Law Enforcement Operations

Law enforcement
The activity of some members of government who act in an organized manner to
enforce the law by discovering, deterring, rehabilitating, or punishing people who violate
the rules and norms governing that society.

Warrant of Arrest

Service of Warrant of Arrest/ Search Warrant

Warrant of Arrest

A written authority issued to arresting officer to make an arrest or take a person into
custody in order that he may be bound to answer for the commission of an offense.

General Guidelines (Warrant of Arrest)


1. All arrests should be made only on the basis of a valid Warrant of Arrest issued by a
competent authority, except in instances where the law allows warrantless arrest.

2. No violence or unnecessary force shall be used in making an arrest, and the person
to be arrested shall not be subjected to any greater restraint than what is necessary
under the circumstances.

3. As a general rule, arrests can be made on any day of the week and at any time of the
day or night.

4. Only judges are authorized to issue Warrants of Arrest.

5. A Warrant of Arrest is no longer needed if the accused is already under detention. An


Order of Commitment is issued by the judge in lieu of the Warrant of Arrest.

When may a police officer arrest a person without a warrant?


1. When, in his presence the person to be arrested has committed, is actually,
committing or is attempting to commit an offense.
“caught in the act of committing a crime” ( inflagrante delicto)

2. When an offense has in fact just been committed and he has personal knowledge of
facts indicating that the person to be arrested had committed it;

3. When the person to be arrested is a prisoner who has escaped from a penal
establishment or place where he is serving final judgment or temporarily confined while
his case is pending or has escaped while being transferred from one confinement to
another.

Can private person serve a warrant?


Private person cannot serve a warrant of arrest because to arrest a person by virtue of
a warrant is an exclusive authority of police officers.

What if a person lawfully arrested escape?
Any person may immediately pursue or retake him without warrant at any time in any
place within the Philippines.

Requisites of a valid warrant of arrest


• It shall be issued upon probable cause.
• The probable cause is determined personally by the judge upon
examination under oath or affirmation of the complainant and the
witnesses he may produce; and
• Particularly describing the person to be arrested.

Method of Arrest
When making an arrest by virtue of a warrant, the officer shall inform the person
to be arrested of the cause of the arrest and of the fact that a warrant has been issued
for his arrest.

Except when he flees or forcibly resist before the officer has opportunity so to inform
him, or when the giving of such information will imperil the arrest.

After the arrest, if the person arrested so requires, the warrant shall be shown to him as
soon as practicable.

Validity of Warrant
The warrant of arrest remains valid as long as the person stated therein is not arrested
regardless of the number of days that already lapsed, while a search warrant is valid
within ten days from issuance.

Search warrant
An order in writing issued in the name of the People of the Philippines, signed by a
judge and directed to a peace officer, commanding him to search for personal property
described therein and bring it before the court. (Sec1, Rule 126 of the Rules of the
Court)

3. Particularly describing the things and the place to be searched.

A search warrant may be issued for the search and seizure of the following
personal properties except;
A. Subject of the offense
B. Stolen or embezzled and other proceeds or fruits of the offense;
C. Used or intended to be used as a means if committing a crime.

When to serve a Search Warrant?


The search warrant must direct that it be served in the day time, unless the affidavit
asserts that the property is on the person or on the place ordered to be searched, in
which case, a direction may be inserted that it be served at any time of the day or night.
(Sec 9, Rule 126 of the Rules of Court)

Life span of Search Warrant


A search warrant shall be valid within ten (10) days from its date. Thereafter, it shall be
void. (Sec 10, Rule 126 of the Rules of Court)

Omnipresence means, obvious presence of police officers this is achieved through high
police visibility discourages criminals not to execute whatever plans they have. The
psychology behind it speaks that if the police is always seen by the people conducting
regular patrol it will be implanted that the police is always there even in his absence
thereby effectively creating a feeling of security to law abiding people and a deterrent to
would be offenders.

Police patrol
An indispensable component and function of police departments.
The act of moving about in an area of police officers for the purpose of observation,
inspection, collaboration, prevention of crime, and provision of a secured environment.

Patrol as the backbone in police service


Patrol is considered the backbone of the police department for the following reasons
1. Patrol is the only division or unit in the police department that cannot be eliminated all
other division or units in the police department may be eliminated, if necessary
2. Patrol is the only unit that works on a 24 hours basis for seven days
3. Patrol is the operational hearth of the police department .it is the center and the focal
point of all police activities
4. Patrol is the most visible in the police department patrol officers represent the
integrity and disciple of the whole department by demonstrating a respectable , dignified
and presentable appearance during and after patrol duty.
Patrol as the essence of Police function
The following are the police functions that are attained through the concerted efforts of
all police units but dominated by patrol (PIP-PARES)

In reality, police activities are numerous and diversified elaborating further these
functions is quite complicated to simplify we can generalized the police functions into
two categories, namely (LP)
1. Law enforcement
2. Peace and order maintenance
Law enforcement embraces crime prevention and crime control including customary
functionson the other hand peace and order maintenance covers the peace keeping
and community oriented services

Methods of Patrol
The means used under favorable conditions that provide the most effective utilization of
available personnel, logistics, and funds to render police visibility, assistance and
response.

