CHAPTER 1

AUSTRALIAN DEFENCE FORCE CADETS: GOVERNANCE

INTRODUCTION

1.1 The Australian Defence Force Cadets (ADF Cadets) comprises the
Australian Navy Cadets (ANC), the Australian Army Cadets (AAC), and the
Australian Air Force Cadets (AAFC). These Cadet Forces are voluntary, uniformed
youth development organisations established w ithin Defence. They comprise Officers
of Cadets (OOC), Instructors of Cadets (IOC) and Cadets, and drawing on support
from schools, the community and ADF Cadets Approved Volunteers as well as from
Defence. The ADF Cadets has a distinctive Service character and relationships, and
the three Cadet Forces are closely allied to the three ADF Services, respectively the
Royal Australian Navy, the Australian Army and the Royal Austral ian Air Force
(RAAF). The prime focus of the ADF Cadets is on youth development, however, it
also seeks to encourage young people interested in the ADF to pursue careers in
Defence and to engender a positive community attitude towards the ADF.

1.2 The ANC, the AAC and the AAFC are established under subsections 38(1) of
the Naval Defence Act 1910, 62(1) of the Defence Act 1903, and 8(1) of the Air Force
Act 1923 respectively. Those Acts authorise the making of regulations that make
provision for, and in relation to, the organisation, maintenance, regulation, control
and discipline of the cadet forces. The Acts describe the periods and conditions of
service of members (other than conditions of service w ith respect to which
determinations under s 588 may be made), and the promotion of members. Such
regulations have been made, in Cadet Forces Regulations 2013 (CFR 13). Under
Defence Act 1903, s 588, the Minister for Defence may make determinations relating
to remuneration, allowances and other benefits for OOC, IOC and cadets. Such a
determination has been made in Defence Determination 2005115 Conditions of
Service (as amended).

1.3 In accordance with CFR13 OOC and IOC are not members of the ADF.
Cadets are not members of the ADF. However, ADF Cadets Personnel are, for the
purposes of the Privacy Act 1988, considered part of Defence, and under the Work
Health and Safety Act 2011 , OOC and IOC and cadets are deemed workers and the
relevant Service Chief is deemed to be the employing authority. The Military
Rehabilitation and Compensation Act 2004 makes provision for the compensation of
OOC, IOC and cadets for injuries and illnesses incurred in connection with their ADF
Cadets duties. The Financial Management and Accountability Act 1997 and Public
Governance, Performance and Accountability Act 2013, and associated Regulations
and Orders under that legislation, contain provisions relevant to the application of
public moneys by the ADF Cadets.
POLICY STATEMENT
1.4 The ADF Cadets is a personal development program for young people,
conducted by Defence in cooperation with schools and the community . ADF Cadets
benefits the Nation by developing an individual's capacity to contribute to society,

fostering an interest in Defence Force careers, and developing ongoing support for
Defence. The ADF Cadets is an inclusive organisation that provides opportunities for
young people from a wide range of social backgrounds and abilities.

1.5 The objectives of the ADF Cadets are:

a. to conduct a creative youth development program in a military environment


that extends individuals beyond their self imposed limits;

b. to develop an understanding of the balance between personal freedoms and


choice and the responsibilities that they bring;

c. to promote self reliance, self esteem and self discipline, and develop and
recognise a broad range of skills including leadership and team work;

d. to contribute to social development by encouraging pride in self, community


and nation; equipping young people to be better citizens; encouraging a
volunteer ethos; developing work and life skills; and providing a supportive
and safe environment; and

e. to contribute to the development of the ADF through cooperation with the


community ; enhancing Defence's reputation in the community ; maintaining
Service customs traditions and values; promoting understanding of what
Defence does, and generating a return on Defence's investment by
promoting Defence career opportunities.

