Dear Mayor Merrera III:
This pertains to your letter dated March 29, 2023 requesting for the Department’s
opinion on the following, quoted hereunder in toto:
1. Whether or not the Municipal Government of Binmaley can validly allocate funds
for additional benefits, subsidy/honorarium of Barangay Health Workers whose
main functions are primarily lodged with Barangay Local Government Units?
2. Whether or not a Sangguniang Bayan Member, on his own and without any
request from the Office of the Mayor, has the authority to allocate funding for
the ordinance providing for additional benefits, subsidy/honorarium of Barangay
Health Workers using the Special Purpose Appropriation funds under the
Office of the Mayor?
3. Whether or not a Sangguniang Bayan Member, through the proposed
ordinance, can unilaterally imposed programs and items of appropriations under
the Special Appropriation1 Purpose funds of the Office of the Mayor?
4. In the event that the said proposed additional benefits, subsidy/honorarium of
Barangay Health Workers cannot be validly funded by the Municipal
Government under the Special Purpose Allocation of the Mayor, where can the
appropriation be charged?

Per your representation, the Sangguniang Bayan of Binmaley, Pangasinan intends to

pass an ordinance, entitled: “An ordinance Providing Guidelines for the Registration
of Binmaley Barangay Health Workers (BHWs); Granting All Qualified BHWs
Additional Benefits and Subsidy/Honorarium, Appropriating Funds and For Other
Purposes”. Pertinent provisions are: (1) Benefits and Incentives of Municipal-Paid
BHWs; (2) Honorarium Subsidy for BHWs; (3) Financial Assistance to Retiring BHWs;
and (4) Appropriation for the Additional Benefits and Incentives for Qualified BHWs is
chargeable against the FY 2024 budget for Special Purpose Appropriation for Program
and Projects for Essential Community Services.

Thus, the above mentioned queries.

At the outset, this Department deems it wise to discuss the foregoing queries into one
discussion only as they are interrelated.
