:Ý b¥MrT XÂ b¥kÍfL wYM xgLG WHEREAS, it is necessary to protect the reputation


lÖT bmS«T yNGD o‰ §Y yts¥„ sãCN and goodwill of business persons engaged in
mLµM SM XÂ ZÂ lm«bQ# XNÄþhùM btm manufacturing and distribution of goods as well as
úúY :ÝãCÂ xgLGlÖèC mµkL múkRN l¥ rendering services by protecting trademarks to avoid
SwgD yNGD MLKT _bÝ ¥DrG b¥SflgùÜ\ confusion between similar goods and services;

yNGD MLKèC bnÉ gbà oR›T WS_ WHEREAS, trademarks, in the course of free trade,
y¹¥ÓCN MRÅ bmM‰T XÂ _Q¥cWN play an important role in guiding customers’ choice
b¥S«bQ rgD kFt¾ DRš XNħcW y¬wq and protecting their interests;

WHEREAS, it is believed that protection of
lNGD MLKèC _bÝ ¥DrG lB¼¤‰êE trademarks could have positive impact on national
xþ÷ñ¸ mÄbR btlYM lNGD X xþNÇST¶ economic advancement and especially on the trade and
L¥T xãN¬êE xStêAå XNÄlW bm¬mnù\ industrial development of the country;

yÝlù xgÆB l¤§ TRgùM Ω¸Ãs«W µLçn In this Proclamation, unless the context: otherwise

1/ “ywL yNGD MLKT” ¥lT bÆlb¤TnT 1/ “collective trademark” means a trademark


yÃzWN ¥HbR xƧT MRèC wYM xg distinguishing the goods or services of
LGlÖèC kl¤lÖC sãC MRèC wYM members of an association, which is the owner
xgLGlÖèC lmlyT y¸ÃglGL yNGD of the trademark, from those of other
MLKT nW”” undertakings;

2/ “FRD b¤T” ¥lT bzþH xêJ xNqA


$9 ytmlktW FRD b¤T nW”” 2/ “court” means the court referred to in Article 49
of this Proclamation;
3/ “qĸ yNGD MLKT” ¥lT bNGD ML
3/ “earlier trademark” means a trademark which

has been entered in the register of marks or has

a date of application for registration earlier than

4/ “foreigner” means a person who is not domiciled
nê¶ ÃLçn wYM bxþT×eà WS_ or has no registered business in Ethiopia;
ytmzgb yNGD o‰ yl¤lW sW nW””

5/ “ygùM„K wdB” X “ygùM„K ÈbþÔ 5/ the terms “customs port” and “customs station”
ygùM„K ÆlSLÈNN XNdg l¥ÌÌM shall have the meanings assigned to them under
x¿‰„N lmwsN bwÈW xêJ qÜ_R the Re-Establishment and Modernization of

MdÆ SMMnT m¿rT y:ÝãC wYM and revised at Stockholm, in 1967, at Geneva,
xgLGlÖèC MdÆ nW”” in 1977 and amended in 1979;

Ælb¤T l¥N¾WM l¤§ sW yNGD 7/ “license contract” means a contract whereby

MLKtÜ XNÄþ«qMbT y¸fQDbT services in respect of which the trademark

of priority;

b¤T dNB nW”” Regulations to be issued pursuant to Article 47
of this Proclamation;

03/ “yb¤tzmD SM” ¥lT yxND b¤tsB 13/ “surname” means a name shared in common to
xƧT bt«L k¸sÈ cW SM btlY identify members of a family, as distinguished
bwL y¸«qÑbT ymlà SM sþçN from each member’s given name. Also called
yb¤tsB SM wYM ym=rš SM family name,or last name.

3. Scope of Application

bXNµ lXNµ mRç wYM xþT×eà xÆL Subject to the principles of reciprocity or in
bçnCbT ›lM xqF WL §Y bmmSrT accordance with any treaty that Ethiopia is a party

:ÝãC wYM xgLGlÖèC kl¤lÖC distinguishing goods or services of a person
sãC :ÝãC wYM xgLGlÖèC bGLI from that of other persons shall be eligible for
lmlyT y¸ÃSCL kçn lþmzgB registration.

yqläC QNJT _bÝ y¸d rGlT color combinations; a trademark, which is
sþçN yNGD MLKtÜ ytmzgbW bklR registered in color, shall only be protected in
q lM kçn _bÝ y¸drGlT the color combination in which it is registered.

