रृेि करने ृाले जनगम के जनयजमत कममचाठरय के मामले में, कें ्ीय
जसजृल सेृा (राष्ट्रीय पेंिन प्रणाली का कायाम्‍ृयन) जनयम, 2021 और कें ्ीय जसजृल सेृा (राष्ट्रीय पेंिन प्रणाली के
ऄंतगमत ईपदान का संदाय) जनयम, 2021 लागू ह गी:
बिते कममचारी राज्य बीमा जनगम के ऐसे सेृाजनृनत्त कममचाठरय के मामले में, ऄंजतम अदेि पाठरत करने से पहले
कें ्ीय जसजृल सेृा (राष्ट्रीय पेंिन प्रणाली के ऄंतगमत ईपदान का संदाय) जनयम, 2021 के जनयम 5 के परं तकक के
ईपबंध के ऄनकसार, संघ लगक सेृा अयगग के साथ परामिम लागू नहीं हगगा।
(3) एक कममचारी जजसे कगइ चगट लगती ह, या चगट लगने के कारण जजसकी मनत्यक हग जाती ह, या ऄपने कतमव्य के पालन के
दौरान और ईसके कारण जजसकी मनत्यक हग जाती ह, ईसे, समान ृेतनमान और कें ्ीय सरकार के कें ्ीय जसजृल सेृा
(ऄसाधारण पेंिन) जनयमाृली, 1939 में जनधामठरत ितों के ऄधीन, आन जृजनयम के प्रकािन की तारीख पर यथा
लागू तथा ऐसे अिगधन के ऄधीन भी जज्‍हें कें ्ीय सरकार के ऄनकमगदन से जनगम द्वारा ऄपनाया जाए, ऄसाधारण
पेंिन दी जा सकती ह।
(4) जनगम के कममचाठरय के मामले में, कें ्ीय जसजृल सेृा (पेंिन) जनयम, 2021 में जनधामठरत प्राजधकाठरय की िजतियय
और प्रकायों का प्रयगग, आस जृजनयम के प्रयगजन के जलए, ऄध्यि, जनगम के ऄनकमगदन से महाजनदेिक द्वारा समय-
समय पर जारी जलजखत अदेि के ऄनकसार जनगम के ऄजधकाठरय या प्राजधकाठरय द्वारा दकया जाएगा।
9. जनयंत्रण और ऄनकिासन.― (1) जनगम के सभी कममचारी, ऄध्यि, जनगम, के सामा्‍य ऄधीिण और जनयंत्रण के ऄधीन
ह गे।
(2) आन जृजनयम के ईपबंध पर प्रजतकू ल प्रभाृ डाले जबना, महाजनदेिक, जृत्त अयकतिय और मकख्य सतकम ता ऄजधकारी कग
छगड़कर, जनगम के सभी कममचाठरय के संबंध में अचरण और ऄनकिासन, कें ्ीय जसजृल सेृा (अचरण) जनयम, 1964,
द्वारा िाजसत ह गे, जसा दक कें ् सरकार के ऄजधकाठरय और कममचाठरय पर लागू हग सकता ह, या ऄध्यि, जनगम, समय-
समय पर, सामा्‍य या जृिेर् अदेि द्वारा जृजनर्ददष्ट कर सकते हैं।
(3) जनगम में प्रत्येक पद के जलए जनयकजतिय प्राजधकारी, ऄनकिासजनक प्राजधकारी और ऄपीलीय प्राजधकारी ऐसे ह गे जग दूसरी
ऄनकसूची में जृजनर्ददष्ट दकए जा सकते हैं और जनगम के कममचाठरय के अचरण, ऄनकिासन और जनयंत्रण से संबंजधत िजतियय
का प्रयगग ईतिय ऄनकसूची में जृजनर्ददष्ट ऄनकसार दकया जाएगा।
10. जनलंबन.― (1) जनयकजतिय प्राजधकारी, या कगइ ऐसा प्राजधकारी जजसके ऄधीनस्ट्थ जनयकजतिय प्राजधकारी ह, या ऄनकिासजनक
प्राजधकारी, या महाजनदेिक द्वारा साधारण या जृिेर् अदेि से, आस जनजमत्त प्राजधकन त कगइ ऄ्‍य प्राजधकारी, जनगम के
दकसी कममचारी कग जनलजम्बत कर सके गा—
(क) जहां ईसके जृरुद्ध दकसी ऄनकिासजनक कायमृाही पर जृचार दकया गया ह या लंजबत ह; ऄथृा
(ख) जहां, ईतिय प्राजधकारी की राय में, ृह स्ट्ृयं ऐसे दक्रयाकलाप में लगा ुअ ह, जग जनगम के जहत या राज्य की
सकरिा पर प्रजतकू ल प्रभाृ डालने ृाले हैं; ऄथृा
(ग) जहां ईसके जृरुद्ध दकसी दांजडक ऄपराध से संबंजधत कगइ मामला ऄ्‍ृेर्ण, जांच या जृचारण के ऄधीन ह:
परं तक जनलम्बन का अदेि जनयकजतिय प्राजधकारी से नीचे के स्ट्तर के प्राजधकारी द्वारा जारी दकए जाने की जस्ट्थजत में संबंजधत
प्राजधकारी, जनयकजतिय प्राजधकारी कग ईन पठरजस्ट्थजतय की तत्काल ठरपगटम करे गा, जजसमें अदेि दकया गया था।
(2) यदद जनगम के दकसी कममचारी कग -
(क) चाहे दकसी अपराजधक अरगप के जलए या ऄ्‍यथा , ऄड़तालीस घंटे से ऄजधक की ऄृजध के जलए ऄजभरिा में
जनरुद्ध रखा जाता ह तग ृह जनरगध की तारीख से;
(ख) ईसे दकसी ऄपराध के जलए दगर्जसद्ध ठहराया जाने पर ऄड़तालीस घंटे से ऄजधक की ऄृजध के जलए काराृास का
दण्ड ददया जाता ह और ऐसी दगर्जसद्ध के पठरणामस्ट्ृरूप तत्काल पदच्यकत नहीं दकया जाता ह या हटाया नहीं
जाता ह या ऄजनृायमता सेृाजनृनत नहीं दकया जाता ह तग ऐसी दगर्जसद्ध की तारीख से, जनयकजतिय प्राजधकारी के
अदेि से जनलंजबत दकया गया समझा जाएगा।
स्ट्पष्टीकरण - आस ईप-जृजनयम के खंड (ख) में जनर्ददष्ट ऄड़तालीस घंट की ऄृजध, दगर्जसजद्ध के पश्चात् काराृास के प्रारं भ
से संगजणत की जाएगी और काराृास की अंतराजयक कालाजृजधय कग, यदद कगइ ह तग, आस प्रयगजन के जलए जहसाब में
जलया जाएगा।
(3) जहां जनलम्बनाधीन दकसी कममचारी कग सेृा से पदच्यकत कर ददए जाने/हटा ददए जाने या ऄजनृायमत: सेृाजनृनत्त कर
ददए जाने के जलए ऄजधरगजपत कगइ िाजस्ट्त आन जृजनयम के ऄधीन ऄपील में या पकनर्नृलगकन में ऄपास्ट्त कर दी जाती ह
और मामला ऄजतठरतिय जांच या कारम ृाइ के जलए या दक्‍हीं ऄ्‍य जनदेि के साथ, पकन: भेज ददया जाता ह, तग ईसके
जनलंबन के अदेि के बारे में यह समझा जाएगा दक ृह कग पदच्यकत कर ददए जाने/हटा ददए जाने या ऄजनृायमत:
सेृाजनृनत्त कर ददए जाने के मूल अदेि की तारीख से ही प्रृनत्त बना ुअ ह और ऄगले अदेि हगने तक प्रृनत्त बना रहेगा।
(4) जहां दकसी कममचारी कग सेृा से पदच्यकत कर ददए जाने/हटा ददए जाने या ऄजनृायमत: सेृाजनृनत्त कर ददए जाने के
जलए ऄजधरगजपत कगइ िाजस्ट्त, दकसी ्‍यायालय के जृजनश्चय के पठरणामस्ट्ृरूप या ईसके द्वारा ऄपास्ट्त या िू्‍य घगजर्त कर
दी जाती ह या हग जाती ह और ऄनकिासजनक प्राजधकारी, मामले की पठरजस्ट्थजतय पर जृचार कर, यह जृजनश्चय करता ह
दक ईसके जृरुद्ध ईन ऄजभकथन की जजन पर पदच्यकत कर ददए जाने/हटा ददए जाने या ऄजनृायमत: सेृाजनृनत्त कर ददए
जाने की िाजस्ट्त मूलत: ऄजधरगजपत की गइ थी, ऄजतठरतिय जााँच की जाए, तग कममचारी के बारे में यह समझा जाएगा दक ृह
पदच्यकत कर ददए जाने/हटा ददए जाने या ऄजनृायमत: सेृाजनृनत्त कर ददए जाने के मूल अदेि दक तारीख से, जनयकजतिय
प्राजधकारी द्वारा जनलजम्बत कर ददया गया ह और ऄगले अदेि हगने तक जनलजम्बत बना रहेगा ।
परं तक ऐसी ऄजतठरतिय जांच का अदेि ईसी जस्ट्थजत में ददया जाएगा जब दक ्‍यायालय ने मामले के गकणृगकण पर
जृचार दकए जबना पूणमत: तकनीकी अधार पर अदेि पाठरत दकया हग।
(5) (क) ईप-जनयम (7) में ऄंतर्नृष्ट ईपबंध के ऄधीन दकया गया या दकया गया समझा जाने ृाला जनलम्बन का अदेि तब
तक प्रृनत्त रहेगा, जब तक दक यह ईस प्राजधकारी द्वारा अिगजधत या रद्द नहीं कर ददया जाता, जग ऐसा करने के जलए
सिम ह।
(ख) जहां कगइ कममचारी (चाहे दकसी ऄनकिासजनक कायमृाही के संबंध में या ऄ्‍यथा) जनलजम्बत दकया जाता ह या
जनलजम्बत दकया ुअ समझा जाता ह और आस जनलम्बन के दौरान ईसके जृरुद्ध कगइ ऄ्‍य ऄनकिासजनक कायमृाही प्रारम्भ
की जाती ह तग ृह प्राजधकारी, जग ईसे जनलजम्बत रखने के जलए सिम ह, ऐसे कारण के जलए, जग ईसके द्वारा लेखबद्ध
