THE CONSTITUTION (SCHEDULED CASTES AND SCHEDULED TRIBES) ORDERS (SECOND AMENDMENT) BILL, 2022

The following ACT of parliament received the assent of the PRESIDENT on the "1st Jan 2022" and is here by published for
general information.
The Constitution (Scheduled Castes and Scheduled Tribes) Orders (Second Amendment) Bill, 2022, seeks to amend the
Constitution (Scheduled Castes and Scheduled Tribes) Orders (Amendment) Act, 1976. This Bill seeks to provide for the
inclusion of certain communities in the list of Scheduled Castes or Scheduled Tribes in certain states. The Bill amends the
Constitution (Scheduled Castes and Scheduled Tribes) Orders (Amendment) Act, 1976 to provide for the inclusion of certain
communities in the list of Scheduled Castes or Scheduled Tribes in certain states. The Bill also seeks to provide for the exclusion
of certain communities from the list of Scheduled Castes or Scheduled Tribes in certain states. The Bill seeks to amend the
Constitution (Scheduled Castes and Scheduled Tribes) Orders (Amendment) Act, 1976 by providing for the inclusion of certain
communities in the list of Scheduled Castes or Scheduled Tribes in certain states. The Bill also seeks to provide for the exclusion
of certain communities from the list of Scheduled Castes or Scheduled Tribes in certain states. The Bill provides that the
inclusion of certain communities in the list of Scheduled Castes or Scheduled Tribes in certain states or the exclusion of ce rtain
communities from the list of Scheduled Castes or Scheduled Tribes in certain states shall be made by notification in the Offi cial
Gazette after consultation with the state governments concerned. The Bill seeks to amend the Constitution (Scheduled Castes
and Scheduled Tribes) Orders (Amendment) Act, 1976 to provide for the inclusion of certain communities in the list of
Scheduled Castes or Scheduled Tribes in certain states and the exclusion of certain communities from the list of Scheduled
Castes or Scheduled Tribes in certain states. The Bill seeks to provide for the inclusion of certain communities in the list of
Scheduled Castes or Scheduled Tribes in certain states and the exclusion of certain communities from the list of Scheduled
Castes or Scheduled Tribes in certain states. This Bill seeks to bring about an amendment to the Constitution (Scheduled Castes
and Scheduled Tribes) Orders (Amendment) Act, 1976 for the inclusion of certain communities in the list of Scheduled Castes
or Scheduled Tribes in certain states. The Bill seeks to provide for the exclusion of certain communities from the list of
Scheduled Castes or Sched.
STATEMENT OF OBJECTS AND REASONS
Scheduled Castes have been defined in clause (24) of article 366 of the Constitution as "such castes, races
or tribes or parts of or groups within such castes, races or tribes as are deemed under article 341 to be
Scheduled Castes for the purposes of this Constitution.". Scheduled Tribes have been defined in clause
(25) of article 366 of the Constitution as "such tribes or tribal communities or parts of or groups within
such tribes or tribal communities as are deemed under article 342 to be Scheduled Tribes for the
purposes of this Constitution."

341. Scheduled Castes.—(1) The President may with respect to any State or Union territory, and where it
is a State, after consultation with the Governor thereof, by public notification, specify the castes, races or
tribes or parts of or groups within castes, races or tribes which shall for the purposes of this Constitution
be deemed to be Scheduled Castes in relation to that State or Union territory, as the case may be.

342. Scheduled Tribes.—(1) The President may with respect to any State or Union territory, and where it
is a State, after consultation with the Governor thereof, by public notification, specify the tribes or tribal
communities or parts of or groups within tribes or tribal communities which shall for the purposes of this
Constitution be deemed to be Scheduled Tribes in relation to that State or Union territory, as the case
may be.
BENEFITS OF THIS AMENDMENT

1. Improved Representation: The Bill provides for increased representation of SCs and STs in the local
government bodies and Panchayats. This will ensure that the voices of these communities are heard in
the decision-making process.
2. Increased Opportunities: The Bill will provide increased opportunities for SCs and STs to participate in
the socio-economic development of the country.
3. More Access to Resources: The Bill will provide SCs and STs with more access to resources such as land
and education. This will help to raise the standard of living of these communities.
4. Improved Quality of Life: The Bill will also ensure that the quality of life of SCs and STs is improved
through better access to healthcare, education and other essential services.
5. Strengthened Rights: The Bill will also strengthen the rights of SCs and STs to participate in the local
decision making process and access to resources. This will ensure that their rights are properly protected.

6. There should be no delay in the registration of FIR in cases of crimes against SCs/STs;
7.Delay in trial of cases of crimes against SCs/STs may be reviewed on a regular basis in the Monitoring
Committee/monthly meetings Chaired by District and Sessions Judge attended by District Magistrate,
Superintendent of Police and Public Prosecutor of the district.
Notwithstanding such repeal, anything done or any action under the said
Ordinance, shall be deemed to have been done or taken under the
corresponding provisions of this Act.
