NOTICE INVITING TENDER

8 PRINTED FORMS OF TENDER: Consisting of detailed plans, Technical Specifications, schedule of quantities, of
work to be completed and set of ‘Conditions of Contract’ for the Contractor who will be awarded this project, can
be obtained upon at the address as detailed in para 6 above.
9 The project site is available for start of work on the date as stipulated in these documents.
10 The acceptance of the tender will rest with the Owner, who does not bind itself to accept the lowest tender, and
reserves to itself the right and authority to reject any or all the tenders received without assigning any reason
thereof. All tenders in which the prescribed requirements and conditions are not fulfilled or are incomplete in any
respect are liable to be rejected.
11 Canvassing in respect with the tenders is strictly prohibited. Tenders submitted by contractors who resort to
canvassing stand the risk of their tenders being rejected.
12 Upon award of contract for this project, names of the accredited representatives of the contractor responsible for
this project shall be submitted to the Owner within 7 days after the date of written instruction to commence
works.
13 Sales tax, Turnover tax, GST or any other materials, in respect of this contract shall be made payable directly by
the Contractor to the authorities concerned. The Owner shall not entertain any claim what so ever in this respect.
In the event of nonpayment / defaulting in payment of dues and CPF etc. by the contractor, The Owner reserves

the right to withhold the dues/payment and make payments to the local / state / central Government Authorities or
to laborers as maybe applicable and same sum shall be adjusted from the amounts due to the contractor.
14 VALIDITY OF OFFER
The tender for this development work shall remain open for acceptance for a period of 90 days from the date of
opening of tenders. If any tenderer withdraws his tender before the said period or makes any modifications in the
terms and conditions of the tender which are deemed by the Owner to be not acceptable, the Owner, shall without
prejudice to any other right or remedy, be at liberty to forfeit the said earnest money.
15 The tender for the work shall not be witnessed by a contractor who himself/themselves has/have tendered or who
may tender for the same work. Failure to observe this condition would render tenders of the contractor tendering
as well as witnessing the tender liable to summarily rejection.
16 If it is found that the tender is not submitted in proper manner, being full of omissions, corrections or unreasonable
rates and amounts, The Owner reserves the right to take suitable action against the contractor.
17 The contractor shall comply with the provisions of the Apprentices Act 1961, and the rules and order issued from
time to time. Failure to comply will represent a breach of the contract and the Owner, may at his discretion cancel
the contract. The contractor shall then be held liable for any pecuniary liability arising on account of any violation
by him of the provisions of the Act.
18 Unsealed tenders will be summarily rejected.
19 Before tendering, the contractor shall inspect the site to fully acquaint himself with all existing site conditions in
regard to the accessibility of site, nature and extent of land parcel, space for construction staging and phasing,
installation of T & P etc. conditions affecting accommodations and movements of labour etc. required for the
satisfactory execution of the contract. No claims what so ever on such account shall be deemed admissible by
The Owner. Under any circumstances.
20 The contractor shall diligently review all Technical Specifications and carefully study the tender drawings, in
conjunction with this document prior to submitting a tender. Any omissions or failure to understand any portions of
this tender documents shall remain the responsibility of the Contractor
21 The contractor’s responsibility for the project shall commence from the date of issue of Letter of Intent for this
project
22 The contractor should verify accuracy of all plans, elevations and sections shown in the tender drawings and in
case of doubt, should make every effort to submit written questions to the Owner for clarifications. No allowance
shall be made in the contract sum for any such failure to reconcile or fully understand these documents for any
potential conflicts
23 Tender documents shall be submitted as per Format provided. All tenders shall strictly conform to this
requirement. All tender documents shall be completely filled in and where necessary, initialed. Incomplete tenders
are liable to be rejected.
24 The Contractor, in submitting the tender, must provide complete and satisfactory information regarding its
financial standing, technical and specific organizational capacity to execute the work, including CV’s of the Core
Team to be assigned this project and all other information to support the stipulated terms and conditions attached
herein, beyond any doubt.
25 The Contractor shall submit an Updated List of Current Projects underway along with the value of work
undertaken by Contractor & the time period of completion/expected completion.
26 The Contractor shall submit details of construction machineries/owned and proposed to be deployed for the
project
27 RATES
1) The contractors shall quote in figures and words the rate, and amount tendered in by them. The amount of each
item shall be clearly stated and the requisite totals given.
2) In case of figures, the word “Rs.” should be written before the figures of rupees and word Ps. After the decimal
figures e.g. Rs.2.15 Ps and in case of words the word Rupees should precede and the ‘Paise’ should be written at

