A SYNOPSIS ON THE JUST CONCLUDED STAKEHOLDERS WORKSHOP ON THE REVIEW OF

STANDARD BIDDING DOCUMENTS AND PUBLIC PROCUREMENT HELD ON 8TH NOVEMBER 2022 AT
RADISSON BLU HOTELS IKEJA, LAGOS NIGERIA.

The Workshop commenced proper at about 25mins before 10am with an opening prayer from the
second stanza of the national anthem after which the opening remark was taken by the director
Bureau of Procurement, ably represented by the Director of Energy and Infrastructure, Bureau of
Public Procurement, Engr. Babatunde Kuye.

Shortly after that, the workshop session commenced which was handled by Barr. Chibuzo a
Managing Partner of the A and E Law Partnership. It was focused on the review of the draft standard
bidding documents (SBDs) and public procurement, where the draft of the new standard bidding
documents was contrasted with the old version developed in the year 2009 and last updated in the
year, 2011. The old SBDs consisted of the following sections:

1. Standard request for proposals small assignment (lump sum)


2. Standard request for proposals small assignment (time based)
3. Standard Bidding Documents national shopping
4. Standard Bidding Documents goods
5. Standard Request for Proposals complex lump-sum
6. Standard Bidding Documents complex time-based
7. Standard Bidding Documents small works
8. Standard Bidding Documents works
9. Standard request for proposals for the selection of individual consultants

Obviously, this was just 9 sections as against about 17 sections shown below,

in the updated draft of the SBDs awaiting reviews and comments by stakeholders and final updating
and implementation by the Bureau of Public Procurement. The obvious changes and updates which
have been observed at first sight between the two documents has been due to the lessons that has
been garnered over the years (over a decade now to be precise) through the implementation of the
2009/2011 SBDs whose gaps and shortcomings have been reasonably addressed to an appreciable
extent to come up with a template whose relevance to the contemporary bidding process in
compliance with worlds best practices which is to be fully adopted for use in the coming business
year. The Management of the Bureau thought it necessary to throw open the draft to the
Stakeholders and all responsible bodies, individuals and firms whose interests may in one way or the
other be affected by the proposed changes, so as to achieve a transparent and relatively unbiased
and generally accepted standard for operations and business in coming fiscal years. A deeper dive
was taken into the obvious increasing complexities of the procurement process in the recent times
and was aimed at consequently achieving a transparent system that can measure up to international
standards so as to be able to cater for an envisaged international and intercontinental jobs in within
the shortest time. As a matter of fact, only a brief of the above mentioned 17 documents was briefly
reviewed at the workshop due to the brevity of time and the voluminous nature of the materials so
developed. Questions regarding salient matters such as clarifications on certain clauses of the
Documents in terms of Scope, Registration with the Bureau of Public Procurement before or after a
contract has been won among other concerns were adequately addressed in the breakout and
closeout sessions.

The new draft of the Standard Bidding Documents (SBDs) consisted of a total of over two thousand
pages as against the previous copy which had only about a thousand and seven hundred pages. Due
the volume of materials to be reviewed, link access to the materials was provided for remote
downloads reviews and commenting within a space of two weeks from the date of the workshop
(22nd November 2022). To this effect every stakeholder was advised to focused on the aspect the
draft SBDs relevant to their area or line of business.
