ORDINANCE NO. 9THCC-037

ORGANIZING THE CITY COUNCIL ON DISABILITY AFFAIRS (CCDA)


OF SANTIAGO CITY AND FOR OTHER PURPOSES

WHEREAS,the Philippine Constitution in the declaration of principles and state


policies mandates the state to promote social justice in all phases of national development;

WHEREAS,Article 13, Section 2 of the Constitution includes disabled persons as


one of the priority sectors to be given access to essential goods and services at affordable
cost;

WHEREAS, Article 13, Section 13 of the Constitution further provides that the
state shall establish a specific agency for disabled persons for the rehabilitation, self-
development and self-reliance into the mainstream of society;

WHEREAS, the Local Government Unit of Santiago City recognizes the rights
and privileges of its constituents and stakeholders as strong partners in the promo
realization of its developmental goals regardless of status, gender, disabled or not;

WHEREAS,the Sangguniang Panlungsod is mandated by the Local Government


Code of 1991 (RA 7160) particularly Title 2, Chapter 3, Section 458 (5)(XIV) to "Provide
for the care of disabled persons, paupers, the aged, the sick children and other needy and
disadvantaged persons particularly children and youth below eighteen (18) years of age,
and subject to availability offunds, establish and provide for the operation of centers and
facilities for said needy and disadvantaged persons" x x x;

WHEREAS, the Sangguniang Panlungsod enacted Ordinance No. 5thCC-39


Establishing the Office of Persons with Disability Affairs in the City of Santiago,
Appropriating Funds andfor Other Purposes in order to sustain and continuously carry out
the task of monitoring, evaluating, data gathering needs assessment, planning the
establishment of production center, creation of job opportunities and advocacy for PWDs
welfare in all the barangays of Santiago City;

WHEREAS, there is a need to organize an institutional support group that will
include various offices and sectors who shall set the overall direction, goals and monitor
the implementation of the programs of the Office of Persons with Disability Affairs in the
City of Santiago;

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod in its


Regular Session duly assembled, that -

SECTION 1. Title. The Title of this Ordinance shall be "Organizing the City
Council on Disability Affairs (CCDA) of Santiago City andfor Other Purposes ".

SECTION 2. Composition. The City Council on Disability Affairs in the City of


Santiago shall be composed of the following:

A. Officers and Members

Chairperson City Mayor

Vice-Chairperson Chairperson, Committee on Social Welfare


& Community Development
Members Persons with Disability Affairs Officer;

City Social Welfare and Development Officer;


DILG - City Local Government Operations Officer;
Division School Superintendent of DepEd;
Public Employment & Services Coordinator;
City Planning & Development Officer;
City Budget Officer;
City Health Officer;
City Engineer;
City Treasurer;
President of Liga ng mga Barangay;
3 Representatives from Civil Society Organizations
having Programs/Services for PWDs;
Santiago City Chief of Police;

B. National Partners and Stakeholders:

1. Department of Public Works and Highways (DPWH);


2. Land Transportation Franchising and Regulatory Board (LTFRB);
3. Department of Trade and Industry (DTI);
4. Commission on Human Rights (CHR);
5. Department of Justice (DOJ);
6. Commission on Higher Education (CHED); and
7. Department of Social Welfare and Development (DSWD);
SECTION 3. Functions of the Council. The Council shall perform the following
functions:

a. Formulate City Plan of Action for PWDs; incorporate projects and
programs needing assistance by the barangay and ensure its integration
into City Development Plan;
b. Monitor and evaluate the implementation of City and Barangay
Development Plans for PWDs;
c. Submit quarterly status report on the plan implementation through the
City Planning and Development Office (CPDO);
d. Promptly address issues and concerns affecting PWDs;
e. Advocate for the increased support and resources allocation for the
PWDs programs and projects;
f. Provide technical assistance to the community-based frontline workers
through the conduct of Capability Building and Human Resource
Development Activities;
g. Prepare contingency measures to protect PWDs and their families in
crisis situations brought about by natural and man-made calamities; and
h. The Persons with Disability Affairs Office (PDAO) shall serve as the
Secretariat of the Council.
SECTION 4. Fund and Support. Budgetary and Administrative support will be
under the Office of the City Mayor and as maybe provided in the Annual 20% Economic
Development Fund (EDF).
SECTION 5. Repealing Clause. All other Orders, Rules, Regulations and Issuances
or parts thereof which are inconsistent with this Ordinance are hereby repealed or modified
accordingly.
SECTION 6. Effectivity Clause. This Ordinance shall take effect immediately upon
its approval.
