Exercises on drafting an RTI application and legal


opinion.

Learning Objectives:

● Learn to draft RTI applications.

● Learn to identify the public authority to whom the RTI application is to be filed.

● Learn how to draft a legal opinion.

Exercise 1: Drafting an RTI application.

A. Raj studies BA.LLB in Nagpur university. He is aggrieved with the evaluation


of the answer books by the university as his grades have fallen due to the
poor assessment. He approaches you to draft an RTI application for
demanding copies of the answer books. Draft an RTI for him and advise about
the RTI filing fees required to obtain the said information. Also, identify the
Public Authority to whom the RTI application shall be filed. Following are the
subjects:

1) Code of Criminal Procedure;

2) Indian Penal Code;

3) Indian Evidence Act;

4) Intellectual Property Law;

5) Constitution of India;

6) Company Law

There are 40 pages for one answer book.

B. After 25 days, Raj receives a reply. The information is refused stating that the
university rules provide that answer books cannot be obtained. Is the response of the
Public Officer valid? Answer with proper reasons.

Exercise 2: Draft a legal opinion.

Raj received poor marks in his examination. He is very upset about the same. He
wants to know about the identity and address of the evaluator. Can he file an RTI on
this point? Answer with proper statutory reasons and precedents, if any.
