AGREEMENT FOR SALE

This AGREEMENT FOR SALE made this the day of June,


2022 (Two thousand twenty two) A.D.
BETWEEN
(1) SRI PATHIKRIT BANDOPADHYAY, PAN : ANKPB8796M, Son
of Jayanta Kumar Bandopadhyay, (2) SMT MOUSUMI DUTTA, PAN :
AZHPD4860H, Wife of Pathikrit Bandopadhyay both by occupation
Service . both by religion Hindu, by Nationality Indian, both residing
at 22b, Ramratan Bose Lane, P.0. -Shyambazar , Kolkata - 700004,
W.B, India hereinafter referred to as the 4OWNERS/VENDORS"
(which terms, expression shall unless excluded by or repugnant to the
context be deemed to mean and include their heirs, executors,
successors, administrators, legal representatives and assigns) of the
ONE PART.

AND

SRI DHARMA NARAYAN GHOSH, PAN : AKVPG0062D, son of


Late Hazari Lal Ghosh, by Nationality -Indian, by faith Hindu, by
Occupation - Service, residing at Vill.- Shilberia, P.O.- Ulasi, P.S.
Hanskhali, Dist.- Nadia, Pin -741502, hereinafter referred to as the
PURCHASER" (which terms, expression shall unless excluded by or
repugnant to the context be deemed to mean and include his heirs.
executors, successors, administrators, legal representatives and
assigns) of the OTHER PART.
AND WHEREAS one Smt. Nila Dutta (Ghosh) was the absolute
owner of the schedule mentioned property. The Governor of the State
of West Bengal seized and possessed the said schedule mentioned
property and handed over the said property toSmt. Nila Dutta (Ghosh)
have paid the sum of Rs. 19,677.06 (Rupees nineteen thousand six
hundred seventy seven and six paise ) oniy to the Govt, as a
consideration value of the house .

AND WHEREAS the Deed of Conveyance executed by Between the


Governor and Smt Nila Dutta (Ghosh ), wife of Late Ashok Kumar
Ghosh registered in Book No 1, Volume No 30, Page No 127 to 134,
Being No 3158 , for the year 1992 , of the A.D.S.R. Office at Kalyani
for L.I.G house on Plot No B - 2 | 128 at Kalyani township , in the
district of Nadia.
AND WHEREAS the said Smt. Nila Dutta (Ghosh) is the absolute
owner of the Plot being Plot No. B- 2 / 128 (L.I.G ) in Sub-Block No. B
- 2, Block No. B in the township of Kalyani, developed by the
Government of West Bengal within the jurisdiction Sub-Division
Kalyani, District Nadia, P.S. Kalyani, Additional District Sub-Registry
Office Kalyani, more particularly mentioned and described in the
Schedule hereunder written.

AND WHEREAS after got the said property Smt. Nila Dutta
(Ghosh) took possession of the property and mutated her name in the
Kalyani Municipality, by paying Taxes in her name.
AND WHEREAS the said Smt. Nila Dutta (Ghosh) intending to
Sell her rent free interest in the said plot of land with building
hereinafter more particularly mentioned and described in the
Schedule hereunder written in favour of the JHARNACONSTRUCTION
represented by it's Sole Proprietor Sri Goutam Datta for the
consideration hereinafter mentioned vide recorded in Book No 1,
Volume No 1303-2018 , Page No - 88819 to 88836, Deed No. 5179, for
the year 2018 Office of Additional Sub - registrar office at Kalyani and
got possession thereto

AND WHEREAS the land OWNERS is possessing and


enjoying of
the said land mneasuring 5 (five) Cottahs, 6 (six) Chattaks 30 (thirty )
Sg. ft. to be, the same or a little more or less and a brick built building
standing thereon at being Municipal Holding No.
B-2/128 (L.I.G) Kalyani within the limits of the Kalyani Municipality,
under P.S. Kalyani in the Dist. of Nadia as the lawful owner thereof
without any interruption by anybody having being free from all
encumbrances attachment charges, liens etc., for the sake of brevity
hereinafter referred to and called as the SAID
PROPERTY' more
particularly mentioned and described in the Schedule hereunder
writtcn.