दकए जाएंग,े यह जनदेि दे सके गा दक कममचारी तब तक जनलजम्बत बना रहेगा जब तक दक ऐसी सभी कायमृाजहयां या ईनमें
से कगइ कायमृाही समाप्त न हग जाए।
(ग) आस जृजनयम के ऄधीन दकया गया या दकया गया समझा जाने ृाला जनलम्बन का अदेि दकसी भी समय, ईस
प्राजधकारी द्वारा जजसने अदेि दकया था या जजससे द्वारा अदेि दकया समझा गया था, ऄथृा ईस प्राजधकारी द्वारा जजसके
ऄधीनस्ट्थ ृह प्राजधकारी ह, अिगजधत या रद्द दकया जा सकता ह।
(6) (क) आस जृजनयम के ऄधीन दकया गया या दकया ुअ समझा गया जनलम्बन अदेि, आस प्रयगजनाथम गठठत समीिा
सजमजत की जसफाठरि पर, जनलम्बन की तारीख से न्‍बे ददन की समाजि से पहले अिगजधत या प्रजतसंहरण करने के जलए
सिम प्राजधकारी द्वारा ईसकी समीिा की जाएगी और जनलम्बन की ऄृजध ब़ााते ुए या प्रजतसंहरण करते ुए अदेि
पाठरत दकए जाएंगे।
(ख) परृती समीिाएं जनलम्बन की जृस्ट्ताठरत ऄृजध की समाजि से पहले की जाएाँगी। जनलम्बन का जृस्ट्तारण एक बार में
एक सौ ऄस्ट्सी ददन से ऄजधक नहीं हगगा।
(7) ईप जृजनयम (1) या (2) के ऄधीन दकया गया या दकया ुअ समझा गया जनलम्बन अदेि न्‍बे ददन की ऄृजध के
बाद तब तक मा्‍य नहीं हगगा जब तक दक ईसे न्‍बे ददन की समाजि से पहले, समीिा के बाद अगे और ऄृजध के जलए
जृस्ट्ताठरत नहीं कर ददया जाता :
परं तक ईप जृजनयम (2) के ऄधीन समझे गए जनलम्बन के मामले में, जनलम्बन की ऐसी समीिा की अृश्यकता
नहीं हगगी, यदद कममचारी जनलंबन के 90 ददन के पूरा हगने के समय जनलंजबत बना रहता ह और ऐसे मामले में 90 ददन
की ऄृजध की गणना ऄजभरिा में जनरुद्ध कममचारी की जनरुजद्ध से ठरहाइ की तारीख या जजस तारीख कग ईसकी जनरुजद्ध से
ठरहाइ की बात ईसकी जनयकजतिय प्राजधकारी कग सूजचत की जाती ह, जग भी पश्चातृती हग:
परं तक यह और दक ऐसे मामले में जहां आन जृजनयम के ऄधीन कगइ अरगप-पत्र जारी नहीं दकया गया ह, जनलम्बन
या समझा गया जनलम्बन, जसा भी मामला हग, जजसके ऄंतगमत ईप जृजनयम (6) के जनबंधन के ऄनकसार कगइ जृस्ट्ताठरत
ऄृजध भी ह, के ऄधीन कक ल ऄृजध जनम्नजलजखत से ऄजधक नहीं हगगी ––
(क) यदद कममचारी कग ईप जृजनयम (1) के खंड (क) के जनबंधन के ऄनकसार जनलंजबत रखा गया ह, तग जनलंबन अदेि
की तारीख से दग सौ सत्तर ददन; या
(ख) यदद कममचारी कग ईप जृजनयम (1) के खंड (ख) या खंड (ग), जसा भी मामला हग, के जनबंधन के ऄनकसार
जनलंजबत रखा गया ह तग जनलंबन अदेि की तारीख से दग ृर्म; या
(ग) ईप जृजनयम (2) के ऄधीन समझे गए जनलंबन की दिा में ईस तारीख से, जब ऄजभरिा में जनरुद्ध कममचारी
जनमकम्‍त हगता ह या ईस तारीख से जब जनरगध से ईसकी जनमकमजतिय के तथ्य की सूचना ईसके जनयकजतिय प्राजधकारी कग दी
जाती ह, दग ृर्म, जग भी पश्चातृती हग।
11. िाजस्ट्तयां.― जनगम के दकसी कममचारी पर जनम्नजलजखत िाजस्ट्तयां समकजचत और पयामप्त कारण से तथा आसमें आसके
पश्चात् ईपबंजधत के रूप में ऄजधरगजपत की जा सकें गी, ऄथामत:् -
छगटी िाजस्ट्तयां:
(i) पठरननदा;
(ii) ईसकी पदग्‍नजत रगकना;
(iii) ईसके द्वारा ईपेिा या अदेि के भंग से जनगम कग ईसके द्वारा पुंचाइ गइ दकसी धन संबंधी हाजन की ृेतन में से
पूणमत: या भागत: ृसूली;
(iv) समय–ृेतनमान में जनम्नतर प्रक्रम पर तीन ृर्म से ऄनजधक की ऄृजध के जलए संचयी प्रभाृ के जबना और ईसकी
पेंिन पर प्रजतकू ल प्रभाृ डाले जबना, ऄृनजत;
(v) ृेतन ृनजद्ध रगकना।
बड़ी िाजस्ट्तयां :
(vi) खंड (iv) में यथा ईपबंजधत के जसृाए, दकसी जृिेर् जनधामठरत ऄृजध के जलए समय-ृेतनमान में दकसी जनचले तक
घटाना और साथ ही ये ददिा-जनदेि देना दक ्‍या कममचारी ऐसे ृेतनमान में स्ट्तराृनत दकए जाने की ऄृजध के दौरान
ृेतन-ृनजद्ध ऄर्नजत करे गा ऄथृा नहीं और यह दक ्‍या ऐसी ऄृजध के समाि हग जाने पर ईनके ृेतन भाृी ृेतन-ृनजद्ध
स्ट्तराृनजत के कारण मकल्तृी हगगी या नहीं;
(vii) दकसी जनम्नतर समय ृेतनमान, श्रेणी, पद या सेृा पर ऄृनजत जग कममचारी का ईस समय ृेतनमान, श्रेणी, पद
या सेृा पर पदगन्नत के जलए सामा्‍यत: ृजमन हगगी जजससे ईसे ऄृनत दकया गया था ऐसा आस जृर्य से संबंजधत
जनदेि सजहत या ईनके जबना दकया जा सके गा दक कममचारी जजस श्रेणी पर पद या सेृा से ऄृनत दकया गया ह ईसमें
प्रत्याृतमन की ्‍या ितम हगगी और ऐसी श्रेणी या पद या सेृा में ऐसे प्रत्याृतमन की दिा में ईसकी ज्येष्ठता और ृेतन की
बाबत ्‍या हगगा; –
(क) समय-ृेतनमान, श्रेणी, पद या सेृा में ऄृनजत की ऄृजध से ईसकी भाृी ृेतनृनजद्ध का मकल्तृी हगना
संचाजलत हगगा और यदद हां तग दकस सीमा तक; और
(ख) कममचारी ईच्चतर समय-ृेतनमान, श्रेणी, पद या सेृा में ऄपनी मूल ृठरष्ठता पकन: प्राप्त करे गा;
(viii) ऄजनृायम सेृा जनृनजत्त ;
(ix) सेृा से हटाया जाना, जग जनगम के ऄधीन भाृी जनयगजन के जलए जनरहमता नहीं हगगी;
(x) सेृा से पदच्यकजत जग सामा्‍यत: जनगम के ऄधीन भाृी जनयगजन के जलए जनरहमता हगगी:
परं तक ऐसे प्रत्येक मामले में जजसमें अय के ञातात रोतगत से ऄजधक पठरसंपजत्त रखने का अरगप या दकसी पदीय कायम
कग करने या न करने के जलए हेतक या आनाम के रूप में दकसी ्‍यजतिय से, ृध पाठरश्रजमक से जभ्‍न कगइ पठरतगर्ण स्ट्ृीकार
करने का अरगप जसद्ध हग जाए तग खंड (ix) या खंड (x) में ईजल्लजखत िाजस्ट्त ऄजधरगजपत की जाएगी:
परं तक यह और दक दकसी अपृाददक मामले में और जलजखत रूप में दजम जृिेर् कारण से कगइ ऄ्‍य िाजस्ट्त
ऄजधरगजपत की जा सकती ह।
स्ट्पष्टीकरण—जनम्नजलजखत कग, आस जृजनयम के ऄथम में, िाजस्ट्त नहीं माना जाएगा, ऄथामत् :—
(i) कममचारी की ृेतन ृनजद्ध का आस कारण रगका जाना दक ईस पद कग, जजसे ृह धाठरत दकए ुए ह या ईसकी जनयकजतिय के
जनबंधन कग िाजसत करने ृाले जृजनयम या अदेि के ऄनकसार दकसी जृभागीय परीिा कग ईत्तीणम करने में ऄसफल
रहा ह;
(ii) दकसी कममचारी कग, जृजधृत गठठत जृभागीय पदग्‍नजत सजमजत द्वारा ईसकी पदग्‍नजत के मामले पर जृचार करने के
पश्चात् ऄजधष्ठायी या स्ट्थानाप्‍न हजसयत में ईस श्रेणी या पद पर पदग्‍नत न करना जजस पर ृह पदग्‍नजत के जलए
पात्र ह;
(iii) दकसी ईच्चतर श्रेणी या पद पर स्ट्थानाप्‍न रूप से कायम करने ृाले दकसी कममचारी का दकसी जनचली श्रेणी या पद पर
आस अधार पर प्रत्याृतमन दक ईसे ऐसी ईच्चतर श्रेणी, या पद के जलए जृजधृत गठठत जृभागीय पदग्‍नजत सजमजत
द्वारा या ईसके अचरण से ऄसम्बध्द दकसी प्रिासजनक अधार पर ऄयग्‍य समझा गया ह;
(iv) दकसी ऄ्‍य श्रेणी या पद के जलए पठरृीिा पर जनयक्‍त दकसी कममचारी का, पठरृीिा की ऄृजध के दौरान या
