Re: Final Pay of Nerissa A. Pamiloza

Dear Sir/Ma’am,

Good morning,

I am writing on behalf of my client, Ms. Nerissa A. Pamiloza, who is a former employee of


your Non-Government Organization (NGO), “Sustainable Development Solutions Network
Youth Philippines, Inc.”

My client has asked me to contact you on her behalf as she feels that her requests for her
final pay are being ignored or treated with a distinct lack of attention.

My client was employed by your NGO on 24 May 2021, and involuntarily left your employ
on 29 June 2022 as she was being unfairly treated by her immediate superior and saw no other
option that to just leave to get out of what was definitely a very toxic situation for her, one in
which she was denied being allowed to go home, threatened with court cases for illegal training
bonds if she resigned, and is now being accused of not liquidating a two million peso budget.
Such situation would warrant a very serious case for Constructive Dismissal, at the very least,
should my client wish to file one.

As an NGO, one would assume that you are aware of the rules surrounding the release of
such things as final pay, and the remedies for such that are provided for in the Labor Code,
countless Department Orders and Labor Advisories, and a plethora of jurisprudence.

As such, one assumes that you are aware of the requirement of ALL employers, regardless of
status, to provide that final pay within 30 days of an employee’s last day of work. Since her last
day of work was on 29 June 2022, albeit a forced last day due to circumstances beyond her
control, and she has no clearance to complete, asking for her Final Pay should not require her to
jump through hoops and wait for months to receive it.

As per my client, she has already formally requested her final pay, and in her discussions
with a member of Admin or HR, she has been repeatedly informed that there are no updates as
yet. Then she was told that “Ngayon po ang nabanggitlang na irrelease ay kay Sir Coco po”.

The next thing she was told was “Hindi ko po sure yung banggit ni sir chris. Pero ino-
confirm ko rin po kay XP”, and “For discussion pa raw po nila ni sir xp yung mga backpay”.

Meanwhile, previously, the aforementioned “Sir Chris” informed her:

“Alright, thanks for telling me Nerissa, so don’t worry about,


I’m currently making steps to take care of all pending accts ng
SDSN in the coming weeks, para clean slate na ung books ng
SDSN.
So that would include yours too.”

And yet, still no final pay is forthcoming, and my client is beginning to consider her other
options, which includes the filing of a complaint in the NLRC.

In view of your repeated failure to release her final pay, which must include her pro-rated
13th month pay and SIL conversion, I hereby give you ONE WEEK from today to provide either
her final pay in the form of a bank check or a confirmed time and date within that week on which
she can retrieve it.

Your failure to comply with this directive WILL result in further legal action being taken
against the NGO without further notice.
