CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This Contract to Sell, made and executed in the City of Zamboanga, Philippines,
by and between-

MOHAMMAD NUR CHIONG married to _____________________ of legal age,


Filipino citizen and a resident of Sagali, Zamboanga City, hereinafter referred to as the
“SELLER”,
- and -
HERNA J. HALPI-ALBANI and KIER ABDELHAKEEM H. JAMUD, of legal
age, Filipino citizens and a resident of Cabaluay, Zamboanga City, Philippines
hereinafter referred to as the “BUYER”;

WITNESSETH;
WHEREAS, the SELLER is the true, absolute and registered owner of that
portion Lot, more particularly described as follows with the following;

That it is hereby greed and understood that the BUYER shall pay the SELLER
the agreed for the amount price of One Hundred Fifty Thousand (P150, 000.00)
PESOS, Philippine currency;

NOW THEREFORE, for and in consideration of the foregoing premises and of


the mutual covenants and stipulations hereinafter set forth, the parties herein have
agreed as they hereby mutually agree to enter into this Contract under the following
terms and conditions:

1. That the BUYER shall pay a cash in the amount of FIFTY THOUSAND
(50,000.00) PESOS, Philippine currency as down payment and leaving a
remaining balance of ONE HUNDRED THOUSAND (P100,000.00) PESOS,
Philippine currency;

2. That the said balance amounting to ONE HUNDRED THOUSAND (100,000.00)


PESOS shall be paid in cash upon the settlement of the Transfer Certificate of
Title issued by the Registry of Deeds to the said BUYER.

3. That upon full payment, the SELLER binds himself to execute the Final Deed of
Sale and deliver unto the BUYER the Transfer Certificate of Title issued by
the Registry of Deeds and Official Receipt of the above-described Land. The
SELLER free and clear from any liens and encumbrance, except such as may be
subsisting by operation of law;

4. That it is hereby agreed and understood that in case of death, disability and/or
incapacity of either the BUYER or the SELLER, the compulsory heirs of the
BUYER and the SELLER shall respect and abide by the terms and conditions set
forth in this Contract to Sell and further shall assume the respective duties and
responsibilities agreed herein.

5. That the PARTIES agreed that the land/Lot referred to in this Contract shall be
held in trust by the lawyer pending full payment and execution of the Final Deed
of Sale.

6. That this Contract to Sell shall inure to the benefit of, and be binding upon, the
parties hereto and their respective heirs, legal representatives and assigns.

day of March 2023 in the City of Zamboanga, Philippines.

and every page hereof, and relates to a contract to sell of a parcel of land situated in the
Barrio of Sta. Maria, Zamboanga City.