1.6 ADF Cadets Personnel should be enabled to deliver the ADF Cadets
program in an environment of trust and empowerment; expect and receive support in
the administration and planning of the program and when things go wrong; receive
timely responses to their day-to-day needs; and be recognised for their contribution .

1.7 Cadets should experience a program of safe, enjoyable, disciplined activities


that contribute to their development into balanced, responsible adults; help develop
their potential as future leaders; provide opportunities for them to undertake a range
of challenging and interesting military-like activities unique to the ANC, AAC and
AAFC respectively; familiarise them with the culture, values and environment of the
Service with which they associate themselves as cadets, and with the ADF as a
whole; and contribute to the fulfilment of accreditation requirements for relevant
activities.

1.8 Parents and guardians of cadets should be confident that their children are
participating in a program of activities that are safe, well-organised and properly
supervised. Parents and guardians should be assured that their children will derive
benefits from these programs leading to their development as responsible, balanced
adults.

1.9 Schools and communities should gain an understanding of the purpose and
goals of the ADF Cadets, including that it is primarily a youth development scheme
that benefits the nation; the presence of a uniformed, disciplined group of young
people who are available to support a variety of important ceremonial and other
activities; and a positive outlet for youth participation.

1.10 The ADF should gain a uniformed presence in Australian communities, some
of them remote from routine contact with ADF organisations; opportunities to
reinforce the positive image of the ADF in communities across the nation;
opportunities to ensure that cadets develop a positive view of contact with their
respective Service and the ADF as a whole that they will carry with them throughout
their lives; and a significant source of potential recruits.

1.11 Under Naval Defence Act, s 39(1), Defence Act, s 62(9), and Air Force Act, s
8(9) respectively , each of the Chief of Navy, the Chief of Army and the Chief of Air
Force is to administer their respective cadet force, subject to:

a. CFR13;

b. any relevant determinations under Defence Act s 588;

c. any directions of the Minister (including the Parliamentary Secretary for


Defence, who has portfolio responsibilities for the ADF Cadets); and

d. any directions of the Chief of Defence Force (CDF) (and the Vice Chief of
Defence Force (VCDF) as delegate pursuant to CDF Directive 02/2013)
including CDF Directive - Governance of the Australian Defence Force
Cadets 07/2014.

1.12 Under Naval Defence Act, s 44B(3A), Defence Act, s 120A(3DA) and Air
Force Act, s 8A{1A), the CDF's powers of direction may be delegated to the VCDF.
By CDF Directive 2/2013, the CDF's power to give directions with respect to the
administration of the ADF Cadets has been delegated to VCDF.

1.13 Each of the ANC, AAC and AAFC is to be administered in accordance with
the policies contained in this Part 3 of YOUTHPOLMAN, in order to achieve the
above purpose and objectives.

SCOPE
1.14 The policy contained in this Chapter applies to:

a. all Defence personnel;

b. all ADF Cadets personnel; and

c. external service providers where adherence to the requirements of this


Chapter has been made a condition of their contract.

ROLES AND RESPONSIBILITIES

Chief of Defence Force


1.16 CDF is responsible for issuing directions, subject to and in accordance with
any directions of the Minister, to the Service Chiefs in relation to the administration of
their respective cadet force.

Vice Chief of Defence Force Group


1.17 VCDF, as delegate of CDF, provides the single ultimate point of policy,
governance and accountability for the ADF Cadets, and is responsible for:

a. issuing direction to the Service Chiefs in relation to the administration of the


ADF Cadets;

b. ensuring that the ADF Cadets comply with applicable legislation;

c. promulgating joint ADF Cadets policies;

d. overseeing the governance of the ADF Cadets;

e. investigating, and where appropriate, establishing joint ADF Cadets cells


within CRESD to achieve consistency, uniformity, synergies and economies;
and

f. providing advice to CDF on ADF Cadets matters.

Service Chiefs
1.18 Subject to CFR13, any relevant s 588 Determination, the directions of the
Minister, CDF and VCDF, Service Chiefs are responsible for the administration of
their respective cadet forces , including the responsibilities of an employing authority
under the Workplace Health and Safety Act.