समाजि पर, ईसकी स्ट्थायी श्रेणी या पद पर ऄपनी जनयकजतिय के जनब्‍धन या ऐसी पठरृीिा कग िाजसत करने ृाले
जृजनयम और अदेि के ऄनकसार प्रत्याृतमन;
(v) दकसी ऐसे कममचारी की सेृाओं का, जजसकी सेृाएं कें ्ीय सरकार या राज्य सरकार ऄथृा कें ्ीय सरकार या राज्य
सरकार के जनयंत्रणाधीन दकसी प्राजधकरण से ईधार ली गइ थीं, कें ्ीय सरकार या राज्य सरकार या प्राजधकरण
जजससे ऐसे कममचारी की सेृाएं ईधार ली गइ थीं, के ्‍ययन पर प्रजतस्ट्थापन;
(vi) दकसी कममचारी की ऄधज ृर्नर्ता या सेृाजनृनजत्त से संबंजधत ईपबंध के ऄनकसार ईसकी ऄजनृायम सेृाजनृनजत्त;
(vii) सेृाओं का समापन —
(क) पठरृीिा पर जनयक्‍त दकसी कममचारी की सेृाओं का, ईसकी पठरृीिा की ऄृजध के दौरान या समाजि पर,
ईसकी जनयकजतिय के जनब्‍धन या ऐसी पठरृीिा िाजसत करने ृाले जृजनयम और अदेि के ऄनकसार; ऄथृा
(ख) जृजनयम-6 के ईपबंध के ऄनकसार दकसी ऄस्ट्थायी कममचारी की; ऄथृा
(ग) दकसी करार के ऄधीन जनयगजजत सरकारी कममचारी की, ऐसे करार के जनब्‍धन के ऄनकसार;
(viii) कें ्ीय जसजृल सेृा (अचरण) जनयम, 1964 के जनयम 3-ग के ऄजभप्रेत यौन ईत्पीड़न की जिकायत की जांच हेतक
जनगम में बनाइ गइ जिकायत सजमजत की जसफाठरि पर ददया गया हजामना।
12. ऄनकिासजनक प्राजधकारी तथा ऄनकिासजनक कायमृाही संजस्ट्थत करने के जलए प्राजधकार.―
(1) जनगम के ऄंतगमत पद के संबंध में ऄनकिासजनक प्राजधकारी दूसरी ऄनकसूची में जृजनर्ददष्ट हैं :-
(2) आन जृजनयम के ऄधीन जृजनयम 11 के खंड (i) से (v) में जृजनर्ददष्ट दकसी भी िाजस्ट्त कग ऄजधरगजपत करने के जलए
सिम कगइ ऄनकिासजनक प्राजधकारी, आन जृजनयम के ऄंतगमत खंड (vi) से (x) में जृजनर्ददष्ट दकसी भी िाजस्ट्त कग
ऄजधरगजपत करने के जलए सिम नहीं हगने पर भी ईतिय जृजनयम के खंड (vi) से (x) में जृजनर्ददष्ट दकसी भी िाजस्ट्त कग
ऄजधरगजपत करने के जलए दकसी कममचारी के जृरुद्ध ऄनकिासजनक कायमृाही संजस्ट्थत कर सकता ह।
स्ट्पष्टीकरण –– जहां दकसी ृेतनमान में पद धारण करने ृाले कममचारी ऄगले ईच्चतर ृेतनमान के पद पर, पठरृीिा पर
ऄथृा ऄस्ट्थायी रूप से पदग्‍नत हगता ह, तग ृह आस जृजनयम के प्रयगजन के जलए ईच्चतर ृेतनमान का पदधारण करने
ृाला समझा जाएगा।
13. िाजस्ट्तयां ऄजधरगजपत करने के जलए प्रदक्रया.― (1) िाजस्ट्तयां ऄजधरगजपत करने की प्रदक्रया कें ्ीय जसजृल सेृाएं
(ृगीकरण, जनयंत्रण और ऄपील) जनयम, 1965 के संगत ईपबंध के ऄंतगमत यथा ईपबंजधत हगगी।
(2) जहां ईप जृजनयम (1) में संदर्नभत प्रदक्रया दकसी प्रयगजन, जसे- जांच ऄजधकारी ऄथृा प्रस्ट्तकतकताम ऄजधकारी ऄथृा
बचाृ सहायक के जलए कें ्ीय सरकार के सेृारत ऄथृा सेृाजनृनत्त कममचाठर य की जनयकजतिय ईपबंजधत करती ह, तग आसके
जलए जनगम के सेृारत ऄथृा सेृाजनृनत कममचाठरय पर भी जृचार दकया जाएगा।
(3) जनगम में पद के संबंध में िाजस्ट्तयां ऄजधरगजपत दकए जाने के प्रयगजनाथम सिम प्राजधकारी जद्वतीय ऄनकसूची में
जृजनर्ददष्ट ऄनकसार ह गे :
परं तक कें ्ीय जसजृल सेृाएं (ृगीकरण, जनयंत्रण और ऄपील) जनयम, 1965 के संगत ईपबंध के ऄंतगमत यथा
ईपबंजधत संघ लगक सेृा अयगग से परामिम जनगम के कममचाठरय के मामले में लागू नहीं हगगा।
14. कें ्ीय सरकार, राज्य सरकार, अदद में प्रजतजनयकजतिय पर पदधाठरय के बारे में ईपबंध.―
(1) जहां दकसी कममचारी की सेृाएं जनगम द्वारा कें ्ीय सरकार, राज्य सरकार या दकसी ऄ्‍य प्राजधकरण (आसके पश्चात्
आस जृजनयम में ईधार लेने ृाले प्राजधकारी के रूप में संदर्नभत) कग ईधार दी गइ ह, तग ईधार लेने ृाले प्राजधकारी कग ऐसे
कममचारी कग जनलंबन के ऄधीन रखने के प्रयगजन हेतक जनयकजतिय प्राजधकारी की और ईसके जृरूद्ध ऄनकिासजनक कायमृाही
करने के प्रयगजन हेतक ऄनकिासजनक प्राजधकारी की िजतिययां ह गी।
परं तक ईधार लेने ृाला प्राजधकारी, जनगम (आसके पश्चात् आस जृजनयम में ईधार देने ृाले प्राजधकारी के रूप में
संदर्नभत) कग ऐसे कममचारी के जनलंबन के अदेि या ऄनकिासजनक कायमृाही, यथाजस्ट्थजत, प्रारं भ करने ृाली पठरजस्ट्थजतय
की तत्काल जानकारी देगा।
(2) ऐसे कममचारी के जृरूद्ध की गइ ऄनकिासजनक कायमृाही में जााँच पठरणाम कग ध्यान में रखते ुए–
(i) यदद ईधार लेने ृाले प्राजधकारी की राय ह दक जृजनयम 11 के खंड (i) से (v) तक में जृजनर्ददष्ट िाजस्ट्तय में से
कगइ भी िाजस्ट्त कममचारी पर ऄजधरगजपत हगनी चाजहए, तग ृह ईधार देने ृाले प्राजधकारी से परामिम के बाद
ईस मामले पर ऐसे अदेि कर सकता ह, जसा ृह अृश्यक समझे: -
परं तक ईधार लेने ृाले प्राजधकारी और ईधार देने ृाले प्राजधकारी के बीच मतभेद हगने की दिा में कममचारी की
सेृाएं ईधार देने ृाले प्राजधकारी के जनयंत्रणाधीन प्रजतस्ट्थाजपत कर दी जाएंगी;
(ii) यदद ईधार लेने ृाले प्राजधकारी की यह राय ह दक जृजनयम 11 के खंड (vi) से (x) तक में जृजनर्ददष्ट िाजस्ट्तय
में से कगइ भी िाजस्ट्त कममचारी पर ऄजधरगजपत की जानी चाजहए, तग ृह ईसकी सेृाएं ईधार देने ृाले
प्राजधकारी के जनयंत्रणाधीन प्रजतस्ट्थाजपत कर देगा और जांच की कायमृाजहयां ईधार देने ृाले प्राजधकारी कग
ऄग्रेजर्त करे गा तथा ईस पर ईधार देने ृाला प्राजधकारी, यदद ृह ऄनकिासजनक प्राजधकारी ह, ईस पर ऐसा
अदेि पाठरत कर सके गा, जसा ृह अृश्यक समझे, या यदद ृह ऄनकिासजनक प्राजधकारी नहीं ह, तग
ऄनकिासजनक प्राजधकारी कग मामला सौंप देगा, जग ईस मामले में ऐसे अदेि पाठरत करे गा, जसे ृह अृश्यक
समझे।
परं तक ऐसा कगइ अदेि पाठरत करने से पहले ऄनकिासजनक प्राजधकारी जृजनयम 13 के ईपबंध का ऄनकपालन
करे गा।
स्ट्पष्टीकरण –– ऄनकिासजनक प्राजधकारी ईधार लेने ृाले प्राजधकारी द्वारा ईसे ऄग्रेजर्त जांच के ठरकॉडम पर आस खंड के
ऄधीन या जहां तक हग सके , जृजनयम 13 के ईपबंध के ऄनकसार अगे ऐसी जांच करने के बाद, जसी ृह अृश्यक समझे,
अदेि दे सके गा।
15. जनगम में प्रजतजनयक्‍त पदधाठरय के संबध
ं में ईपबंध.―
(1) जहां जनगम (आसके पश्चात् आस जृजनयम में ईधार लेने ृाले प्राजधकारी के रूप में संदर्नभत) के दकसी कममचारी, जजसकी
सेृाएं कें ्ीय सरकार या राज्य सरकार या स्ट्थानीय प्राजधकारण से ईधार ली गइ हैं, के जृरूद्ध जनलंबन का कगइ अदेि
दकया गया ह या कगइ ऄनकिासजनक कारम ृाइ की गइ ह तग ईधार देने ृाले प्राजधकारी (आसके पश्चात् आस जृजनयम के
ईधार देने ृाले प्राजधकारी के रूप में संदर्नभत) कग ईन पठरजस्ट्थजतय , जजनमें कममचारी के जनलंबन के अदेि दकए गए थे
या ऄनकिासजनक कायमृाही प्रारं भ करने, जसा भी मामला हग, की तत्काल जानकारी दी जाएगी।
(2) कममचारी के जृरूद्ध की गइ ऄनकिासजनक कायमृाही में जनष्कर्ों के अलगक में, यदद ऄनकिासजनक प्राजधकारी की राय ह
