AGREEMENT OF LEAVE AND LICENCE

THIS AGREEMENT OF LEAVE AND LICENC E IS MADE A T KOLKATA on this 1 s t of March`22 .


BETWEEN
Mrs. Sudarsona Aley aged about 57 years, PAN Number ATIPA9152E, residing at West
Wind Flat Number Block-1/5A,78 Raja S . C Mallik R o a d , Ramg arh, Kolka ta -700084
(Hereinafter called the OWNER/LICENSOR /LESSOR
AND
Mr Rohit Kumar Singh aged a b o u t 4 2 years, P A N N u mb e r CQCPS5428N,
r e s i d i n g at 19/2 SURYASHISH APARTMENT FLAT B2 , CENTRAL PARK
JADAVPUR KOLKATA 700032 (Hereinafter called the
LESSEE/LICENSEE)
WHER EAS the Licensor is the absolute owner of the resid ential flat as mentioned in
SCHED ULE “A”
AND WHE R E A S the LESSEE, in search f or temporary r e s id e n t ia l accommodation, has
approached the LESSOR, to take the said flat as mentioned in SCHEDULE” A” on Leave
and License basis.
AND WHER EAS the LESSOR being satisfied has agreed to give the said flat as mentioned
in SCHEDU L E” A” on LEAVE AND LICENCE b a s i s to the L E E S E E f o r a period of
22 (Twenty-two) months from 1st May ,2022 to 29 th Feb, 2024.

The LESSEE s h a l l p a y a monthly License fee of Rs 26,500 (Twenty-six thousand five


hundred only) every month for the use and occupation on of Licensed premises

That the Lessee shall keep with the Licensors a sum of Rs 50,000 (Fifty thousand) as
interest free security deposit to the LICENSOR. Security deposit shall be payable on or
before execution of this Agreement. Security deposit shall be refunded by the LICEN S O R
at the time of handing over the vacant possession of the premises by the LICENS E E.
Further, estimated amount of any damages made to the fixtures and electrical gadgets
and amount of other unpaid bills and any costs, charges and expenses which the Licensor
may be required to incur by reason of occupation and use of the Licensed portion on
will be deducted from the Security Deposit amount by the licensor at
the t ime of refund, and if the damage amount exceeds the Security Deposit amount then
the licensee has to pay the extra amount. The Security Deposit will be refunded after
deducting any dues towards unpaid electricity bill(s), if any.

To pay License fee of Rs. 26,500/- (Twenty-six thousand five hundred only) in advance on or
before the 7th of each month by RTGS/NEFT in favor of the LICENSOR. In the event of
non-payment of License Fees on due date, the Licensee shall pay an interest @ 5% p.a on
the unpaid License Fees until the time of actual payment from its due date.
To use the licensed portion on with due care and caution o n and “keep and maintain” the
interior of the licensed portion and the licensor’s fixtures (doors, windows, storage racks
etc.) therein in good and tenable/habitable condition on throughout the period of license.
Not to carry out any permanent or temporary structural additions and alternations to the
premises or the contained fixtures.
To permit at all reasonable times during continuation on of the term of license the
Licensor, his agents/ assigns to enter the Licensed portion to inspect and view the state
a n d condition thereof by prior appointment.
Not to use the premises for any commercial, illegal or immoral purpose or commit any
act or deed that may cause nuisance or annoyance to the Licensor or to the occupants of
the neighboring flats in the build ing wherein the licensed portion is situated.
Not to damage the public facilities in the apartment build ing and compound.
Not to sub-License, assign or otherwise part with the possession in part or whole of the
Licensed portion in favor of any other person.
Not to claim any tenancy right and shall not have any right to transfer, assign, and sub-let
of the licensed portion the premises.
Any damage caused to the flat or its contained fixtures during the period of occupancy
shall be made good by the Licensee as per the existing market rate.
The Licensee will pay the monthly electric consumption charges of every month.
The Licensor shall not be liable for any theft, loss, damage or destruction of any propert y
of the Licensee or of any other person lying in the licensed portion or of any bodily
injury or harm to any person in the licensed portion from any cause whatsoever to the
extent the theft, loss, damage, destruction, injury or harm has not been caused or
contributed to by the Licensor.
The LICENSEE will h a n d over the vacant possession of the said flat with all fittings and
fixtures as it was licensed out in the beginning of the license term on expiry of the license
period as per this agreement unless the same is renewed for a further period.

This agreement is valid for 22 (Twenty-Two) months starting from 1st May,2022 to 29 Feb,
2024 and thereafter this agreement can be renewed f o r a further period of 11(eleven)
months if the LESSORS have no objection to lease the said flat again for further period.

In the event of renewal of the Agreement for any further period there will be an increment
on monthly License fee by 10% for the next 11 (eleven) months and for the renewal of the
agreement b o t h the parties have to consult one month p r io r to the expiry of existing
agreement.

The Agreement shall have a lock-in period of 5 (Five) months from both the sides under
normal situatio n but in case of any material breach o f the t e r ms o f this License the
agreement shall be discontinued at once and the Licensee shall have to leave the premises
immediately without any adjustment of security deposit.

On expiry of lock-in period the Licensors and the licensee shall be entitled to terminate this
agreement d u r in g its subsistence by serving one month’s prior notice in writing to other
parties.

If the Licensee commits default in regular and punctual payments of monthly compensation
as aforementioned or commit/s breach of any of the terms, covenants and conditions of this
agreement or if any legislation on prohibiting the leave and license is imposed, the Licensors
shall be entitled to revoke and / or cancel the License hereby granted by giving notice in
writing of One (1) month.

If the license fee for two months is not paid or the Licensee commits breach of
any of the terms, covenants and conditions of this agreement then the LICENSO RS can
occupy the licensed premises in presence of two witnesses and the agreement will be
terminated forthwith.
The Licensor shall pay all taxes and duties assessed, levied , charged and imposed by or
payable to any lawful authority in respect of Licensed portion.

The Licensors will pay common maintenance charges of the apartment building.

Licensors undertake to handover vacant and peaceful possession of the Licensed portion to
the Licensee simultaneously with the execution of this Agreement and on payment of
stipulated security deposit and License fee for the month of May,2022.
SCHEDULE A

ALL THAT one resid ential flat at the b u ild in g named a s “West Wind” marked Flat No.
5A/Block 1 on the fifth floor measuring 1291 (Twelve hundred ninety-one) sq.ft. super
built-up area more or less consisting of two bedrooms, one living/d ining/kitchen space &
two toilets along with one open car parking at 78, Raja S.C Mallik Road, Ramgarh, Kolkata
700084 with all common facilities available in the building.
