MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENT

This agreement entered into between AURORA STATE COLLEGE OF TECHNOLOGY,


SCHOOL OF INDUSTRIAL TECHNOLOGY, with office address at Brgy. Zabali, Baler
Aurora, Aurora, Philippines, a duly recognized institution by the Commission on Higher
Education (CHED), represented in this agreement by DR. EUTIQUIO L. ROTAQUIO Jr.,
PhD., College President and hereinafter known as the “SCHOOL/INSTITUTION”.

And Automotive Engineering Technology, a bonafide student of the aforementioned school


with the occurrence of his/her legal guardian whose name and signature appears on this
document and are hereinafter known as the “ON THE JOB TRAINEE’

AND

Annie’s Motor Cycle Parts & Repair Shop, a duly registered company with an office address
at Sitio Hacienda Brgy Nonong Sr. San Luis, Aurora represented by RODOLFO TANGSON
in this agreement and hereinafter referred to as the “COMPANY”

WITNESSETH:

WHEREAS, ASCOT is a duly recognized Higher Education Institution (HEI) that offers the
course of Bachelor of Industrial Technology major in Automotive Engineering Technology and
with a curriculum requirement that the students enrolled in the abovementioned program undergo
Immersion II trainee;

WHEREAS, the FIRST PARTY, in its desire to enhance the training and development
of more and more professionals, has agreed to provide support to the students of ASCOT in the
form of training on the operations and latest developments in the industry;

WHEREAS, SECOND PARTY is a duly registered construction firm engaged in


exercising general supervision and control over the implementation of repair and maintenance of
construction projects which can enhance the skills of the practicumers.

WHEREAS, SECOND PARTY is willing, able, committed and ready to provide the on
the Immersion II trainee; and

WHEREAS, ASCOT and the Annie’s Motor Cycle Parts & Repair Shop executed a
Memorandum of Agreement that covers the internship program’s objectives and principles
pursuant to their established Internship Plan for the Student;

WHEREAS, the Student accepts this Agreement and the respective Internship Plan with
all its terms and conditions as contained herein;

NOW, THEREFORE, for and in consideration of the foregoing premises, the Parties
hereby agree as follows:

1. That the School/Institution, represented by the Director/Area Chairman/Program


Coordinator/OJT Coordinator, in relation to the Experiential Learning Program shall
undertake the following responsibilities:
1.1. Communicate and coordinate with the company representative or immediate
superior of the practicumer about matters related to the required experiential learning
objectives of the latter;
1.2. Provide the practicumer with orientations as regards to its objectives, to wit, target
learning outcomes, program final output, and evaluation after the program and even
behavioral conduct expectations while undergoing Experiential Learning Program;
1.3. Make periodic checks of practicumer, either through random actual location visits
or telephone calls to monitor his/her progress,
1.4. Require the students to submit their practicum progress reports during a scheduled
formal class meeting;

2. That the Annie’s Motor Cycle Parts & Repair Shop, represented by Mr.Rodolfo
Tangson, in relation to Industrial Immersion, shall undertake the following responsibilities:

2.1. Guide the students all over the training activities.


2.2. Provide mentorship to students and facilitate the provision of technical assistance;
2.3. Provide free relevant instruction, exposure, and training to the Student, consistent with
its policies, rules, and regulations and with the established Industrial immersion. It shall
treat the Student in a professional manner, and shall ensure that the Student, in the
course of training, shall not be exposed to any form of harassment/unethical practice or
tasks and work assignments that are unreasonably risky, dangerous, or unrelated to the
purposes of the Industrial immersion;

3. That the Student/Practicumer should abide by the following responsibilities:

3.1. The Student shall abide by the administrative policies, rules, and standards of the
Company/Institution and ASCOT as provided by the ASCOT Student Handbook;
3.2. The Student shall accomplish and submit to the assigned Industrial Immersion
Coordinator a weekly journal of activities, including success stories as well as
challenges and reflections on the training experience;
3.3. The Student shall report to the Department Industrial Immersion Coordinator
within two (2) days after completion of the training;
3.4. The Student shall accomplish the assigned tasks to the best of his/her abilities and
conform with the Industrial Immersion set forth by ASCOT/Department and the Annie’s
Motor Cycle Parts & Repair Shop;
3.5. The Student shall complete the agreed scope of work within the agreed duration
of the Program; and
3.6. The Student shall timely report for training and promptly accomplish assigned
tasks or assignments in the best of his/her ability and in view of his/her expected skill
and knowledge of the subject matter.
3.7. The Student should prepare and present the outcome of the Industrial Immersion
in the Faculty of Industrial Technology in order to evaluate its learning knowledge and
skills.

4. General Conditions:

4.1 The duration of the program shall be equivalent to 240 working hours commencing on
the deployment of students which should be completed within 6 weeks.
4.2. The Student shall report for work at the Annie’s Motor Cycle Parts & Repair Shop
located at Sitio Hacienda Brgy Nonong Sr. San Luis, Aurora, from 8:30 am to 5:30 PM,
which is inclusive of a one (1) hour break/launch time and reasonable
morning/afternoon break times not exceeding Fifteen (15) minutes;
4.3. The Company/Institution and ASCOT will conduct a post-training review and
evaluation of the program and the performance of the Student;
4.4. The Company/Institution and ASCOT will conduct a post-training review and
evaluation of the program and the performance of the Student;
4.5 The Company/Institution is not obliged to employ the Student upon completion of the
training. The Company/Institution, however, upon consultation with the ASCOT, may
invite qualified students to submit themselves to examinations, and interviews, and file
pertinent documents in support of their application;
4.6 The Student shall be personally responsible for any and all liabilities arising from
his/her gross negligence in the performance of his/her duties and functions while under
training with the Company/Institution;
4.7 The Parties shall not divulge any information that it may have access to and any such
information will only be used for academic purposes;
4.8 This Agreement shall not, in any way, constitute an employee-employer relationship
between the Company/Institution with the Student;
4.9 The Student shall be personally responsible for any and all liabilities, injury to
his/herself, or to property or persons attributable to his/her own fault or negligence
while in the course of his/her training. In this light, the Student shall hold the
Company/Institution or ASCOT free and harmless from any demand, claim or
complaint, whatsoever arising from this training agreement, except in cases of gross
negligence, malicious acts, and criminal acts by any of the officers, employees or
agents of the Company/Institution or ASCOT;
4.10. In the event that the Student materially violates any company policy, the
Company/Institution shall have the right to immediately, with due process, terminate
the Internship Plan in relation to such Student by immediately serving a written notice
to ASCOT;
4.11. Should any provision of this Agreement or part thereof is rendered void, illegal, or
unenforceable by any law to which it is subject, it shall be rendered void, illegal, or
unenforceable only to that extent and not further. The invalidity or unenforceability of
any provision of this Agreement shall not affect or impair other provisions that are
valid, binding, and enforceable

5. This MOA shall be effective on the date of signing by both parties until either party notifies
the other of its intention to terminate it, in which event; the MOA shall stand terminated at
the end of the student’s training.
6. This MOA will be effective from the date of signing by both parties and will last for five (5)
years renewables for the same number of years.

IN WITNESS WHEREOF, the parties have signed this Memorandum of Agreement at


the date and place above-stated.

Both are known to me to be the same persons who executed and signed all the pages of the
foregoing instrument together with their witnesses. This agreement consists of four (4) pages
including this page where the acknowledgment is written, and the parties thereto acknowledge to
me that the same is their own free and voluntary act and deed and that of the entities which they
respectively represent.