दक जृजनयम 11 के खंड (i) से (v) तक में जृजनर्ददष्ट िाजस्ट्तय में से कगइ भी ईस पर ऄजधरगजपत हगनी चाजहए तग
ऄनकिासजनक प्राजधकारी जृजनयम 13 के ईपबंध के ऄध्यधीन, ईधार देने ृाले प्राजधकारी से परामिम करने के बाद,
ईस मामले पर ऐसे अदेि पाठरत कर सके गा, जसे ृह अृश्यक समझे।
(3) सेृाएं ईधार लेने ृाले और ईधार देने ृाले प्राजधकारी के बीच मतभेद हगने की दिा में कममचारी की सेृाएं ईधार देने
ृाले प्राजधकारी के जनयंत्रणाधीन प्रजतस्ट्थाजपत कर दी जाएगी।
(4) यदद ऄनकिासजनक प्राजधकारी की यह राय ह दक जृजनयम 11 के खंड (vi) से (x) तक में जृजनर्ददष्ट िाजस्ट्तय में से कगइ
भी कममचारी पर ऄजधरगजपत की जानी चाजहए तग ृह ऐसे कममचारी की सेृाएं ईधार देने ृाले प्राजधकारी के
जनयंत्रणाधीन प्रजतस्ट्थाजपत कर देगा और जांच की कायमृाजहय कग, जसा ृह अृश्यक समझे, ईसे ऐसी कारम ृाइ के
जलए ऄग्रेजर्त कर देगा।
16. ऄपीलें.― आन जृजनयम में ऄंतर्नृष्ट दकसी बात के हगते ुए भी, जनम्नजलजखत अदेि के जृरुध्द कगइ ऄपील नहीं हगगी-
(i) कें ्ीय सरकार द्वारा दकया गया कगइ अदेि;
(ii) जनलंबन अदेि से जभन्न, ऄ्‍तृमती प्रकन जत का या सहायक प्रकन जत का या ऄनकिासजनक कायमृाही के ऄंजतम जनपटारे का
कगइ अदेि;
(iii) जृजनयम 13 के ऄधीन जांच के दौरान दकसी जांच प्राजधकारी द्वारा पाठरत कगइ अदेि।
17. अदेि, जजनके जृरूद्ध ऄपील हग सके गी.―
जृजनयम 16 के ईपबंध के ऄध्यधीन, जनगम का कममचारी जनम्नजलजखत सभी या दक्‍ही अदेि के जृरूद्ध ऄपील कर
सके गा, ऄथामत् :-
(i) जृजनयम 10 के ऄधीन दकया गया या ुअ समझा गया जनलम्बन का कगइ अदेि;
(ii) जृजनयम 11 में जृजनर्ददष्ट िाजस्ट्तय में से कगइ भी िाजस्ट्त ऄजधरगजपत करने ृाला अदेि, चाहे ृह ऄनकिासजनक
प्राजधकारी द्वारा दकया गया हग या ऄपीलीय या पकनरीिण प्राजधकारी द्वारा;
(iii) जृजनयम 11 के ऄधीन ऄजधरगजपत दकसी िाजस्ट्त में ृनजद्ध करने ृाला कगइ अदेि;
(iv) ऐसा कगइ अदेि जग -
(क) आन जृजनयम द्वारा या करार द्वारा यथा जृजनयजमत ईसके ृेतन, भत्त , पेंिन या सेृा की ऄ्‍य ितों से ईसे
ृंजचत करता ह या ईसके ऄजहत में ईनमें फे र-फार करता ह; ऄथृा
(ख) दकसी ऐसे जृजनयम या करार के ईपबंध का ईसके ऄजहत में जनृमचन करता ह;
(v) कगइ अदेि जग –
(क) ईसे दकसी ईच्चतर सेृा श्रेणी या पद पर स्ट्थानाप्‍न रूप से कायम करते ुए दकसी ईसे जनम्नतर सेृा श्रेणी या
पद पर िाजस्ट्त के रूप में जनम्न रूप से प्रजतृर्नतत करता ह।
(ख) पेंिन कम करता ह या ईसे रगकता ह या आन जृजनयम के ऄधीन ऄनकञातेय ऄजधकतम पेंिन से ईसे ृंजचत
करता ह,
(ग) ईसकी जनलम्बन की ऄृजध के जलए या ईस ऄृजध के जलए जजसके दौरान ईसे जनलम्बन के ऄधीन समझा
जाता ह या ईसके दकसी भाग के जलए ईसे संदत्त दकए जाने ृाले जनृामह और ऄ्‍य भत्ते ऄृधाठरत करता ह,
(घ) जनम्नजलजखत ऄृजध के जलए ईसके ृेतन और भत्ते ऄृधाठरत करता ह:-
(i) जनलम्बन की ऄृजध के जलए; या
(ii) सेृा से ईसकी पदच्यकजत, हटाए जाने या ऄजनृायम सेृाजनृनजत्त की तारीख से या दकसी जनम्नतर श्रेणी
या पकन: स्ट्थापन, पद, समय-मान या ृेतन के समय-मान के प्रक्रम में ऄृनजत की तारीख से ईसकी सेृा,
श्रेणी या पद पर ईसकी बहाली की तारीख तक की ऄृजध के जलए; ऄथृा
(ङ) यह ऄृधाठरत करता ह दक ईसके जनलम्बन की तारीख से या ईसकी पदच्यकजत, हटाए जाने, ऄजनृायम
सेृाजनृनजत्त या जनम्नतर सेृा, श्रेणी, पद समय-ृेतनमान या ृेतन के समय-मान के प्रक्रम में ईसकी ऄृनजत
की तारीख से ईसके ग्रेड या पद पर ईसकी बहाली या पकन:स्ट्थापन की तारीख तक की ऄृजध दकसी प्रयगजन
के जलए कत्तम्‍य पर जबताइ गइ ऄृजध के रूप में मानी जाएगी या नहीं।
स्ट्पष्टीकरण––आस जृजनयम में, ऄजभ्‍यजतिय ––
(i) “जनगम का कममचारी” पद के ऄंतगमत ृह ्‍यजतिय भी अता ह, जग जनगम की सेृा से मकतिय हग गया ह;
(ii) “पेंिन” पद के ऄंतगमत ऄजतठर्‍त पेंिन, ईपदान और ऄ्‍य सेृाजनृनजत्त जहतलाभ अते हैं।
18. ऄपीलीय प्राजधकारी.― जनगम का कगइ कममचारी, जजसके ऄंतगमत ऐसा ्‍यजतिय भी ह जग जनगम की सेृा में ऄब
नहीं रहा ह, जृजनयम 17 में जृजनर्ददष्ट सभी या दकसी अदेि के जृरूद्ध ऄपील ईस प्राजधकारी कग, जग आस जनजमत या तग
जद्वतीय ऄनकसूची में या ऄध्यि, जनगम के साधारण या जृिेर् अदेि द्वारा जृजनर्ददष्ट दकया जाए या जहां कगइ ऐसा
प्राजधकारी जृजनर्ददष्ट न हग, ृहां जनम्नजलजखत कग ऄपील कर सके गा ऄथामत् ––
(क) यदद ृह अदेि, जजसके जृरूद्ध ऄपील की गइ ह, जनयकजतिय प्राजधकारी के ऄधीनस्ट्थ प्राजधकारी द्वारा दकया गया ह
तग, जनयकजतिय प्राजधकारी कग, या
(ख) ऐसा अदेि जग ऄध्यि, जनगम द्वारा दकया गया हग तग, कें ्ीय सरकार कग;
19. ऄपील का प्रस्ट्तकतीकरण और जृचार दकया जाना.― जृजनयम 17 के ऄधीन कगइ ऄपील प्रस्ट्तकत की जाएगी और
जृजनयम 18 में जृजनर्ददष्ट ऄपीलीय प्राजधकाठरय द्वारा ऐसे प्ररूप एृं रीजत से, और ऐसी प्रदक्रया के ऄनकसार गनहीत तथा
जृचठरत की जाएगी, जसी कें ्ीय जसजृल सेृाएं (ृगीकरण, जनयंत्रण और ऄपील) जनयम, 1965 में जृजनर्ददष्ट ह।
20. ऄपील के अदेि का कायाम्‍ृयन.― ृह प्राजधकारी जजसके अदेि के जृरूद्ध ऄपील ुइ ह, ऄपीलीय प्राजधकारी द्वारा
पाठरत अदेि कग दक्रयाज्‍ृत करे गा।
21. पकनरीिण.― (1) आन जृजनयम में ऄंतर्नृष्ट दकसी बात के हगते ुए भी, ––
(i) कें ्ीय सरकार; या
(ii) ऄध्यि जनगम; या
(iii) महाजनदेिक; या
(iv) जद्वतीय ऄनकसूची में यथा जृजनर्ददष्ट, पकनरीजित दकए जाने ृाले प्रस्ट्ताजृत अदेि की तारीख से छह माह के भीतर,
ऄपील प्राजधकारी, या
(v) ऄध्यि, जनगम के साधारण या जृिेर् अदेि द्वारा आस जनजमत जृजनर्ददष्ट कगइ ऄ्‍य प्राजधकारी और ईतने समय के
भीतर जजतना ऐसे साधारण या जृिेर् अदेि में जृजहत दकया जाए, दकसी भी समय, ईस पर या स्ट्ृप्रेरणा पर या ऄ्‍यथा
दकसी जांच के ऄजभलेख कग दकसी भी समय मंगृा सके गा और आन जृजनयम के ऄधीन दकए गए दकसी अदेि का पकनरीिण
कर सके गा ककतक जजसकी कगइ ऄपील की नहीं गइ ह या जजसकी कगइ ऄपील की ऄनकमजत नहीं ह, और
(क) अदेि कग पकष्ट, ईपा्‍तठरत या ऄपास्ट्त कर सके गा, या
(ख) अदेि द्वारा ऄजधरगजपत िाजस्ट्त कग पकष्ट, कम, ृर्नधत या ऄपास्ट्त कर सके गा या जहां कगइ िाजस्ट्त ऄजधरगजपत न की गइ
हग, ृहां िाजस्ट्त ऄजधरगजपत कर सके गा, या
(ग) मामला ईस प्राजधकारी कग, जजसने अदेि दकया ह या दकसी ऄ्‍य प्राजधकारी कग ऐसी ऄजतठरतिय जााँच का जनदेि देते
ुए भेज सके गा जग ृह मामले की पठरजस्ट्थजतय में ईपयक्‍त समझे, या
(घ) ऐसे ऄ्‍य अदेि पाठरत कर सके गा जग ृह ठीक समझे:
