y¸gŸ _Ê :Ý# MRT# mœ¶Ã# ¹q_ X equipment and commodities in solid, liquid or
gaseous form, and electricity, as will as

installation, transport, maintenance or similar

obligations related to the supply of the goods if

y¥FrS# y_gÂ# y¥dS o‰ XNÄþhùM tÙÄŸ site preparation, excavation, installation of equipment
yçn kêÂW o‰ ÃLbl« êU ÃlW and materials, decoration, as well as services
xgLGlÖT sþçN# ymgNÆT# bÆlb¤TnT incidental to works, if the value of those services does
not exceed that of the works themselves and includes

d) “Consultancy Service” means a service of an

yÄþ²YN# ytl† PéjKèCN y¥d‰jT# study, design and organize specific projects,
ldNb®C MKR ymS«T# oL«Â ymS«T advise clients, conduct training and transfer
X :WqTN y¥St§lF yx¥µ¶nT ÆH¶ ÃlW knowledge;

e) “Procurement” means the purchasing hiring or
¿/ «Gi» ¥lT :ÝãCN# yGNƬ zRF o‰ãCN obtaining by any other contractual means of

r/ «Gi fɸ xµL» ¥lT Ñlù bÑlù wYM f) “Procuring entity” means public body, which is

ymNGoT m/b¤T# kFt¾ yTMHRT tÌM budget, higher education institutions and public

fɸ xµ§T yWS_ gbþ nW”” Government treasury or aid grants and credits put at
the disposal of procuring entities by foreign donors
through the Federal Government internal revenue of
procuring entities;
¹/ «ymNGoT Gi» ¥lT bGi fɸ xµ§T
bmNGoT gNzB y¸kÂwN Gi nW””
h) “Public Procurement” means procurement by
procuring entities using public funds;
q/ «xQ‰bþ» ¥lT lGi fɸ xµ§T :Ý wYM
xgLGlÖT l¥QrB wYM yGNƬ zRF o‰ i) “Supplier” means a physical or juridical person under
l¥kÂwN WL ygÆ sW wYM DRJT nW”” contract with a procuring entity to supply goods,
works or services;

DRJT nW”” j) “Candidate” means a physical or juridical person
invited to take part in public procurement or seeking

k) “Bidder” means a physical or juridical person
c/ «y=r¬ snD» ¥lT tʼnÓC y=r¬ submitting a bid;

l) “Bid documents” means the documents

prepared by the procuring entity to bidders as a
basis for preparation of their bids;

m) “Procurement directives” are the directives
mm¶Ã nW”” issued by the Minister under this Proclamation;
ß/ «¸nþSTR X ¸nþSt½R» ¥lT XNdQdM
tktlù ygNzB yxþ÷ñ¸ L¥T ¸nþSTR X n) “Minister or Ministry” means the Minister or
¸nþSt½R nW”” the Ministry of Finance and Economic
Development respectively’

mBT yts«W xµL nW”” o) “Person” means natural or juridical person

3. ytfɸnT wsN 3. Scope of Application

1/ YH xêJ b¥ÂcWM yØÁ‰L mNGoT Gi 1/ This Proclamation applies to all Federal public
§Y tfɸ YçÂL”” procurement.

2/ bzþH xNqA N;ùS xNqA 1 ytngrW bþñRM 2/ Notwithstanding Sub-Article (1) of this Article,
¸nþST„ xGÆB µ§cW ymNGoT m/b¤èC the Minister, in consultation with the relevant
yb§Y `§ðãC UR bmmµkR bB¼¤‰êE public bodies, may in the interest of national
dHNnT X bxgR mk§kà MKNÃT Gi btly security or national defense decide to use a
zÁ XNÄþf{M Wœn¤ lþs_ YC§L”” YH different procedure, in which case the Minister
b¸çNbT gþz¤ ¸nþST„ GiãC bqÜ«Æ shall define the method of procurement to be
W«¤¬¥ bçn mNgD XNÄþf{Ñ l¥DrG followed in order to serve the interest of economy
y¸ÃSCL yGi zÁ bo‰ §Y l¥êL and efficiency.