1. Foot Patrol- Type of patrol which is restricted to small areas and is used to deal
with special situations while maintain radio contact which officers in patrol cars.
The oldest form of police patrol work.
The most expensive type of patrol as the area becomes large. it requires more men to
cover the entire geographical area where a department is assigned to safeguard
• non-vehicular patrol
• conducted in heavily populated areas
• Provides the patrol officers familiarity on the ground and better observational,
identification and solution to peace and order concerns in their beat.
• Enables patrol officers to establish and maintain favorable relations with the
community through person-to-person contact.
• Patrol officers are able to more readily detect situations which require police
action.

• They are able to develop excellent sources of information which can lead to the
detection and intervention in criminal activities.

Used to secure 2 types of police geographical units such as post and beat.
1. Post - a predetermined position or location where an officer is assigned for
guard duty.
2. Beat - the smallest area specifically assigned for patrol purposes
TYPES OF FOOT PATROL
• Fixed foot patrol - usually used for traffic, surveillance, parades, and
specific events.
• Moving foot patrol - used where there is considerable foot movement
such as patrolling business and shopping centers, high crime areas, and
in places where there are many or multiple family dwellings.
Significance of Foot Patrol
•Make visibility of officers
•Make greater contact with the community
•Increase rapport with community members.
•Increase community policing; and
• Improve police officer job attachment and satisfaction.
Disadvantage of Foot Patrol
• Low mobility resulting to limited coverage of the patrol area.
• Low response time to telephone complaints.
• Foot patrol method involves a large number of personnel since officers are
assigned on small areas of jurisdiction called beats.
Traditional foot Patrol patterns
✓ Clockwise patrol pattern - It is the patrol pattern that is done at the start
of the eight hours tour of duty, which purposes is for the patrol officer to

survey the condition and situations of the boundaries of his area of
responsibility.
✓ Counter clockwise - this can be used at the last of duty to ensure that no
untoward incident hem to the patrol area of responsibility.
✓ The ZigZag or freewheeling pattern- this pats pattern is done by
patrolling the streets within the perimeter of the beats not at random but
with a definite target location where patrol officer knows that his presence
is necessary. this action is based on the study of the situation and
condition of the beat
✓ Straightway pattern - It is the type of patrol pattern that is done by
patrolling the length of the street. It is the easiest way to observe the
movement of the patrol officer

2. Mobile Patrol
Conducted through the use of land-based vehicles.

MOTORCYCLE PATROL
✓ Primarily used for conducting operations against motorcycle-riding
✓ criminals and those perpetrating street crimes.
✓ Used for traffic management and for security escort duties.
✓ High mobility of motorcycle patrols even in traffic congested areas makes them
effective in addressing crimes.

Two phases to consider In Managing Mobile Patrol


1. Administrative Aspect
A. Staff Supervisor - an inspector in charge of shift or platoon.
B. Disposition Officer- supervising deskman
C. Deskman - police officer assigned to receive phone calls from the public and
reports from the mobile patrol crews.
D.Dispatcher - police officer in charge of the radio control rooms that are
dispatching mobile patrol crew to the scene of assignments, transmitting and
receiving, recording radio message.

A. Field Supervisor - one who supervises mobile crew in the field, for discipline
and performance.
B. two men complement uniformed patrolman in the radio car, one acting as the
driver and the other as the recorder.

Advantages of Automobile Patrol


✓ High mobility allowing coverage of greater area.
✓ Quicker response time to telephone complaints. Greater efficiency in responding
to emergency calls and other called - for services.
✓ More economical as compared to foot patrol.
✓ More effective street pursuit of offenders.
✓ More effective traffic enforcement.
✓ Provide the officers with necessary protection during increment weather.
✓ Enable officers to carry supplementary equipment essential in patrolling.

Disadvantage of Automobile Patrol;


❖ Diminished personal contact with the public.
❖ Little opportunity to develop sources of information.
❖ Marked police vehicle hampers (inhibits) apprehension and surveillance
operations

BICYCLE PATROL
It is regarded as the simple and inexpensive means of silent transportation to carry
police office throughout their patrol duty.
Advantages
✓ Lower cast (Inexpensive) to operate as compared to motorcycle and
automobiles.
✓ Areas not accessible by patrol cars or are too wide or foot patrol can be covered
by bicycle.
✓ Increased mobility and stealth since bicycle can be Fated quietly and without
