Dynamic Fuel Surcharge:

The fuel surcharge shall be calculated on basic freight based on average fuel price of four metro cities. Fuel
surcharge will Increase /Decrease by 1% with every Increase/ Decrease of Rs.3 /- in average fuel price of four
Metro cities; minimum 12% fuel surcharge shall be applicable.

❖ The average fuel price at the time of signing the contract is Rs 99.62/- per Ltr.

Other Terms and Conditions:

1. In case of cheque bounce, penalty charges of Rs. 500/- + “Taxes” will be applicable for each case.
2. Loading, Unloading Hamali, Warai, Thappi would be excluding if applicable.
3. Above Rates for one point Pickup & one point Delivery Only.
4. Vehicle Detention charges: Rs. 700/-.
5. Rate would be revised; in case of hike in diesel price or change in any Govt; policy.
6. TDS to be deposited against the PAN no. AAACV1559Q.
7. Transit insured by Consignor or Consignee and All material booked under “Owner Risk”, In case of any
claim against damage/shortage, theft etc. of consignments, our liability is subject to issue of “Certificate of
Facts” after receipt of Survey Report & other required documents from Customer.
8. Statutory requirements like eWay bill, Permits and /or any other legal documents shall be handed over by
customer to V-Trans at the time of booking as per the norms issued by Government of India or State
Government from time to time.
9. Demurrage charges shall be applicable beyond maximum of 7 days from the date of arrival at destination.
V-Trans shall provide 45 days period to collect the goods , in case of failure V-Trans shall have right to sell
the goods by auction, private contract or otherwise or even destroy the consignment as required under any
laws applicable from time to time, without prejudice to its other legal remedies to recover its dues. V-Trans
shall have the right of reconciliation of customer’s ledger and balance/accounts in books at the end of
every quarter and customer shall provide all relevant details and documents as and when required by V-
Trans.
10. Customer shall defend, indemnify, and hold V-Trans and its employees and agents harmless from and
against all claims, liabilities, losses, damages, fines, penalties, payments, costs, and expenses, including, but
not limited to attorney fees and costs of suit caused by and resulting from the violations of the terms of this
contract or negligence on the part of customer.
11. The consignment shall not contain any items or materials which are classified as prohibited or restricted or
hazardous or dangerous by any Authority or regulations or provisions of any Indian Law or by Laws of
public authority. In the event of any consignment being found containing any of the aforesaid items or
materials, the customers agrees and undertakes to indemnify V-Trans and its officers in respect of all claims
and losses that may arise consequent thereto. Further, the customer will be solely responsible for all cost
and consequences for booking any such items or materials through V-Trans.
12. The customer shall ensure that the packaging of the shipments is adequate to carry the shipment, carriage
worthy, so as to withstand the normal rigors, jerks and jolts of transportation hazards. V-Trans reserve its
right to reject any shipment, if the packing is not transit worthy.
13. The Customer agrees to pay and/or reimburse V-Trans on demand the service charge, penalties or all other
levy in respect of any consignment booked by the customer.
14. V-Trans shall not be responsible for any delay in delivery, loss or damage of the consignment caused due to
any act of God, force majeure including accidents, natural calamities, riots, commotion, strikes or any other

 cause whatsoever beyond the control of V-Trans or due to inherent defect in the contents or due to
criminal acts of third parties. No claim for loss or/and damage will be entertained by V-Trans in such event.
15. In the event of non-payment of any of the dues or payment, charges, levies or any other amount as
payable by customer to V-Trans, then V-Trans shall have lien on the goods of customer and V-Trans
reserve the right to liquidate the goods in lien to recover the amount payable from customer.
16. The terms and conditions printed on overleaf of the goods consignment note shall be considered as part of
this contract and in event of any conflict, the consignment note term shall prevail.
17. Customer shall indemnify V-Trans, its employees, directors & Officers etc. against any losses, claims,
expenses, liabilities and damages incurred, due to any misrepresentation, act, negligence, omission or
commission caused by the employees, servants, of customer including breach of terms of this Contract.
18. It is expressly understood and agreed by and between the parties that all shipments entrusted by Customer
and booked by V-Trans shall be on “SAID TO CONTAIN BASIS” i.e. V-Trans shall be under no obligation to
verify the description and physical contents of the shipments declared by the customer on the consignment
note, customer shall undertake and ensure to make correct and factual declaration on the consignment
note. However, V-Trans reserves right to inspect and/or refuse booking of shipments not conforming to
these terms and conditions, without assigning any reasons whatsoever. In case of imported shipment, the
customer has to inform the booking office of the V-Trans to get a pre inspection survey done before the
pickup of consignment. It is agreed between the parties that if V-Trans incurred any loss or damage due to
any misrepresentation made by the customers on consignment note then customer shall indemnify such
loss and damages.
19. In case of any dispute between the parties Mumbai courts shall have exclusive jurisdiction in the matter.

20. GST shall be levied at the prevailing rate @ 12% of invoice amount.
