SUPREME STUDENT COUNCIL (SSC)

PREAMBLE

We, the students of MMG College of General Santos City, Inc. with the help of Almighty God, believing in
the need for a better-organized student council and in the development of the youth as future leaders of the
nation, do hereby promulgate and adopt this Constitution and By-Laws of the Supreme Student Council that
shall advance, implement, and maintain our goals and aspirations embody the ideas of academic standard of
our Alma Mater.

CONSTITUTION AND BY-LAWS OF THE SUPREME STUDENT COUNCIL


Article I: General Provision
Sec. 1 This Constitution and By- Laws shall be known as the Constitution and By- Laws of the
Supreme Student Council of MMG College of General Santos City, Inc.
Sec. 2 For purposes of this Constitution and By-Laws, SSC refers to the Supreme Student Council
of MMG College of General Santos City, Inc.
Article II: Name and Domicile
Sec. 1 The name of the organization shall be known as the Supreme Student Council. Sec. 2 The
office of the SSC shall be located within the school premises.
Article III: Declaration of Principles and Objectives
Sec. 1 The SSC of MMG College of General Santos City, Inc. shall promote mutual understanding
thru social, civic, intellectual, recreational and scientific programs and activities.
Sec. 2 The SSC shall have the following duties:

a. Develop love of God and country, moral character, personal discipline, leadership and
efficiency among its members;

b. Train members for effective and efficient leadership;

c. Help the students develop self-confidence;

d. Promote unity among leaders and studentry;

e. Maintain school aspiration to promote quality education and academic excellence;

f. Serve and protect student’s rights and welfare;

g. Represent the studentry in the policy making body of the school concerning student’s

welfare; and,

h. Must not be biased on whatever conflict arises if the organization is affected.


Article IV: Membership
Sec. 1 All bonafide students are the members of the studentry to whom the SSC shall be
accountable at all times.
Article V: Rights of Student
Every student has the following rights:
Sec. 1 To enjoy responsible freedom of speech and expression.
Sec. 2 To avail of all the services offered by the SSC.
Sec. 3 To conduct and participate in all school activities.
Sec. 4 To inform all the issues and matters concerning them.
Sec. 5 To vote, be nominated and be elected into the office.
Sec.6 To be represented in the different meetings and assemblies of the school on issues
affecting the welfare of the studentry.
Sec. 7 To due process.
Article VI: Duties and Obligations of Student
Every student has the following duties and obligations:
Sec. 1 To observe the Laws of the Republic of the Philippines, and the rules and regulations
of the school at all times.
Sec. 2 To pay the P250.00 SSC Fee per semester as regulated and approved by CHED
regulation.
Sec. 3 To support and promote the trusts and objectives of SSC and the school.
Sec. 4 To abide with the SSC Constitution and by–Laws.
Sec. 5 To participate actively in all CHED recognized school activities and strive for
academic excellence.
Sec. 6 To exercise his/her rights and responsibilities as an SSC member.
Sec. 7 Student who fails to participate in every school activity shall be sanctioned by
providing 50.00 pesos worth of school supplies per attendance missed, and or any
material(s) equivalent to the said amount that is needed by the SSC office. Attendance card
should be kept safe and secured. Once it’s lost the student will pay the full amount required
per day activity.
Article VII: Powers and Duties of the Supreme Student Council

Sec. 1 The Supreme Student Council shall be the highest governing body of the entire studentry.
Sec. 2 The SSC shall have the following functions and responsibilities:

a. Formulate and recommend programs that will address relevant issues and concerns of
studentry;

b. Plan and implement policies and programs designed to protect and to promote student’s
rights and welfare;

c. Monitor and evaluate the student’s activities in the school and in the community;

d. Create committees necessary to address the needs of the students;

e. Make recommendations to school authorities regarding student matters, affairs, and


activities;

f. Monitor and coordinate elections of other recognized campus co-curricular


clubs/organizations;

g. Recommend to the School President the granting, renewal or revocation and accreditation
of campus student’s organizations;

h. Turn-over financial assets, documents, properties and other responsibilities to the new set of
Student Officers, and,

