GROUNDS OF DIVORCE-

Section 10A of the Indian Divorce Act of 1869 allows Christians to seek divorce in two
ways:

1. Mutual Divorce: In Court, a divorce can be granted if both spouses agree to have one
and determine that they can no longer live together.
2. Contested Divorce: A divorce decree may be requested by either the husband or
wife. It is prohibited for a husband to engage in sodomy, cruelty, bestiality, adultery,
desertion without justification, to have gone unheard for seven years or more, to
assume the death of the spouse, to renounce the world, to cease being Christian, to
refuse to consummate the marriage with wilful refusal, or to act cruelly.1