AND WHEREAS said JHARNA

records of the Kalyani Municipality.
AND WHEREAS said JHARNA
CONSTRUCTION as Lawful owner
of the aforesaid property by mnaking
construction of the proposed
building said JHARNA CONSTRUCTION have got a
Sanctioned
building plan from Kalyani Municipality, dated 30.07.2018 for
construction of G+4 storied residential building into and over the said
Plot of land being premises No B- 2 / 128 ( L.I.G.) Kalyani, Nadia , Pin
- 741235,W.B morc fully mentioncd in the First Schedule hereunder
written in the name and style "GOPAL ABASAN" The land owner
through Developer JHARNA CONSTRUCTION have already completed
construction of the said proposed building after demolishing the old
single storied building in accordance with the sanctioned building
Plan duly sanctioned and accorded by Kalyani Municipality. Thereafter
the said DEVELOPER / PROMOTER ic. JHARNA CONSTRUCTION
have already handed over the said apartment namely "GOPAL
ABASAN" after completion of the construction as per approved plan of
the Kalyani Municipality, to the land owner and the Developer have no
objection to sale these flat to any third party.
AND WHEREAS the present G+4 Apartment consist of several
flats including one Flat No C-1 , on the 3rd floor, (Road Side)
measuring 1000 Square feet of super built up area and 100Square
Feet four wheeler car parking space which is spccifically mentioncd
in the second schedule written hereunder.

AND WHEREAS due to urgent need of moeny the Developer


decided to sold out one Flat Being No. C-1 , on the 3rd floor , (Road
side ) measuring super built up area 1000 sqft. and 100 Square
Feet four wheeler car parking space of the (G+4) storied building
known as "GOPAL ABASAN" constructed by the Developer (
hereinafter referred to as the said flat) comprising of Three nos. Bed
rooms , one No. drawing cum dining , one kitchen, two toilets ,
one Verandah and the present vendors after being satisfied about the
title of the Owner and the right of the Developers in respect of the said
property and after inspection of the relevant papers and documents
and the sanctioned plan of the proposed building the vendors herein
purchase the same by way of a Deed of Conveyance being Deed No.
1458 of 2020, vide Book No. I, Volume No. 1303-2020, pages from
30784 to 30810 which was registered at A.D.S.R. Kalyani on
12.06.2020.

AND WHEREAS after purchasing the said Flat & Car parking
space the present vendors are the absolute owner and possessors of
the same and they have every right to sale, Gift, transfer, convey of the
same.

AND WHEREAS the Vendors i.e. the party of the First Part have
agreed to sale out the Flat No. C - 1 (Road Side), on 3rd floor and
measuring 1000 Square Feet super Built up area and 100 Square
Feet four wheeler car parking space for a total price settled at Rs.
36,00,000/- (Rupees Thirty Six Lakh) only together with
proportionate undivided share and interest in the common areas and
facilities mentioned and described in the Third & Fourth Schedule
hereunder written in favour of the above named Purchasers i.e. the
party of the Second Part.
AND WHEREAS the Purchaser have also agreed that the present
Owner shall not be responsible for management of the said Complex

2. That it is further agreed by the parties hereto that the payment

a. The total consideration of the said premises being a sum of Rs.


36,00,000/- (Rupees Thirty Six Lakh) only and the purchaser
paid Rs. 5,00,000/- (Rupees Five Lakh) only as advance on

b. The Vendors hereby agrees to make and register the deed of
Conveyance within 03 (Three) months from the date of execution
of this agreement.
C. The seller shall make out a marketable title to the said property
free from all encumbrances,
d. The seller undertake that the flat as mentioned in the schedule
herein is not under any encumbrances and there is no
government tax, statutory dues, levies by whatever name called
under the law of the land for the time being in force and the said
flat & car parking space is free from all encumbrances and holds
a clear marketable title.
e. The seller shall deliver the photocopies of the relevant documents
relating to the said flat in their possession within days from the
date hereof for inspection thereof by the purchasers or their
advocate for Investigation of title.
f. Timeis the essence of this agreement. Both the parties agree that
they intendto complete the sale of the said flat and complete the
registration within the above mentioned stipulated period.
If for any default on the part of the Purchaser, the registration of
the Deed of Conveyance is not possible within the aforesaid
period, the Vendor will refund the advanced amount after
deduction of 20% within 07 (seven) days from the date of demand
by the Purchaser unless otherwise mutually agreed upon by
the
