Discuss. Support your answer with relevant constitutional provisions and case law. (20 marks) 00440 Question Nos. 03 and 04 are based on the following factual scenario. In answering the questions given below assume that the Constitution of Saja is similar to that of the Second Republican Constitution of Sri Lanka, The State of Saja is a small island located in the middle of the Namibian ocean. Recently, a majority of the members of the Saja Parliament signed a resolution and presented it to the Speaker of the House, to initiate impeachment proceedings against the Chief Justice of the country. The resolution contained ten allegations relating to misconduct and non-disclosure of financial assets. Thereafter, a Parliamentary Select Committee was appointed to investigate the charges against the Chief Justice. The Parliamentary Select Committee was composed of seven Cabinet Ministers and four members of Parliament from the opposition political parties. However, before starting the hearing the four members from the opposition political parties refused to represent the committee and resigned from the committee. Meanwhile, the legality of the Parliamentary Select Committee was questioned in the Supreme Court of Saja. Based on the legal proceedings initiated in the court, the Supreme Court requested Parliament to suspend the impeachment proceedings until the court deciding the matter. The Parliament disregarded the Supreme Court’s request and the Chief Justice appeared before the Parliamentary Select Committee for the hearing. However, after two days,the Chief Justice walked away from the hearing in protest over the denial of a fair hearing and principles of natural justice. It ‘was pointed out that the Chief Justice was not provided full disclosure of the evidence in relation to the charges; was not given adequate time to respond to the charg ; was denied the right of cross - examination; and was treated in a derogatory and disrespectful manner by some members of Parliament in the committee and denied the right to a public hearing. However, without responding to all these allegations, the remaining members of the Select Committee concluded their investigation and decided that the Chief Justice was guilty of four charges out of the ten. Subsequently, the Supreme Court ruled that the appointment and the legal status of the Parliamentary Select Committee were not constitutionally valid. Meanwhile, the Court of Appeal of Saja issued a writ quashing the findings of the Parliamentary Select Committee after hearing a writ application filed on behalf of the Chief Justice, It further ordered the Parliamentary Select Committee to reinitiate a proper proceeding to investigate alleged offences leveled against the Chief Justice. However, disregarding both orders the Parliament of Saja passed a motion with two third majority to impeach the Chief Justice. The following day the President of Saja endorsed the decree to remove the Chief Justice from office and delivered it to the Chief Justice. In a public statement made by the 00440 Chief Justice after removal from the office, the Chief Justice said “The accusations leveled against me are blatant lies. Iam innocent of all charges and I have been unlawfully removed from office”. As a member of the Special Committee appointed to draft a new Constitution for the State of Saja, you are supposed to submit a report on the rule of law and the applicability of this concept under a democratic Constitution, Prepare your report in the light of the importance of upholding the rule of law in the State of Saja with special reference to the narrow interpretation of the rule of law.
