LEAVE AND LICENSE AGREEMENT

THIS AGREEMENT is made on the _____day of ______ 20XX.

BETWEEN

1] Mr/Mrs/Miss______________, Age ____Years, residing at _____________, hereinafter


referred to as the “LICENSOR” (which expression unless repugnant to the context or
meaning thereof shall mean and include heirs, executors and administrator) of the ONE
PART.

AND

2] Mr/Mrs/Miss residing at: ___________________________

Hereinafter referred to as the “LICENSEE “(Which expression unless repugnant to the


context or meaning thereof shall mean and include its successor or successor and
assigns) of the SECOND PART.

WHEREAS the licensor is the owner of the house having:
Four - bed rooms
One - Living room
One – Kitchen with an attached store room
One- Dining room
Three - Bathroom

AND WHEREAS the Licensee has requested the licensor to grant the license of the said
premises on leave and license for a period of 11 (Eleven) months i.e. form 01.09.2017 to
31.07.2018 to which the Licensor has agreed.

NOW THIS AGREEMENT WITHNESSETH AS UNDER IT IS HEREBY AGREED BY


BOTH THE PARTIES:

1] The LICENSOR hereby grants to the LICENSEE and the LICENSEE hereby accepts from
the LICENSOR the License to use & occupy the said premises viz. H/No. Q/10 Anupam
Nagar, Behind TV Tower, Raipur, Chhattisgarh, 492006. The said Leave and license
Agreement shall commence on and from 01.09.2017.and shall be for the duration of 11
(Eleven) months from the said date. However, the license can be renewed with mutual
consent after the expiry of the LICENSE period (eleven months) on the increase of 5%
(five percent) of the License fee and all other conditions of the leave and license
agreement shall remain the same. Further, if either the LICENSOR or the LICENSEE
wants to terminate this license before the expiry of eleven months they shall give two
months’ notice to the other party.

2] That, the LICENSE FEE which is initially agreed upon to be Rs. 32000/- (rupees thirty two
thousand only) is to be enhanced by 5% after the expiry of eleven months.

3] The Licensee has agreed to pay and shall pay a sum of Rs. 32000.00 (Rupees Thirty
Two Thousand only) per month as License fee for the said premises on or before the 6st
day of each month in advance by cheque for the use and occupation of the said
premises which is exclusive of water & society charges. Also, the Electricity charges will
be paid by Licensee separately as per actual consumption.

3] The Licensee shall pay to the Licensor a sum of Rs. 32000.00 (Rupees thirty thousand
only) towards the security Deposit, free of interest, refundable after handing over the
peaceful and vacant possession of the licensed premises to the LICENSOR after
deduction of any fee due, or any fee towards any damages to the property, electricity,
maintenance, etc.

4] The Licensor has agreed to and the Licensee shall be entitled to permit one of the
Licensee’s employees with his family to use and occupy the said premises for office cum
residential purpose for the duration of the leave and License agreement with prior
intimation to the Licensor.

5] The LICENSEE shall keep the leased premises in neat and tidy conditions and shall
attend to its minor repairs from time to time at his costs. At the time of vacating the
LICENSED premises, he shall deliver its vacant possession in the same condition as it
was given at the time of entering into the LICENSE AGREEMENT with the LICENSOR,
however, subject to the normal wear and tear on the expiration or early termination of the
leave and License agreement for the reasons herein contained.

6] The Licensee shall not make any alternation and or additions of a permanent nature to
the said premises without the previous consent in writing of the Licensor. The Licensee,
however is permitted to furnish the said premises on the manner the Licensee deems fit
but the Licensee shall put back the said premises in its original condition when delivering
vacant possession thereof to the Licensor.

7] It is agreed by and between the parties hereto that the agreement shall not create any
relationship of landlord and tenant between the parties hereto and the Licensee has not
been granted any interest in the said premises except the permission to use and occupy
the said premises only.

8] On expiry or sooner termination of this agreement the LICENSEE shall deliver its vacant
possession of the said premises without obstruction and obstacles to the LICENSOR
and the LICENSOR shall refund the amount of security deposit to the Licensee after
deduction of any fee due, including fee towards damage to the property, electricity due,
etc.

9] Subject to clause 4 hereof the Licensee shall not assign transfer or sublet the said
premises or any part thereof.

10] In the event of any breach of any of the terms and conditions herein contained on the
part of the License, the Licensor shall be at a liberty to put an end to the leave and
License agreement on giving to the Licensee a one month’s notice in that behalf and to
claim vacant and peaceful possession of the said premises and on the expiry of the said
period of one month‘s notice. The Licensee shall hand over vacant and peaceful
possession thereof to the Licensor.

11] (A) Any notice required to be served shall be deemed to sufficiently served on the
Licensee if addressed and sent to the Licensee. Q/10 Anupam Nagar, Behind TV

11] (B) It is agreed by and between the parties hereto that on the termination or early
termination of the Leave and License agreement for any reason whatsoever, the
representative authorized in writing by the Licensee only shall hand over vacant and
peaceful of the said premises to the Licensor and that Licensor shall accept such
vacant and peaceful possession of the said premises from such authorized
representative of the Licensee only and from no one else.

12] The Licensee shall allow the Licensor to inspect the said premises after prior notice or
intimation of at least 5 hours from the Licensor to the Licensee.

IN WITHNESS WHEREOF the parties have hereunto set and subscribed their respective
hands, the day month and the year first herein above written.