परं तक दकसी भी िाजस्ट्त कग ऄजधरगजपत या ृर्नधत करने का अदेि दकसी पकनरीिण प्राजधकारी द्वारा तब तक नहीं
दकया जाएगा जब तक दक जनगम के कममचारी कग प्रस्ट्ताजृत िाजस्ट्त के जृरूद्ध ऄ‍याृेदन करने का यकजतिययक्‍त ऄृसर नहीं
दे ददया जाता ह और जृजनयम 11 के खंड (vi) से (x) तक में से जृजनर्ददष्ट िाजस्ट्तय में से दकसी कग ऄजधरगजपत करने या
ईस अदेि द्वारा, जजसे पकनरीजित दकया जाना ह, ऄजधरगजपत िाजस्ट्त कग कथग्‍त जृजनयम के खंड (vi) से (x) में जृजनर्ददष्ट
दकसी िाजस्ट्त तक ृर्नधत करने का प्रस्ट्ताृ दकया जाता ह; और यदद ईस मामले में जृजनयम 13 के ऄधीन पहले से जांच न
की गइ हग, ृहां ऐसी कगइ िाजस्ट्त जृजनयम 13 में दी गइ रीजत में जांच के पश्चात के जसृाय ऄजधरगजपत नहीं की जाएगी।
परं तक खंड (i) से (v) में जृजनर्ददष्ट प्राजधकाठरय द्वारा पकनरीिण की िजतिय का प्रयगग नहीं दकया जाएगा, जब तक दक-
(क) ृह प्राजधकारी, जजसने ऄपील में अदेि दकया ह; या
(ख) ृह प्राजधकारी जजसे ऄपील की जा सकती ह दक्‍तक कगइ ऄपील नहीं की गइ ह, ईसके ऄधीनस्ट्थ नहीं ह।
(2) पकनरीिण के जलए कगइ भी कायमृाही तब तक प्रारं भ नहीं की जाएगी, जब तक दक-

(क) ऄपील की पठरसीमा-काल का ऄृसान नहीं हग जाता; या
(ख) यदद कगइ ऄपील की गइ ह तग ऄपील का जनपटारा नहीं हग जाता।
(3) पकनरीिण के जलए अृेदन पर ईसी रीजत से कारम ृाइ की जाएगी मानग ृह आन जृजनयम के ऄधीन कगइ ऄपील हग।
22. पकनर्नृलगकन.― जब कगइ नइ सामग्री या साक्ष्य जग पकनर्नृलगकना अदेि पाठरत करते समय प्रस्ट्तकत नहीं दकया गया था
ऄथृा ईपल्‍ध नहीं था और जजसमें मामले की स्ट्ृरूप कग बदल देने का प्रभाृ ह, कें ्ीय सरकार की जानकारी में अता ह
ऄथृा लाया जाता ह तग ृह दकसी भी समय ऄपनी मजी से ऄथृा ऄ्‍यथा, आन जृजनयम के ऄधीन पाठरत दकसी अदेि
का पकनर्नृलगकन कर सकती ह:
परं तक िाजस्ट्त लगाने ऄथृा बढाने ृाला कगइ अदेि कें ्ीय सरकार द्वारा तब तक नहीं दकया जाएगा जब तक दक
प्रस्ट्ताजृत िाजस्ट्त के जृरूद्ध ऄ‍याृेदन करने के जलए संबंजधत कममचारी कग ईजचत ऄृसर न ददया गया हग ऄथृा जहााँ
जृजनयम 11 में जनर्ददष्ट कगइ बड़ी िाजस्ट्त लगाने ऄथृा ईतिय अदेि द्वारा लगायी गयी छगटी िाजस्ट्त कग बड़ी िाजस्ट्त में
बदलने का प्रस्ट्ताृ हग और यदद मामले की जााँच जनयम 13 के ऄधीन पहले नहीं की गइ ह तग जनयम 13 में जनधामठरत जााँच
पड़ताल करने के पश्चात के जसृाय ऄजधरगजपत नहीं की जाएगी।
23. कममचाठरय का अचरण.― जनगम के कममचारी अृश्यक पठरृतमन सजहत तदनकरूप ृेतनमान अहठरत करने ृाले
कें ्ीय सरकार के ऄजधकाठरय और कममचाठरय पर समय-समय पर लागू अचरण जनयम द्वारा िाजसत ह गे।
24. सेृा की ऄ्‍य ितें.― कममचाठरय की सेृा की ितों से संबंजधत ऄ्‍य मामल में, जजनके जलए आन जृजनयम में कगइ
ईपबंध नहीं दकया गया ह या ऄपयामि ईपबंध दकया गया ह, तदनकरूप ृेतनमान अहठरत करने ृाले कें ्ीय सरकार के
ऄजधकाठरय और कममचाठरय पर समय-समय पर लागू जनयम, लागू ह गे:
परं तक जहां जनगम का यह मत ह दक आस जृजनयम के ऄंतगमत दकसी मामले के संबंध में कें ्ीय सरकार के जनयम या
अदेि से जृचलन अृश्यक ह, तग जनगम कें ्ीय सरकार का पूृम ऄनकमगदन प्राि करे गा।
25. कें ्ीय सरकार के जनयम कग लागू करने के जलए सिम प्राजधकारी.― आन जृजनयम के ऄंतगमत जनगम के कममचाठरय पर
तदनकरूप कें ्ीय सरकार के जनयम कग लागू करने के प्रयगजन के जलए ऄध्यि, जनगम ईन सभी िजतियय और कन त्य के प्रयगग
के जलए सिम प्राजधकारी ह गे, जग कें ्ीय सरकार के जृजभन्न जनयम के ऄंतगमत राष्ट्रपजत या स्ट्थानीय सरकार या मंत्रालय
या भारत सरकार के जृभाग में जनजहत हैं।
26. ऄध्यि, जनगम के अदेि कग प्रमाजणत करने का प्राजधकार.― ऄध्यि, जनगम द्वारा पाठरत अदेि (ऄनकिासजनक मामल
में पाठरत अदेि सजहत) ऄपर अयकतिय या बीमा अयकतिय या जचदकत्सा अयकतिय, या आनसे उपर के पद के समकि ऄजधकारी
द्वारा प्रामाजणत दकए जाएंगे।
27. ऄसाधारण मामल में छू ट.― जहां महाजनदेिक का यह समाधान हग जाता ह दक दकसी कममचारी की सेृा की ितों के
जृर्य में दकसी जृजनयम या ईपबंध के प्रचालन से दकसी जृजिष्ट मामले में ऄसम्यक कष्ट हगता ह, तग ृह ऄध्यि, जनगम, के
पूृम ऄनकमगदन से, अदेि द्वारा ईस जृजनयम या ईपबंध की ऄपेिाओं कग ऐसे जृस्ट्तार तक तथा ऐसी ितों के ऄध्यधीन जसी
दकसी ्‍यायसंगत और साम्यपूणम रीजत से मामले में कायमृाही करने में अृश्यक हग, ऄजभमकतिय या छू ट दे सके गा,
परं तक ऐसा कगइ जृचलन या छू ट कें ्ीय सरकार के तदनकरूप ृेतनमान अहठरत करने ृाले कें ्ीय सरकार के
ऄजधकाठरय और कममचाठरय पर लागू जनयम या ऄनकदि े के ृतममान ईपबंध से ऄजधक नहीं हगगी।
28. भारत के संजृधान के प्रजत जनष्ठा की िपथ.― प्रत्येक कममचारी से, जनगम की सेृा में ऄपनी जनयकजतिय के समय, भारत के
संजृधान के प्रजत स्ट्थाजपत जृजध ऄनकसार ऄपनी जनष्ठा की िपथ लेना या सत्यजनष्ठा से प्रजतञातान करना ऄपेजित हगगा।
29. कममचाठरय द्वारा की जाने ृाली घगर्णा.― प्रत्येक कममचारी जजस पर ये जृजनयम लागू हगते हैं, जनम्नजलजखत घगर्णा
करे गा, नामतः:-
“मैं एतदद्वारा घगर्णा करता/करती हाँ दक मैंने कममचारी राज्य बीमा जनगम (कममचाठरृनंद एृं सेृा की िते) जृजनयम,
2023 कग प़ाा और समझा ह तथा मैं एतदद्वारा ईतिय जृजनयम द्वारा बद्ध हगने के जलए हस्ट्तािर करता/करती और सहमत
हगता/हगती हाँ।

30. अदेि , सूचना, अदद का तामील हगना.― आन जृजनयम के ऄंतगमत संबंजधत कममचारी पर ददया गया या जारी दकया
गया प्रत्येक अदेि, सूचना और ऄ्‍य अदेजिका ईसे व्यजतियगत रूप से तामील की जाएगी या ईसे पंजीकन त डाक या स्ट्पीड
पगस्ट्ट या अजधकाठरक आले्‍रॉजनक संचार द्वारा सूजचत दकया जाएगा।
31. समय-सीमा में छू ट देने और जृलंब कग माफ करने की िजतिय.― आन जृजनयम में ऄजभव्यतिय रूप में ऄ्‍यथा ईपबंजधत
के जसृाय, आन जृजनयम के ऄंतगमत कगइ अदेि देने का सिम प्राजधकारी ईपयकतिय और पयामि कारण से, आन जृजनयम के
ऄंतगमत दकए जाने हेतक ऄपेजित दकसी बात के जलए आन जृजनयम में जृजनर्ददष्ट समय कग जृस्ट्ताठरत या दकसी जृलंब कग
माफ कर सके गा।
32. िंकाओं का जनृारण.― आन जृजनयम के दकसी ईपबंध के जनृमचन के कारण यदद कगइ िंका ईत्पन्न हगती ह तग, ृह
मामला महाजनदेिक या ऐसे ऄ्‍य प्राजधकारी, जसा महाजनदेिक द्वारा साधारण या जृिेर् अदेि द्वारा जृजनर्ददष्ट दकया
जाए, कग संदर्नभत दकया जाएगा तथा महाजनदेिक या ऐसा प्राजधकारी ईसे जृजनश्चत करे गा।

EMPLOYEES’ STATE INSURANCE CORPORATION

NOTIFICATION
New Delhi, the 12th June, 2023.
