ORDER:
The Superintendent of Police, Thanjavur in his letter second cited stated that
a complaint has been received by the Deputy Superintendent of Police, Pattukkottai
Sub division from Tmt. Dhanalakshmi wife of the deceased Rajasekar, by alleging
that on 22.06.2023, her husband and herself was picked by Sub Inspector of Police,
Tmt. Umasankari of K.K. Nagar Police Station and taken to Trichirappalli for enquiry
and there she harassed her and her husband along with K.K. Nagar Police and
requested fair enquiry and necessary legal action should be initiate against the Sub
Inspector of Police Tmt. Umasankari and others responsible for her husband’s
death.
Hence, to discern the prima facie about the alleged allegation about custodial
torture an enquiry u/s 151 of Police Standing Order is sinequanon.
The Sub Divisional Magistrate and Revenue Divisional Officer,
Pattukkottai is hereby ordered to conduct detailed enquiry u/s 151 of
Police Standing Order and submit his report within 21 days, whether there
had been Police excesses that led to the suicide of Thiru.Rajasekar.

It has come to my notice that one Rajasekar residing at Pallivasal Street,
Pattukkottai committed suicide on 25.06.2023 by jumped infront of the Ernakulam
Express between Adhirampattinam Railway station to Pattukkottai Railway station
and died on the spot itself.

The letter, F.I.R. and other relevant documents were perused and on perusal
it reveals that to discern the prima facie about the alleged allegation about
custodial torture which led to suicide an enquiry by the Judicial Magistrate u/s
176(1A) of Criminal Procedure Code is sinequanon. Hence, it is request you to
send the necessary requisition to the Principal District Judge in order to appoint
Judicial Magistrate for necessary enquiry as directed by the National Human Rights
Commission.
