Manner of Commission: (Narrative)

That on August 12, 2022, a then 18 year old Maximo invited his then 15 year old
girlfriend, Tina, in their house at Panungyan Mendez, Cavite to celebrate their first year
anniversary as a couple. They met at plaza’s covered court and they went together to his
house. When Tina decided to go home, Maximo asked her to stay and sleep at his house
and Tina agreed. He told her that there’s only one available room so they will sleep
together, and there, Maximo said to his girlfriend that he wants Tina’s virginity as

anniversary gift and if she really love him she should give it to him. Tina consented
Maximo’s suggestion. Tina only got home the next day on August 13, 2022 in the
afternoon when her parents located her at Maximo’s house. She was forced to come with
her parents and they went to Mendez Police Station to file a complaint against Maximo
Enriquez and she undergone medico-legal examination and the result was there’s a
laceration in her genitalia indicating that she was being penetrated. Maximo was
apprehended and brought to Mendez Police Station.

Explain:

Circumstances drove him to perpetrate his crime. First, it was their

anniversary with his girlfriend. Second, there was no one at home aside from him and his
girlfriend during the time he committed the crime. And lastly, they shared only one room
where they did the act. Those circumstances favored Maximo to lure his girlfriend and get
what he wanted.

Due to Maximo’s insecurities towards his brother and grudge towards his parents, he sought
