Vacuum Cleaner, Blower, Floor Cleaning Machine, etc. shall be provided and maintained by the Agency at its own cost + Stock Register needs to be maintained by the agency for usage of materials and get to be signed from the concerned person of Avidipta-! Avidipta-1 (L&M) will not provide any mode of transport in respect of manpower or any items/materials required by you for executing the housekeeping service. While on duty, all the housekeeping staff members must be in uniform with identity card and copy of job allocation. There will be no employer-employce relationship either between Aviciptarl (L&M) and M/s ASSPL or staff member(s)/ workmen engaged /deputed by you for the said 4. However, if the contract is terminated due to any default of you, the said security deposit will be forfeited 5. The approx. number of housekeeping stalf to be deputed is 14 (Fourteen) as mentioned above and is as Per present requirement. However, the Avidipta-I (L&:M) authority is at liberty to increase or decrease the number of staff as per requirement from time to time and the payment will be made on actual accordingly at the same rate and as applicable at the same respective rate, as applicable and on actual. Note: The age of workmen deployed should not be more than 60 years. Also, no Minor is permitted for rendering the said service under this contract. ‘The Contractor shall maintain Attendance Register and Wages Registers for all the stalf members/ workmen deputed by them under the contract at Avidipte-! (L&M), Kolkata for the said housekeeping service. 7, Your payment will be released monthly on arrear basis within two weeks against submission of bill complete in all respect, viz. copies of monthly PF and ESI deposits challans with ECR and P-Tax deposit document/receipt of the workmen deputed by you, monthly attendance statement, pay slip/shect duly signed by your said workmen and after satisfactory certification by the concerned person/s of Avidipta:] (L&M). All payments due to you shall normally be made through RTGS/NEFT. Deductions, if any (TDS, etc.) and as applicable, will be made during payment. You should submit details of your Bank A/c (A/¢ Holders Name, Bank & Branch Name, IFS Code) and PAN No. along with the bill. Your bill should contain your PAN and bank details (Bank Name & Branch, A/c No., IFS Code, etc.) should be clearly mentioned in the bills for payment through NEFT/RTGS. 8. Since there may be delay in releasing payment by Avidipta-I (L&M) to the Contractor/Agency duc to contingencies, payment of wages to the manpower/ staff members deputed by the contractor at Avidipta- I (L&M) for rendering housekeeping services should not be linked with receiving of payment from Avidipte-I (L&M) and the contractor/ agency shall pay the wages to his manpower deployed by 07% of every month without fail; no request for relaxation will be entertained in this regard. The contractor/ ‘agency should issue monthly pay slips with all the details of PF, ESI, deductions, etc. to its said staff members. In case of disputes for non-payment of wages to the supplied manpower or any other dispute, the payment duc to the Contractor may be withheld till settlement of the disputes, ‘Avidipta-l (L&M) will pay the agency as per the above quoted rates (ref, Table-A). However, the Avidipta-t (L&M) authority reserves the right to deduct payment from the monthly bill due to non-satisfactory service, etc. for which a minimum of 5% of the bill amount may be deducted as penalty. 10. Payment will be deducted on pro-rata basis and as applicable in the event of absent of any of the said manpower on any day or so; however, it is preferred and strongly recommended for a suitable Page 4 of 7 replacement as far as safety & security is concerned and to avoid such deductions, as applicable, in the event of non-satisfactory service or any default, payment may be deducted aa penalty as deemed ft which will be decided by the Avidipta-I (L&M) authority and decision of Avidipta-I (L&M) in this regard shall be final & binding on you. 11. Payment to the manpower will be considered as per actual based on their attendance and penalty on the said payment may be imposed due to misbehavior/ misconduct of the manpower, The amount of deduction as may be decided by the authority of the Avidipta-I (L&M) and the decision of the said authority will be final & binding on the contractor and its manpower. 12.The timely payment of Employees’ contribution towards PF & ESI at scheduled rates will be the responsibility of M/s ASSPL. You shall be responsible for the payment of the said wages and allowances of your deputed staff members and payment of all statutory dues to the persons employed by you for Broviding the said services at Avdipta (LM. Aviiptat(L&M) shall in no way be responsible for any lefault with respect to any statutory obligation related to the manpower deputed by you at Avidipta-l (Las), Kolkata. ° mee 13. The contractor shall provide the following, at its own cost, to its manpower deputed for rendering the said service: + Uniform (Trouser, Shirt, Cap, Shoes, -2 sets each) including washing/ maintenance cost © Waterproof + Umbrella No expenditure will be borne by Avidipte-I (L&:M) in this regard. 14. You shall issue the following to your staff members deputed at Avidipta-1 (L&sM) and copies of the same should be submitted to Avidipte-I (L&M) within one month from the date of issuing of this work order: a) Photo Identity Card b)_EPF Number and UAN Card/Number ¢) BSI Card/Number 15. The contractor shall be solely responsible for all injuries and accidents, if any, to persons deployed by him in Avidipta-1 (L&M). The manpower shall be insured by the contractor against personal accidents arising out of and during the course of their duties. You shall be solely responsible for their wages, statutory obligations, fringe benefits, conduct, leave records, etc. 16.In case of any damage or loss that might be caused to Avidipta-l (LAM) due to lapse, directly or indirectly, on the part of workmen discharging service, you shall be held fully responsible and will be bome by the Agency and in this connection, Avidipta-t (L8M) shall have the right to deduct appropriate amount from the bill amount payable to you or from the security deposit or you may pay for the same to make good such loss to Avidipta-I (L&M) besides imposition of penalty. In case of frequent lapses on the part of the workmen deployed by the Agency, Avidipta-I (L&sM) shall be within its right to terminate the Contract forthwith or take any other action as deemed fit without assigning any reason whatsoever. The famount of loss or damage as determined by the Avidipta-I (LAM) authority shall be final and binding on you, M/s ASSPL will indemnify Avidipte-I (LésM) in case of any damage or lability which may arise on account of action due to you/your person deployed at Avidipta-I(L&M). 