Consent to transfer of

applicant's personal data to the third country

§ 1 (Purpose of data processing)


For performance of the given order for visa registration or electronic permit for a trip (ESTA, ETA, eVisum, etc.)

for the country / in compliance with the order


countries: Country(ies) of destination form as of date of order placement

the customer/ applicant requires collection, transfer, and processing of personal data provided by the customer/applicant, respectively, executed by "Visa
Support und Business Solutions GmbH", registered at Theaterplatz 11, 53177 in Bonn, to the authorized consular agencies of the destination country in
Germany or to the consular / immigration agencies of the corresponding country of destination in the third state, outside EU, as well.
Data processing is performed in the country, where the head office of data importer is located, i.e. the corresponding consular agency or consular /
immigration agency of the third state.
Embassies and consular agencies of the third countries (outside the EU, as well), and their officials represent the consular / immigration agencies of their
countries in the host country, in particular. In compliance with art. 22 and 31 of Vienna Convention on Diplomatic Relations (WÜD) they are subject to special
protection and, respectively, in certain circumstances, they cannot be subject to the system of justice of the host country or current EU legislation. Thus,
processing of the personal data transferred to apply for visa is actually performed in the country, represented by the consular agency in Germany or EU, even
if this representative office is located on the territory of Germany of EU.
Since "Visa Support und Business Solutions GmbH" registered at Theaterplatz 11, 53177 Bonn, cannot apply for visa / electronic entry permit required for
execution of the order given by the customer / applicant, it involves the consular agency or the immigration body of the third country; "Visa Support und
Business Solutions GmbH" company can act on behalf of the applicant as a representative only and as an intermediary in respect to the consular agency /
immigration body of the destination country (the third state).

§ 2 (Data subject to special protection) In terms of order execution depending on the current visa requirements of the destination country it is also required
to transfer the personal data subject to special protection to the corresponding consular agency or immigration office. Depending on the type of information
required for execution of the instruction, this information can cover personal data reflecting racial and ethnic origin, political opinion, religious belief or
worldview, or membership in trade unions, and, perhaps, biometric data, and etc. In terms of the considered relevant instruction to apply for visa / electronic
entry permit, such personal data can be requested by the consular agency or consular / immigration office of the country of destination.

§ 3 (Decision on reasonability) There is a possibility, that the EU Comission in terms of art. 45, par. 1, 3 "Basic Declaration on Personal Data Protection
(DS-GVO)" has not made up a decision on reasonability in respect to the country, where the head office of the consular / immigration agency is located, or the
country represented by the consular representative office in Germany where processing of personal data will be respectively performed. It means that the EU
Commission have not approved the positive solution, yet, concerning the fact that the data protection level in this country corresponds to the European Union
level on the basis of the DS-GVO Declaration.

§ 4 (Proper warranties) DS-GVO Declaration concerning data transfer to the third country or to the international organization provides for the so-called
proper warranties, art. 46 cl. 2, 3 of DS-GVO Declaration. Such warranties can be non-available for the above-mentioned country of destination.

§ 5 (Probable risks) The probable risks that may not be excluded at the moment for the applicant/customer considering the above-mentioned paragraphs are,
particularly, as follows:
- Apart from the direct goal of order execution, your personal data can be transferred to the third persons by consular / immigration
bodies of the country of destination.
- You cannot consistently perform or declare your rights for obtaining the reference information in the consular / immigration agency.
- The chance that data processing fails, since the technical measures on personal data protection do not fully comply in terms of quality and quantity with the
requirements of DS-GVO Declaration is rather high.

§ 6 (Consent/ recall) Hereby I explicitly agree to transfer my personal data, including information subject to special protection (see § 2) under article 9 cl. 1 of
DS-GVO Declaration on provision of the service, entrusted by me to the consular / immigration agencies/ representative offices, located in the above-
mentioned country of destination, or the bodies representing such country in Germany or in EU.
I can recall my consent in respect to "Visa Support und Business Solutions GmbH", registered at Theaterplatz 11, 53177 in Bonn The recall shall not
influence the legal character of data processing performed on the basis of the consent before the recall. In this case "Visa Service Bonn GmbH &
Co.KG/VISUM.de" company will not be able to execute the main contract (instruction) and, hence, it cannot complete it or it will have the right to terminate the
contract with me immediately.
