Remonstration on visa refusal decision by

Susan Wangari MELI, visa application reference number 2600853

Dear Ladies and Gentlemen,

I Susan Wangari Meli, Kenyan Passport No. BK421913, wish to remonstrate

against the refusal of my visa application reference number 2600853 dated
22/06/2023.
The rejection letter is dated 21.07.2023 and was sent to me by post on
29.07.2023.

The reason for the refusal of the visa are doubts about my
alleged lack of readiness to return to Kenya (No. 13. of the refusal).

These doubts are unfounded and I ask you to reconsider your decision
with my reasons. Thank you very much!

1. I am not fleeing Kenya, I have a good life here with my family, my little son
and my friends. My German husband Josef also supports me regularly and
visits me.

2. I will continue my current studies after my holiday in Germany, at my place

of residence in Nakuru, because I need this diploma in Kenya.
I had attached the letter of admission and the letter of no objection from the
school to my visa application.

3. For me and my German husband Josef Lausch, it is not certain whether we

would ever want to live together in Germany. My husband likes Kenya very
much and since he is self-employed and does his job completely online and
remotely, he can work, earn money and live anywhere in the world with an
internet connection.

4. For me it would be a very difficult step to leave Kenya, I am very rooted in

my community and church here and it is difficult for me to make new
acquaintances. If I were ever to make such a decision, it would require a lot
of preparation and not a hasty, spontaneous action that would also cause
considerable legal difficulties.

5. Of course I would like to have the chance to get to know the home country of
my husband and his family. My mother-in-law Anneliese will be 80 years old
in September and can no longer make a trip for health reasons. And I really
want to meet her in person.

6. The timing of my trip from 20.09. to 19.10.23 is not random. I would definitely
like to
- be there for my stepson Noé's 22nd birthday on 24/09,
- celebrate the 80th birthday of my mother-in-law on 07.09 and
- as a wife, to take part in the Aschheim community council excursion
to Mougins, France, with my husband.
My husband will retire from the local council in the foreseeable future and it
would be a great pity for us if I could not take part in this trip.

7. I have a good relationship with Josef's grown-up children from phone calls,
but of course I would also like to meet them in person. This is also a very
important point for us when Josef moves to Kenya with me.

8. I am NOT taking my 4-year-old son with me on the trip to Germany, as I do

not want him to miss pre-school, where he is currently learning English
intensively. Good English is very important for life and school in Kenya.
My mother will take care of him and bring him to school during the 4 weeks of
my holiday in Germany. Much longer is not possible because then she has no
more help for her farm and she cannot take my son to the farm because there
is no adequate pre-school at the farm.

In any case, I can't imagine life in Germany without my son. Four weeks
without him are hard enough for me.

For this reason alone, the fear that I will stay in Germany is incomprehensible
and unfounded.

9. My German skills are still very much at the beginning and I would not be able
to communicate well in Germany. If I ever want to live in Germany, then only
with a good knowledge of German so that I can integrate well. In this case, I
know that a national visa has to be applied for and that certain requirements
have to be fulfilled. We will fulfil these as soon as necessary if I ever apply for
a national visa.

My German husband and a lawyer friend helped me to write the letter in German,
as my German is not good. The complete translation in English is enclosed, so I
know that the German text corresponds to my English draft.

For the above reasons, I ask you to approve my visa application so that I
can meet my in-laws, my mother-in-law and my husband's home country.

On 19 October 2023, I will start my journey home to Kenya as planned.

The flight is booked, paid for and cannot be postponed again.