3/ A trademark eligible for registration may

yMLKtÜN L† ÆHRY y¸qNS wYM protection unless they undrmine the distinctive
yl¤§ sWN mBT y¸_S XSµLçn character of the trademark or infringe the rights

6. lMZgÆ BqÜ Sl¥Yçnù yNGD MLKèC 6. Trademarks Inadmissible for Registration

1/ y¸ktlùT bNGD MLKTnT >¸F±Œo˙ 1/ The following trademarks shall not be admissible

h/ yzþH xêJ xNqA 5 DNUg¤ãCN a) a trademark which does not conform to the
y¥ÃৠyNGD MLKT# provisions of Article 5 of this
Proclamation;

MLKT# b) a trademark which consists of sound or
odour;

c) a trademark which is incapable of

distinguishing the goods or services of one

person from those of other persons;

r/ lMZgÆ yqrbW yNGD MLKT f) a trademark consisting exclusively of signs


y¸mlk¬cWN :ÝãC wYM xgL or indications which have become
GlÖèC b¸mlkT wYM bxþ÷ñ customary in the current language use in
¸ÃêE wYM yNGD XNQSÝs¤ãC relation to such goods or services for
WS_ ytlmÇÂ bU‰ mGÆbþÃ which the registration of a trademark is
ÌNÌnT y¸ÃglGlù MLKèCN applied for, or which have become
wYM mlÃãCN BÒ yÃz yNGD customary in economic and business
MLKT# activities;

BÒ yÃz yNGD MLKT# technical result of the good or that gives
substantial value to the good.

bTN ï¬ wYM yXÝãCN ›YnT h) a trademark that is likely to mislead the
ÆHRY btmlkt ÞZbùN wYM public or the business community, in
yNGÇN ¥ÞbrsB lþÃúST y¸CL particular as regards to the geographical
yNGD MLKT# origin of the goods or services, or their
nature or characteristics;

úYñR k¥N¾WM hgR mNGoT# i) unless authorized by a competent authority,

imitation of or contains an armorial

bearing, flag or other emblem, a name or

abbreviation or initials of the name of, or

state, intergovernmental organization, or

2/ yNGD MLKT MZgÆ ¥mLkÒ bqrbbT 2/ The provisions of Sub-Article (1), (e), (f) and (j)
qN yNGD MLKtÜ b_QM §Y bmêlù of this Article shall not apply if it is ascertained
MKNÃT bxþT×eà WS_ b¸gÆ that by the date of receipt of an application for
y¸¬wQ mçnù ktrUg« yzþH xNqI registration of a trademark, the trademark has,
N;ùS xNqI 1/¿/# /r/ X /b/ DNUg¤ãC as a result of its use, become well known in
tfɸ xYçnùM”” Ethiopia.

7. bƒSt¾ wgN mBT MKNÃT mmZgB 7. Refusal of Registration of Trademarks on


y¥YClù yNGD MLKèC Grounds of Third Party Rights

xND yNGD MLKT b¸ktlùT yƒSt¾ A trademark shall not be registered because of the
wgñC yQD¸Ã mBèC MKNÃT lþmzgB following third party priority rights:-

1/ kxND ›YnT wYM tmúúY :ÝãC 1/ when it is identical with an earlier trademark of
wYM xgLGlÖèC UR ytÃÃz yl¤§ sW another person in respect of the same goods or
qĸ yNGD MLKT UR xND ›YnT services or closely related goods or services, or
yçn wYM múkRN lþÃSkTL y¸CL if it so nearly resembles such a trademark as to
tmúúYnT ÃlW ª<Œ\ be likely to deceive or cause confusion;