the end. Unless the ratio is in whole rupees and followed by the words ‘only’ should be written closely following
amount which should not be written in the next line.
3) An item rate tender containing percentage below /above will be summarily rejected. However, when a tenderer
willingly offers a rebate, this offer may be considered.
4) Rates quoted by the contractor in item rate tender in figures and words shall be accurately filled in so that there is
no discrepancy in the rates written in figures and words. In case of discrepancies, the following procedure shall be
followed:
- When there is difference between amount in figures and words, the rates corresponding with the amount
worked out by the contractor shall be taken as correct.
- When the amount of the item is not worked out by the contractor or it does not correspond with the rate
written figure or words then the rate quoted by the contractor in words shall be taken correct.
- When the rates quoted by the contractors tally in words and figures but the amount is not worked out
correctly, the rate taken by the contractor shall be taken as correct and not the amount.
5) (a) Rates quoted shall cover the providing the waterproof stores for 1000 bags of cement with suitable lock and
key arrangement.
(b) Rates quoted shall cover the cost of site laboratory for routine tests. The Contractor shall equip this lab with
all such equipment as required to perform tests for a project of this type
© Rates shall include costs for removal and demolition of all temporary facilities constructed for this project and
shall include all storage sheds, working yards, etc and leave the site level, clean of debris and returned to original
condition after completion of works or instructed by the Owner from time to time or before final payment.
6) Rates quoted shall include all scaffolding, hoists, tackles, and other planks, shuttering profiles and all other
equipment generally required for proper execution of the work.
(a) Rates shall be inclusive of all taxes of octroi, toll, professional tax, royalties or any other taxes or levies etc
payable directly by the contractor to the taxing authorities except applicable GST. Owner will not review or
approve any such type claims.
(b) In the event of nonpayment or default in payment of any Sales tax, Turnover tax, Excise Tax, WCT or any
other tax including labour payment of PF shall be deemed owed to the Owner from contractors and to be fully
settled prior to final payment.
7) The rates for all items of works, unless clearly specified otherwise, shall include cost of all labour, materials and
other inputs involved in the execution of all such items.
8) The quoted rates shall be for all heights, lifts and leads and depth unless specified otherwise.
9) The rates quoted by the contractor shall cover the cost of loading, transportation to site and unloading, storing
under covers as required, assembling of parts, and incorporating or fixing materials in the project site including all
preparatory works as is required foreclosing, preparing, loading, returning empty case of containers to the place
of Origin. For Owner supplied items unloading, storing under covers as required, assembling of parts, and
incorporating or fixing materials in the project site including all preparatory works as is required shall be included
in rates.
10) The contractor is bound by the rates quoted for all items, irrespective of quantities mentioned in the tender. No
extra amount will be paid due to alteration, variation, omissions, modifications of the quantities put to tender
unless specifically agreed to by the Owner.
11) Contractor shall be responsible for liberal curing of brickwork, RCC, PCC, Plaster etc. or as per requirement of the
respective and relevant Code. Any deviation or non-compliance will result in the dismantling of all such works, at
the cost of the contractor and no extras payable for curing this defect
12) Position, level and layout of the foundations pedestals, inserts, portions, access, reinforcement and formwork
shall all be verified as being absolutely correct and consistent with Contract Documents and shop drawings, prior
to commencement of concrete installations.

13) Rates quoted shall be inclusive of establishing workers housing quarters outside the project site, at a location to
be determined by Contractor within a radius of 3 KM from the project site. The cost incurred by the Contractor on
this account deemed to be included in the rates as quoted.
14) The Owner reserves the right to source and place orders for any item or group of work, including the right to split
the work between two or more subcontractors, if such actions are determined necessary to keep the project on
schedule. Such corrective actions shall not constitute a breach of contract.

15) The tender should be submitted in English language only. Supporting documents such as Annual accounts,
Balance sheets, Owners certifications, Testimonials etc., if attached in any other language, should be translated
into English and certified to be correct by the relevant diplomatic mission or Embassy.
16) Overwriting shall be avoided. Mistakes shall be scored through and corrections incorporated and attested by the
authorized signatory. All pages of the BID documents shall be numbered, signed and submitted along with a
signed letter of transmittal.
17) References, Information and Certificates from the respective Owners certifying for performance and suitability,
technical know-how or capability of the Bidder shall be signed by the authorized signatory of Owner.
18) The Bidder is advised for furnish any additional information, which they think is necessary in regard to its
capabilities. No further information will be entertained after submission of Qualification BID document unless it is
called for by Owner
19) Documents submitted in connection with the BID will be treated as confidential and will not be returned.
20) The cost incurred by Bidders in preparing their Bid, in collecting information, in providing clarifications or attending
discussions, conferences or in making presentations, site visits etc., in connection with this Bid will not be
reimbursed by The Owner under any circumstances.
21) The entire project is to be completed within completion time mentioned in the Contract. Items to be supplied by
Owner are as provided in the Attached “Procurement Responsibility Sheet”.
22) Start of Construction on site is envisaged to commence by _________. All works shall be done in compliance
with Technical Technical Specifications, relevant Indian standards (IS) Codes, International Codes and local bye-
laws.
23) The contractor shall be responsible for procurement of all quality materials, unless stipulated in the Procurement
Responsibility Sheet, required for the performance of the contract.
24) The Owner’s minimum expectations are that the selected contractor will innovate and will deploy i) efficient and
speedy construction techniques, ii) best construction management practices, iii) streamlined procurement and
quality check procedures iv)Quality Assurances Plan, Environment and Safety Plan to meet the appropriate
standards and Keep site clean at all times and v), All skills and technical talent as required to keep the project on
schedule and within budget, while building a project of the highest overall quality
25) Bids made by a partnership firm shall be signed by all partners of the various firms, their full type written/hand
written names and current addresses, or alternatively by a partner holding power of attorney for the firm in which
case a certified copy of the power of attorney shall accompany the Bid. A certified copy of the deed, full names
and current addresses of all the partners of the firm shall also accompany the Bid
26) The Contractor Shall produce Banker’s Solvency Certificate of the value of Rs. 5 Crores, dated on or after
__/__/____.
27) Prior to the Pre Bid meeting all the Tenderer’s are requested to submit their points via. Mail up to
