HOW TO START SELLING LIQUOR INTO RESTAURANTS, STORES, BARS


ETC. AND ALL THE REQUIREMENTS (CONTRACTS, PROOF OF BUSINESS
ETC.)

A special (SRX) restaurant alcoholic beverage license can be obtained (if certain requirements
are met) at any time, and is an exception to the number of licenses per county restrictions. The
SRX license allows you to sell beer, wine, and liquor for consumption-on-premises, in
connection with a restaurant.

However, a restaurant must derive 51% of their revenue from food and non alcoholic beverages
to qualify for this special license. If this percentage cannot be met and maintained, the restaurant
would not qualify for the special license and would then be required to obtain a regular (quota)
license.

The annual license fee for an alcoholic beverage retail license ranges between $28 and $1,820,
depending on the type of beverages you wish to sell, and the county in which your business will

MAIN REQUIREMENTS
BEER, WINE AND LIQUOR CONSUMPTION ON PREMISES (8COP)

This license category includes a number of specialty licenses such as Restaurants (SFS),
Motels/Hotels (S), Bowling Alleys (SBX), Hospitals (H), Airport Lounges not owned by an
airline (SAL), Pleasure Ships (SPX), Civic Centers (SCX), County Commissions (SCC), etc.

Application Requirements:

 FEE: Fees vary based upon county populace. Temporary licenses are ¼ of the
permanent license fee or $100, whichever is greater. Please see the fee chart I
sent to you
 APPLICATION: Complete form DBPR ABT-6001 by clicking on "Printable
Application" at the bottom of this page (detailed instructions included). If you
already have a copy of the detailed instructions, you may prefer to obtain the form
without the instructions in ABT-6001 PDF or ABT-6001 Word format. I have

 FINGERPRINTS: If applicable, In-State residents should visit the Florida


Department of Law Enforcement's web site to get a list of approved Lives can

Alcoholic Beverages and Tobacco's Originating Agency Identifier Number (ORI#)

 ARREST DISPOSITION: Provide certified copies of arrest disposition, if
applicable.
 MORAL CHARACTER: Provide mitigation of moral character, if applicable.
 RIGHT OF OCCUPANCY: Submit Right of Occupancy, if applicable.
 SKETCH: Submit sketch of premise.
 ZONING: Submit Zoning approval, if applicable.
 HEALTH: Obtain and submit health approval, if applicable.
 H&R: Submit approval from Hotels and Restaurants, if applicable (SFS).
 SECRETARY OF STATE: Submit Secretary of State/Certificate of Status, if
applicable.
 DOR: Obtain and submit Department of Revenue clearance.
 FEIN: Submit Federal Employer's Identification Number (FEIN), if applicable.
 SSN: Submit Social Security Number (SSN), if applicable.
 CONTRACTS: Submit Contracts or Agreements, if applicable.
 PARTNER, OFFICER OR STOCKHOLDER: Submit Partner, Officer or
Stockholder information, if applicable.
 GENERAL LAWS: Submit acknowledgement of meeting the minimum
requirements listed in general laws and special acts, if applicable.
 SUBMIT APPLICATION: Submit your application online via the Online
Services link below, or alternatively, mail or hand deliver a printable application to
one of our district offices.

4. ANY REQUIREMENTS OR INSPECTIONS WITH THE HEALTH DEPARTMENT


(CHD) FOR A DISTILLERY?

Inspections are performed at the County Health Department (CHD) level by the Environmental
Health section. Each CHDs Environmental Health section is responsible for all DOH-regulated
food service establishments located within their county. There are several types of inspections
that are performed. The types of inspections that you may see in this report are routine
inspections, re-inspections, and complaint inspections. Routine inspections are periodic
inspections that are performed as a part of the on-going food safety system. Re-inspections are
completed when a facility has violations that need corrections in more than the standard time
frame. Complaint inspections are performed in response to a citizen’s complaint. Both routine
and complaint inspections are unannounced inspections. This means there is no prior notice or
pre-arranged time frame before the inspector arrives. If a re-inspection is required, the facility is
given a specific date by which specified violations must be corrected; therefore, there is an
arranged time for the re-visit.
Once an inspector completes an inspection, it is given a result of Satisfactory, Unsatisfactory, or
Incomplete. "Satisfactory" means that there were no observed violations at the time of inspection
or the violations that were observed were not significant enough to require correction before the
next routine inspection. "Unsatisfactory" means that the violations were a significant threat to
public health and sanitation and require correction before the next routine inspection. An
"Incomplete" inspection means that the inspection was interrupted and the inspector had to leave
before completing the inspections.

5. REQUIREMENT’S FOR SELLING ALCOHOL/SAMPLE TASTINGS AT


FESTIVALS IN FLORIDA.

RULES FOR LIQUOR TASTINGS (FROM FLORIDA STATUTES SECTION 565.17)

i. For Florida distilleries, the only legally sanctioned tasting opportunity (outside of a craft
distillery’s own gift shop) is through a licensed distributor or vendor who is providing
samples on a licensed vendor premises. See Florida Statutes Section 565.17.
ii. In the typical festival situation, a municipal agency or non-profit organization obtains a
One-Day Permit (ODP) to sell beer, wine, or spirits on the festival premises. In this
situation, the festival organizer could sell admission to the festival or sell samples by the
glass, and the spirituous beverages would have to be provided by a distributor or the
organizer (which can purchase through the distributor or through another licensed
vendor).
iii. Liquor tastings may be conducted by distributors or vendors only, not manufacturers.
iv. Liquor tastings are permitted on premises licensed for the sale of spirits for consumption
on premises or consumption off premises.
v. Liquor tastings must be limited to and directed toward members of the general public age
21 years or older.