17. In the event of non-satisfactory service or any default, you may pay for the same or payment may be deducted as penalty as deemed fit which will be decided by the Avidipta-I (L&M) authority and decision of Avidipta-I (L&M) to this effect shall be final & binding on you. 18. The agency shall abide by the rules and regulations of Avidipta-I (LAM) as may be enforced from time to time and shall render the housekeeping service in the Avidipta-1 (L&M) premises/ campus in close co- operation with others at the site, 19. In case of any damage or loss to the property or material caused directly or indirectly by your personnel, you shall be held fully responsible and the authority of Avidipta-I(L&M) shall be eniitled to deduct appropriate amount as penalty from the security deposit or the bill amount payable to you or you may Page 5 of 7 pay for the same. The amount of loss or damage as determined by the Avidipta- authority be final and binding on you. ne 7 Peel CAM authority sha 20. You shall verify the character, antecedents of personnel before deploying them at Avidipta-1 (L&M) and submit the particulars (ic. name, father’s name, date of birth, address, qualification, etc. alongwith photo Identity Card (Voter 1D/Aadhaar Card, etc)) of your deputed staff members to Avidipta-! (L&M). You shall ensure that the said staff members engaged by you shall be well disciplined. They should be gentle and bear good moral character. You shall be fly responsible about the conduct of your employees deputed at Avidipta-t (LEM). If it is found that the conduct or efficiency of any of the said personnel is unsatisfactory, you shall have to replace the person concerned immediately and engage a new one. The decision of the Avidipta-I (L&M) Authority in this regard shall be final and binding on you. 21. The contractor shall ensure that the manpower deputed by him should bear good moral character with amicable & polite nature, well-disciplined and sincere. If, at any time, any of the manpower are found to be guilty of misconduct in any manner, the Contractor shall replace him forthwith. If it is found that the efficiency of any manpower deployed by the contractor is unsatisfactory, the contractor shall replace him immediately with a new person under intimation to Avidipte-I (L&M). Also, in the absence of any manpower suitable replacement should be provided during his period of absence, under intimation to concerned official/s of Avidipta-I (L&M), for uninterrupted & smooth functioning, 22. You shall ensure that the staif members engaged by you shall not smoke beedis, cigarettes or take alcoholic drinks, nor they are allowed to chew pan, tobacco items etc. during duty hours. They should be gentle and bear good moral character. You, the housekeeping Agency, shall be fully responsible about the conduct of your employees deputed at Avidipta-I (L&M) and shall ensure that they should deal with the residents, visitors, all the stake holders, etc. politely and cordially while enforcing discipline. If it is found that the conduct or efficiency of any of the workmen is unsatisfactory, the housekeeping Agency shall have to remove the person concerned immediately and engage a new one. The decision of the ‘Avidipta-I (LéM) Authority in this regard shall be final and binding on the Agency/ Contractor. The ‘workmen should be well versed and experienced about the office decorum and should know the etiquette and well behaved. The Contractor shall be responsible for the acts and conducts of its personnel. In the event of any misconduct the decision of the Avidipta-I (L&.M) in the matter shall be final & binding. 23, Payment of Bonus to the workmen shall be as per the rule imposed by the GoWB/ authority concemed and at the discretion of the agency concerned only; Avidipta-I(L&:M) will no way be held responsible for the same. Further, the deployed workmen should not approach to the residents/ others of the complex for payment of Tips or Bonus which generally happens during festive seasons. 24, Requesting Tips from the residents any time by the workmen, specifically during the festive seasons, viz. Durga Puja, Dipawali, etc. is strictly prohibited and the contractor should deal such matters solely at their end only and ensure no such incident occur; Avidipta-I(L&M) shall not be involved to settle such matters-The staff members deputed for the service should be in uniform while on duty along with the Identity Card to be issued by you. 25. M/s ASSPL shall be solely responsible for all injuries and accidents to persons deployed by you for the seid service. The workmen shall be insured by you against personal accidents arising out of and during the course of their duties. 26.1n case of disputes for non-payment of wages to the supplicd manpower or any other dispute, the payment due to you may be withheld till settlement of the disputes. 27. Dispute, if any, arising out of the service contract shall be settled by mutual discussion and the decision of Avidipta-I (L&M) will be final and binding on you. 28. You shall undertake that any act of omission or commission including theft, by your staff shall be your sole responsibility and further that you shall compensate the Avidipte-I(L&M) immediately, any loss or damage or theft occurring on account of your staff individually or collectively. 29.The contract may be withdrawn due to any reason by either side by giving 60 days’ notice. The agreement with Avidipta-l(L&M), in such case, will be treated as cancelled before its expiry. However, the said notice period may be extended by mutual agreement tll alternate arrangements are made by Avidipta-t(L&M) 90. However, Avidipta-I (L&M) authority reserves the right to terminate the contract at any time at its sole discretion due to non-satisfactory service or due to any applicable reason and decision of Avidiptacl (L&M) to this effect shall be final and binding on you. However, if not renewed extended further, the contract shall stand automatically expired after it's due date without giving any notice in writing, 81. An agreement on Non-judicial Stamp Paper containing all the terms and conditions of the service is to be made by you with Avidipta-I (L&M) within 10 days from the date of receiving of this work order and the same should be notarized by you at your cost. 92, Other relevant Terms and Conditions as mentioned in the tender document (NIT No. 03/2023 (AV-I L&M) are also applicable. 33. All disputes are subject to Kolkata Jurisdiction only.