i. Submit financial, accomplishment and terminal reports to the school authorities every end
of the semester.
Article VII.A. Special Powers of SSC

j. The SSC Officers, on his/her third 3rd year level can run twice as his/her position, if, there’s
a power of recommendation given to him/her;

k. SSC Officers can run for 2nd time. running 3rd year if, there’s a power of recommendation
given to him/her from;

l. SSC Adviser recommendation letter to extend the term of certain officer to run;

m. No one can revoke the approval of higher rank or the School President;

n. If the SSC officers of the current organization want to run in higher position for the

possibility to oppose his/her President, they must set an election within the organization and
the Presiding Officer is the SSC Adviser; see Article XVI.A. Special Meetings and
Quorums.

Article VIII: Composition, Election, Qualifications and Term of Office of the SSC
Sec. 1 The officers of the SSC are the duly elected President, Vice President, Secretary, Treasurer,
Auditor, Public Information Officer, Peace Officer and the Departmental Representative.
Sec. 2 The departmental president shall automatically be the departmental representative of his/her
department.

Sec.3 All SSC elections shall be annually conducted every fourth week of May.
Sec. 4 Elections for the Departmental Officers shall be annually conducted every 2nd week of
September.
Sec.5 The Campaign Period shall not be more than five (5) school days prior to the SSC elections,
unless otherwise stipulated in an appropriate CHED regulation.
Sec.6 Candidates for all SSC elective positions shall be or have;

a. A bonafide and not a working student;

b. A good academic standing with a general average of 80% and above without any failing
grade during the 1st Semester of Academic Year;

c. A good moral character,

d. Not been subjected to any disciplinary sanction; and,

e. Paid the SSC Fee and other related SSC contributions since his/her admission to the school.
Sec. 8 Once elected, all SSC Officers, except the Departmental Representative shall be considered
resigned and ineligible from all major elective or appointive positions in other clubs and organizations.
Major elective or appointive positions shall refer to the position of President, Vice President, Secretary,
Treasurer, Auditor, Public Information Officer, Peace Officer or equivalent positions, including Editor-in-
chief, Managing Editor and Associate Editor of the School Paper or Publication.
Sec. 9 A residency of at least one (1) semester shall be required of the candidates for all SSC
elective positions.
Sec. 10 The SSC officers shall hold office for one (1) or two (2) academic years;
Sec.11 The SSC Officers, on his/her third 3rd year level can run for re-election on any position, if,
there’s a power of recommendation given to him/her;
Sec 12. SSC Adviser recommendation letter to extend the term of certain officer to run;
Sec 13. No one can revoke the approval of higher rank or the School President;
Article IX: Duties and Functions of SSC Officers
Sec. 1 The President shall be the chief executive officer of the SSC. He/She shall have the following
duties:

a. Preside over all meeting and/or may designate another officer to preside for a specific
meeting in the absence of the Vice Presidents of External and Internal Affairs;

b. Enforce this Constitution and By-Laws and other regulations that maybe promulgated;

c. Sign all official minutes, resolutions, correspondences, and other official documents of the
SSC;

d. Heads the coordinating Council of Campus Co-curricular Clubs/Organizations;

e. Implement SSC programs and projects;

f. Create Ad Hoc Committees, as the need arises, the chairperson or which shall be appointed
by the SSC president; and,

g. Perform such functions inherent and incidental to his/her office.


Sec. 2 The Vice President shall have the following duties:
a. Assist the President in all matters where his/her assistance is necessary;

b. Assume the office of the President should the position become vacant;

c. Supervise members in planning and arranging meetings or programs of activities;

d. Head the Internal Affairs Committee and conceptualize programs and projects and plan
activities with Departmental Representatives; and,

e. Perform such other duties assigned by the SSC.


Sec. 3 The Secretary shall have the following duties:

a. Keep accurate records of the minutes and document proceedings of every meeting;

b. Keep a file of all pertinent documents of the SSC and make them accessible to the
studentry;

c. Call and prepare all notices of SSC meetings;

d. Head the Supreme Student Council; Secretariat; and,

e. Perform such other duties assigned by the SSC.


