2. MATTERS TO BE INVESTIGATED:

a. To determine surrounding Circumstances behind the shooting incident that transpired

on November 30, 2022 at about 8:30 PM at Brgy 1 Poblacion, Catubig, Northern Samar
Victimizing Marvin Despe, perpetrated by suspect Mark Jeo Lee.

b. To determine the Criminal liability of the suspect for appropriate filing of the Case
before the court.

3. FACTS OF THE CASE

a. In the afternoon of November 30,2022, Catherine Despe 49 yrs old, appeared this PS
and alleged that at around 8:30 pm of same date, certain Mark Jeo Lee, shot to death
Marvin Despe, student of UEP-PRMC on the left breast part of his body which led to his
death. According to the witness namely Kiem Luna, at around 8:30pm in the evening he
saw Mark Jeo Lee running going outside the house where the incident happened, the
said Mark Jeo Lee was have a gun and blood to his cloth. Morover, judicial affidavits of
the complainant and the witness were made by this PS in order to file a case for
Homicide there inquest will be made However, the filing of such was not made within
the regulatory period of detention considering that the proof of death of the victim such
as post mortem report and death certificate are pending release on the ground that the
examining Doctor was out of town. A case for Homicide thru ordinary filing shall be filed
against the suspect, once the required is secured.

b. It was further supported by the post mortem issued by Catubig Northern Samar
Hospital dated November 30, 2022 signed by MA.CRISTINA MIRAS, M.D. attending
physician who conducted the post mortem examination, there appears the name of
Marvin Despe, 20 yrs old, single, student, and resident of Brgy 1 Poblacion Catubig
Northern Samar who was brought to their Hopital for post mortem examination on
November 30, 2022, it appears also the primary cause of death of the letter was shot on
his left breast part of his body.

c. Same in death certificate issue by the office of the civil registar of Catubig with
registry no. 105, their appear again the name of Marvin Despe, male, 20yrs old, single,
student, who died on November 30,2022 due to shooting incident in his left breast part
of his body.

D. same fingerprint laboratory report, according to the expert, that the latent print found
in the crime scene and the requested fingerprint from the suspect are found identical.

4. DISCUSSION

a. In this instant case, it is crystal clear that Mark Jeo Lee shot the Victim Marvin Despe
in the left breast chest of the body that resulted to his death. It also Clear that the
suspect has the motive of revenge against the victim due to previous incident occurred
between them.

5. CONCLUSION

a. In the View of the foregoing facts, there is no doubt that suspect have committed a
crime of Homicide when he killed the Victim. There was no aggravating circumstances
in the commission of his crime.

6. RECOMMENDATION
a.Let a Case of Homicide be filed against Mark Jeo Lee in Proper Court.

INFORMATION
The undersigned prosecutor, charges MARK JEO LEE, of the crime of Homicide
Committed as follows:
That on November 30, 2022 at about 0830H, at Brgy 1Poblacion, UEP-PRMC
Municipality of Catubig, Philippines and within the Jurisdiction of this Honorable Court,
shot of gun Caliber 45 and unlawfully, and feloniously, with just motive with intent to kill,
Shot Marvin Despe in the left breast part of his body Causing his instanteneous death.

CERTIFICATION AS TO CONDUCT OF INQUES

I hereby certify that the accused was lawfully arrested without a warrant and that,
upon being informed of his rights, refused to waive the provisions of article 125 of the
Revised Penal Code and for this reason, an inquest was conducted: that based on the
compalaint and the evidence presented before me without any countervailing evidence
submitted by the accused, despite the opportunity To do so, there is reasonable ground
to believe that the accused has committed the crime of Homicide and should, thus be
held for said crime, that this information was with prior authority of the city Prosecutor.

The undersigned Investigator of the Catubig Police Station at Brgy 1 Catubig Northern
Samar and the oath accuses MARK JEO LEE of Homicide penalized under Article 249
of the Revised Penal Code, committed as follows:

That on November 30, 2022 at about 0830H, at Brgy,1 Poblacion, UEP-PRMC

Municipality of Catubig, Philippines and within the Jurisdiction of this Honorable Court,
and accused armed with gun and with intent to kill Marvin Despe attack and shot said
Mark Jeo Lee dericting the blow against upon him one (1) shot of Caliber 45 in the left
breast part of the body Causing his instantaneous death.
