RESOLUTION EARNESTLY REQUESTING ENGINEER POL DE LOS SANTOS, REGIONAL

DIRECTOR DPWH- CARAGA REGION XIII TO GRANT ON USING ROAD RIGHT OF WAY ON
NATIONAL HIGHWAY FOR TRICYCLES ALTERNATE ROAD WITHIN THE JURISDICTION OF
CARMEN, AGUSAN DEL NORTE

WHEREAS: House Bill # 279, sponsored by Representative Evelina G. Escudero “ AN ACT

PROHIBITING TRICYCLES TO PLY ALONG NATIONAL HIGHWAY AND PROVIDING PENALTIES
FOR VIOLATION THEREOF.”

WHEREAS; Under the guidelines issued by the DOTC (DOTr), as reiterated under the Department of
Interior and Local Government Memorandum Circular nos. 2011- 68 and 2007- o7, tricycles are
prohibited to ply along national highways utilized by four wheeled vehicles greater than 4 tons and where
normal speed exceed of 4o km per hour. If there is no alternative route or road network available for
tricycles, such as routes beyond the town proper, however the Sangguniang Bayan/ Panlungsod shall
provide exception through the enactment of an ordinance.

The unregulated tricycle operations pose hazards to commuters and tricycle drivers themselves that so
often lead to loss of lives. further, the presence of tricycles along the national highways where there are
buses, jeepneys, cars and other motor vehicles impedes the flow of traffic.

WHEREAS; Another DILG Memorandum Circular No. 2020- 036, under section ll paragraph C,
Infrastructure Development- Immediately upon the effectivity of this memorandum, LGU’s are enjoined to
include in their plans the construction of local roads or overpass which shall serve as an alternate route
for tricycles and pedicabs. Further, the Tricycles Route Plan of LGU- Carmen, Agusan del Norte shall be
valid only for two (2) years from the issuance of this memorandum. Thereafter, LGU- Carmen is
expected to have constructed necessary route for tricycles and pedicabs.

WHEREAS; The Municipal Development Council of LGU- Carmen, Agusan del Norte held a meeting last
June 04,2020 pertaining the budget for calendar year 2021, and one highlight agenda was the
tricycles/pedicabs alternative road. The said council chaired by Honorable Mayor, JOVITTE C. CALO,
suggested to use the national highway- road right of way for the construction of tricycles/pedicabs
alternate road within the jurisdiction of Carmen, Agusan del Norte.

NOW, THEREFORE-

BE IT RESOLVED; by the Sangguniang Bayan of Carmen, Agusan del Norte, in session duly assembled
to earnestly requesting ENGR. POL DELOS SANTOS- Regional Director of DPWH, Caraga Regional
Office XIII, Butuan City for granting to use the national highway Road Right Of Way for tricycles/
pedicabs alternate roads within the jurisdiction of Carmen, Agusan del Norte.

RESOLVED FURTHER; To transmit copies of this resolution to HONORABLE JOVITTE C. CALO,

Municipal Mayor for her information and appropriate action.