1.19 Service Chiefs are responsible for:

a. ensuring that their respective cadet forces comply with CFR13, any relevant
s 588 Determination, any relevant direction of the Minister, the CDF or the
VCDF, and the joint ADF Cadets policies contained in this Part;

b. ensuring that single Service Instructions, policies and Single Cadet Force
Procedures align with the joint ADF Cadets policies contained in this Part;

c. resourcing the implementation of this policy, including the provision of


ordinary recurrent funding, permanent and Reserve ADF staff, APS staff, and
logistics support; and

d. fostering the ADF Cadets, including ensuring that every Cadet Unit is
formally supported by a permanent or Reserve unit wherever practicable.

1.20 Service Chiefs administer thei r respective cadet forces through their
respective Director-General Cadets, who are also responsible for:

a. ensuring that the policies contained in Part Three of YOUTHPOLMAN are
implemented; and

b. ensuring that single cadet force procedures align with the policies contained
in Part Three of YOUTHPOLMAN.

Head Cadet Reserve and Employer Support Division


1.21 Head Cadet Reserve and Employer Support Division (HCRESD) is
responsible for:

a. developing ADF Cadets policies in accordance with SoDI process, and


conducting regular reviews of those policies;

b. monitoring and reporting on the governance of the cadet forces, including


compl iance with the policies contained in this Part;

c. allocating any special additional financial support that Government may wish
to channel directly to the ADF Cadets; and

d. advising CDF and VCDF on ADF Cadets matters.

Directors-General Cadets
1.22 The Directors-General Cadets are responsible for:

a. supporting their respective Service Chiefs in ensuring that any relevant single
cadet force procedures are consistent with policies in Part Three of
YOUTHPOLMAN;

b. ensuring that all ADF Cadets personnel are aware of policies in Part Three of
YOUTHPOLMAN and their obligations under them; and

c. developing single cadet force procedures relati ng to the implementation of,


and compliance with, policies in Part Three of YOUTHPOLMAN.

ADFC Commanding Officers

1.23 ADFC Commanding Officers are responsible for:

a. ensuring that all ADF Cadets personnel are aware of policies in Part Three of
YOUTHPOLMAN and their obligations under them ; and

b. ensuring that Non-Defence Personnel comply with policies contained within


Part Three of YOUTHPOLMAN, and that their participation is conditional
upon such compliance.

ADF Cadets personnel


1.24 ADF Cadets personnel are required to comply with the ADF Cadets policies
contained in Part Three of YOUTHPOLMAN.

providers
1.25 ADF Cadets personnel and Defence personnel engaged in procuring external
service providers to provide goods or services to ADF Cadets must ensure that
contracts include provisions that explicitly require compl iance with all relevant ADF
Cadets policies in Part Three of YOUTHPOLMAN.

DELEGATIONS

1.26 Service Chiefs may delegate their functions under this policy.

MONITORING AND REPORTING

1.27 HCRESD is responsible, on behalf of VCDF, for monitoring and reporting on


compliance with ADF Cadets policy.

1.28 The Directors-General Cadets are responsible, on behalf of their respective


Service Chiefs, for monitoring and reporting on compliance with ADF Cadets policy
within their respective cadet forces.

IMPLEMENTATION

1.29 All Groups and Services responsible for the management of ADF Cadets,
youth and Defence youth engagement and development programs must ensure that
appropriate arrangements and adequate resourcing are in place to enable the
policies outlined in YOUTHPOLMAN to be effectively implemented.

1.30 The joint ADF Cadets pol icies contained within Part 3 of YOUTHPOLMAN
supersede all relevant extant si ngle Cadet Force policies on the matters to which it
relates, and in the event of any inconsistency joint ADF Cadets policies prevail over
single Cadet Force policies.
