 TERMS AND CONDITIONS
1. China Bank Savings (hereinafter called the Bank) on behalf of the applicant, may use any correspondent, agent, or sub-agent to remit the aforesaid amount through its customary
channels.
2. The Bank, in making the remittance, shall not be responsible for any loss or damage arising from any cause beyond its control, including but not limited to the following:
a. the act, failure, neglect or default of the Bank’s correspondents, agents, or sub-agents;
b. any delay, error, omission, mutilation, interruption, or default in the transmission of messages by any mail, telegraph, cable, or wireless company, or otherwise;
c. any act of government, its agencies, or unit exercising governmental powers, de jute or de facto;
d. Inconsistency between the name and account number of the beneficiary in this application form.
3. Notwithstanding the discrepancy mentioned in No. 2 (d) above, for PESONet transactions, the receiving bank may, at its sole discretion, proceed with the transaction if it finds that
the account number in this application form properly matches the account number on its record.
4. The Bank may send any message in connection with this transfer in plain language, code, or cipher. The Bank shall not be liable for errors, neglect, or default of any correspondent,
agent, or sub-agent.
5. The Bank is authorized to disclose Applicant’s name, account number and/or other account information contained in the application form to the beneficiary, receiving bank and any
other parties involved directly or indirectly in the transmission of the payment for the purpose of processing the telegraphic transfer. The Bank shall not be liable to any loss or
damage arising from its disclosure of account information.
6. Any refund of the remittance amount if requested by the Applicant from the Bank, shall only be made once the Bank has received a written confirmation of effective cancellation of
the remittance from the Applicant and after receipt of the funds/reimbursement from the corresponding bank. In case the funds were already converted to another currency,
refund shall be made based on the Bank’s applicable exchange rate at the time of the refund transaction, net of expenses and charges that the Bank and its correspondents, agents
and sub-agents have incurred.
7. When payment is returned by a beneficiary bank, the amount returned may differ from the original transaction because of charges deducted by the beneficiary bank and/or
differences in the prevailing exchange rate when returning the payment, beneficiary bank charges are outside the Bank’s control. Any charges taken by the beneficiary bank at the
time the initial payment was processed will not be refunded to the Applicant in the event that the payment is returned. Should the Applicant wish to re-execute the payment
transaction, the Bank’s standard charges shall apply.
8. The Applicant agrees to comply with the Bank’s policies in relation with anti-money laundering and counter-terrorism financing regulations of the Bangko Sentral ng Pilipinas (BSP),
Anti-Money Laundering Council (AMLC) and other appropriate government agencies. The Bank is required to act in accordance with the laws and regulations operating in various
jurisdictions which relate to the prevention of money laundering, terrorist financing and the provision of financial and other services to any person or entity which may be subject to
sanctions. The Bank may take any action which it in its sole and absolute discretion considers appropriate to take, in accordance with all such laws and regulations. Such action may
include but not limited to (a) the interception and investigation of any payment messages and other information or instruction sent to or by the Applicant or on its behalf, (b)
making further inquiries as to whether a name which might refer to a sanctioned person or entity actually refers to that person or entity and (c) reversion of the telegraphic
transfer.
9. The Bank, duly represented by its Correspondent Bank, reserves the right not to process this application and/or to reverse the telegraphic transfer, if the Bank is of the opinion that
the Applicant violated the aforementioned policies or if any information given is incomplete or is not sufficiently clear or false or might be involved in a breach of any sanction
imposed by governmental, quasi-governmental and regulatory authority in any relevant jurisdiction which is likely to result in loss of funds or a penalty being imposed by the Bank.
The Bank has the right at any time to reject, refuse or reverse the telegraphic transfer (whether in whole or in part) effected on behalf of the Applicant in order to comply with any
applicable laws, regulations, guidelines, restrictions and administrative rules.
10. Any draft is issued with the distinct understanding that it will be forwarded immediately for presentation to the drawee. The Bank will not be responsible should the draft be
dishonored as a result of delay in presentation or late arrival or non-arrival of advice of drawing or any other reason beyond the Bank’s control.
11. Refund may be made if requested by the applicant, but only if and after the Bank receives all copies of the demand draft issued are surrendered and on the basis of the Bank’s
buying rate on the day refund is made less the expenses of the Bank, its correspondents, agents, and sub-agents.
12. In the event the demand draft is lost, stolen, or destroyed, the Bank reserves the right to impose any condition relative to the refund/replacement of the said draft.
13. Should the Bank become involved in any litigation arising from, connected with, or otherwise related to, this application and/or transaction(s) contemplated herein including but
not limited to any inconsistency(ies) between the name and account number of the beneficiary indicated in this application form, any and all losses, liabilities, claims, damages,
attorney’s fees, expenses, and the like, which the Bank may be made to pay, incur, or advance, shall be paid/reimbursed by the applicant, immediately upon demand.