Sec. 4 The Treasurer shall have the following duties:

a. Keep all financial records of the SSC;

b. Serve as the disbursing officer of all the SSC’s funds;

c. Prepare the annual budget of the SSC;

d. Prepare liquidation reports every after activity;

e. Formulate pertinent financial guidelines for the organization;

f. Head the Finance Committee; and,

g. Perform such other duties assigned by the SSC.

Sec.5 The Auditor shall have the following duties:


a. Certify the legitimacy and correctness of the disbursement of funds;

b. Audit all expenditures of the SSC funds every end of the semester;

c. Assist the Treasurer in formulating guidelines and reports;

d. Keep and update inventory of all the SSC’s Property;

e. Act as the Assistant Head of the Finance Committee, and;

f. Perform such other duties assigned by the SSC.


Sec. 6 The Public Information Officer shall have the following duties:

a. Popularize the trusts and objectives of the SSC;

b. Build and maintain a credible image of the SSC;

c. Take charge in the promotion of SSC projects and activities;

d. Head the publicity committee, and;

e. Perform such other duties assigned by the SSC.


Sec. 7 The Peace Officer shall have the following duties:

a. Help the Presiding officer to maintain peace and order during meetings;

b. Act as Disciplinary Officer, if needed;

c. Maintain peace and order within the premises of the school;

d. Act as Chief Peace Officer and over all Sgt. At arms of subordinate organizations and classes;

e. Chair the student’s welfare committee and appoint its members, and;

f. In case of uncontrollable situation of any event the Guidance Counselor shall intervene.

g. Perform such other duties assigned by the SSC.


Sec. 8 The Departmental Representative/s shall have the following duties:

a. Represent his/her department in the required meetings of the SSC;


b. Serve as the grievance desk for his/her respective department;

c. Conceptualize and implement programs and projects, and recommend policies for their
respective department;

d. Assist the effective implementation of the SSC’s Programs and Projects, and;

e. Can suggest and recommend policies and procedures related to the SSC operation but has no
power to make major decisions.
Article X: Permanent Committees in the Supreme Council
Sec. 1 There shall be seven (7) permanent committees in the SSC, namely, the Executive
Committee, Internal Affairs Committee, Secretariat, Finance Committee, Publicity Committee, Student’s
Welfare Committee and the Special Projects Committee. Members of each committee in the SSC shall be
appointed by the President from among the officers.
Sec. 2 The Executive committee shall be headed by the SSC President and shall act as the
administrative arm of the SSC.
Sec. 3 The Internal Affairs committee shall be headed by the SSC Vice-President and shall take
charge of all matters regarding the members of the SSC and their functions.
Sec. 4 The Secretariat shall be headed by the SSC Secretary and shall be the official SSC work
group.
Sec. 5 The Finance committee shall be headed by the SSC Treasurer and shall be responsible for
financial aspect concerning SSC.
Sec. 6 The Students Welfare Committee shall be headed by the SSC Public Information Officer and
shall be responsible for disseminating information on matters concerning the SSC.
Sec. 7 The Students Welfare Committee shall be headed by the SSC Peace Officer and shall look
after the rights of the students and act upon their complaints.
Sec. 8 The Special Projects Committee shall be headed by a person appointed by the SSC President
and shall implement programs and projects of anti-drug abuse, anti-smoking, community extension,
outreach, and environmental programs.
Sec. 9 Other committees, permanent or ad hoc in nature may be created by the SSC as the need
arises.
Article XI: Coordinating Council of Campus Co-Curricular Organizations
Sec. 1 The coordinating council shall be headed by the President of the Supreme Student Council as
the chairperson.
Sec. 2 The coordinating council shall be composed of the different Presidents of all recognized
legitimate campus co-curricular organizations.
Sec. 3 The coordinating Council shall have the following functions:

a. Coordinate school-wide activities, which need the participation and involvement of the
whole studentry;

b. Provide consultative mechanics and support for the implementation of the various programs
and projects of all co-curricular affairs organizations;

c. Plan programs and synchronized student activities on campus.

