XNQSÝs¤ hBTN bqÜ«Æ W«¤¬¥ bçn mNgD _QM funds is essential to a well-functioning government:.

ymNGoT Gi bqÜ«Æ W«¤¬¥ bçn mNgD WHEREAS, public procurement must be carried out

xDLã yl¤lbT XNÄþçN ¥drG tgbþ Slçn# also fair, transparent and non-discriminatory;

Republic of Ethiopia, it is hereby proclaimed as follows;

2. T R Ù » 2. Definitions
h/ «:Ý» ¥lT b«ÈR# bfœ> wYM bUZ mLK a) “Goods” Means raw material, products and

gaseous form, and electricity, as will as

installation, transport, maintenance or similar

xgLGlÖT sþçN# ymgNÆT# bÆlb¤TnT incidental to works, if the value of those services does
not exceed that of the works themselves and includes

ldNb®C MKR ymS«T# oL«Â ymS«T advise clients, conduct training and transfer
X :WqTN y¥St§lF yx¥µ¶nT ÆH¶ ÃlW knowledge;

e) “Procurement” means the purchasing hiring or
¿/ «Gi» ¥lT :ÝãCN# yGNƬ zRF o‰ãCN obtaining by any other contractual means of
XÂ xgLGlÖèCN bGi# bkþ‰Y wYM goods, works and services;
b¥ÂcWM l¤§ tmúúY WL ¥GßT nW””
r/ «Gi fɸ xµL» ¥lT Ñlù bÑlù wYM f) “Procuring entity” means public body, which is
bkðL bØÁ‰L mNGoT bjT y¸tÄdR partly or wholly financed by Federal Government
ymNGoT m/b¤T# kFt¾ yTMHRT tÌM budget, higher education institutions and public
XÂ tmúúY xÌM ÃlW xµL nW”” institutions of like nature;

§Y tfɸ YçÂL”” procurement.
2/ bzþH xNqA N;ùS xNqA 1 ytngrW bþñRM 2/ Notwithstanding Sub-Article (1) of this Article,
¸nþST„ xGÆB µ§cW ymNGoT m/b¤èC the Minister, in consultation with the relevant
yb§Y `§ðãC UR bmmµkR bB¼¤‰êE public bodies, may in the interest of national
dHNnT X bxgR mk§kà MKNÃT Gi btly security or national defense decide to use a
zÁ XNÄþf{M Wœn¤ lþs_ YC§L”” YH different procedure, in which case the Minister
b¸çNbT gþz¤ ¸nþST„ GiãC bqÜ«Æ shall define the method of procurement to be
W«¤¬¥ bçn mNgD XNÄþf{Ñ l¥DrG followed in order to serve the interest of economy
y¸ÃSCL yGi zÁ bo‰ §Y l¥êL and efficiency.

kxND b§Y kçnù mNGo¬T wYM k›lM with an obligation of the Federal Government
›qF DRJèC UR ÆdrgW wYM b¸ÃdRgW under or arising out of an agreement with one
SMMnT wYM kSMMntÜ kmn= GÁ¬ UR or more other states or with an international
y¥YÈÈM kçn bSMMntÜ ytmlktW Y{ÂL”” organization, the provisions of that agreement
shall prevail.
5. Procurement Directives
5. yGi mm¶ÃãC
1/ The Minister is authorized to issue procurement

directives to fulfill the objectives and to carry out

the provisions of this Proclamation.

2/ If more than one procuring entity needs the same

›YnT :Ý wYM xgLGlÖT lmG²T# yGNƬ may instruct one entity or a specially appointed
o‰ l¥¿‰T y¸fLgù b¸çNbT gþz¤ agent to procure such items on behalf of other
¸nþST„ xND ymNGoT m/b¤T wYM lzþhù entities or to enter into framework agreements
o‰ ytÌÌm DRJT Gi fÚ¸ xµ§T SM based on aggregate purchase under which
GiWN bQNJT XNÄþÃkÂWN wYM Gi fɸ procuring entities may place orders for certain
xµ§T y¸fLgùTN :Ý# yGNƬ zRF o‰ X types of goods, works and services.

