where they can be seen with a casual eye in the handling of the goods.

PRICE TO BE FIXED
In many cases in commodity trade, parties conclude a
contract for sale without setting the price.
The price is left to be fixed/set later by one of the
parties according to a pre-determined formula.
This formula is in terms of some agreed market (ex.
futures market) or other standard as set or recorded
by a third person or agency.
A relevant delivery period (ex. month) of
the futures market is specified/chosen in the contract,
and its price at a given moment will determine (or fix)
the price of the physicals contract.

1. Should balance between attractive short lead time and
consequences of subsequent late deliveries (esp. if payment
by L/C).
Late delivery constitutes a breach of contract and is subject
to liquidated damages. (please refer to the upcoming clause
“Penalties”.
It is far better to promise 12 weeks and deliver in 10, than to
promise 10 but deliver in 12

3. Where there is a delivery by instalments the Parties should
indicate every date of delivery for each instalment.
4. The type of delivery terms (trade term, time of delivery, partial
shipment or transshipment) that you choose affect not only the
price but also the risk of loss that you will have to bear
=> should think carefully before accepting the terms.