No. Z-24/14/1/2020-DPC (E.I).–– In exercise of the powers conferred by sub-section (1) of section 97 read
with clause (xxi) of sub-section (2) and sub-section (2A) of that section and sub-section (2) of section 17 of the
Employees‘ State Insurance Act, 1948 (34 of 1948), and in supersession of the Employees‘ State Insurance
Corporation (Staff and Conditions of Service) Regulations, 1959, except as respects things done or omitted to be done
before such supersession, the Employees‘ State Insurance Corporation, hereby makes the following regulations,
namely:-
1. Short title and commencement. –– (1) These regulations may be called the Employees‘ State Insurance
Corporation (Staff and Conditions of Service) Regulations, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.–– (1) In these regulations, unless the context otherwise requires,––
(a) ―Act‖ means the Employees' State Insurance Act, 1948 (34 of 1948);
(b) ―Chairman, Corporation‖ means the Chairman of the Employees‘ State Insurance Corporation appointed under
clause (a) of section 4 of the Act read with sub-rule (2) of rule 2 of the Employees‘ State Insurance (Central) Rules,
1950;
(c) ―Chairman, Standing Committee‖ means Chairman appointed under clause (a) of section 8 of the Act read with
sub-rule (2) of rule 2 of the Employees‘ State Insurance (Central) Rules, 1950;
(d) ―Corporation‖ means the Employees' State Insurance Corporation established under the Act;
(e) ―Director General‖ means the Director General of the Corporation;
(f) ―Employee‖ means a person appointed to or borne on the cadre of the staff of the Corporation;
(g) ―month‖ means a calendar month;
(h) ―post‖ means a post under the Corporation, specified in column (2) of the First Schedule annexed to these
regulations, the conditions of service of which, except the method of recruitment, shall be such as specified in these
regulations;
(i) ―Schedule‖ means a Schedule annexed to these regulations;
(j) ―service‖ means service under the Corporation;
(k) ―Standing Committee‖ means the Standing Committee of the Corporation as constituted under section 8 of the
Act.
(2) Words and expressions used herein, but not defined, shall have the respective meaning assigned to them in the
Act or the relevant rules applicable to the officers and employees of the Central Government drawing corresponding
scale of pay.
3. Application.–– (1)These regulations shall apply to every regular employee of the Corporation in respect of the
posts specified in the First Schedule.
(2) In the case of persons appointed by the Corporation on deputation basis from the lending authorities, namely, the
Central Government or State Government or Union territory Administration or local bodies or autonomous bodies
including Universities, the terms and conditions of appointment shall be governed as settled by the respective
appointing authority as specified in the Second Schedule, in consultation with the lending authority.
(3) These regulations shall not be applicable to the persons appointed on contract or tenure basis.
4. Appointing authority.–– The appointing authority in respect of the posts specified in the First Schedule, shall be as
specified in column (4) of the Second Schedule:
Provided that the Chairman, Corporation may, by general or special order, delegate to any other authority or
officer of the Corporation, the power to make appointments to any post or class of posts specified in the First
Schedule.
5. Probation.–– (1) Every employee appointed to a post by direct recruitment or re-employment before the age of
superannuation shall be on probation.
(2) The period of probation and other conditions of service relating thereto in respect of the employees appointed on
direct recruitment or promotion or re-employment before the age of superannuation shall be as applicable to the
officers and employees of the Central Government drawing corresponding scales of pay.
6. Resignation, termination, etc.–– (1) Notwithstanding anything contained in these regulations, a permanent
employee shall not leave or discontinue his service without giving three months‘ notice, in writing of his intention to
do so, to the appointing authority and subject to the acceptance of the same by the appointing authority.
(2) Notwithstanding anything contained in these regulations, a temporary employee shall not leave or discontinue his
service without giving one month‘s notice, in writing of his intention to do so, to the appointing authority.
(3) The rules or instructions, as may be applicable to the officers and employees of the Central Government drawing
the corresponding scales of pay in respect of resignation or termination, shall be applicable to the employees of the
Corporation referred to in sub-regulations (1) and (2).
(4) The services of a temporary employee may be terminated without assigning any reason therefor, at any time, after
giving him one month‘s notice by the appointing authority:
Provided that the services of any such employee may be terminated forthwith and on such termination the
employee shall be entitled to claim a sum equivalent to the amount of his pay and allowances for the period of notice
at the same rates at which he was drawing them immediately before the termination of his service, or as the case may
be, for the period by which such notice falls short of one month.
7. Pay, leave, provident fund, retirement age and allowances .–– (1) The scales of pay attached to the posts under
the Corporation shall be as specified in the First Schedule.
(2) The Central Civil Services (Leave) Rules, 1972, as may be applicable to the officers and employees of the Central
Government, shall mutatis mutandis be applicable to the employees of the Corporation drawing corresponding scales
of pay.
(3) The General Provident Fund (Central Services) Rules, 1960, as may be applicable to the officers and employees of
the Central Government, shall mutatis mutandis be applicable to the employees of the Corporation drawing
corresponding scales of pay.
(4) The age of retirement for the employees of the Corporation shall be such as may be prescribed by the Central
Government in respect of the officers and employees of the Central Government drawing corresponding scales of pay
in accordance with Rule 56 of the Fundamental Rules.
(5) The employees of the Corporation shall be entitled to such allowances including travelling allowance and
concessions, as may be admissible from time to time to the officers and employees of the Central Government
drawing corresponding scales of pay.
8. Pensionary benefits.–– (1) All regular employees of the Corporation who entered service on or before the 31 st
December, 2003, other than the Principal Officers appointed under section 16 of the Act, shall be entitled to the
benefits of pension, commutation of pension, family pension, death-cum-retirement gratuity and service gratuity as are
applicable to the officers and employees of Central Government under the Central Civil Services (Pension) Rules,
2021:
Provided that in the matter of the pensioners of the Employees‘ State Insurance Corporation, the consultation
with Union Public Service Commission, as provided under proviso to rule 8 of the Central Civil Services (Pension)
Rules, 2021 before passing of final orders, shall not be applicable.
(2) The Central Civil Services (Implementation of National Pension System) Rules, 2021 and the Central Civil
Services (Payment of Gratuity under National Pension System) Rules, 2021 shall be applicable in the case of regular
employees of the Corporation who have entered service on or after the 1 st January, 2004:
Provided that in the matter of such retired employees of the Employees‘ State Insurance Corporation, the
consultation with Union Public Service Commission, as provided under proviso to rule 5 of Central Civil Services
(Payment of Gratuity under National Pension System) Rules, 2021 before passing of final orders, shall not be
applicable.
(3) An employee, who sustains an injury, or dies as a result of an injury, or dies in the course of and as a consequence
of the performance of his duty, may be awarded an extraordinary pension on the same scale and subject to the same
conditions as laid down in the Central Civil Services (Extraordinary Pension) Rules, 1939 of the Central Government,
as in force on the date of the publication of these regulations, and also subject to such modification as may be adopted
by the Corporation with the approval of the Central Government.
(4) In the case of employees of the Corporation, the powers and functions of the authorities as prescribed in Central
Civil Services (Pension) Rules, 2021 shall be exercised by the officers or authorities of the Corporation, for the
purposes of this regulation, as per written orders issued from time to time by the Director General with the approval of
the Chairman, Corporation.
9. Control and discipline.–– (1) All employees of the Corporation shall be subject to the general superintendence and
control of the Chairman, Corporation.
(2) Without prejudice to the provisions of these regulations, the conduct and discipline in respect of all employees of
the Corporation, except Director General, Financial Commissioner and Chief Vigilance Officer, shall be governed by
the Central Civil Services (Conduct) Rules, 1964, as may be applicable to the officers and employees of the Central
Government, or as the Chairman, Corporation may, from time to time, by general or special order, specify.
(3) The appointing authority, disciplinary authority and appellate authority for each post in the Corporation shall be
such as may be specified in the Second Schedule, and the powers related to conduct, discipline and control of the
employees of the Corporation shall be exercised as specified in the said Schedule.
10. Suspension.–– (1) The appointing authority, or any authority to which the appointing authority is subordinate, or
the disciplinary authority, or any other authority empowered in that behalf by the Director General, may, by general or
special order, place an employee of the Corporation under suspension ––
(a) where a disciplinary proceeding against him is contemplated or is pending; or
(b) where, in the opinion of the said authority, he has engaged himself in activities prejudicial to the interests of the
Corporation or the security of the State; or
(c) where a case against him in respect of any criminal offence is under investigation, inquiry or trial:
Provided that where the order of suspension is made by an authority lower in rank than the appointing
authority, such authority shall forthwith report to the appointing authority, the circumstances in which the order was
made.
(2) An employee of the Corporation shall be deemed to have been placed under suspension by an order of the
appointing authority––
(a) with effect from the date of his detention, if he is detained in custody, whether on a criminal charge or otherwise,
for a period exceeding forty-eight hours;
(b) with effect from the date of his conviction, if, in the event of a conviction for an offence, he is sentenced to a term
of imprisonment exceeding forty-eight hours and is not forthwith dismissed or removed or compulsorily retired
consequent to such conviction.