3/ For the purpose of Sub-Article (2) of this Article
3/ lzþH xNqA N;ùS xNqA 2 xfÉ{M «yWL “Framework agreement” means an agreement
¥:qF» ¥lT bx¤jNsþW btfqdlT xµL XÂ entered into by an entity or agent appointed by the
bxQ‰bþW mµkL y¸frM Gi fɸ xµ§T Agency and the supplier which enables procuring
xND ›YnT :Ý# yGNƬ-zRF o‰ wYM entities to procure same king of goods, works and
xgLGlÖT bWL ¥:qû btwsn êU kxQ‰bþW services with a price fixed in the framework
UR b¸drG yxfÉ{M WL lmG²T agreement by each concluding a performance
y¸ÃSC§cW SMMnT nW”” agreement with said supplier.
YH xêJ XÂ bzþH xêJ m¿rT b¸nþST„ This Proclamation and the procurement directives of
y¸w«ù yGi mm¶ÃãC ÞZbù XNÄþÃWÝcW the Minister shall be promptly made accessible to

THE PUBLIC PROCUREMENT AGENCY
8. yx¤jNsþW mÌÌM
8. Establishment
1/ ymNGoT Gi x¤jNsþ kzþH bº§ «x¤jNsþ» 1/ There is hereby established Public Procurement Agency
XytÆl y¸«‰# ‰sùN yÒl yÞG sWnT (hereinafter referred to as the “Agency”) as an
ÃlW yØÁ‰L mNGoT mo¶Ã b¤T çñ autonomous Federal Government organ having its own
juridical personality.

2/ yØÁ‰L mNGoT yGi xfÉ{M y¸m‰bTN 2/ set standards for the public procurement systems

3/ yGi fɸ xµ§T kzþH b§Y ytzrz„TN 3/ monitor compliance of this proclamation by

x¤jNsþW kzþH b¬C ytzrz„TN tGÆéC The Functions of the Agency are:
ÃkÂWÂL”-
1/ bmNGoT Gi ±lþsþãC# mRçãCÂ xfÉ{ 1/ advise the Federal Government on all public
äC §Y yØÁ‰L mNGoTN ¥¥kR# lKL procurement policies, principles and imple-
lÖC yt½KnþK DUF mS«T# mentation, and provide technical assistance to
the regional governments;
2/ bØÁ‰L mNGoT WS_ ÃlWN ymNGoT
Gi xfÉ{M oR›T tGƉêEnT mk¬tL# 2/ monitor and report to the minister the per-
l¸nþST„ ¶±RT ¥DrG X bÞG bxfÉ{M formance of the public procurement systems in
oR›tÜ §Y y¥ššÃ hœïC ¥QrB# the federal government, initiate amendments on

ments;

yçnW ¥Sr© ›YnT XÂ yÑÃW :DgT competent authorities;
y¸ktlW £dT XNÄþwsN ¥DrG#
4/ prepare, update and issue authorized versions of
4/ bo‰ §Y XNÄþWlù ytfqÇ mdb¾ yGi the standard bidding documents, procedural
snìC# x¿‰„N y¸m„ QÛC X l¤lÖC forms and any other attendant documents to
lGi xfÉÉM xGÆBnT çcW snìCN procuring entities;
¥zUjT# wQ¬êE XNÄþçnù ¥DrG#
5/ ensure that any deviation from the use of the
5/ ktfqÇ mdb¾ yGi snìC# x¿‰„N standardized bidding documents, procedural
k¸m„ QÛC XÂ l¤lÖC lGi xfÉ{M forms and any other attendant documents is
xGÆBnT µ§cW snìC WÀ Gi y¸f{mW effected only after the prior written approval of
x¤jNsþW bA¼ùF SMMntÜN sþs_ BÒ mçnùN the Agency;

6/ receives, reviews, and records applications by
6/ bxNqA !1 N;ùS xNqA 6 m¿rT kxQ‰bþãC candidates for registered supplier status in
ZRZR WS_ lmmZgB y¸qRbù ¥mLkÒ accordance with Article 21 Sub-Article (6) and
ãCN mqbL# mmRmR XÂ mmZgB # issue certificates to those registered in the
ltmzgbù xQ‰bþãC yMSKR wrqT mS«T# suppliers list;
0/ yGi xfÉ{M YHNN xêJ «Bö ytkÂwn 10/ To ensure that the process is in accordance with
mçnùN l¥rUg_# this Proclamation conduct;
h/ b=r¬ ZGJT £dT yGi MRm‰# a) procurement audits during the bid preparatory
process;
l/ b=r¬ x¹Âð yçnW tʼnC bWlù
m¿rT o‰WN b¸ÃkÂWNbT gþz¤ b) contract audits in the course of the
yWL MRm‰# execution of an award bid; and

