AGREEMENT

This agreement is made at Ganesh Nagar, Tq Omerga & Dist.Dharashiv.on – between M/S
Shakuntala Enterprises, Dharashiv (Herein after referred as 'The Contractor' which expression shall
unless excluded or repugnant to the context shall include its successor, or permitted assignees) on one
part and the 'Maharashtra State Electricity Dist. Company’s’ (here in after referred as 'The Company’s' to
the context shall include its successor, or assignees) on other part. Whereas The Dy. Executive
Engineer, MSEDCL, sub-division office, Omerga permitted to execute the work for shifting of LT line
which is passing from residential area under At Sarpanch Grampanchayat , Ganesh Nagar ,Tq Omerga
& Dist.Dharashiv Through a Licensed Electrical Contractor on turnkey basis according to the powers
delegated to him as per rules, For the work for shifting of LT line, Ganesh Nagar ,Tq Omerga &
Dist.Dharashiv (herein after referred as 'the said work') in accordance with the terms, conditions,
specifications connected thereto and the contractor in response there to has accepted the said work,
The Dy. Executive Engineer, MSEDCL, sub-division office, Omerga On behalf of the Company’s being
the competent accepting authority and in pursuance thereto a contract is concluded with 'the contractor'
on the terms and conditions specified in the Order bearing No.: Dy.EE/OMG/TS/DDF/____ -
dt._________ , and more exhaustively described in the letter and contract for works, on terms and
conditions mentioned therein.
 NOW THIS AGREEMENT IS WITNESSED AND IT IS HEREBY AGREED AND DECLARED AS
UNDER.

In considerations of the terms and conditions of the said order placed with him, the contractor hereby
convenates with the Company’s that he shall and will be and perform all works and things under the con-
tract mentioned and described under the said specifications, and also which are implied that may
reasonability be necessary for the due completion of the said contract within such time in such manner
subject to the terms and conditions and stipulations contained and applicable in this contract.

AND DECLARE FURTHER THAT

1) The contractor shall hereby undertake the said work for shifting of LT line which is passing from
residential area under At Sarpanch Grampanchayat Ganesh Nagar ,Tq Omerga & Dist.Dharashiv
complete in its manner as more clearly described under the scope of work together with all ancillaries and
commuted work under this contract.

2) The contractor shall indemnify the Company’s from all claims against any injury caused to any person
whether workmen or not, while in or upon the works or the site of the work and the Company’s shall
not be bound to defend any claim brought under the 'Workmen’s Compensation Act' and the contractor
shall be governed by conditions of the contract.

3) The ‘Contractor’ hereby give guarantee for two year from the date of commissioning of the line for ‘the
said works’ carried out as per ‘the said order’, and the cost of damages occurred on the said line if any
will be borne by the ‘Contractor’.

The validity of this agreement shall stretch over the entire period of the said contract, including
authorized/ approved extension, if any from the date of its issue but it shall post-facto cease and be
cancelled upon successful and satisfactory completion of the above said contract.

IN WITNESSES WHERE THE common seal of the contractor Shakuntala Enterprises, Dharashiv
(there into affixed on date __ _/__ _/__ ____).