4. ›lM ›qF GÁ¬ãC 4. International Obligations

1/ YH xêJ yØÁ‰L mNGoT kxND wYM 1/ To the extent that this Proclamation conflicts
kxND b§Y kçnù mNGo¬T wYM k›lM with an obligation of the Federal Government
›qF DRJèC UR ÆdrgW wYM b¸ÃdRgW under or arising out of an agreement with one
SMMnT wYM kSMMntÜ kmn= GÁ¬ UR or more other states or with an international
y¥YÈÈM kçn bSMMntÜ ytmlktW Y{ÂL”” organization, the provisions of that agreement
shall prevail.

2/ bzþH xNqA N;ùS xNqA 1 ytmlktW 2/ Where an agreement referred to in Sub-Article


SMMnT lxþT×eà wYM bxþT×eà nê¶ lçnù (1) of this Article contains a preference or
tʼnÓC L† xStÃyT y¸fQD b¸çNbT preferences in favor of national and resident
gþz¤ Gi fÚ¸ xµL tfɸ y¸çnW L† bidders, a procuring entity shall ensure that the
xStÃyT b=r¬ snD WS_ bGLA applicable preference or preferences are clearly
XNÄþmlkT ¥DrG xlbT”” stated in the bidding documents.

5. Procurement Directives
5. yGi mm¶ÃãC
1/ The Minister is authorized to issue procurement
1/ ¸nþST„ yzþHN xêJ ›§¥ãC kGB l¥DrS
directives to fulfill the objectives and to carry out

the provisions of this Proclamation.
y¸rÇ mm¶ÃãCN lþÃwÈ YC§L””
2/ If more than one procuring entity needs the same
2/ kxND b§Y yçnù Gi fɸ xµ§T xND kind of goods, works or services, the Minister
›YnT :Ý wYM xgLGlÖT lmG²T# yGNƬ may instruct one entity or a specially appointed
o‰ l¥¿‰T y¸fLgù b¸çNbT gþz¤ agent to procure such items on behalf of other
¸nþST„ xND ymNGoT m/b¤T wYM lzþhù entities or to enter into framework agreements
o‰ ytÌÌm DRJT Gi fÚ¸ xµ§T SM based on aggregate purchase under which
GiWN bQNJT XNÄþÃkÂWN wYM Gi fɸ procuring entities may place orders for certain
xµ§T y¸fLgùTN :Ý# yGNƬ zRF o‰ X types of goods, works and services.

y¸ÃSCL yWL ¥:qF XNÄþfRM lþÃZ

3/ For the purpose of Sub-Article (2) of this Article
3/ lzþH xNqA N;ùS xNqA 2 xfÉ{M «yWL “Framework agreement” means an agreement
¥:qF» ¥lT bx¤jNsþW btfqdlT xµL XÂ entered into by an entity or agent appointed by the
bxQ‰bþW mµkL y¸frM Gi fɸ xµ§T Agency and the supplier which enables procuring
xND ›YnT :Ý# yGNƬ-zRF o‰ wYM entities to procure same king of goods, works and
xgLGlÖT bWL ¥:qû btwsn êU kxQ‰bþW services with a price fixed in the framework
UR b¸drG yxfÉ{M WL lmG²T agreement by each concluding a performance
y¸ÃSC§cW SMMnT nW”” agreement with said supplier.

6. yÞG snìCN ÞZbù XNÄþÃWQ Sl¥DrG 6. Public Accessibility of Legal Texts

YH xêJ XÂ bzþH xêJ m¿rT b¸nþST„ This Proclamation and the procurement directives of
y¸w«ù yGi mm¶ÃãC ÞZbù XNÄþÃWÝcW the Minister shall be promptly made accessible to
mdrG XÂ lx«ÝqM xMcE bçn mNgD boR›T the public and systematically maintained.

