LEARNING CONTRACT

ASSOCIAÇÃO 101010 Portugal, a social solidarity association, located at Rua Neves Ferreira nr. 13B,
1170-273 Lisbon, registered under tax identification number 515722812, in this act represented by Pedro Santa
Clara and Paulo Rodrigues da Silva, hereinafter referred to as the Training Entity and the I, hereinafter
referred to as the Trainee.

CONSIDERING:
1) That the Training Entity is a social solidarity association whose purpose is the educational and
technological development, vocational training, social inclusion, and skills development for the creation
of opportunities for the insertion of populations and territories into the social job market;
2) That, for the accomplishment of its social purpose, the Training Entity develops the project of School 42
in Portugal;
3) That the Trainee seeks to learn new content, update technological knowledge and develop skills to
enhance their employability;

The present Training Contract is hereby executed, which is governed by the following clauses, which the
parties accept and mutually undertake to enforce

CLAUSE 1 – Object
1. A Training Entity undertakes to provide the School 42 Program to the Trainee.
2. The training program is mostly carried out in a practical context, with part of it being carried out in a work
context, at a company designated as an employer entity.
3. This contract does not generate or establish any subordinate work relationships and expires upon
completion of the training for which it was entered into.

CLAUSE 2– Location, duration and schedule


1. The training program is provided by the Training Entity and takes place at its facilities or at other locations
indicated by it, including those of the employer entity.
2. The start date is the date selected by the Trainee from the possible dates offered by the Training Entity.
3. The initial phase of the training ("Piscine") lasts 4 weeks.

CLAUSE 3 - Duties of the Training Entity


1. The duties of the Training Entity are:
a) To ensure the scheduled training;
b) To provide the necessary and adequate support for the implementation of practical training in a work
context according to the training methodology;
c) To provide technical-pedagogical support to trainees during the period in which this training component
takes place, in accordance with the employer entity;
d) To register the Trainee in the personal accident policy;
e) To issue a Certificate of Qualifications and/or Diploma to the Trainee upon completion of the training;
f) To treat the Trainee's Personal Data in strict compliance with the GDPR.

CLAUSE 4 – Trainee’s Rights


1. The Trainee shall have the right to demand compliance with the duties set out in clause 3 of this contract
from the Training Entity.
2. The Trainee also has the right to receive training in conditions that comply with health, hygiene and safety
conditions required by the legislation in force and to benefit from the provisions of the Trainee Regulation in
force at the beginning of the training.

CLAUSE 5– Trainee’s Duties


1. The Trainee's duties are:
a) To attend training regularly in order to acquire the necessary knowledge;
b) To know and respect the rules and operating procedures of the training;
c) To complete the various pre-registration tasks required by the Training Entity correctly and honestly;
d) To use equipment and other assets entrusted to him/her for the purposes of training with care and to ensure
its good conservation;
e) To know and comply with the rules and procedures established in the Trainee Regulation in force at the
beginning of the training.

CLAUSE 6 - Attendance and Financing of the Training


1. Attendance is governed by the Trainee Regulation in force at the beginning of the training.
2. The financing of the training under this Contract is provided by the Training Entity through donations
from private entities, training grants, public funds, or other means of financing that the Training Entity
decides to use.

CLAUSE 7 - Subsequent Changes and Termination


1. If, for reasons beyond its control and not attributable to it, if the Training Entity cannot fully implement
the planned training program, it may undertake necessary adjustments, but must at all times previously
communicate it in writing to the Trainee.
2. This Contract may be terminated by unilateral termination by either party, upon written communication.

CLAUSE 8 - Applicable Legislation


This contract, in all matters not provided for herein, shall be governed by the provisions of Decree-Law No.
242/88, of July 7, and other complementary legislation.
