1). Street, Drain and Building Act SDBA 1974 [Act 133] and UBBL 1984
➢ This Act aims to provide a uniform system in Local Authority areas of Malaysia
and sets out rules to regulate the activities relating to street, drainage and
building in those areas
2). Construction Industry Development Board CIDB 1994 [Act 520]
➢ CIDB was established to regulate, develop and facilitate the construction industry
towards achieving global competitiveness.
3). Statutory Board
➢ The Board of Engineers Malaysia (BEM) is a statutory authority founded in 1972
representing the engineering profession in Malaysia.
➢ The Board of Architects Malaysia (BAM) is a statutory authority responsible for

COURSE OBJECTIVES
This course will enable Construction Site Supervisor (CSS);
1. To impart the basic knowledge as Effective CSS based on SDBA 1974 [Act 133],
CIDB 1994 [Act 520] and REA 1967 [Act 138]
2. To get sufficient training as BEM Inspector of Work (IOW) Intern;
➢ Work as subordinate with Accredited IOW and Qualified Person (P. Eng.)
➢ Attend BEM CPD courses and Record yearly CPD point @ myBEM Online
➢ Submission form must be endorsed by BEM Qualified Person (P. Eng. / PEPC)
with sufficient work experience (Diploma @ 2 year and Degree @ 1 year)

Construction Site Supervisor (CSS) is limited to;
1. CSS specific tasks of Preparation, Supervision, Control and Record of QMS
(Quality Manual, Document and Record) and QAS Assessment, with;

➢ Monitor all construction activities and prepare related document
➢ Preparing Sample for Inspection Test Plan (ITP)

2. Attending QAQC activities and inspection with the Inspector of Work (IOW)

SCOPE OF SDBA 1974 [Act 133] and REA 1967 [Act 138]
The Related by Laws is limited to;
1. SDBA 1974 [Act 133] and UBBL 1984 / Part II / By-Laws 5, said,
“ Where under these By-laws any plan, drawing or calculation in relation to any
building is required to be submitted by qualified person, no erection or
continued erection of that building shall take place unless that qualified person
or any person duly authorised by him undertakes the supervision of the
erection and the setting out, where applicable, of that building “.
2. REA 1967 [Act 138 / Sec 7(2) (ab)] said,

“ An Inspector of Works who is registered with the Board may, subject to
section 8, take up employment which requires him to assist the
Professional Engineer in the supervision of engineering works ”

CIDB Sijil Kecekapan Kemahiran Pembinaan (SKKP) is limited to;
1. The eligibility requirements for the application and accreditation program for a
Construction Site Supervisor (CSS) are as follows;
➢ Academic Qualification
➢ Years of Experience in related construction field
➢ Fulfil the eligibility requirements for application and accreditation
2. CSS Mode and Assessment processes are as follows;
➢ Undergoing course and sitting for written assessment for each study package
➢ Sitting for written assessment

3. Successful candidates having passed through any mode will be accredited with a

HOW TO REGISTER AS CIDB CSS AND BEM / BAM IOW
Registration as CIDB Construction Site Supervisor (CSS) Level 4;
1. CSS Accreditation Program is made up of five (5) components ;
a. Knowledge and Competent - Site Supervisor who is knowledgeable, competent to facilitate and fulfil
his supervisory works efficiently in meeting the cost, time and quality expected from the project.
b. Safety and Quality – Site Supervisor who upholds the importance of safety culture in the workplace
and ensuring quality deliverables from his services.
c. Effective and Teamwork – Site Supervisor who is able to work independently yet effectively in multi-
disciplinary team for construction industry excellence.
d. Reliable and Communication – Site Supervisor who is reliable, helpful and able to communicate
effectively and contribute his skills for efficient project management.
e. Ethical and Environmental - Site Supervisor who applies the ethical responsibility towards society,
environment and embrace the importance of sustainable development in his profession.

Registration as Board of Engineers Malaysia (BEM) IOW;
2. It is mandatory for university diploma in engineering graduate to register as
Inspector of Works with BEM if he/she wants to take up employment as an
Inspector of Works (IOW);
a. This is in accordance with section 7(2)(ab) which specified that “an Inspector of Works who is
registered with the Board may, subject to section 8, take up employment which requires him to assist
the Professional Engineer in the supervision of engineering works”
b. An Inspector of Works is a person registered under the Registration of Engineers (Amendment 2015)
REA 1967 [Act 138 / Rev 2015 / Sec 10E].
c. Existing Inspector of Works may register with the Board by completing BEM Declaration Form. The
BEM Declaration Form need to be endorsed by a Professional Engineer (PE) of the Engineering
Consultancy Practices or the employer.