Explanation.–– The period of forty-eight hours referred to in clause (b) of this sub-regulation shall be computed from
the commencement of the imprisonment after the conviction and for this purpose, intermittent periods of
imprisonment, if any, shall be taken into account.
(3) Where a penalty of dismissal, removal or compulsory retirement from service imposed upon an employee under
suspension is set aside in appeal or on review under these regulations and the case is remitted for further inquiry or
action or with any other directions, the order of his suspension shall be deemed to have continued in force, on and
from the date of the original order of dismissal, removal or compulsory retirement and shall remain in force until
further orders.
(4) Where a penalty of dismissal, removal or compulsory retirement from service imposed upon an employee is set
aside or declared or rendered void in consequence of or by a decision of a court of law and the disciplinary authority,
on a consideration of the circumstances of the case, decides to hold a further inquiry against him on the allegations on
which the penalty of dismissal, removal or compulsory retirement was originally imposed, the employee shall be
deemed to have been placed under suspension by the appointing authority from the date of the original order of
dismissal, removal or compulsory retirement and shall continue to remain under suspension until further orders:
Provided that no such further inquiry shall be ordered unless it is intended to meet a situation where the Court
has passed an order purely on technical grounds without going into the merits of the case.
(5)(a) Subject to the provisions contained in sub-regulation (7), any order of suspension made or deemed to have been
made under this regulation shall continue to remain in force until it is modified or revoked by the authority competent
to do so.
(b) Where an employee is suspended or deemed to have been suspended (whether in connection with any disciplinary
proceeding or otherwise), and any other disciplinary proceeding is commenced against him during the continuance of
that suspension, the authority competent to place him under suspension may, for reasons to be recorded by him in
writing, direct that the employee shall continue to be under suspension until the termination of all or any of such
proceedings.
(c) An order of suspension made or deemed to have been made under this regulation may at any time be modified or
revoked by the authority which made or is deemed to have made the order or by any authority to which that authority
is subordinate.
(6) (a) An order of suspension made or deemed to have been made under this regulation shall be reviewed by the
authority which is competent to modify or revoke the suspension, before expiry of ninety days from the effective date
of suspension, on the recommendation of the Review Committee constituted for the purpose and pass orders either
extending or revoking the suspension.
(b) Subsequent reviews shall be made before expiry of the extended period of suspension and the extension of
suspension shall not be for a period exceeding one hundred and eighty days at a time.
(7) An order of suspension made or deemed to have been made under sub-regulation (1) or (2) shall not be valid after
a period of ninety days unless it is extended after review, for a further period before the expiry of ninety days:
Provided that no such review of suspension shall be necessary in the case of deemed suspension under sub-
regulation (2), if an employee continues to be under detention and in such case the period of ninety days shall be
computed from the date the employee detained in custody is released from detention or the date on which the fact of
his release from detention is intimated to his appointing authority, whichever is later:
Provided further that in a case where no charge-sheet is issued under these regulations, the total period under
suspension or deemed suspension, as the case may be, including any extended period in terms of sub-regulation (6)
shall not exceed––
(a) two hundred and seventy days from the date of order of suspension, if the employee is placed under
suspension in terms of clause (a) of sub-regulation (1); or
(b) two years from the date of order of suspension, if the employee is placed under suspension in terms of clause
(b) or clause (c) of sub-regulation (1), as the case may be; or
(c) two years from the date the employee detained in custody is released or the date on which the fact of his
release from detention is intimated to his appointing authority, whichever is later, in the case of deemed
suspension under sub-regulation (2).
11. Penalties.–– The following penalties may, for good and sufficient reason and as hereinafter provided, be imposed
on an employee of the Corporation, namely:-
Minor penalties:
(i) censure;
(ii) withholding of his promotion;
(iii) recovery from his pay of the whole or part of any pecuniary loss caused by him to the Corporation by
negligence or breach of orders;
(iv) reduction to a lower stage in the time-scale of pay by one stage for a period not exceeding three years,
without cumulative effect and not adversely affecting his pension;
(v) withholding of increments of pay.
Major penalties:
(vi) save as provided for in clause (iv), reduction to a lower stage in the time-scale of pay for a specified period,
with further directions as to whether or not the employee will earn increments of pay during the period of such
reduction and whether on the expiry of such period, the reduction will or will not have the effect of postponing
the future increments of his pay;
(vii) reduction to lower time-scale of pay, grade, post or service for a period to be specified in the order of penalty,
which shall be a bar to the promotion of the employee during such specified period to the time-scale of pay, grade,
post or service from which he was reduced, with direction as to whether or not, on promotion on the expiry of the
said specified period –
(a) the period of reduction to time-scale of pay, grade, post or service shall operate to postpone future
increments of his pay, and if so, to what extent; and
(b) an employee shall regain his original seniority in the higher time scale of pay, grade, post or service;
(viii) compulsory retirement;
(ix) removal from service which shall not be a disqualification for future employment under the Corporation;
(x) dismissal from service which shall ordinarily be a disqualification for future employment under the
Corporation:
Provided that, in every case in which the charge of possession of assets disproportionate to known-sources of
income or the charge of acceptance from any person of any gratification, other than legal remuneration, as a motive or
reward for doing or forbearing to do any official act is established, the penalty mentioned in clause (ix) or clause (x)
shall be imposed:
Provided further that in any exceptional case and for special reasons recorded in writing, any other penalty
may be imposed.
Explanation.— The following shall not amount to a penalty within the meaning of this regulation, namely:—
(i) withholding of increments of pay of an employee for his failure to pass any departmental examination in
accordance with the regulations or orders governing the post which he holds or the terms of his appointment;
(ii) non-promotion of an employee, whether in a substantive or officiating capacity, after consideration of his case,
by a duly constituted departmental promotion committee to a grade or post for promotion to which he is eligible;
(iii) reversion of an employee officiating in a higher grade or post to a lower grade or post, on the ground that he is
considered by a duly constituted departmental promotion committee to be unsuitable for such higher grade or post or
on any administrative ground unconnected with his conduct;
(iv) reversion of an employee, appointed on probation to any other grade or post, to his permanent grade or post
during or at the end of the period of probation in accordance with the terms of his appointment or the regulations and
orders governing such probation;
(v) replacement of the services of an employee, whose services had been borrowed from the Central Government or
State Government or any authority under the control of the Central Government or State Government, at the disposal
of the Central Government or State Government or the authority from which the services of such an employee had
been borrowed;
(vi) compulsory retirement of an employee in accordance with the provisions relating to his superannuation or
retirement;
(vii) termination of the services—
(a) of an employee appointed on probation, during or at the end of the period of his probation, in accordance
with the terms of his appointment or the regulations and orders governing such probation; or
(b) of a temporary employee in accordance with the provisions of regulation 6; or
(c) of an employee, employed under an agreement, in accordance with the terms of such agreement;
(viii) any compensation awarded on the recommendation of the Complaints Committee established in the
Corporation for inquiring into any complaint of sexual harassment within the meaning of rule 3-C of the Central
Civil Services (Conduct) Rules, 1964.
12. Disciplinary authority and the authority to institute disciplinary proceedings. –– (1) The disciplinary
authorities in respect of posts under the Corporation are as specified in the Second Schedule.
(2) A disciplinary authority, competent under these regulations to impose any of the penalties specified in clauses (i)
to (v) of regulation 11, may institute disciplinary proceedings against any employee for the imposition of any of the
penalties specified in clauses (vi) to (x) of the said regulation, notwithstanding that such disciplinary authority is not
competent under these regulations to impose any of the penalties specified in clauses (vi) to (x).
Explanation.––Where an employee holding a post in any scale of pay is promoted, whether on probation or
temporarily to the post of the next higher scale, he shall be deemed for the purpose of this regulation to hold the post
of such higher scale.
13. Procedure for imposing penalties.–– (1) The procedure for imposing penalties shall be the same as provided for
under the relevant provisions of the Central Civil Services (Classification, Control and Appeal) Rules, 1965.
(2) Where the procedure referred to in sub-regulation (1) provides for appointment of serving or retired Central
Government employees for any purpose, such as, Inquiry Officer or Presenting Officer or Defence Assistant, then the
serving or retired employees of the Corporation shall also be considered for the same.
(3) The competent authorities for the purpose of imposing penalties in respect of the posts in the Corporation shall be
as specified in the Second Schedule:
Provided that consultation with Union Public Service Commission as provided under the relevant provisions
of the Central Civil Services (Classification, Control and Appeal) Rules, 1965, shall not be applicable in the case of
employees of the Corporation.
14. Provisions regarding Officials on deputation to Central Government, State Government, etc.––
(1) Where the services of an employee are lent by the Corporation to the Central Government, State Government or
any other authority (hereafter in this regulation referred to as the borrowing authority), the borrowing authority shall
have the powers of the appointing authority for the purpose of placing such an employee under suspension, and of the
disciplinary authority for the purpose of conducting a disciplinary proceeding against him:
Provided that the borrowing authority shall forthwith inform the Corporation (hereafter in this regulation
referred to as the lending authority) of the circumstances leading to the order of suspension of such employee or the
commencement of the disciplinary proceeding, as the case may be.
(2) In the light of the findings in the disciplinary proceedings conducted against the employee –
(i) if the borrowing authority is of the opinion that any of the penalties specified in clauses (i) to (v) of
regulation 11 should be imposed on the employee, it may, after consultation with the lending authority, make
such orders in the case as it deems necessary:
Provided that in the event of a difference of opinion between the borrowing authority and the
lending authority, the services of the employee shall be replaced at the disposal of the lending authority;
(ii) if the borrowing authority is of the opinion that any of the penalties specified in clauses (vi) to (x) of
regulation 11 should be imposed on the employee, it shall place his services at the disposal of the lending
authority and forward to the lending authority, the proceedings of the inquiry and thereupon, the lending
authority may, if it is the disciplinary authority, pass such order thereon as it may deem necessary, or if it is
not the disciplinary authority, submit the case to the disciplinary authority which shall pass such orders in the
case as it may deem necessary:
Provided that before passing any such order the disciplinary authority shall comply with the
provisions of regulation 13.
