PRELIMINAR INFORMATION

1. Policy 156 “Tender Process” (dated 21/11/2016) regulates the Direct Awarding (purchase to a single supplier, without
performing a tender process).
2. It is mandatory to specify the data of the provider selected, mark the Direct Awarding type and explain in a
clear way the need to award to a single supplier without running a tender process.
3. All the Direct Awarding shall be authorized by the Head of the Requesting Unit (i.e. organizational unit identified in an
Organizational Directive in force).

DIRECT AWARDING CASES

Direct awarding to a single supplier, without performing a tender process, is allowed only under specific circumstances
hereafter described:

When no suitable bids are available after having performed a tender
when the products involved are manufactured exclusively for the purpose of research, experimentation, study or
development; direct awarding shall not be allowed for the supply of products manufactured to test the commercial viability
or to recover research and development costs.
when, for technical or artistic purposes or those connected with the protection of exclusive rights, the contract can be X
awarded only to a specific supplier company.
when, due to the extreme urgency caused by unpredictable events, the timing of contract awarding does not fit the
deadlines defined by
Requesting Unit requirements.
For additional deliveries by the original supplier in the following cases:
-partial replacement of supplies or installations currently in use
-extension of existing supplies or installations
-if the change of supplier would require the purchase of material with different technical characteristics, whose use or
maintenance would result in incompatibility or disproportionate technical difficulties
for contracts to be awarded under a prevailing national or international framework agreement, provided that the framework
agreement has been awarded in accordance with applicable regulations.
for purchases with conditions of particularly advantageous and short-lived terms and/or prices, in order to buy these
supplies with considerably
lower cost compared to current market conditions

Brief description of the contract scope

Dada la obsolescencia funcional y tecnológica del actual sistema de compras de energía de CODENSA es requerido tener una
aplicación que cubra las necesidades del área de negocio que cumpla con los estándares de desarrollo exigidos por el grupo
ENEL y que haga parte de una plataforma unificada para los sistemas de compras de energía a nivel del grupo ENEL en
Colombia.

Se ha encontrado que el sistema Ingenplan, desarrollado por el proveedor INDRA Colombia Ltda. que actualmente se utiliza
en EMGESA, es compatible con la funcionalidad del área respectiva en CODENSA por lo que al adquirir dicho sistema para
CODENSA se optimizan costos de licenciamiento de producto, se logran sinergias en el desarrollo y se mantiene una
plataforma unificada para Colombia.
 JUSTIFICATION

Motivation of the Direct Awarding

El proveedor INDRA ya desarrolló un sistema similar (Ingenplan) para la empresa EMGESA, dicho producto servirá como
plataforma base para el desarrollo para CODENSA, aprovechando así el conocimiento específico y la experiencia del
proveedor. Teniendo en cuenta lo anterior, es necesario iniciar un proceso de adjudicación directa para la
implementación del producto en CODENSA y lograr la actualización tecnológica y funcional requerida por el negocio
para apalancar sus metas.
El valor del importe incluye la adquisición de las licencias de Ingenplan, Greporting e Ingencom.