3. In accordance with the Architects Act 1967 section 27M & 27N, any person
may apply registration by holds qualification recognize by the Board to be
registered as an Inspector of Works;
a. For any person whom has meet BAM qualification required, The prescribed practical experience is for
a minimum period of two (2) years (104 weeks) which must be obtained prior to the registration as an
Inspector of Works with the Board of Architects Malaysia.
b. For Existing Clerk of Works, the prescribed practical experience is for a minimum period of five (5)
years (260 weeks) which must be obtained prior to the registration as an Inspector of works with the
Board of Architects Malaysia.
c. The Practical Experience Log Book, is to record the practical experience which have been acquired by
the applicant as evidence of meeting the appropriate requirement covering the full scope of basic
Scope of IOW Responsibilities. The Log Book and/or any other evidence, will be examined by the

CIDB 1994 [Act 520 / Rev 2011 / Sect 33A];
1. Compliance to the requirement of Act 520 as stipulated by Part VII, Section 33A (1)
2. Improved construction site work quality through supervision by a accredited and
competent Construction Site Supervisor
3. Ensuring the Construction Site Supervisor’s competency meets the National
Occupational Skills Standard developed by the industry
4. The accreditation of the Construction Site Supervisor in Malaysia for all
construction personnel/individuals who are involved directly or indirectly in
supervisory duties at construction sites, and who fulfil the eligibility requirements
5. The four (4) mainstream arenas for the Construction Site Supervisor are
Civil & Structure, Buildings & Architecture, Mechanical Works and Electrical Works

REA 1967 [Act 138 / Rev 2015 / Sect 10E & 24A];
1. Compliance by the Certificate of Registration issued to an Inspector of Works (IOW)
shall expire on the 31 December of the third year from the date the certificate of
registration is issued.
2. IOW must renew their IOW registration every 3 years upon payment of RM30.00
and shall submit documentation proof that they have satisfied such conditions as
determined by the Board.
3. The Board may refuse to renew the registration of an Inspector of Works if he/she
has failed to satisfy any conditions as determined by the Board.
4. Every registered IOW shall notify the Register of any change in business address
within three (3) months of the change as specified in Section 14 of REA.

Architect Act 1967 [Act 117 / Rev 2015 / Sect 27M & 27N];
1. Compliance by the Evaluation report shall reveal sound judgement in solving
practical problems and procedures followed by the applicant.
2. IOW shall submit the Report that will assist the Examiner in his assessment as to
whether the applicant is adequately exposed to Professional Practice and is to be
recommended for acceptance to the remainder of the IOW Examination
3. The Board may refuse to renew the registration of an Inspector of Works if he/she
has failed to satisfy any conditions as determined by the Board.
4. IOW who if found by the Disciplinary Committee to have contravened or failed to
comply with any of the provisions of this Act or any rules made thereunder will be
given written reprimand, max fine RM25000, suspension 2 years or cancellation
(Sect 27Q)

1). Certificate of Practical Completion (CPC)
➢ When the Architect is satisfy with all the physical works being completed in the building
with all the supporting documents from all relevant authority for the application of
Certificate of Fitness (CF) submitted by Contractor
➢ Contractor will be able to claim for the release of 1st half – the 2.5% of the 5% retention
sum from Developer
2). Certificate of Fitness for Occupation (CFO)

➢ Upon submission of Borang E, the Local Authority will have to reply within 14 days,
whether to accept or reject the application of CFO
3). Vacant Possession (VP)

➢ Approval Letter Issued by Local Authority for Certificate of Fitness for Occupation (CFO).
➢ The Developer can hand over key to Owner and thus start the countdown of Defect

➢ Principal Submitting Person (PSP) main tasks are to submitting plans to Local Authority for
KM Approval and Borang G comprise a 21-stage certification required for completion
throughout the project.
➢ Surat Sokongan from essential services (TNB, SAJ, IWK, R&D, Bomba) are required before
PSP can submit Borang F and notification of completion of building. With the new CCC
process, VP can be issued simultaneously at the point of CCC approval.
➢ Stage 6 : Deposit all CCC Document to OSC 3.0 Plus and LAM / BEM
i. Why : F/F1 Form Issuance by PSP
ii. When : Within 14 Days after F/F1 Form Issuance
iii. How : All Document (G Forms, Endorsement Letters and F/F1 Form)
iv. CCC Digital Certificate : Will be issued by BAM / BEM

DLP Warranty Claims;
5). Defect Liability Period (DLP)
➢ It is the only time the Developer can lay claim to any unfinished, defective and substandard
quality to be rectified by the Contractor at the contractor’s own expense
➢ Usually, subject to the contract, a material stock of between 10 per cent and 15 per cent is
to be acquired from the main contractor in respect to tiles, granite, marble, door locks and
handles, manual call point and paints.
➢ Under Housing Development Act (HAD) Malaysia, the DLP is 24 months, starting from the
date you receive your keys (VP). Within this period, the homeowner will need to check for
any damage, defects, as well as poor or faulty workmanship.

Defect Schedule CMGD and Final Claim;
6). Certificate of Making Good Defects (CMGD)
➢ At the end of the DLP, the Superintendent Officer (S.O.) will prepares a schedule of defects,
listing those defects that have not yet been rectified, and agrees with the contractor the
date (max within 3 month) by which they will be rectified and at the contractor's cost.
➢ When the S.O. considers that all items on the schedule of defects have been made good,
they issue the CMGD. This has the effect of releasing the remainder of any retention
(balance 2.5%) and brings about issuing of the final certificate.
➢ The Contractor must submit Final Claim with all supporting documents (within 3 month)
after received the CMGD from S.O. The S.O. with the process of calculating and agreeing
any adjustments to the contract sum, will prepare the Final Account and release the Final
Certificate to the Contractor