Explanation.–– The disciplinary authority may make an order under this clause on the record of the inquiry forwarded
to it by the borrowing authority, or after holding such further inquiry as it may deem necessary, as far as may be, in
accordance with the provisions of regulation 13.
15. Provisions regarding officials on deputation to Corporation.–– (1) Where an order of suspension is made or a
disciplinary proceeding is conducted against an employee of the Corporation (hereafter in this regulation referred to as
borrowing authority) whose services have been borrowed from the Central Government or a State Government or
local authority, the authority lending his service (hereafter in this regulation referred to as the lending authority) shall
forthwith be informed of the circumstances leading to the order of suspension of the employee or of the
commencement of the disciplinary proceeding, as the case may be.
(2) In the light of the findings in the disciplinary proceeding conducted against the employee, if the disciplinary
authority is of the opinion that any of the penalties specified in clauses (i) to (v) of regulation 11 be imposed on him,
the disciplinary authority may, subject to the provisions of regulation 13, after consultation with the lending authority,
pass such orders on the case as it may deem necessary.
(3) In the event of a difference of opinion between the borrowing authority and the lending authority, the services of
the employee shall be placed at the disposal of the lending authority.
(4) If the disciplinary authority is of the opinion that any of the penalties specified in clauses (vi) to (x) of regulation
11 be imposed on the employee, it shall place the services of such employee at the disposal of the lending authority,
forwarding to it, the proceedings of the inquiry for such action as it may deem necessary.
16. Appeals.–– Notwithstanding anything contained in these regulations, no appeal shall lie against––
(i) any order made by the Central Government;
(ii) any order of an interlocutory nature or of the nature of a step-in-aid or the final disposal of a disciplinary
proceeding, other than an order of suspension;
(iii) any order passed by an inquiring authority in the course of an inquiry conducted under regulation 13.
17. Orders against which appeal lies.–– Subject to the provisions of regulation 16, an employee of the Corporation,
may prefer an appeal against all or any of the following orders, namely :-
(i) an order of suspension made or deemed to have been made under regulation 10;
(ii) an order imposing any of the penalties specified in regulation 11, whether made by the
disciplinary authority or by any appellate or reviewing authority;
(iii) an order enhancing any penalty imposed under regulation 11;
(iv) an order which -
(a) denies or varies to his disadvantage, his pay, allowances, pension or other conditions of service
as regulated by these regulations or by agreement; or
(b) interprets to his disadvantage the provisions of any such regulation or agreement;
(v) an order –
(a) reverting him while officiating in a higher grade or post to a lower grade or post, otherwise than
as a penalty;
(b) reducing or withholding the pension or denying the maximum pension admissible to him under
these regulations;
(c) determining the subsistence and other allowances to be paid to him for the period of suspension
or for the period during which he is deemed to be under suspension or for any portion thereof;
(d) determining his pay and allowances –
(i) for the period of suspension; or
(ii) for the period from the date of his dismissal, removal or compulsory retirement from
service or from the date of his reduction to a lower grade, post, time-scale or stage in a time
scale of pay, to the date of his reinstatement or restoration to his grade or post; or
(e) determining whether or not the period from the date of his suspension or from the date of
dismissal, removal, compulsory retirement or reduction to a lower grade, post, time-scale of pay or
stage in a time scale of pay to the date of his reinstatement or restoration to his grade or post shall be
treated as a period spent on duty for any purpose.
Explanation.–– In this regulation, the expression ––
(i) ―employee of the Corporation‖ includes a person who has ceased to be in the service of the Corporation;
(ii) ―pension‖ includes additional pension, gratuity and any other retirement benefit.
18. Appellate authorities.–– An employee of the Corporation, including a person who has ceased to be in the service
of the Corporation, may prefer an appeal against all or any of the orders specified in regulation 17 to the authority
specified in this behalf either in the Second Schedule; or by a general or special order of the Chairman, Corporation;
or where no such authority is specified ––
(a) to the appointing authority, where the order appealed against is made by an authority subordinate to it; or
(b) to the Central Government, where such order is made by the Chairman, Corporation.
19. Submission and consideration of appeals.–– An appeal under regulation 17 shall be submitted and shall be
entertained and considered by the appellate authorities specified in regulation 18 in such form and manner, and in
accordance with the procedure specified in the Central Civil Services (Classification, Control and Appeal) Rules,
1965.
20. Implementation of orders in appeals.–– The authority which made the order appealed against shall give effect to
the orders passed by the appellate authority.
21. Revision.–– (1) Notwithstanding anything contained in these regulations, ––
(i) the Central Government; or
(ii) the Chairman, Corporation; or
(iii) the Director General; or
(iv) an appellate authority, as specified in the Second Schedule, within six months of the date of the order
proposed to be revised; or
(v) any other authority specified in this behalf by the Chairman, Corporation by a general or special order,
and within such time as may be specified in such general or special order, may at any time, either on his or its
own motion or otherwise, call for the records of any inquiry and revise any order made under these
regulations, but from which no appeal has been preferred or from which no appeal is allowed, and may-
(a) confirm, modify or set aside the order; or
(b) confirm, reduce, enhance or set aside the penalty imposed by the order, or impose any penalty,
where no penalty has been imposed; or
(c) remit the case to the authority which made the order to or any other authority directing such
authority to make such further enquiry as it may consider proper in the circumstances of the case; or
(d) pass such other orders as it may deem fit:
Provided that no order imposing or enhancing any penalty shall be made by any revising authority unless the
employee of the Corporation has been given a reasonable opportunity of making a representation against the penalty
proposed, and where it is proposed to impose any of the penalties specified in clauses (vi) to (x) of regulation 11 or to
enhance the penalty imposed by the order sought to be revised to any of the penalties specified in clauses (vi) to (x) of
the said regulation; and if an inquiry under regulation 13 has not already been held in the case, no such penalty shall
be imposed except after an inquiry in the manner laid down in regulation 13:
Provided further that no power of revision shall be exercised by the authorities specified in clauses (i) to (v),
unless––
(a) the authority which made the order in appeal; or
(b) the authority to which an appeal would lie, where no appeal has been preferred,
is subordinate to him.
(2) No proceeding for revision shall be commenced until after––
(a) the expiry of the period of limitation for an appeal; or
(b) the disposal of the appeal, where any such appeal has been preferred.
(3) An application for revision shall be dealt with in the same manner as if it were an appeal under these regulations.
22. Review.–– The Central Government, may, at any time, either on its own motion or otherwise review any order
passed under these regulations, when any new material or evidence which could not be produced or was not available
at the time of passing the order under review and which has the effect of changing the nature of the case, has come, or
has been brought, to his notice:
Provided that no order imposing or enhancing any penalty shall be made by the Central Government unless
the employee concerned has been given a reasonable opportunity of making a representation against the penalty
proposed or where it is proposed to impose any of the major penalties specified in regulation 11 or to enhance the
minor penalty imposed by the order sought to be reviewed to any of the major penalties, and if an inquiry under
regulation 13 has not already been held in the case, no such penalty shall be imposed except after inquiring in the
manner laid down in regulation 13.
23. Conduct of employees.–– The employees of the Corporation shall be governed mutatis mutandis by the conduct
rules applicable from time to time to the officers and employees of the Central Government drawing corresponding
scales of pay.
24. Other conditions of service. –– In respect of all other matters relating to the conditions of service of employees,
for which no provision or insufficient provision has been made in these regulations, the rules applicable from time to
time to the officers and employees of the Central Government drawing corresponding scales of pay shall apply:
Provided that where the Corporation is of the opinion that it is necessary to make departure from the rules or
orders of the Central Government in respect of any matter under this regulation, it shall obtain prior approval of the
Central Government.
25. Competent authority for application of Central Government rules.–– For the purpose of application of the
corresponding Central Government rules to the employees of the Corporation under these regulations, the Chairman,
Corporation shall be the competent authority to exercise all the powers and functions which are vested in the President
or Local Government or Ministries or Departments of the Government of India, under the various Central Government
rules.
26. Authority to authenticate order of the Chairman, Corporation.–– The orders passed by Chairman,
Corporation (including orders passed in disciplinary matters) shall be authenticated by an officer equivalent to the
rank of Additional Commissioner or Insurance Commissioner or Medical Commissioner, or above.
27. Relaxation in exceptional cases.–– Where the Director General is satisfied that the operation of any regulation or
provision in the matter of conditions of service of an employee causes undue hardship in any particular case, he may,
with the prior approval of the Chairman, Corporation, by order, dispense with or relax the requirements of that
regulation or provision to such extent, and subject to such conditions as may be considered necessary for dealing with
the case, in a just and equitable manner:
Provided that any such deviation or relaxation shall not exceed the extant provisions of the Central
Government rules or instructions applicable to the officers and employees of the Central Government drawing
corresponding scales of pay.
28. Oath of allegiance to the Constitution of India.–– Every employee shall be required to take an oath or solemnly
affirm his allegiance to the Constitution of India, as by law established, at the time of his appointment to the service of
the Corporation.
29. Declaration to be made by employees.–– Every employee, to whom these regulations apply, shall make the
following declaration, namely: ––
―I hereby declare that I have read and understood the Employees‘ State Insurance Corporation (Staff and Conditions
of Service) Regulations, 2023, and I hereby subscribe and agree to be bound by the said regulations.

30. Service of orders, notice, etc.–– Every order, notice and other process made or issued under these regulations,
shall be served in person on the employee concerned or communicated to him by registered post or speed post or
official electronic communication.
31. Power to relax time-limit and to condone delay.–– Save as otherwise expressly provided in these regulations,
the authority competent under these regulations to make any order may, for good and sufficient reasons, extend the
time specified in these regulations for anything required to be done thereunder, or condone any delay.
32. Removal of doubts.–– If any doubt arises as to the interpretation of any of the provisions of these regulations, the
matter shall be referred to the Director General or such other authority, as may be specified by the Director General,
by a general or special order, and the Director General or such authority shall decide the same.