3/ when it is identical with or confusingly similar

ktmzgb yNGD MLKT UR xND ›YnT those in respect of which the registration is
kçn wYM lþÃúST b¸CL dr© applied for, provided that the use of the
tmúúY kçn wYM TRgùÑN yÃz kçn trademark in relation to those goods or services
x«ÝqÑ b:ÝãcÜ wYM bxgLGlÖècÜ would indicate a connection between those
mµkL GNßùnT XNÄl b¥SmsL goods or services and that the interest of the
btmzgbW yNGD MLKT Ælb¤T _QM owner of the registered trademark is likely to be
§Y gùÄT lþÃdRS y¸CL kçn\ damaged by such use;

PROCEDURES FOR REGISTRATION
yNGD MLKT yMZgÆ oR›T OF TRADEMARK

8. Application for Registration


8. yMZgÆ ¥F@ªƒ
1/ Applicatuion for registration of a trademark
1/ yNGD MLKT MZgÆ ¥mLkÒ lzþhù shall be made in the prescribed form and filed
x§¥ btzUj y¥mLkÒ QI täLè with the Office accompanied by payment of the
bdNbù ktwsnW KFÃ UR lAÞfT b¤tÜ application fee prescribed by the Regulations.

2/ An application for registration shall cover only
2/ xND yMZgÆ ¥mLkÒ y¸YzW xND one trademark.

3/ The applicant shall, after completing the
3/ xmLµcÜ bdNbù ytwsnWN y¥mLkÒ application form prescribed by the Regulations,
QI bmѧT y¸ktlù TN snìC xÃYø attach and submit the following documents:

a) three copies of a reproduction of the
h/ yNGD MLKtÜN ÂÑÂ ƒST QJãC\ trademark;

b) a list of goods and services classified in


l/ y›lM xqF MdÆN m¿rT b¥DrG accordance with the international
yNGD MLKtÜ y¸ÃglGLÆcWN classification of goods and services for
:ÝãC wYM xgLGlÖèC ZRZR XÂ which registration of the mark is requested
yMdÆ KFL qÜ_‰cWN\ and the class numbers of the classification;

d) a document certifying payment of the fee

4/ An applicant who is a foreigner shall appoint

The applicant may withdraw the application any
time while it is pending.

10. Right of Priority
0. yqĸnT mBT 1/ Where any applicant files his application in
Ethiopia within six months from the date on
1/ ¥N¾WM xmLµC bWÀ xgR yNGD which he first filed in a foreign country an
MLKtÜ XNÄþmzgB µmlktbT qN xN application for the same trademark in respect of
Sè ÆlùT 6 w‰T WS_ bxþT×eà same goods or services, the date on which the
yNGD MLKtÜ ltmúúY XÝãC wYM application was first filed in the foreign country
xgLGlÖèC XNÄþWL ¥mLkÒ sþÃqR shall be regarded as the date of filing if the
B yqĸnT mBT sþ«YQ btmzg applicant claims the right of priority and
bbT AÞfT b¤T TKKl¾ntÜ ytrUg« furnishes within the prescribed time limit a
yqĸWN ¥mLkÒ QJ X l¤lÖC copy of the earlier application certified as
y¸«yqÜ snìCN mr© btwsnW correct by the office with which it was filed and
ygþz¤ gdB µqrb ¥mLkÒW bWÀ other documents and information as prescribed.

2/ Where the Office finds that the declaration
2/ lAHfT b¤tÜ yqrbW mGlÅ bzþH submitted does not fulfil the requirements of
xNqA N;ùS xNqA /1/ XÂ bdNbù Sub-Article (1) of this Proclamation and the
ytwsnWN mSfRT y¥Ãৠkçn Regulations, the said declaration shall be
ytÆlW mGlÅ XNÄLqrb Yö«‰L”” considered not to have been made.

AÞfT b¤tÜ yNGD MLKT MZgÆ The Office shall, when an application for the

ywNjL on-oR›T Þ¯C DNUg¤ãC Criminal Procedure Code on search and seizure

$. yFT¼B¼¤R mFTÿãC 40. Civil Remedies

1/ yNGD MLKT mBT mÈSN b¸ml 1/ The court hearing a case of infringement of a

xÃYø b¸ÃqRbW ¥mLkÒ m¿rT relevant evidence made by the right holder, and

xmLµcÜ mBt½ ytÈsÆcW ÂcW BlÖ applicant, seize and detain goods which are

1/ ¥N¾WM sW bdNbù ytmlktWN 1/ Any person may request for search of a