7. `§ðnT t«ÃqEnT 7. Responsibility and Accountability

1/ Gi fɸ xµ§T Sl¸ÃkÂWnùT Gi X 1/ Procuring entities shall have overall responsibility


SlWlù xfÉ{M «Q§§ `§ðnT ÃlÆcW sþçN# for the procurement process, and contract
btlYM# implementation in particular, shall be responsible
for:

h/ btgbþW ysW `YL ytd‰j yGi yo‰ a) causing to be established a Procurement Unit
KFL y¥ÌÌM# staffed at an appropriate level;

l/ y=r¬ ÷¸t½ y¥ÌÌM X xƧtÜN b) establishing a tender committee and


ymsyM# appointing its members

¼/ y=r¬ ¥S¬wqEÃãCN y¥WÈT# c) advertising bid opportunities;

d) communicating award decisions;


m/ y=r¬ x¹ÂðãCN y¥S¬wQ#

e) certifying the availability of funds to support


¿/ WlùN kmfrÑ bðT Gi lmf{M
the procurement activity before signing a
y¸ÃSCL bqE bjT mñ„N y¥rUg_#
contract;
r/ yGi WlÖCN ymfrM# f) signing contracts for procurement activities;
s/ btʼnÓC y¸qRbù xb¤tܬãCN mRMé g) investigating complaints by bidders; and
Wœn¤ ymS«T# rendering decisions thereon;
¹/ yxb¤tܬãCN Q©þ X yMRm‰ GŸèCN h) submitting a copy of any complaints and
XÂ bGŸècÜ m¿rT yts«WN Wœn¤ reports of the findings and decisions to the
yÃz ¶±RT lx¤jNsþW y¥QrB# Agency;

q/ kx¹ÂðW UR ytdrgW WL# x¹Âð i) ensuring that the implementation of the


bçnÆcW ÝlÖC hùn¤¬ãC m¿rT awarded contract is in accordance with the
mf{ÑN y¥rUg_ GÁ¬ xlÆcW XÂ# terms and conditions of the award.

b/ XNdxSf§gþntÜ yGi oR›TN y¸ÃSf j) outsource procurement activities to third

down in the procurement directives.

THE PUBLIC PROCUREMENT AGENCY

1/ ymNGoT Gi x¤jNsþ kzþH bº§ «x¤jNsþ» 1/ There is hereby established Public Procurement Agency
XytÆl y¸«‰# ‰sùN yÒl yÞG sWnT (hereinafter referred to as the “Agency”) as an
ÃlW yØÁ‰L mNGoT mo¶Ã b¤T çñ autonomous Federal Government organ having its own
juridical personality.

2/ The Agency shall be accountable to the Minister.

01. yx¤jNsþW tGÆéC 11. Functions of The Agency

x¤jNsþW kzþH b¬C ytzrz„TN tGÆéC The Functions of the Agency are:

1/ bmNGoT Gi ±lþsþãC# mRçãCÂ xfÉ{ 1/ advise the Federal Government on all public
äC §Y yØÁ‰L mNGoTN ¥¥kR# lKL procurement policies, principles and imple-
lÖC yt½KnþK DUF mS«T# mentation, and provide technical assistance to
the regional governments;
2/ bØÁ‰L mNGoT WS_ ÃlWN ymNGoT
Gi xfÉ{M oR›T tGƉêEnT mk¬tL# 2/ monitor and report to the minister the per-
l¸nþST„ ¶±RT ¥DrG X bÞG bxfÉ{M formance of the public procurement systems in
oR›tÜ §Y y¥ššÃ hœïC ¥QrB# the federal government, initiate amendments on

5/ ensure that any deviation from the use of the
5/ ktfqÇ mdb¾ yGi snìC# x¿‰„N standardized bidding documents, procedural
k¸m„ QÛC XÂ l¤lÖC lGi xfÉ{M forms and any other attendant documents is
xGÆBnT µ§cW snìC WÀ Gi y¸f{mW effected only after the prior written approval of
x¤jNsþW bA¼ùF SMMntÜN sþs_ BÒ mçnùN the Agency;

6/ receives, reviews, and records applications by

ãCN mqbL# mmRmR XÂ mmZgB # issue certificates to those registered in the
ltmzgbù xQ‰bþãC yMSKR wrqT mS«T# suppliers list;

7/ maintains a list of suppliers who by reason of

under a public procurement contract, or having

provided false information about their

procurement by the Agency;

