The Authority hereby adopts and promu`gates these Revised GuideIines on the
Accreditation of Voiuntary A刷略tors in the CDA reIative to vo-untary a「bit略tion as a mode of

djspute resoIution in acco「dance with the ADR Act of2004○          ○

Section l. TITしE. This shaII be known as the Revjsed Guidelines on the AI;Creditation of

Wlunta「y Ahoitrators in the Cooperative Development Autho面y (CDA).

Section 3。 NATURE OF ACCRED営丁ATtON。 The foIIowing a「e the d肺erent nature of
accreditation :

1. /nitia/Acc旧制別ion. This is initiaily granted to individuais whose name is found in

the CDA PooI of Vbluntary Arbit略torS, This is evidenced by a Ce珊cate of

Accred itation ,

2. Renewa/ ofAccIed鵬蘭on, This is granted to Accredited Vbiuntary Arbit略tOr (AVA〉

Who appIies for renewaI of his/he「 appIication before the expiration of his/her initial

acc「ed itation.

The AVA under preventive suspension cannot apply for renewal of acc「editation until

Sectioれ4。 INITIAしREQUIREMEN丁S FOR ACCRED看TATION。

1- Qua憫ca書ions. Any pe「son desi血g to become an Aocredited Vbluntary Arbitrato「

(AV相shall possess the minimum qua岡cations for accreditati6n, aS foilows:

a章Must be of legal age;

b. Must be F帥pino citizen residing in the Ph掴ppines;

C, Must be a holde「 of at Ieast a Bachelo「’s degree;

d, Must have at Ieast two (2) yea「S eXPerience in coope「ative ope「ation pr must have

2. Documen章ary Requirements。 Applicants fo「 AVA sha= submit an appIication Ie請er

to CDA Head O簡ce, togethe「 with the foIIowing:               ’

1. Aocomplished CDA Personal Data Sheet (PDS) Form which shall be secured from
the Legal Affairs Service, Said PDS which must be swom shall spec柄ca=y mention

that the applicant has no pending case in any court or t「ibunaI;

2. Two (2) copies of ``2 x 2’’picture;

3, Certified true copy of DipIoma, Or Certificate of Admission to the Bar, Or Certificate

from the Professional Regulatjon Commission (PRC);        ¥

4. Ce珊cate of Empioyment showing that the appIicant has two (2) years expe「ience

in the cooperative sector or Ce両ficate of T略ining that applicant has undergone the

「equired trainings.

3. Training Requirements. AIl applicants, Who have compiied with the above-
mentioned requirements, Sha町und料go a pre-aCCre航afron t「ainihg program to equIP

them with the basic knowiedge, Sk帥S, and va看ue o「ientation necessary to pe「form the

「esponsibiIities and function of an AVA.

Section  5。 ADDtTIONAし  REQUIREM ENTS FOR REN EWAL/  RE -

ACCREDITA丁獲ONIREINSTATEMENT OF ACCREDITATiON. An M may 「enew/「e-
accredited/reinstated his/her accreditation upon submission of the fo=owing documents:

Section 7・ VALIDITY OF ACCREDITAT書ON〃 The acc「editation sha= be valid fo「 five (5) years

from the date of approva!, unless earIier revoked by the Autho「ity・議sha旧ake effect on the

date shown on the Certificate of Accreditation,

Section 8" GROuNDS FOR DENIAしOF ACCREDITATION. The fd川owjng sha= be grounds

4. Non-aCCePtanCe Of VA appointment to a case where he/She was nominated without

Valid reason fo「 three (3) consecutive occasions; and,

5- Such other grounds as the Autho「ity may determine臆_

Section 9。 WIODE OF REVOCATION OF THE CERT田CATE ACcREDITAT漢ON OF AN

ARBITRATOR. The Ce棚cate of Accreditation (COA) of an AIbit「ator may be revoked under

1 。 Automatic Revocation

1.1 Death; and,                            ,

2. Volunta「y Revocation

An AVA may at his/her own initiative voIuntarily seek the子eVOCation of his/her

3・ lnvoluntary Revocation" The Authorty may revoke, a債e「 due notice and hearing,

the Ce輔icate of Accreditation of an AVA in any of the fdilowing grounds‥

 b. Conviction by血al judgment of a crime involving mo噂I tu「pitude;

C. Adiudged g刷ty in any administrative case or civiI case invoIving financial transaction

O「 any Other晦Iated acts that may tamish his/he「 credib晒ty as an AVA;    ‘

d' VIolation of the tems and conditions of the accreditation;

e" W晒ul and continuous act showing Iack of interest as AVA

f. VIolatien ofthe CDA Code of P「ofessional Responsib阻y for AVAs; and,

g. Negligence and dereIiction of duty as AVA

Section lO" PREV剛TIVE SuSP馴SION" The血thority can p「eventively suspend an

Arbit「ato「 fo「 a period not exceeding thirty (30) days upon軸ding of a p「ima facie existence of

a g「ound for 「evocation o「 upon 「eceipt of a complaint,

P「eventive suapension shali be issued叫the Board of Direc竜「s or thei「 authorized

「ep「esentatives wheneve「 the「e is a possib岨y that the AVA conce「ned is in a position to exert

undue in血ence o「 pressu「e to witness/es andlor tampe「 with evidence whi-e the case against

him/he「 is pending,

The commencement of any revocation proceedings of the COA of an AVA shall serve
as a ground for suspension of his/her autho「ity to be engaged as an A¥体言n ali cooperative

disputes nationwide・ AII CDA Regional O櫛ces sha= be no軸ed immediately of such fact.

The decision of the Authority on the revocation of the acc「editation shal! be軸aI and

executory暮

Service (LAS) sha!l maintain a Iist of aII the names of Accredited Vdluntary Arbitrators (AVAs)
