Beroni WARRANTY POLICY - TYRES

Every effort is made to ensure the highest possible standards of both material and workmanship.

1. Duration of Warranty:
Beri Udyog Pvt Ltd. (COMPANY) warrants and certifies to the customer (purchaser) that the tyres supplied
by them are warranted against failure to complete their satisfactory tyre life (tread pattern worn up to tread
wear indicator ‘TWI’ or 2 years from the date of purchase whichever is earlier) as a result of any inherent
deficiency relating to material or workmanship, leading the tyre to become unusable. No adjustment will be
entertained where the same or the notification thereof is made after the period of three (2) years from the
date of manufacture.

2. Condition of Warranty:
2.1 The Company’s/seller liability will be limited to the repair or replacement of the part, which are proven
defective within the aforesaid warranty period in normal, proper use and service as per schedule, when
owned by the original buyer only.

2.2 As manufacturer/ Company/seller does not have any control over the conditions under which a tyre is
operated, this warranty shall not cover the following reasons.
2.2.1 Tyre failure as a result of improper application, misalignment, wheel imbalance defective break,
shock absorbers, use of chains, non-approved rims, overloading, running flat, wreck, collision,
accident, any wilful, reckless or negligent abuse.
2.2.2 Operation of the tyre not in accordance with the recommended inflation pressure, Speed, load
specified by the manufacture and /Supplier.
2.2.3 Normal wear and tear.
2.2.4 Normal deterioration or damage.
2.2.5 Wrong or improper application of the tyre or for an application not in accordance with the
specification or recommendation of the manufacture of the Implement/machinery.
2.2.6 External influences such as the conditions of the road or other surface on which the tyre is operated,
chemicals, pollution, acid rain, hail, sand, air, salts, stones, fires, disaster - natural or otherwise and
any act of God.
2.2.7 Tyre once repaired / retreaded, worn through plies / ply exposed.

2.3 The forgoing warranty doesn’t apply to or include repair or replacement as result of
2.3.1 Accident
2.3.2 Mis-application / misuse / mis-handling / wrong handling.
2.3.3 Lack of proper maintenance.
2.3.4 Repair improperly performed or replacement improperly installed by any person other than an
authorized representative.
2.3.5 Modification without acknowledgment of the Manufacturer.
2.3.6 Normal wear & tear, deterioration or damage.
2.3.7 Damage from the external influence as environment condition, heavy stones, fires disaster –
natural or otherwise and any act of God.

The use of the product with replacement part not manufactured or supplied by the Company will invalidate
this warranty.

3. General Qualification:
3.1 The Company desires and expects that the purchaser shall make thorough examination of the company
product before buying. The authorized dealer of the company’s product are in no way the legal agent of the
company and have no right or authority to give any other warranty ,assume any obligation on its behalf ,or to
bind the company in anyway.

3.2 The Company’s liability under this warranty is dependent upon the strict observation by the purchaser of the
following provision:

3.2.1 The purchaser at the time of taking delivery shall complete, sign and return the product Delivery
Checklist and Warranty Card to the dealer.
3.2.2 The purchaser should ensure that all schedule service is carried out periodically without any lapse,
as per company recommendation, which is available in the Operator/Service Manual furnished with
each of the product/Implement.
3.2.3 Company reserve the right to make changes in the design or introduce any improvement or add
part on product at any time without incurring any obligation to install the same on product previously
sold.

4. Compensation Payable Under The Warranty:

4.1 The above warranty is in lieu of all other warranties expressed or implied, and no person agent or
representative of the company is authorized to give any other warranties on the company’s behalf or to
assume other liability in connection with above product.
4.2 Any product adjustment under this warranty will be considered upon inspection of the tyre by an accredited
representative of company. If a tyre is certified as defective (by an accredited representative of company)
within 10% of tread wear, then the tyre will be replaced on F.O.C. basis.
4.3 Any adjustment made pursuant to this warranty shall be based on the unused remaining tyre depth (RTD) or
prorata tread wear based on measurement of Non Skid Depth and percentage wear. The prorated
compensation will be calculated as follows:-
A = Original Tread Depth of the tyre, B = Remaining Tread Depth
Compensation = B / A x C
at the time of removal of the tyre, C = Cost of the tyre

4.4 Price ruling at the time of claim receipt will be taken for calculating the claim compensation.
4.5 Adjustment claims or parts replacement under warranty will be sent by Sea/Road transport on the Freight
paid basis.
OR
Along with subsequent shipment to the buyer.
OR
In the event of urgent requirement the parts will be sent by air on “to-pay” basis.

4.6 Warranty parts will be sent to dealer only and not to end user. Company will not cover any transport costs.
4.7 The warranty shall not cover or include any duty or taxes incurred by the purchaser in relation to the product
or any incidental charges such as loss of use of product loss of time, expenses of fuel, demounting &
mounting, telephone, travel, lodging, transportation, loss or damage to personal property or any form of
commercial or other loss of revenue.

All proceeding relating to any dispute arising between the company and the purchaser on the liability of the
company under this warranty shall be taken in civil court having JURISDICTION in KARNAL only.
