AN12.01.103. Part 2.1 discusses Clause 3.4 of the ACEA Client-Engineer Agreement, suggesting it
should be amended to a ‘pay when paid’ arrangement. These ‘pay when paid’ and ‘pay if paid’
arrangements are no longer legal under the various state Security of Payments Acts. The state acts are
all different in detail, but the spirit is the same. That being if you have a contract with someone your
payment under it should not be conditional on another contract to which you are not a party. (Fair enough
really…)

AN10.02.110 states that "provided the client has paid all fees due to the architect under the contract,
these entitlements pass from the client to any subsequent owner of the building/site......for example the
client sells the site with the design prepared for them in which case the new owner may build the design
under the license agreement'" This is not the case if you use the CAA 2019. If you use the CAA 2019
then the licence is revoked when the site changes hands.
