AFFIDAVIT

I, MINERVA MANIEGO, of legal age, Filipino, married and

resident of 70 South Maya St., Philam Homes, Quezon City
accordance with law, hereby depose and say that:

1. I and Ceasar Melchor G. Ortiz were living together as

husband and wife without the benefit of marriage since 1999
until 2013.

2. During the course of our cohabitation, I was able to acquire

the parcel of land in Marikina covered by Transfer
Certificate of Title No. 009-2012005530 through loan
agreement with Philippine National Bank. The land is
registered to my name after the loan was fully paid.

3. Before the final payment of the property, Caesar Melchor G.

Ortiz proposed for the construction of an apartment in that
property. He furthered proposed that for us to finish
construction of the apartment, we have to borrow an amount
of P2,000,000.00 from her sister.

4. Caesar convinced me to execute any document to show that

he is a co-owner of the property so that his sister will lend
the amount of P2 Million. Consequently, I requested PNB to
include Caesar’s name in the deed of sale which was denied
by the PNB. I also executed an affidavit stating that Caesar
Melchor G. Ortiz is a co-owner of that property.

5. The truth of the matter is that the affidavit I have executed in

July 28, 2009 before Atty. Marcel G. Silvestre and the letter
dated July 20, 2009 to PNB are merely means to
accommodate the request of Caesar so that we can borrow
P2 Million from his sister. Had it been that Caesar is my co-
owner of the property, I could have executed a deed of
donation or deed of sale in his favor.

6. It was unlikely for me to purchase that property since I have

been an overseas Filipino worker in Japan from 1997 to
2009 when it was fully paid.
 7. Thus, I am recanting my statement in my affidavit dated July
28, 2009 that Caesar and I are the co-owners of the property.
The truth of the matter is that I am the sole owner of that
property.

8. I am executing this affidavit to attest to the truth of the

foregoing facts and for legal intents and purposes it may
serve.