d. Serve as a venue to present accomplishment reports, financial reports, and such other
reports of the SSC and other organizations as are necessary or required, and,

e. Set rules and standards for the collection of membership fees or contributions by recognized
campus co-curricular clubs or organizations for the approval of the School President.
Sec. 4 The coordinating shall meet once every quarter or upon notice of the request of any of its
members as often as the council may deem necessary,
Sec. 5 The School President shall serve as the Adviser of the coordinating council, such as, all
resolution and agreements arrived at by coordinating council shall be noted by the School Admin.
Article XII: Supreme Student Council Adviser
Sec. 1 The SSC adviser shall be designated by the School President among the three (3) teacher
nominees’ officers through a resolution.
Sec. 2 The SSC Adviser shall have the following qualifications:
Preferably a social studies teacher, department head or any competent, able and willing teacher, and,
with good moral character and reputation in the school and community.
Sec. 3 The SSC Adviser shall monitor all programs, projects activities and meetings of the SSC at
all times.
Article XIII: Commission on Elections
Sec. 1 The commission on elections, wherein referred to as the SSC Comelec, shall be established
within 45 days before the day of the election.
Sec. 2 The SSC Comelec shall be the only agency that will manage the election process including
the campaign.
Sec. 3 The SSC Comelec shall be composed of 11 members represented by each year level who do
not have vested interest in the election, or in any way related to any of the candidates, and who shall select a
chairperson among themselves.
Sec. 4 The Composition of the members shall be 3 from the first-year level (incoming second year),
four from the Second Year Level (incoming 3rdyear), and four from the third year (incoming 4th year)
Sec. 5 The Composition of the members of the SSC Comelec shall be appointed by the adviser of
the SSC.
Sec. 6 The SSC COMELEC shall have the following duties and responsibilities:

a. Conduct fair, honest, and systematic elections;

b. Formulate an election code or modify an existing election code if necessary, subject to the
approval of the School President;

c. Validate the electoral proceedings and results.

d. Accept or revoke candidacy;

e. Proclaim the new set of officers;

f. Keep all pertinent election documents;

g. Decide on protest relative to the conduct and results of the elections;


h. Prepare and distribute the necessary election paraphernalia, certificate of candidacy forms,
and other election-related materials before, during, and after the election: and;

i. Disqualify candidates who have violated any of the guidelines, which have been
promulgated.
Article XIV: The General Assembly
Sec. 1 The General Assembly of the SSC shall be composed of all Students, Faculty and staff of the
school
Sec. 2 The General Assembly shall be a forum for information and consultations, which decisions
shall be significantly considered.
Sec.3 The General Assembly shall be convened by the President once every end of the semester and
as the need arises.
Article XV: Membership to the Division, Regional and National Federation of Supreme Student
Council
Sec. 1 As a duly constituted SSC, and having adopted the standard Constitutions and By- Laws, this
SSC shall be, and shall remain to be, an automatic member of the Division, Regional and National
Federation of Supreme Student Council.
Sec.2 As such, this SSC shall abide by the rules and regulations issued by the proper federation
consisted with the policies and guidelines of the Commission on Higher Education.
Article XVI: Meetings and Quorums
Sec. 1 The SSC shall conduct regular meeting every first and third week of the month or as agreed
upon by the officers.
Sec. 2 Special meetings of the SSC may be called upon by the President or by majority of the SSC
officers.
Sec. 3 Majority of the SSC officers (50% + 1) shall constitute a quorum.
Sec. 4 Each SSC officer is entitled to only one vote except for Departmental Representatives.
Sec. 5 No proxy shall be allowed to vote except for cases of urgency with valid reason provided that
he/she:

a. Has an approved authorization letter from the SSC Adviser.