8/ conduct periodic inspections of the records and

physical facilities, managerial capability

information is required by this Proclamation to
be official, who:

a) discloses to any person or that person’s

representative any matter in respect of
¥ÂcWNM mr© l¥ÂcWM l¤§ sW
another person that may in the exercise of
wYM yzþH sW wkþL lçn sW xúLæ
the procurement officer’s powers or the
ys«# performance of the procurement officer’s
duties come to the procurement officer’s
knowledge;
l/ bzþH xêJ m¿rT GiN b¥kÂwN rgD
ÃlWN oLÈN l¥Sf{M wYM yo‰ b) permits any other person to have access to
GÁ¬WN lmwÈT XNÄþÃSCL GiWN records in the possession or custody of the
b¸fAmW m/b¤T zND y¸gßWN Procuring entity, except in the exercise of
¥ÂcWNM mr© bFRD b¤T T:²Z µLçn the procurement officer’s powers or the
bStqR lƒSt¾ wgN xúLæ ys« performance of the procurement officer’s
XNdçn# duties under this Proclamation or by order
of a court;

procuring entity in carrying out the provisions
of this Proclamation who :

wYM l¤§ ›YnT KFà wYM Sõ¬ a) directly or indirectly asks for or receives in
XNÄþdrGlT y«yq wYM ytqbl lKFÃW connection with any of his duties a
wYM lSõ¬W tSÍ wYM mÃÏ y«yq payment or gift whether pecuniary or
wYM ytqbl# wYM otherwise or promise or security for that
payment or reward;
l/ bGi tGÆR §Y ¥ubRbR wYM kzþH
xêJ DNUg¤ãC UR wYM kts«W b) enters into or acquiesces in an agreement to
`§ðnT mLµM xfÉ{M UR y¸ÝrN do or to abstain from doing, permit conceal,
tGÆR lmf{M# ¥DrG y¸gÆWN or connive at any act or thing whereby the

wYM ltmdb sW# bribe to any person appointed to or employed in
any procuring entity with intent:

h/ yqrblTN Wœn¤ bm«bQ §Y ÃlWN gùÄY a) to influence the decision or action of that
wYM bo‰ `§ðntÜ MKNÃT lþqRBlT person on any question or matter that is
b¸CL gùÄY §Y y¸s«WN Wœn¤ wYM pending, or may be brought before him in
y¸wsdWN XRM© l¥Æ²T wYM# his official capacity; or

b) to influence that person to commit, or aid


l/ bmNGoT Gi §Y y¥ubRbR DRgþT
or abet in committing any fraud on the
XNÄþf{M wYM DRgþtÜ lþf{M XNÄþrÄ
procurement, or to connive at, collide in or
wYM XNÄþtÆbR wYM lDRgþtÜ mf{M
allow or permit any opportunity for the
hùn¤¬ãCN l¥mÒcT XNÄþS¥¥#
commission of any such fraud;

b¥sB gùï lmS«T ÝL kgÆlT# is guilty of an offence and liable on
kqrblT wYM ks«W _Ít¾ çñ mgßtÜ conviction to a fine of not less than Birr
sþrUg_ bwNjL HG ybl« y¸ÃSqÈ 50,000 and to rigorous imprisonment for a
µLçn bStqR kBR $ ¹þH çns ygNzB term of not less than ten (10) years and not
mqÅ X k0 ›mT y¥ÃNS X k! ›mT more than twenty (20) years it the penal
b¥YbL_ Inù Xo‰T YqÈL”” higher punishment it prescrihed on the
nenal code this will have effect.

$5. dNB mm¶Ã y¥WÈT oLÈN 55. Power to issue Regulation and Direction

1/ YHN xêJ l¥Sf™M y¸nþSTéC MKR b¤T 1/ Where it is necessary for the implementation of
XNdxSf§gþntÜ dNB lþÃwÈ YC§L”” this proclamation, the Council of Ministers may
issue a Regulation.
2/ YHN xêJ l¥Sf™M ¸nþST„ mm¶ÃN
lþÃwÈ YC§L”” 2/ The Minister may issue directive to implement
this Proclamation.
