The Commissioner warrant was re-issued to me by this Honorable Court on

4.11.82 to measure the petition mentioned property with the help of a qualified
surveyor to divide the suit property.

In pursuance of the above directions, I visited the suit properties on 7.4.83

accompanied by Mr.Nanoo Nair, Taluk Sub Inspector of Survey, Coimbatore the
petitioner’s counsel and Mr.Rajamanickam, T.Junior counsel of the respondent’s
counsel and the work was commenced at about 3.45 P.M. and completed at about
6.00 P.M. on the same day.

The suit properties is part of S.F.No.24 measuring 1.74 acres out of a total
extent of 4.74 acres in Vadavalli Village, Coimbatore taluk. At the time of
inspection it was found out after referring to Survey records that S.F.No.24 had
already been sub divided and the suit property is S.F.No.24/1 and it measures
totally 1.78 acres. Details of measurements are given with rough sketch enclosed.

As already suggested in my earlier report dated 24.9.82, an extent of 62

cents on the south eastern side of S.F.No.24/1 measuring 249 links on all the four
sides be allotted to the petitioners towards their share as per the preliminary decree
marked in yellow in the rough sketch. The rough sketch may be treated as part and
parcel of this report.

Petition filed on 25/2/1982 under order XX rule 18 and order XXVI rule 13 read
with Section 151 CPC to partition and allot the plaint schedule property.

This petition, with the Petitioners represented by Thiru. T.Sadasivam and the
Defendant represented by Thiru. R.Rajamanickam has been taken up by me for
final hearing before this court on 29.4.83. After reviewing the affidavit, the
defendant's statements and all related documents, and arguments of both the
plaintiff’s and the defendant that were under my purview to this day, this court
pronounces the following order and passes this final decree.

1. In the attached plan drawn out by the Commissioner, the area marked and
highlighted in yellow is allotted to the plaintiff’s 1 to 5.

part of this judgment and final decree.

Schedule of Property

Within Coimbatore Joint II Sub-Registrar Office, Coimbatore Taluk,

Vadavalli Village, Survey No 24 totaling 4.74 acres (tharam 6.8.0), east of
the land owned by Kutti Ramasamy Naicken, south of the land owned by
Mumma Naicken, west of the land owned by Maruthachala Naicken, within
this a sub-division of 1.74 acres (tharam 2–6–0) of land and in addition, the
2 Jujube trees standing on the land.