b. Must be any Departmental Representative


Article XVII: Finance
Sec. 1 The SSC’s funds shall be classified into Trust Funds and Special Funds. Trust Funds shall
consist of the SSC Fee, the amount of which shall be regulated by the SSC in consultation and with the
approval of the School President but in no case shall it exceed the limit set by the Commission on Higher
Education in an appropriate official regulation. The special funds are funds that come from donations,
sponsorship, fund-raising projects or any amount derived from legitimate sources.
Sec. 2 All recipient of monetary funds from all sources shall be supported by acknowledgement
receipts.
Sec. 3 A monthly report on the receipts and/or collections made duly signed by the Treasurer and
the President and noted by the SSC Adviser shall be posted on the SSC bulletin board and submitted to the
School President.
Sec. 4 The SSC shall deposit all funds received and collected immediately to a reputable bank under
the account of the SSC President and School President.
Sec. 5 The organization may accept cash donations from any member or any public or private
person or institution, with the approval of the School President as long as it will not affect or compromise
the integrity of the SSC and the school.
Sec. 6 The SSC may undertake fund-raising activities to subsidize its projects or activities.
Sec. 7 The SSC shall enjoy the freedom to determine its priorities in the disbursement of its funds,
provided that it shall be actually, directly, and exclusively used to support and/or finance the SSC programs,
projects and activities.
Sec. 8 All disbursements and bank withdrawals shall be made in accordance with the programs,
projects and activities of the SSC as embodied in the yearly action plan duly approved by the School
President.
Sec. 9 The SSC President and the School President shall be the signatory of all disbursement funds
and bank withdrawals in the SSC. All funds disbursement and bank withdrawals must be accompanied with
an SSC resolution duly noted by the SSC Adviser and all expenses supported by the official receipts. The
School President shall be provided a copy of all resolutions relative to the disbursement made.
Sec. 10 The SSC, through the Treasurer and the Auditor, shall promulgate financial guidelines for
proper financial management.
Sec. 11 At the end of every activity, the SSC shall liquidate expenses before another disbursement
or bank withdrawal shall be authorized. Funds of the SSC shall be audited at the end of the term of the SSC
and at the end of every activity.
Sec. 12 Financial Statements shall be posted in the SSC Bulletin Board every end of the activity,
printed in every issue of the school paper, and a copy to the School President.
Article XVIII: Impeachment, Resignation and Vacancies
Sec. 1 The officers of the SSC may be impeached on the following grounds:

a. Culpable violations of the Constitution and By-laws;

b. Gross misconduct, violence to person in authority, negligence, and disloyalty to the cause of
SSC and the School;

c. Non-attendance in both regular and special meetings for 3 times without valid cause; and,

d. Abuse or misuse of power and authority,


e. If he/she is called by her/his Departmental Head for any disciplinary sanction or any
disciplinary intervention for 3 times, he/she is subject to impeachment.
Sec. 2 Two-thirds vote of the General Assembly shall be final. However, the officer charged shall
be informed 20 days prior to his/her impeachment case proceedings, of the charge/charges against him/her.
Sec. 3 Resignation of an elected officer shall be in writing and shall take effect 5 days after the
approval of the majority of the SSC officers.
Sec. 4 Resignation of an appointed officer shall be in writing and shall take effect immediately after
the approval of the SSC President, SSC Adviser, and Officer of the Student Affairs and Services.
Sec. 5 Any vacancy in any of the positions for the reason of death, resignation, impeachment, shall
be filled, subject to the recommendation of the SSC.
Sec. 6 Any vacancy in the SSC, except the position of the President, shall be filled in within ten (10)
school days from the day the position is rendered or considered vacant, by appointment of the President
from among the qualified members of the SSC. Immediately upon appointment, the appointee shall serve
the remaining period.
Sec. 7 The SSC Comelec shall certify the vacancy occurring in the SSC and the SSC Adviser shall
certify the fact of appointment of the vacant position.
Article XIX: Amendments
Sec. 1 The Constitution and By-Laws may be amended or modified in full or part once every year if
necessary, from its official regulation through a CHED order or memorandum.
Sec. 2 The school SSC, Division and/or Regional Federations of student council may propose
amendments. Such proposal shall be carried through a resolution duly signed and concurred in by a majority
vote of the school SSC officers, the Division or Regional Federations officers concerned voting separately.
Sec. 3 Amendments to this Constitution and By-Laws shall take effect immediately upon approval
of the Chairman of the Commission on Higher Education (CHED).