MRm‰ ¥µ¼¤D# contract in respect of any procurement, as
may be required;

xSgÄJnT ÃlW y:ÝÂ xgLGlÖT ZRZR 11/ adopt, adapt and update common specifications
bo‰ §Y ¥êL# Y¡W ZRZR kx¿‰R UR standards, the use of which shall be mandatory
ytÈÈm X wQ¬êE XNÄþçN ¥DrG# for all procuring entities;
02/ lGi x¿‰R oR›èC bÑlù y¸ÃglGL 12/ determine, develop, introduce, maintain and
ymr© KMCT ¥ÌÌM# ¥gÖLbT# m«bQ X update relate system-wide data bases and
wQ¬êEntÜ yt«bq XNÄþçN ¥DrG# technology, that serues the entire procedure of
procurement
03/ ytÌM XÂ ysW `YL xQM l¥gÖLbT
y¸ÃSCL yxQM GNƬ ±lþsþ :QD XNÄþñR 13/ develop policies and maintain an operational
¥DrG# plan on capacity building, both for institutional
and human resource development;

internationally;

mm¶ÃãC XNÄþhùM b¸nþST„ yts«WN 17/ administer and enforce compliance with all the
l¤lÖC tGÆéC bTKKL o‰ §Y mê§cWN provisions of this Proclamation, regulations
¥rUg_# and directives issued under this Proclamation
and other functions given to it by the
minister.
08/ kGi fɸ xµ§T y¸qRBlTN mr© m¿rT
b¥DrG ymNGoT Gi oR›T b¸gÆ 18/ presents on annual report to the Minister regarding
y¸¿‰ Slmçnù l¸nþST„ ›m¬êE ¶±RT the overall functioning of the public procurement
¥QrB# ¸nþST„ b¸«YqW ZRZR m¿rT system based on information provided to it by
procuring entities and specifying such data as the
bXÃNÄNÇ Gi fɸ xµ§T SltkÂwnW Gi
Minister may request regarding the nature and
›YnT XÂ m«N L† mr©ãCN mS«T# volume of public procurement handled by each
entity;
1/ ¥ÂcWM Gi fɸ xµL wYM xQ‰bþ ÞG 1/ require any information, documents, records and
k¸ÃzW WÀ Slmf{Ñ# Gi bTKKL reports in respect of any aspect of the public
S§l¥kÂwnù# yGiWN xm‰R bTKKL procurement process where a breach,
S§lmf{Ñ wYM Slmmú«„ ¶±RT yqrb wrongdoing, mismanagement or collusion has
wYM ytrUg« XNdçn kGiW xfÉ{M UR been alleged, reported or proven against any
ytÃÃzù mr©ãC# snìC mZgïC XÂ procuring entity or supplier;
¶±RèC XNÄþqRbùlT y¥zZ#
2/ MSKéCN ym_‰T# MSKéCÂ GiW y¸ml 2/ summon witnesses, call for the production of
k¬cW wgñC ݧcWN bmh§ XNÄþs«ù books of accounts, plans, documents and
y¥DrG# y£úB mZgB# P§N# snD XNÄþq examine witnesses and parties concerned on
RBlT y¥DrG# oath;
04. yêÂW o‰ xSkþÃJ oLÈN tGÆR 14. Powers and Duties of the General Manager
2/ kzþH b§Y bN;ùS xNqA 1 yt«qsW «Q§§ 2/ Without limiting the generally provided in sub-

shall:

m/ yx¤jNsþWN yo‰ KNWN y£úB ¶±RT d) prepare and submit to the Minister
xzUJè ÃqRÆL# sþfqDM bo‰ §Y operational and financial report on the
ÃW§L”” activities of the Agency.
¿/ kƒSt¾ wgñC UR b¸drgù GNßùnèC e) represent the Agency in all its relations
hùlù x¤jNsþWN YwK§L”” with third parties.
1/ Gi fɸ xµ§T kmNGoT Gi UR ytÃÃzù 1/ Procuring entities must maintain records and
mZgïCN XÂ snìCN GiW ktf{mbT qN documents regarding their public procurement
xNSè l0 ›mT ÃHL ¥öyT xlÆcW”” bzþH for a period of ten years from the date of
›YnT y¸ÃzùT mr©ãC y¸ktlùTN concluding any procurement proceeding which

¼/ y=r¬ mwÄd¶Ã húB wYM yêU c) The names and addresses of suppliers that
¥Qrbþà Ãqrbù xQ‰bþãC SM xD‰š submitted bids, proposals or quotations,and
XNÄþhùM b=r¬W x¹Âð yçnù tʼnÓC the name and address of the winning
SM xD‰š# suppliers;
2/ yGiW £dT t«Âö kx¹ÂðW UR WL 2/ The record concerning any proceeding shall on
ktfrm wYM b¥ÂcWM MKNÃT Wlù request, and once the proceedings have resulted
ktÌr« bº§ yGiWN ZRZR xfÉ{M in a contract or have otherwise been terminated,
y¸ÃúyW mr© b=r¬W :Œ tú¬ð yçnù be made available to candidates who
twÄĶãC sþ«yqÜ XNÄþÆT mdrG xlbT”” participated in the proceedings. However,
YhùN XN©þ oLÈN ÆlW F/b¤T µL¬zz XÂ except when ordered to do so by a competent
