Subject:- Request for re-investigation of case FIR No. 45/2023 u/s 452
/323/504/506
/ 382/147/148 ipc, 4/25 Arms Act P/S Lakhanpur District Kathua (J&K).

Sir,
With due respect and humble submission I Vikas Mahjan R/o Pathankot beg to
submit the following few lines with regard to subject cited above for your kind
consideration and re-investigation of the above case.
1. That On 24-04-2023, the munshi of our M/S Om stone crusher situated at
Gandyal namely Roshan Singh s/o Shamsher Singh r/o Gandyal Kathua
informed us telephonically that Darshan Singh s/o Baghwan Singh r/o vill.
Keerian teh and distt Kathua along with other 6/7 persons including tipper /
tractor trolly drivers are indulging in illegal mining and extracting the mineral
material i.e. bajri /sand from river bed Ravi river and doing all this forcefully.
2. That after receiving this information we informed the SHO P/S Lakhanpur
immediately and also inform the D.M.O . Kathua Mr. Rajinder Singh.
3. In the meantime at about 11.30 pm on 24/04/2023 my self along with Police
party of P/S Lakhanpur lead by ASI Major Lal belt No EXJ-955917/ in the gypsy
and with 20/25 Police personals in the Police bus reached on spot. In the
meantime I/C Police post Keerian Gandyal along with some police personal
also reached on spot. DMO Kathua Mr. Rajinder Singh Mobile No
9697557499 / 8494043217 along with his staff Kamal Kumar M.No
9697546612 and Joginder Singh driller helper also reached on spot .
4. After seeing the police party, DMO and officials of the Mining department, the
alleged persons Darshan Sngh and others fled away from the spot. The Mobile
No. of Darshan Singh is 9464786486.
5. Police party and DMO Kathua along with his team took the cognizance and
detained 05 tipper drivers along with loaded 05 tippers of bajri/sand and
pb02cr8897, pb06k 8786, pb06l 4786, pb35q 9926 and pb02cc 7797 (photographs
attached here with).
6.Darshan Singh who is complainant in the said case FIR No. 45/2023 u/s
452/323/504/506/382/147/148 IPC, 4/25 Arms Act P/S Lakhanpur stated in his
statement u/s 164 cr.pc that after seeing the police party /other officials of
Mining department we fled away from the spot and could not identified the any
persons in the place of occurrences. He also stated that he himself received injury
while fleeing. He further stated that he has found his stolen amount. In his
statement he stated that owner of crusher namely Mast Ram was present but we
verified that he was not present at the place of occurrence, since it can be verified
through CDR of his Mobile No.
7.It is further submitted that Sh.Abhinav Mahajan who is arrayed as accused in
above said case but he was present in the time of occurrence at Pathankot
alongwith his family & friends, the mobile No. of said Abhinav Mahajan is
9872140336 which can be verified through his CDR/CCTV footage which is also
available. However, the friends namely Divas Puri S/o Bittu Puri r/o Pathankot and
Alok Tehran s/o Anoop Tehran r/o Pathankot who were accompanied him at
Pathankot when occurrence took place(CCTV footage attached herewith for your
kind information)

8. It is also requested that the statements of DMO Kathua Mr. Rajijnder Singh and
his staff members who were present in the place of occurrence are required to be
recorded in the said case.
9. Moreover the statements of all tipper drivers whose tippers were seized are
required to recorded in the case.
10.Also the statements of ASI Major Lal PID No.EXJ-955917 of P/S Lakhanpur
along with nafri and I/C PP Keerian Gandyal who were present at the time of
incident in the place of occurrence are required to verified and recorded
( photographs of all police personnel/mining officers/officials are enclosed
herewith).
11. It is requested to kindly collect the CDR of all alleged
persons/complaint/witnesses for further investigation.
12. It is apt here bring to your kind notice that the SHO/I.O of the case has not
bothered to collect all these evidences. He is investigating the case in a
Very casual manner and showing quite unprofessionalism. Even we have
given CCTV footage to the SHO/I.O of the case.

Keeping in view the above mentioned facts it is vehemently prayer before your
goodself to kindly direct the SHO P/S Lakhanpur to personally investigate the
investigation of the case FIR No 45/2023 u/s 452/323/504/506/382/147/148 IPC ,
4/25 Arms Act so that the investigation ought to be based on facts and reach to
its merit as early as possible.
